Complaint: My first issue this is my first time buying a vehicle on my own. I do n't think I can ever go through this experience of buying another car. I get nauseous thinking about it. I had no idea what I was doing and I feel taken advantage of. I was given a 24.99 % interest rate. My credit score was XXXX the day the loan was wrote. I had no idea this interest rate was high moreover it was illegal in my state and the state rhe financial company was in. I 'm in Arkansas. They 're in California. I bought the SUV XX/XX/XXXXand some months even was able to pay double payments. My state was hit with a flood of historical proportions that have ever been able to be recorded. I had put my payment in our outbox at our local post office that serves XXXX citizens in our small town the day before the flood. It would have been a week early had it left the next day and it was for XX/XX/XXXX and XX/XX/XXXX payments. {$760.00}. When I woke up the next day water was everywhere. I mean EVERYWHERE. Our local XXXX had 9 ft of standing water. The president and our governor declared us a natural disaster area. Apparently my payment never left the post office. Which the post office was barely standing after the water receded. Fine. I called Westlake and they took a check over the phone and I deferred one payment to the end of my contract. Two weeks later I was diagnosed with XXXX XXXX and had to immediately take a sabbatical from work to start XXXX and XXXX. I called Westlake again and they told me they would defer 90 days of payments to the end of my contract. Paid them a {$50.00} dollar payment for each deferred payment. My doctors said more than likely I 'd be at least able to return to work by then. Westlake called me the entire time I was in the hospital, twice when I was receiving XXXX and asked for their payment. I said we deferred those I paid you {$50.00} per payment. I 'm sick may I please call you back. Most of the time I was immediately hung up on and recieved outlandish attitude from the customer service representative. I had bigger fish to fry so to speak so I swallowed the XXXX and pushed myself to get better. XX/XX/XXXX I had enough and I went to trade the vehicle off. The calls. The nasty attitudes. I could n't take it any more and I was trying get healthy. When the dealership called to ask for my payoff they were told the vehicle was in repossession status and demanded the address. I was four hours from home. No one gave them the address and I left after waiting 45 minutes seeing if anyone would show up. They knew the dealerships name and city and state. I know they have XXXX. So I waited. No one ever showed so I leave to come home. Drive four hours home. The next day I get up to go back to my first day back at my place of employment and my truck is gone. Immediately I assume they repossessed it. Who would n't. I fumed for about two weeks and I finally answered the phone one morning when they called and I 'm informed they do not have possession of the vehicle and I need to call the local police as the agent is speaking to someone else and I hear someone say " Do n't tell him we have it .... '' Then I start getting Badgered about late payments. I said no those were deferred and I 'm told we do n't offer a program like that. And suddenly the {$50.00} payments are showing up on my account or so I 'm being told. The agent then tells me to call my local police office. I do. They come fill out a police report. XXXX starts tracking the vehicle. Well. Since it had been two weeks the vehicle is no longer trackable through XXXX. Unless the vehicle is started or electricity fires up the XXXX program. I was never given my personal effects out if my vehicle. There is a {$2700.00} dollar suit that better be there if I ever get this truck back.

