Complaint: West lake financial claims they did not receive my XXXX payment of XXXX. I was not informed about this until XXXX. When I contacted customer service they said they needed proof of payment. I sent them the attached bank statement which I had to get from my bank, showing where the amount was taken out of my account on the due date. They replied saying they needed to see the whole month of XXXX. My bank sent it to them and they claim it was insufficient and they need the transaction number. The customer service rep then said if we do n't receive payment today they will repo the vehicle. I believe I have shown them sufficient proof of payment, they took my money now I want it to show on my account it is paid. They also hit my credit report with a 30 day late payment that I want taken off. I have been paying on time and they have no right to be doing this to me or anyone else!

Complaint: On XX/XX/XXXX, 2017 approximately XXXX XXXX my car was stolen. Westlake financial breached my contract by not following the fair debt credit act. They also had relentless towing company trespass onto my private property and remove my personal private conveyance. Relentless violated chapter 1923. 01 jurisdiction and forcibly enter and unlawfully detain my private property after me asking him to get off my property. I let him know he was in violation of theft and that I can make him accountable for theft of private property. I then called the tow company to file a complaint on the guy who stole my property and was treated rudely while trying t speak to a supervisor, which she failed to do. I then asked to get the CEO/corporate office name and address and was told she could not disclose that information and hung up the phone on me, I called back to try to resolve the issue so that they can return my property and did not get and answer. I called westlake and spoke to a supervisor to resolve this matter and he failed to resolve it. I have documents and videos but I am unable to upload at this time.
Pursuing to title 15 USC 1692 A4 the term creditor is construed to mean one who offers or extends credit or the creator of the debt. I am the only one who can be the creditor to my ability to create a debt. Westlake financial misrepresented their status as the creditor when in fact I am the creditor.

Complaint: I financed a vehicle through XXXX XXXX with Westlake Financial Services. Months after the purchase, I had to make major repairs ( replace the engine ) and that has continued now for 2 years! Anyway, the truck was in an accident which took months to resolve. During which time, we had no choice but to repair our only vehicle. I contacted XXXX to ask how to sign over the insurance check to them to pay the loan balance in full. They went back and forth first telling me it is n't an issue, then calling and telling me I could n't use the check for that then calling back and saying I could, etc. Eventually I had a supervisor confirm that I could pay off the loan that way. Anyway, I received the check, endorsed my portion and mailed it to XXXX on XXXX/XXXX/XXXX or XXXX/XXXX/XXXX. At the end of XXXX XXXX called saying they never received that check. At THEIR behest, I contacted XXXX XXXX and requested a stop payment be placed on the check mailed around XXXX/XXXX/XXXX and a new check was issued on XXXX/XXXX/XXXX. I received that check, endorsed my portion again and mailed it via USPS priority mail. I have confirmation that the check was delivered to their lockbox in XXXX XXXX, CA on XXXX/XXXX/XXXX. I received a letter dated XXXX/XXXX/XXXX stating that the account " has been paid in full ''. Today I received a voicemail that I returned to be told that the payment was not processed due to a " stop payment '' and that they are attempting to collect the balance owed. The stop payment was issued on a check that they INSISTED that they did n't receive!!! Now they 're adding fees to the balance that DOES NOT EXIST meaning that I owe even MORE money to them! Please help me! I am a " single '' ( currently engaged ) mom of a XXXX XXXX XXXX year old child as well as a " XXXX '' XXXX year old and this is my only transportation to WORK, the XXXX, XXXX, XXXX, XXXX, etc. I paid my loan in full AFTER confirming that I was allowed to do so in that manner! Please help me keep the vehicle that I RIGHTFULLY own! This is unethical at best! I live in XXXX and have also filed a complaint here but since the business is based out of California, I am filing here too. I just want the title to the piece of XXXX truck that I paid for even during the entire YEAR that it was broke down and I could n't drive it!! Also, I have a picture of the check before I mailed it, proof it was received, proof on my online account that the balance was paid in full as well as a letter dated XXXX/XXXX/XXXX with a mailing stamp of XXXX/XXXX/XXXX stating the balance was paid in full. I am currently waiting for proof from the insurance company that the check dated XXXX/XXXX/XXXX was cashed successfully! It should n't be THIS hard to pay your bill!!!!!!

