Complaint: On XX/XX/XXXX I spoke with the sales manager to get prequalified with XXXX XXXX XXXX XXXX. I am completely aware that during the financing process they submit multiple credit applications. With this fact in mind, I specifically instructed the sales manager that I ONLY WANTED TO ACQUIRE FINANCING WITH XXXX. I specifically instructed the sales manager to avoid shopping my credit around because I did not want numerous inquiries on my credit report. I am in the process of acquiring a business loan and was told to avoid that sort of activity. The sales manager did not properly communicate my authorization to only submit 1 credit application to the finance manager, which resulted in the UNAUTHORIZED SUBMISSION to several lenders. The General Manager of the dealership has admitted fault and apologized for the unauthorized submissions. While it does bring me solace to know their actions were not malicious, the accidental submissions has hurt my credit report and ability to acquire a business loan. I have challenged the inquiries with the credit bureaus and have been referred to challenge these directly with the lenders.

Complaint: To whom this may concern : This complaint is involving Westlake Financial and XXXX XXXX XXXX.
I purchased a XXXX XXXX from XXXX XXXX XXXX XX/XX/XXXX, my down payment was XXXX My financing was going to be provided by Westlake Financial through an employee program being offered at Westlake Financial.
I started my payments on XX/XX/XXXX for a term of 48 months.
I have been in touch with Westlake and been making my monthly payments to them.
Since XX/XX/XXXX I have been trying to make a payment but I am being told my account is paid off, without any explanation, this does not make any sense.
I have my vehicle and I have been making my regular monthly payments.
No one has informed me of any changes.
When I asked for answers on XX/XX/XXXX, I spoke to XXXX, supervisor of servicing. She told me first that this contract was " boughtback '' by the dealer since XX/XX/XXXX due to a title issue. Having made payments to Westlake for close to a year this made no sense. She then said that Westlake has reimbursed all my payments to me in the form of a check that I should have.
When I asked her for the check amount, date and check number, she could n't provide me any of that information. Then she said that the buyback was received XX/XX/XXXX and would take 21 business days to reimburse the payments I have made. I was speaking to her XX/XX/XXXX, more than 21 business days have passed, she still did n't have an answer for me.
I asked her why this was happening, why no one had contacted me and she had no answers for me.
When I asked her about the down payment she said to speak to the dealer. She told me the dealer would repossess the vehicle because they had title issues. Since I have complied with my contract, I told her that it would n't be correct for the dealer to repossess the vehicle, having complied with my contract and made all my payments.
She told me there was no contract. This does n't make sense, since I did sign a contract at the dealer.
Most of the information she provided to me was vague, either did n't make sense or was incorrect.
I asked for another manager to review this matter and get back to me and have not heard from them.
Regarding the dealer, the dealer XXXX XXXX XXXX, called me asking me to go in for a smog check. When I emailed them to schedule a time, they told me they do n't do smog checks.
They have failed to inform me they " boughtback '' my contract and have no finance company for me. They have not told me about any title issues they are having.
When I called XX/XX/XXXX, a man name XXXX insisted he needed my vehicle for smog.
I confronted him that Westlake claims my loan is closed. He said he did n't have any idea. I told him Westlake claims my account is paid buyback by dealer due to title issues. He insisted again to take my car there for smog but I mention to him I do not feel comfortable. Both dealer and finance company are not telling me what is going on. They are being deceptive instead of honest.
After a down payment and close to a year of payments, this title is still not transferred or in my name. My registration is also expired!
I asked the dealer to provide me answers before I go into the dealership.
I need answers both from the dealer and finance company.

Complaint: Westlake Financial SVC. held Title & the loan on my XXXX XXXX XXXX beginning XX/XX/XXXX**. They were paid by XXXX $ XXXX by my INSURANCE in XX/XX/XXXX yet kept a {$15000.00} balance on the Account until after XX/XX/XXXX. The problem is Westlake repeatedly reported incorrect and conflicting information to all 3 credit reports.
First, I could not possibly have taken the Loan on XX/XX/XXXX because my Drivers License was reactivated on XX/XX/XXXX. This alone would should 've resulted in Westlake correcting the Monthly DUE DATE. Westlake reported to XXXX & XXXX " XX/XX/XXXX PAST DUE > 30 days ''. In fact they have admitted on the phone that records show I paid 2x in XX/XX/XXXX.
On XX/XX/XXXX, accident destroyed the car. XXXX car insurance paid the claim in a timely manner despite Westlake taking 3 weeks adhere to XXXX protocol in releasing TITLE. I was charged and paid a ransom of {$600.00}. XX/XX/XXXX Claim paid by XXXX. Westlake 's sister company " XXXX XXXX '' paid as well. They also posted payments to someone else 's account to add to mess so the XXXX XXXX+ remained on my report .Westlake reported and charged me after TITLE was sent to XXXX.
I only ask they keep their word to correct the 1 late payment during claims process in XX/XX/XXXX and correct XX/XX/XXXX because I paid 2x in XX/XX/XXXX.