Complaint: The issue revolves around the matter of a personal vehicle loan that is held by Westlake Financial Services and myself.
XXXX XXXX, 2017 : Westlake Financial Services was contacted by myself, via phone at the provided number of XXXX to obtain a payoff amount which was given by their automated system and a customer service representative. The amount given was {$9400.00} by the automated system, the customer service representative and online through my account portal.
XXXX XXXX, 2017 : Westlake Financial Services was contacted by myself, via phone at the provided number of XXXX to confirm the payoff amount before proceeding to my personal institution to obtain a bank check. The amount given was {$9400.00} by the automated system, the customer service representative and online through my account portal on this date.
The payoff amount was sent in the form of two ( 2 ) checks. The first in the amount of {$480.00}, the second check in the amount of {$8900.00}, equaling to the given payoff amount of {$9400.00}. The checks were accompanied by a letter identifying myself, my account, my vehicle and the purpose of the payments. The following mentioned items were sent to Wells Fargo Lockbox LBX # XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX via USPS 2-Day Priority Mail ( Tracking # : XXXX XXXX XXXX XXXX XXXXXXXX XXXX ) XXXX XXXX , 2017 : Westlake Financial Services was contacted by myself, via phone at the provided number of XXXX to confirm receipt of the payment as USPS notified me that the package was indeed delivered on XXXX XXXX, 2017. During this phone call, I was told that there was no way to confirm that the package had arrived being that the accounting department was in charge of receiving payments. I was told that I nor anyone within the company could contact the accounting department. During this time the customer service agent informed me that I did not send enough for the payoff amount and that I should have been given a 10 day off amount, which was not given to me at any time. She informed me that I was wrong and informed me that I could see the 10 day payoff amount in my online account information, which you can not, and when she returned from placing me on a brief hold to locate this information after asking her to direct me to this information online, she returned to the call and completely negated the fact of her previous statements being incorrect due to the fact she unable to directed to a " 10 day payoff amount ''.

XXXX XXXX, 2017 : Westlake Financial Services was contacted by myself, via phone at the provided number of XXXX to speak with a supervisor due to all the contradicting information I had been told regarding the check, and that Westlake Finacial Services posted the check as if it were received on XXXX XXXX, 2017 -- which is not factual. The amount sent in on XXXX XXXX, 2017 received XXXX XXXX, 2017 should have satisfied the payoff amount and account should have incurred no additional interest and no additional payment due.
During this call, the Supervisor listened to my issue and said that he would have to go back and listen to my call because the customer service representative should have informed me of the 10-day payoff amount. I alerted the Supervisor, XXXX, that I did get not get said information from anyone. He instructed me to call back 3 hours later that day to get an update.
Three hours later, I contacted XXXX, a Supervisor with Westlake Financial Services and he informed me that he listened to a call that the representative did, in fact, inform me of this 10-day payoff amount. Which is not factual because at no time during the phone calls initiated on XXXX XXXX, 2017 or XXXX XXXX, 2017 was I ever informed of a 10-day payoff amount. He then said it was out of his discretion if the amount could be adjusted and he would have to send an email to his supervisor who would make that decision. XXXX then instructed me to call back before the end of the day to see if his Supervisor responded to the email.
XXXX XXXX, 2017 : Westlake Financial Services was contacted by myself, via phone at the provided number of XXXX to contact the supervisor, XXXX, regarding a follow-up from the email to his head supervisor which had yet to make a response. No response to the email was provided, yet.
XXXX XXXX, 2017 : Westlake Financial Services was contacted by myself, via phone at the provided number of XXXX to get an update on the current standing of my account. I yet again explained the situation to a customer service representative who then spoke with her supervisor while placing me on a brief hold. After returning from the hold she then informed me that the original supervisor, XXXX, who I was speaking to earlier this month attempted to contact me on XXXX XXXX, 2017 but there was no answer, as you see in the call logs provided directly from my cellular device company, XXXX, there was no call from Westlake Financial Services on XXXX XXXX, 2017. The customer service agent informed that there was an emailed response to my situation but this was not able to be communicated from this supervisor directly and would only be conveyed by XXXX, who was out of the office today.
My issue with Westlake Financial Services are : 1. This financial institution could not contact their own accounting department to confirm receipt of payment.
2. This financial institution held a check longer than the standard 5-7 business days.
3. This financial institution posted inaccurate information in regards to when the check was received.
4. This financial institution gives contradicting information during every phone call had with Westlake Financial Services.
5. Westlake Financial Services Customer Service Department states that they notate your account one day with information but then when a follow-up call is made they claim there are no notations and then when the next day, the notations reappear.
6. Westlake Financial Services gave me the runaround from stating that the check was pending, then processing, then pending, then could n't be found, and lastly posted with inaccurate information.
This is has caused a great deal of emotional stress, grief, XXXX, and loss wages due to the time it 's taken to contact Westlake Financial Services repetitively towards this matter.

