Complaint: between XXXX XXXX 2017 and XXXX XXXX 2017 Westlake Financial took out 2 paym ents from my bank instead of the agreed u pon one payment o f XXXX in doing so it overdrafted my account by XXXX they quickly reversed one p ayment of XXXX as of XXXX XXXX 2017 my account 's principal balance was XXXX AFTER the XXXX was processed and the returned XXXX was removed from the account balance.prior to the XXXX being returned the principal balance was XXXX It is my understanding my principal balance does not go up unless there is a late fee. I have never been late on payments. They even tell me I have a 10 day grace period for if I were late. Now this month PRIOR to making another XXXX payment my principal balance is XXXX and everyone I spoke to a t Westlake Financial ha s stated it increased because of the refunded XXXX but that is not true. the balance is seve ral hundred d ollars higher than it should be. why did my principal balanc e go up XXXX .It should have remained at the XXXX as only one payment was refunded. they say there was an NFS fee from my bank but this is only true because of their error in processing 2 payments. It should be noted that my loan payment is XXXX a month but I always pay XXXX I want the balance to b e upg raded to reflect the proper amount as I feel I have not been given credit for the first month payment I made to this. It is also worth noting I p aid 14 o r 15 months on this loan to XXXX XXXX PRIOR to Westlake p urchasing this loan. Complaint: These are additional issues experienced f rom Wilshire Credit a nd their unfair business practices. On XXXX / XXXX / 2017 I overnighted via certified funds cashier check # XXXX in the amount of {$2400.00} to the address on the payoff letter received fro m Wilshire Credit. The overnight confirmation is attached, along with the payoff letter received from Wilshire Credit. I called Wilshire Credit on t he afternoon of XXXX / XXXX / 2017 after receiving confirmation that the payment was received from USPS ( co nfirmation is attached ). I spoke to XXXX who said that she did not see my payment in the system, however I could call back the following morning to confirm if the payment was processed. On XXXX / XXXX / 2017 in the morning XXXX I call ed Wilshire Credit a nd spoke to XXXX who said they did not see any payment posted to my account on XXXX / XXXX / 2017 and that it take s 7-10 bus iness days for a payment to be processed to the account and to call back to check if the payment posted. I called again the afternoon of the XXXX and was told by a representative that there was no payment posted as of yet. On XXXX / XXXX / 2017 in the morning XXXX I calle d Wilshire Credit an d spoke to XXXX she said she can see notes from past representative on my account that I sent in a payment of {$2400.00}. She asked what address I sent it to and I confirmed the address on the payoff letter that is attached to this complaint. XXXX XXXX XXXX # XXXX XXXX advised me that is not their address for payments. I advised her that it was the address on the payoff letter. She said payoffs are handled differently than a regular payment and I advised her that then the letter should of indicated that and it did not. She told me that they always tell people if you mail the payment you should include more money to account for the interest. I advised that the payment was already confirmed received by them. I did contact XXXX XXXX bank and as well confirmed that the cashier 's check was cashed XXXX / XXXX / 2017 by Wilshire. She said that they do not show record of payment on my account. The representative advised me that I sent it to wrong address and there was no record of payment. She said she would take down my information and hopefully i n 7-10 day s the payment would post to my account. I advised that my payment was already confirmed received by their office and needed to be posted retroactively to the date the payment was received and I was told by her that I needed to add additional money for the interest. I advised that was unfair business practice and that if they received the payment on XXXX / XXXX / 2017 it should be posted to my account on that day especially considering the bank already confirmed the check was cashed on XXXX / XXXX / 2017 .
1. Wilshire is e ngaging in unfair and deceptive business practices. The payoff notice indicates an address to send a payment. When calling in to the customer support department you are advised the address on the payoff is not the correct address to send payment. This causes confusion to the consumer as the letter is specific to the address to send the payment and no further instructions are outlined within the context of the pay off notice to send the payment elsewhere. ( see attached ) 2. Wilshire is charging customers interest for their inept accounting practices. When a consumer mails in payment to the address on the pay off notice customers are told by the customer service department to include additional days of interest in the payment to account for Wilshire 's delayed payment processing. Even when Wilshire has a confirmed receipt of payment by the USPS and confirmation from the bank that the payment instrument was cashed, Wilshire continues to ch arge interest beyond the date of receipt of final payment from the consumer.
3. The payoff notice does not indicate there are delays in processing of payment or that it takes 7-10 days to post a payment to your account after receipt of the payment. Again this is unfair and deceptive to the consumer as the financial institute has already cashed the check and is unfairly causing confusion to the consumer by not acknowledging said payment within their ledger tracking. At minimum a general notification should be made to confirm a payment was received so accurate information can be reported to the consumer when calling i n. CFPB has already fined this company for illegal collection tactics. What about consumers who are actually paying their debts??? Their unfair and deceptive business practices are causing consumers to have to pay more in interest and fees, waste countless time and energy trying to track down their payments, unclear information being sent out to consumers on where to send payments by mail and from their customer support department, unfair accounting practices that leave consumers with interest accruing.