Complaint: On XX/XX/XXXX I acquired an auto loan from Westlakes Financial. Monthly payments beginning XX/XX/XXXX. On XX/XX/XXXX I got an unsecured personal loan from XXXX XXXX to pay off Westakes. Now a year and a half later, I tried to finance a vehicle and was denied due to a charge-off on my credit report from Westlakes. I immediately contacted Westlakes and was told that the pay off was short by {$30.00} by XXXX XXXX and now interest had accumulated to {$97.00}. I paid this immediately that evening to resolve it. Now, my account status says Account Paid - Was a Charge-off, which is ruining my credit. I have been denied by numerous banks because of the charge-off. I have made countless phone calls to Westlakes. About 3 different employees at Westlakes looked at my account and said the charge-off was not my fault. All of them said it was common sense that it was not my fault. I was told to call back a week or so later for a final decision on whether they would remove the charge-off. When I called, I was told they decided to not remove the charge-off. If CFPB requests phone calls made by me, you will hear the employees and one supervisor say that the charge-off was not my fault. Westlakes has been sued in the past. They have a history of taking advantage of people with poor credit. CFPB forced Westlakes to pay XXXX XXXX dollars in damages. One of the things Westlakes has been sued for is for breaking or changing contracts without informing clients. I have attached a copy of our contract. The contract is good through XX/XX/XXXX. Westlakes broke our contract and put a charge-off on all of my credit reports over {$30.00} owed, which I was never notified about. The amount was paid and the {$97.00} in interest was paid as well. This financial institution has a history of this sort of activity. To further show you the type of questionable activity that happens at Westlakes, I have attached two letters sent to me and my wife from Westlakes. At the beginning of my search, I tried to finance a car through Westlakes. In the rejection letters we received, we were both told that we were denied due to a previous repossession with Westlakes. My credit reports will show that neither me or my wife have ever had a repossession with any financial institution. Finally, I have also attached a copy of the Westlakes contract and the pay off check from XXXX XXXX to show the documentation. Thank you for your time and for your help.

Complaint: there use to be a XXXX dollar interest at the begin of the loan for the vehicle when i would be passed due because the loan was pricy so i know have to pay XXXX dollars of interest a day the vehicle was sold to me at full price when it was used and my contract was very sketchy plus there has to be proof of malpractice issuing these crazy interese rate for used vehicle because Westlake financial services has been order to pay a settlement of XXXX XXXX dollars to consumers and i purchased a vehicle right after the date in XX/XX/XXXX a year after they found them guilty. Which were used between XX/XX/XXXX and XX/XX/XXXX, violate the federal Fair Debt Collection Practice Act and the Truth in Lending Act, the bureau said i quote XXXX XXXX. I was subject to phone call debt collections right after 3 months and then i would pay high interest and would not qualify to refi because i was in debt and once i was out of debt i still wasnt qualified to refi with Westlake financial service i was given a small window of opertunity to purchase the car by Westlake 4 year term and would like to extend term payment or lower interest rate i feel hopeless when they use tactics to repo the vehicle when i was working in the XXXX XXXX city left it parked and was repo by city traffic control i was only backed up 2 months and had the vehicle for well over 2 years and cant believe i still owe a lot i feel they are commitng fruad the payment doesnt go down.

I was then told by XXXX XXXX that the debt would be removed from all credit bureaus. Instead I received an XXXX alert stating debt debt deem uncollectable bad debt. They have committed fraud by representing to me that we were settling the debt and it would be totally removed from my report. Make them remove it immediately. I money framed that settlement amount to them as agreed. Tell them to remove it or be sued for punitive damages.

I asked them for a copy of the contract with my signature, under the fair credit reporting act, although what they 're trying to do is past the statute of limitations. As I requested before I want a copy of the invoice/contract with my signature.they or XXXX just recently opened this account for no reason but to lower my credit score by almost 40 or more points on purpose. The statute of limitations on this account is four years which is over but if they want to keep reporting this erroneous information, I need to see that contract by law.

Complaint: We purchased a car through XXXX XXXX XXXX that was financed through Westlake Financial in XXXX 2015. We had to pay {$7000.00} cash down and another {$2000.00} to XXXX XXXX XXXX to sponsor the deal. After a year of payments and no tage, I contacted Westlake Financial and asked if they could assist with getting the tile or if they had th etitle to the car. Westlake informed me that they did not have the title, but would be able to get it for me. They wanted me to sign some documents to suspend the loan payments. Three months after signing the suspension documents, I called Westlake Financial and spoke to XXXX XXXX and was told that the title had not been obtained. Westlake ten stated that they could pick up the car and at the time that they had the car in their possession, they would then mail e a check for my money. The Westlake agent was unsure as to how much money would be refunded to me. I made loan payments for 1 year - {$6000.00}, plus the down payment - {$7000.00}, dealer fees - {$2000.00} and insurance payments - {$1500.00}. My out of pocket osts so far - {$16000.00}. Complaint: Sent first certified letter XX/XX/XXXX explanation of a formal dispute requesting inaccurate information on my credit report showing that I was late 30 days or more late on my car payments in XX/XX/XXXX, XX/XX/XXXX. West lake financial received first certified letter on XX/XX/XXXX, they failed to provide me with any requesting documentation that I was late on my payments, however after 30 days time frame nor did they acknowledge my dispute my placing a remark on my credit report in disputing this matter.
I again, followed up with the second certified letter 31 days after sending the first letter, and yet again they failed to acknowledge any of my correspondence about this late payments, requesting documentation. I patiently waited until the 30 day expiration date and they failed to acknowledge my certified letters once again.
Third attempt, was also unsuccessful.

Complaint: I made payments to XXXX XXXX XXXX for over a year to which they never reported. I have contacted them this many times over the last two years. They said there was an issue with my name and that it was coming up twice. They initially asked for a copy of my drivers license and social security card which I provided. They then began asking for marriage certificates and divorce decrees but when asked which ones proceeded to instruct me to call the credit bureau as they could n't help me. I made my payments on time or early and sometimes made over payments.and want this to reflect on my credit as it caused me to have a higher APR on my new car loan.

Complaint: I have been trying to fix this problem since XXXX, but the credit bureaus just go by the word of the Creditor. I reported to the bureaus that that account is not mine because it could n't be my signature because I was fresh out of the hospital from my XXXX and unable to sit up let alone write. I want to see that paperwork with my so called signature to prove that it 's not me. I have the right under the Fair Credit Reporting act to ask and get a copy of The contract with my signature.