Complaint: On XXXX XXXX, 2017, I had an appointment with XXXX XXXX XXXX to fix my coolant system problem. Unfortunately, I found out my vehicle was impounded at a near by police station. I contacted XXXX XXXX XXXX to let them know about the situation and to retrieve the vehicle so that it can be fixed. On XXXX XXXX, 2017 XXXX XXXX XXXX retrieve the vehicle from the impound and I was told that there would be a XXXX dollar towing fee to get the vehicle back. I advised XXXX the sales manager that I would be down the weekend to pick the vehicle up. I arrived at XXXX XXXX XXXX XXXX XXXX, 2017 at XXXX XXXX thinking that they were just closing, but they closed at XXXX. I spoke with XXXX he said that he was thirty mins away on his way home. I again advised him that I would be back the following weekend. I called all threw out the week trying to see what time I can come and pick the vehicle up. I never got a hold of anyone receiving the run around. I made my car payment of about 300 dollars on XXXX XXXX, 2017. I contacted the bank west lake financial about my next payment and to see if they could find out what was going on about my vehicle. I was told that XXXX XXXX XXXX purchased the contract back on XXXX XXXX, 2017 with a ACH back from the bank and that my account with them was closed. XXXX XXXX XXXX advised the bank that there was never a contract on the vehicle. I was sent via text message to refinance the vehicle from sales manager in the amount of XXXX dollars. The bank also refunded my car payment to XXXX XXXX XXXX. This fraudulent experience I received was very unsatisfactory. Both the bank and XXXX XXXX XXXX were giving me the run around.

Complaint: On XX/XX/XXXX my wife and I went to XXXX XXXX XXXX XXXX at XXXX XXXX XXXX, TX XXXX to purchase a pre-owned vehicle. We met with XXXX XXXX at the time we knew him to be part owner and our salesman of XXXX XXXX XXXX XXXX. We traded our XXXX XXXX XXXX XXXX for a XXXX XXXX XXXX XXXX XXXX. We gave him all the necessary documents that he needed. I gave him {$3500.00} cash to go along with my trade in. XXXX XXXX told me and my wife to come back so we could get the paperwork on the car. The only thing I had was one paper that he told me to keep in the car. This was proof of me buying this car. The next week on XX/XX/XXXX, I went to XXXX XXXX XXXX XXXX because I had not heard anything from XXXX XXXX about the paperwork. When I saw him he told me that he was still working on it and he would have it next week. On XX/XX/XXXX I was told that my vehicle plates were in and to come and get the plates. When I got there XXXX XXXX was not there and the guy told me that he would let him know about my issue. I got my plates and then that week a finance company called me and told me where to make payments and how much I had to make. The company was Westlake Financial. I started making payments in the amount of {$380.00} each month. I could never get XXXX XXXX on the phone and by XXXX I was not able to speak to him anymore due to him not being there anymore. I spoke to XXXX XXXX who is the other or now the owner of XXXX XXXX XXXX XXXX, which I am told that XXXX is not there and now they have moved to another location. On XX/XX/XXXX, I went to XXXX XXXXXXXX XXXX XXXX to speak to XXXX, at this time he was not returning my calls or never at this location. I decided to take my car to another dealership. At the dealership, they decided to call Westlake Financial from which my car is under. The salesman asked what was my pay off of the car I have now, Westlake told him that it was about {$10000.00}. The salesman asked how is that possible that it was still {$10000.00} after a year on a {$10000.00} car. They told him that I was paying nothing but interest and I had not even started paying the principal on the car yet. After that, I was upset and wanted to know what was going on. I called Westlake Financial and asked them about this information. They told me that it should have been on the contract I signed when I bought the car. I told them I never received a contract or signed one. They told me that they have my contract and would email it to me. This contract that I received was a contract I never saw before. This contract was 7 pages with initial and signature that was not even mine. I called the Financial Company about these signatures this contract. I was told by Westlake Financial that they had to get a supervisor and do an investigation. After, this I decided to look up my vehicle registration information. My Texas registration has a different price on it then this contract and now I have an issue with the odometer reading too because the car had over XXXX miles when I received but I notice the Dealer told the finance company that the car had XXXX miles at the time he give them that contract. However, on my Texas registration, it has XXXX miles. Once I got this information. The vehicle registration sale price was {$14000.00} at which they give me {$13000.00} for my trade in which left {$1400.00}. However, that was not included with the {$3500.00} cash given. I was even more upset. I went back up to XXXX XXXX XXXX XXXX and asked for the Owner XXXX and I asked for a copy of the contract that they sent to Westlake Financial. I was told XXXX was not there and they could not find any information with my name on it and they didnt have any contracts on me from XX/XX/XXXX. I called back Westlake Financial I was told that I had needed to file a police report on this dealer fraud. I filed this police report on XX/XX/XXXX. I had called onXX/XX/XXXX to let Westlake financial to inform them that the police report was ready. I was talking with the representative that was looking over this contract and I was telling her about my trade in, she informed me that she didnt see a trade in and she didnt see a factored trade in or cash allowance factored into this deal. Then she informed me after further review, she seen those amounts for the trade in and the cash amount. However, the trade in was not applied at all and the cash amount was subtracted from the price of the car. But she also had seen where the cash price was reapplied back into the price of the car loan. Then again on XX/XX/XXXX, I called back again once I got the police report faxed over to them. And spoke to another representative, this representative told me that there was a lot of missed informed information with the account. She stated that the figures were not adding up and that I had paid for my car twice. She told me that the investigating team will be calling me in 72 hours. However, after all this, I get a text from Westlake Financial Service tell me that Friendly reminder, your Westlake Financial payment is due today. Reply pay to make a free payment now. If youve already made a payment, please disregard this message. To stop these text messages, reply STOP. In 15 months I have never received a text like this from them. I really now since learning all this is not comfortable continue to give them my money if this car is paid for according to this paperwork I do have now.