The next day on XX/XX/XXXX I checked my bank statement and noticed they cleared two charges of XXXX and paid them to Westlake financial. Complaint: XX/XX/XXXX- I called wilshire consumer credit to pay off a title loan I had with them for {$2500.00}, I had a pay off amount for {$2700.00} in which I saved up for by XXXX XXXX XXXX with the military. I was informed durning that call there was a new payoff balance of {$3000.00} that I did n't understand where it came from until it was explained to me later on by supervisor XXXX after my car was repossessed. I acknowledged to the first representative during the phone call that I did n't have the {$3000.00}, she then recommended I submit a payoff request for the {$2700.00}, acknowledging me that I would only take a ding to my credit report showing paid in less and then I would still receive my title back in 7-10 business days, not once did she mention the car would still be repossessed during that process, she then give me a two hour processing time to call back and receive an answer. No options to make the account current was given to me, no options to save me {$350.00} in repo fees was given to me, I was n't talked to as if there was a debt nor read my rights about an attempt to collect a debt, on that second hour waiting to get an answer from that process, my car was repossessed. I spoke to three representatives after that, no representative 's could assist me correctly because my account was labeled that " my sole purpose for calling that day was for a settlement '', the process was n't explained to me correctly. I was able to speak with a supervisor, XXXX who took the time to help me and acknowledge me that I was a customer. She acknowledged me that the first rep I spoke with should n't have offered that because my loan was new and I have to have XX/XX/XXXX payment before qualifying for that kind of process. XXXX broke the process down, then offered a positive solution to pay {$900.00} to bring the account current with {$350.00} included to get the car out of repo and within than less than 12 hours I got my car back. XXXX then offered to work a new settlement for {$1500.00} or {$1600.00} to help offset the repo fees and with the pay in less ding on my credit report. XX/XX/XXXX- I received a letter in the mail from wilshire trying to reach me and for me to reach out to them before a repo action can take place, it was mailed out on XX/XX/XXXX and my car was picked up on XX/XX/XXXX. XX/XX/XXXX- XXXX has been great to me during this process, she 's been the middle man since day of the repo. I called in to follow up with the settlement for {$1500.00} or {$1600.00}. Told to call back because the managers have n't responded. XX/XX/XXXX- Called XXXX XXXX for update and given a new pay off amount the management can settle for of {$1800.00} to be paid by XXXX XXXX before the XX/XX/XXXX. I asked to speak with management and the request was sent forward and voice mail left. XX/XX/XXXX- In the mail I received a statement with a payoff balance {$2200.00} by XX/XX/XXXX and I 'm in good standing over all. So I call XXXX and informed her I want to leave the loan on good terms but I should n't have to suffer the repo charged due to the other staffs lack of knowledge. She said she would run that through management. XX/XX/XXXX- XXXX reached out to me through voicemail. I called back and she informed me that management reviewed voice recording and that they in fact say I was informed that no matter the process car would get repossessed, that is n't true and I asked if I could hear that voice recording proof, I was told no because it was for internal use only. I asked again to speak to management and an email was sent for management to contact me. XX/XX/XXXX- I got a letter in the mail from XXXX stating my insurance company informed them I was n't covered due to lack of payment. I call in and spoke to XXXX, she had no follow up to give me regarding management reaching back to me. XXXX told me in regards to the insurance, " XXXX XXXX '' is what I submitted during my initial loan process. I asked how can that be possible when I 'm a XXXX member? She said that 's not her department and she transferred me to the insurance department, and for 25 minutes I was transferring back to regular customer service line and 6 representatives later I finally was able to speak to XXXX XXXX of that department. I asked her how was I able to get approved for that loan with no insurance and it being a major factor of the approval process? She said all Information they get is from a third party. Again bad communication and wrong information being put out. I informed XXXX of my issues with wilshire and let her know how it is im suppose to take their word on what they claim is on a voice recording when their quality of work is not to standard. This process is unacceptable. Out of all the representatives I 've talked to only one ( XXXX ) stepped up and treated me like an actual person. I 've mentioned to other representatives that I ca n't believe I got myself into this loan and the representatives chuckle on the other end of the line and end the call with a little laughter in their voice. Till this day management has not responded to me nor to XXXX for that matter. The settlement process was an option given to me by a wilshire consumer representative who should n't have because I was n't eligible, I called to pay it off or at least get the assistant that the supervisor XXXX provided me. Had I been treated like a person, other than making me feel like I was taking the money out of their pockets, nothing would have escalated like it did. I 'm in the XXXX and I had to XXXX XXXX XXXX XXXX XXXX XXXX for two weeks at a time, XXXX in XXXX and XXXX in XXXX XXXX XXXX with very little communication to payoff this Loan, nothing was taken into consideration to help the situation. Only sorry, agreeance from XXXX that the process was n't handle correctly, there 's nothing they can do, management would get back to me, and they are their own corporate office so I have to wait until management contacts me because there 's no one above them.

Complaint: Westlake Financial is reporting and has reported inaccurate information on my loan. Westlake just started reporting to the credit bureau based on my request for them to report the account to the credit bureaus in XX/XX/XXXX. Up until last week the accounts had been reported in good standing only after I made a complaint to the CFPB about the account not being reporting for the full length of time on the XXXX report. I called Westlake Financial to discuss the late payments that they are reporting. The XX/XX/XXXXpayment they are reporting is not correct as my payment due date was changed from the XXXX to the XXXX of the month making the payment due onXX/XX/XXXXand notXX/XX/XXXX. I made a payment onXX/XX/XXXX which would have made the account less than 30 days late. They are also reporting for the month of XX/XX/XXXX as late. I made arrangements for the payment to be put at the end of the loan this was completed on XX/XX/XXXX which was 12 days prior to the account due date. They advised me when I called today that due to the time it takes to process the paperwork my account became late. I was not advised that such would happen. Again up until last week Westlake had reported all of my payments as on time. So the last six months they reported the account as being on time but after I filed a complaint with CFPB now all of a sudden the account had late payments. It is a violation of the FCRA to report inaccurate information and holds a statutory fine of $ XXXX each occurrence. The person I spoke to today told me that I have to dispute the item with the credit bureau. I explained to her that I would like to dispute it with the creditor as your company is the one that made the mistake with reporting incorrect late payments.

I have made several attempts with the credit bureaus to get these unverified accounts removed with no success. Each dispute returned that XXXX XXXX verified the debt. I sent a certified letter to XXXX XXXX to investigate the accounts as well as requested the contractual agreement I entered with this company, statements and communication sent to me by this company that could substantiate what was being reported on my credit profile. To date this information has not been supplied and my request ignored. This company entered into bankruptcy during the time in which they state these accounts originated with them.
