Lender trying to repossess or disable the vehicle
Complaint: In XXXX XXXX I purchased a XXXX XXXX XXXX . In XXXX XXXX the car was repossessed for delinquent payments. I paid {$980.00} to recover the vehicle and deferred the current payment ( XXXX XXXX ) to remain in a good standing making XXXX XXXX the next payment due. A month later in XXXX XXXX the car was repossessed and was not behind in any way shape or form. 3 days after the car was repoed Westlake Financial r eleased the vehicle at no expense to me. I later filed complaints with the cpfb and for a few months WF responded. I have n't heard anything in months from them, On XXXX XXXX WF repossessed and I was forced to file Bankruptcy ch. XXXX to recover the vehicle. WF are very unprofessional rude and just out right nasty. I have had only one rep to show some type of compassion or customer towards the situation. I am currently still trying to recover the vehicle.

Complaint: In XXXX XXXX , I contacted Wilshire Consumer Credit to barrow {$2900.00} against my car. I had a money emergency and wanted to pay the loan back soon. I was offered a couple of options. The first was to pay interest only, and pay the loan in full when I felt like it ( I said no to paying interest only, and I will never have the money to payoff the loan full amount at once ). The second option was to pay {$220.00} a month for XXXX hree years. I took that one ( the loan was actually thirty six ( 36 ) mon ths, for which I paid a total of {$9300.00}, for a {$2900.00} loan ). In XXXX XXXX , when I called to pay what I thought it was my last payment, I was told that my 'payoff ' amount, was {$2800.00}. They said not to worry, because I qualified to have a new loan re-write, paying the principal this time. I was shocked by the news. This was the first time in 36 months that I was told my balance due. In the past, I have contacted them several times asking why my balance did n't change in my invoice, requesting my new balance. I never was sent what I requested, only the list of already made payments. I was told that my interest changed because sometimes I paid few days late. I trusted them as a regular car loan company, and believed that as long I made my payments on time, I was OK. During all that time, even when I asked, I was never told that at the end of 36 months, I will have to payoff the total loan or renew it. Also in XXXX XXXX , I moved and I misplaced my written contract with them ( inside many boxe s ). Af ter several phone calls that lead nowhere, in XXXX XXXX , XXXX , I wrote them a certified letter explaining my stance, requesting a copy of my contract, and refusing to make any more payments, staying that I already had paid more than the 300 % of the loan amount. The have denied receiving the letter, and kept calling me to collect. I have also told them that that their business behavior is usury in the state of California and if they did n't come up with a honorable solution to my case, I was going to file a complaint against them. They still behaving like I must keep my contract. The car is a XXXX XXXX XXXX XXXX with XXXX miles, and was priced by the XXXX XXXX XXXX at $ XXXX {$1400.00}. During 36 months I was under the impression that I was paying off a very expensive loan. I believe they lied to me all along. As today, I have not received a copy of my loan contract with them. they keep calling and hear no reasoning from my end. I am a sixty five years old senior citizens, that ca n't afford anymore payments ( specially when I never expected to have anymore payments ). Even if they find my contract, and I 'unknowing ' the real content of the contract might signed the wrong agreement, I honestly believe they have scammed me with about {$5000.00} above the State of California 12 % interest rate law, and are still trying to take another {$2800.00} plus interest from me. I was expecting to finish paying the loan, save a little money and change the car for anoth er one in bett er shape. They have th XXXX XXXX XXXX of the car. They have not threatened yet to take the car from me. I am also XXXX , every single day I am sacred that they will show up and take the car.

Complaint: In XX/XX/XXXX I bought a XX/XX/XXXX XXXX the finance company was Westlake Financial Services out of California. I ended up in Bankruptcy before the car was paid for. They repossessed the car in XX/XX/XXXX. Around XX/XX/XXXX-XX/XX/XXXX there was a Judgement placed against me for the remaining balance of {$3200.00} ( roughly ) The lawyer Westlake used was XXXX. They garnished my bank account, then later they began garnishing my paycheck. This was all fine as I know I owed the money. However now after the bill has been paid the original creditor Westlake Financial Services has sent me a letter stating that the payment had not been received on the Judgement.

Complaint: Wilshire Consumer Credit XXXX XXXX XXXX CA XXXX Account numberXXXX Continual Phone Harassment On XXXX, a payment of {$770.00} against a due amount of {$750.00} was made. I am making over-payments [ greater than {$750.00} ] every month on this account. During the payment phone call of XXXX, the WCC rep offered to wrap a past due payment to the end to bring the account current. I accepted. There is currently a past due amount of ~ {$500.00}. The account is less than 30 days past due.

Complaint: I had a loan with Westlake Financial and was advised that my last loan payment in would be in XX/XX/XXXX. I was informed that I would need to pay only late fee charges and returned check fee charge to receive my title. The rep that I spoke with never gave me a date when this amount would need to be paid as it was not goin against my loan balance. For several months the company did not report this as a charge off, nor send any correspondence or make calls demanding payment I made a payment on XX/XX/XXXX in the amount of XXXX. This paid the remainder balance to get my title in full. On XX/XX/XXXX I received a credit notification stating that Westlake Financial reported my account as a charge off with a balance of XXXX. This was reported after my account was paid in full. Not sure how this is possible when it was never reported prior to making my payment. Therefore I am launching a formal complaint and investigation.

Complaint: On XX/XX/2010 I signed a contract with XXXX in XXXX, FL for an auto loan. I never signed any contract with Westlake Financial. They had my account sent to collection for a charge off and also with late payments. When I tried disputing this issue I was told if I wanted my title I must pay the balance of {$190.00} and I was questioning why do I owe a company I was never in contract with. I made a few calls to XXXX XXXX and finally got my title not sure how Westlake Financial ended up with my information but not my only problem is they are reporting negatively on my credit and when I sent information over to them to produce documents to show that I was in contract with them I never got the information. The only thing they keep doing is updating the information through the credit bureau stating that the information is verified and accurate.