Complaint: I financed a car through Westlake Financial. I continued to make payments through this company and had to file BK due to illness. WE offered to reaffirm vehicle, received no response.Continued to make payments. Company reported our account as discharged in BK with a XXXX balance. We requested our title and were sent several letters that it would be forthcoming. In XXXX of 2015 we came home to a repo in process. In CT, you must by law sent a letter of intent and did not. We tried to clear up the issues and called many times during XXXX, XXXX and XXXX. We were treated rudely, often in a derogatory manner, were cursed at and threatened. I have recorded conversations with the bank. We were never given the opportunity to discuss cure of any default and we lost our property. I want monetary reimbursement for the trauma and deceptive practices along with clear FDCPA violations.

Complaint: I took out a small title loan on my paid off XXXX XXXX vehicle for {$2100.00} on XX/XX/XXXX. I was making the monthly payments on the loan and the balance never went down it keep increasing on a monthly basis. I was diagnosis with XXXX XXXX and I still kept in contact with them with updates on my health status. i also advised them I had lost m job due to the amount of time I needed to take off from treatment which they were also advised up. I continue to try and make payments and the balance still continued to increase with unreasonable interest and fees. Then there were issues with car that required very expensive repairs, Which I notified them of that as well, they made no attempts ts to work with me or justify the amount of fees and interest they had been charging me.The issues of my complaint as follows : 1 ) The car then had been repossessed with out any contact being made to me that that it was in that status or that that was the intent. 2 ) The cars value was {$9900.00} without after market accessories included prior to repairs. 3 ) I was never sent information or documentation stating they still was a balance added off {$770.00} 4 ) Reporting inaccurate information to the credit bureaus stating that this was a automobile loan, the last payment being made XX/XX/XXXX, Account Closed XX/XX/XXXX. That there is a balance of {$770.00} still is owed. This information is severely hurting my chance of recovering financially after my heath issues. 5 ) A high balance of XXXX for a {$2100.00} loan

Problem with fees charged
Complaint: In XXXX of 2014, I got a car loan from Westlake Financial. I agreed to a payment of {$350.00} per month. Every time I have made I was charge {$5.00} dollar processing fee. I did n't agree to the {$5.00} charge and it adds up over XXXX payment to {$180.00} more in payment on the loan. I am a XXXX vet on a limited income so this {$5.00} per month is an unplanned expense. Can these loan companies take {$5.00} from every customer? This would add up to a lot of profit on cost that was n't on the loans they give out.

Complaint: XXXX is not reporting one year of payments on my Westlake Financial account. The Westlake account is reporting accurately with XXXX and XXXX so I find it hard to believe that Westlake is reporting it incorrectly to XXXX . I 've requested for this concern to be corrected and XXXX played me as that they are reporting what is being reported to them.

Complaint: Westlake - Wilshire has my account showing closed by grantor and paid charge off. This is untrue! I paid it in full through a refinance of my home back on XXXX - XXXX -14. I even have a letter from them showing this, yet Wilshire-Westlake reports differently. I 've tried to resolve this many times with them, but they do NOT correct the credit bureaus. please help me to have this corrected. it is lowering my credit score, as well as I keep having a hard time getting credit and refinancing my home.

Billing problem
Complaint: I have an automobile loan with Westlake Financial. I have been making the regular payments, some on time and some late, it was never an issue. At approximately XXXX on XXXX XXXX , 2017 they had XXXX XXXX Repossess the vehicle. Upon leaving our property the driver of the tow truck drove approximately 40 miles in the opposite direction of the final holding location in XXXX , NH. I know this because we have a vehicle tracking device installed. You do not need to drive west, north, east then south to get to a location that is east of where I live, unless you are trying to charge more for mileage At XXXX I called Westlake and was told I would have to pay the past due payments and all late fees on my account, plus the repo & storage fees in order to get the vehicle back. This amounted to {$1500.00}. They also told me I had 3 days to pay it or the vehicle would be sold.
I asked them to waive the late fees or put it on the end of the loan and was told that they could not do that, but that they could put the {$350.00} repo fees on the end, which would bring the amount to {$1200.00} which I paid on XXXX XXXX , 2017. I was also told the storage fees would be {$30.00} total, but now I am being charged {$60.00} because Westlake took there time They also insisted that I give them all the same information references, proof of income and residency again. This is information that they were given less than 2 years ago at the onset of the loan.
They did not release the vehicle back to me until XXXX XXXX , 2017 because they had n't scanned my information into the computer the day prior. Lame excuse.
When they applied the money to my account they put it on only payments and not late fees, storage or repo fees. They applied it towards past payments and the XXXX payment which was due on XXXX XXXX . It covered all but {$22.00} of the XXXX payment, on XXXX XXXX they started calling me in regards to the {$22.00} being past due. Seriously.
Then today XXXX / XXXX /17 I received a letter in the mail from them " Notice of Intent to Sell '' which was dated on XXXX / XXXX /17, 3 days after the vehicle was released back to me. I immediately called Westlake and was told well the letter was actually printed on XXXX / XXXX /17 regardless what day the claim to have printed it does not matter whereas it was released on XXXX / XXXX /17 so why print and mail the letter at all. I was told to disregard the letter by the person that answered the phone, but I am concerned They also robo call you when your payments are late. They also call at all hours of the day and night, multiple times per day on both my cell phone and home phone.

Due to not wanting a car note, I decided to borrow money from my 401k to make a cash purchase. Myself and my cousin went to the bank to cash the check and to make the transaction. When I arrived back to XXXX XXXX XXXX, I was asked by a female sales associate to follow her to another location XXXX XXXX XXXX XXXX XXXX. XXXX, Texas XXXX to finalize the sale. The female also stated, during our conversation that she was part owner of both locations. Myself and my cousin waited in the lobby for about 10 min before being called to the office finalize the sale.

I paid XXXX cash and had a balance of XXXX which was set in installments of two payments. I made one payment but when I returned to make another payment, both locations were permanetly closed with no forwarding information. I then filed a complaint with the DMV who investigated my concern. The DMV shared with me that both auto shops were in current litigation and provided me with the phone number to XXXX XXXX. I contacted XXXX XXXX, XXXX XXXX who then asked that I complete an affidavit and have it completed and notorized before my title and plates are released to me.

After returning the affidavit as instructed, I waited several weeks and did not hear back from XXXX XXXX. When I called, she stated that the attorney asked that I send a short email detailing some specific parts of the sale. Over the last 5-6 months, I have provided XXXX XXXX XXXX with all documents pertaining to my purchase. The documents included : Bill of Sale, Bank Statements etc ... After waiting several weeks and no follow-up from XXXX XXXX, I gave them a call. I was then informed by XXXX XXXX that I would have to provide a summary of the entire transaction. I completed the summary and forwarded it as requested. On Thursday, XX/XX/XXXX, I contacted XXXX XXXX who stated that she have no update for me. XXXX XXXX has refused release the title/plates to my vehicle or provide me with updates. As of today, I am no longer able to get another temporary tag for my car. XXXX XXXX XXXX failure to release my title and plates as caused hardship because I am unable to drive the vehicle to doctor appointments and to work.

Complaint: On XXXX XXXX I contacted Wilshire Consumer Credit And Spoke with XXXX a Supervisor. I was calling to get the information XXXX was needing released to acquire a new loan with XXXX. was told i needed to provide a letter of authorization. which my fiance filled out and signed since she is on the account with me, sent it in and authorization was given for XXXX to speak with Wilshire. Upon XXXX speaking with them and calling us back. we were informed that the information XXXX was requesting would not be released. See i was given a 10 day payoff from Wilshire on XXXX XXXX which will expire on XXXX XXXX. I fear that wilshire is stalling to prevent me from being able to have this loan paid out completely. this is unfair to me as it could result in my vehicle being taken and i am making an attempt to pay this loan out.

Unable to receive car title or other problem after the loan is paid off
Complaint: We purchased a car through XXXX XXXX XXXX that was financed throug h Westlake Financial i n XXXX 2015 . We had to pay {$7000.00} cash down and another {$2000.00} to XXXX XXXX XXXX to sponsor the deal. After a year of payments and no tag, I contacted Westlake Financial and asked if they could assist they had the title to the car. Westlake informed me that they did not have it but would be able to get it for me, if I signed some documents for me. After about 3 months, I again called Westlake Financial and sp oke to XXXX XXXX and was told that the title had not been obtaine d. Westlake then stated that they could pick up the car and at the time that they had the car in their possession, they would then mail me a check for my money. The Westlake a gent was unsure as to how much money would be refunded to me. I made loan payments for 1 year - {$6000.00}, plus the down payment - {$7000.00}, dealer fees - {$2000.00} and insurance payments - {$1500.00}. My out of pocket costs so far - {$16000.00}. The interest rate on this loan was : $ 20 %.

Complaint: I had a car title Loan with Wilshire Consumer Credit which was paid in XX/XX/XXXX. I still had not received my vehicle title by XX/XX/XXXX. Contacted the company and they originally claimed that the title was released on XX/XX/XXXX and tried to refer me to a third party vendor ( XXXX ) that wanted to charge me to get information about my title. After refusing and calling back Wilshire Consumer they admitted that the title had still not been released but would get it processed now. When I asked why the title had not been released nearly 6 months after payoff I was told that it could have been any number of errors and they did n't know the exact reason it was never released. <P/>I find the whole process very disturbing and suspicious. Originally lying to me and saying it had been released and referring my to a third party that wanted additional money and then after I refuse to pay they admit that the title has n't been released and simply say " sorry, there was an error somewhere, but it was n't our fault ''

Complaint: I was looking at my credit report and I noticed there was a car loan that was closed and never been paid this was very heartbreaking to see knowing that I have never had any type of car loans in my life and the only credit report that it showing on is my XXXX this is not showing on any other report now that I investigate deeply I am seeing a lot of things on my report that is fraudulent and as a result in identity theft I have communicated with the Creditor Westlake Financial to take this off my credit they said they will try to put a request in the address they have is not the same address is on file where I live at please have them remove this fraudulent activity off my credit report please