Complaint: Wilshire Consumer Credit XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX XXXX - Spoke to XXXX and was told the payoff including all fees was {$2700.00} and that the only way to recover car was to pay {$710.00} immediately which was for my delinquent amount and {$320.00} repossession fees. I asked if the payoff amount included additional fees and he confirmed it did and said that take into account the interest was accruing daily at {$4.00} per day. He said I could only send it via XXXX XXXX X/X/2017 - Confirmed and sent {$710.00} XXXX XXXX reference XXXX - called back and was told that it would take 48-72 hours processing time for the release of my car and that there could potentially be fees that I would have to pay to towing company at {$25.00} per day. Said that there would be a release letter sent to the towing company from Wilshire to release car but to check back on Monday.
<P/>XX/XX/XXXX - Called on Monday morning and was told that the release notice was sent to the towing company. I picked up the car from XXXX XXXX XXXX. I asked what my fees were and they said that there were no fees and that they would charge the lending company who in turn would charge me back additional fees. I asked what is the amount and was told {$25.00} per day and not other fees. The towing company was closed over the weekend so that would be 3 x 25 for fees.

XX/XX/XXXX - Called and spoke to XXXX XXXX who claimed to be a supervisor I asked the payoff amount and was told $ {$2300.00}. I was told that they misapplied my payment of {$710.00} and put it all to principal balance instead of backing out repossession fees of {$320.00} and now an additional contract fee amount of {$75.00}. I explained that on XX/XX/XXXX I was quoted a balance of {$2700.00} by XXXX and she advised that did not include {$320.00} fee I advised that I asked XXXX if all fees were assessed and he had confirmed that amount. She said she would look into it and get back to me. I asked for an accounting letter of my account and was sent a letter that confirmed the balance quoted by XXXX. She said she would look into the call recording to find out what happened and why that amount was quoted. I then called back later that evening and got back on the line with XXXX who said that XXXX was gone for today. XXXX said he did tell me the payoff {$2700.00} amount and was so sorry to misquote fees. He sent me another payoff letter that night {$2300.00}. But said keep in mind that there are adjustments pending on your account because of the misapplication of the fees to principal.

XX/XX/XXXX - I called back in and spoke to XXXX i asked for the payoff amount and if the adjustments were made she said yes but it would not change the balance of my account and that when XXXX quoted me he did not quote me the fees. I advised that is in possible because the only way to recover car is to pay off delinquent balance plus the fees. When adding up from the ledger indicated {$2700.00} so there were nearly 300 additional fees. She stated that there was interest and I said not {$300.00} worth of interst from Friday until Tuesday and based on the quote per diem it was XXXX per day. She asked to place on a brief hold and then said she needed to do more research and I advised she said she would have her research done already from yesterday and I asked to speak with her manager who now was XXXX XXXX. I spoke with XXXX XXXX who again said that there must of been some sort of misquote by agent but she said that my account was pending an adjustment because the {$710.00} was applied to the principal. She said she would look into everything and get back to me and send a payoff letter.

I received a payoff letter for {$2300.00} only good thru today and I called to pay off and was told by XXXX XXXX that I needed to pay {$2300.00}. I said that I had a payoff letter from them that indicated {$2300.00} she said she did not see that letter in her system. I advised that how am i able to receive a payoff letter from them and they not have that amount. I asked to speak to XXXX XXXX the other manager. XXXX told me my payoff was XXXX and i said but i received a payoff letter today for {$2300.00} she said but you asked for adjustments to your payment which changed the prin amount. then i said but this letter was received today at XXXX then she said ok well we have to go by that letter but you have interest accruing i asked her to take my payment and she said she could not take my payment and had to transfer me again to someone else. i said I do not feel comfortable with so many people having different numbers and not knowing the amounts to pay.

I have gotten so many different numbers from this company every time i call for a payoff. they claim one number and then another number. My interest per diem is {$4.00} but {$100.00} 's of dollars have been applied to my account. this company is taking advantage of consumers and need to be stopped they should not be quoting multiple payoff amounts and the agents are uneducated people who do not understand how to read the account ledger system. I want to file a formal complaint for consumer harassment and endangerment.

Complaint: West lake financial services located in California is reported on all XXXX of my major bureau credit reports as a closed unpaid account ... I have disputed this amount with them and have requested on numerous occasions that they send a validation of the debt and why they feel I owe that amount. The most recent call was on XXXX XXXX at XXXX in which proper proof of this amount was not provided instead I was negotiated at a different price then listed on my credit and they would remove the account completely from my credit. I found this very strange and when I asked for paper work and proof I was told it would be emailed to me. I never received the email I called 4 days later and was told someone would call me back. Complaint: Upon viewing my credit report, I noticed that Westlake Financial Services had placed on my credit a XXXX separate balances-one was a charge off balance of {$7100.00} and the other was a past due amount for {$5900.00}, for a vehicle in which was voluntarily surrendered that I had cosigned for. I collaborated with this company via telephone and spoke with a representative there. Upon speaking with this gentlemen, I requested a bill of sale from this company for the amount in which, the vehicle was resold for and the difference in which was owed. The gentlemen, then abruptly to me that he could provide me with a breakdown of all of the charges including an impound fee, in which was not true. The car was surrendered from XXXX ' auto body and repair, after they had to be contacted several times by myself and the owner of the auto body shop. Again I requested a bill of sale for the resale of the vehicle and was told that it would be provided, this occurred in early XXXX XXXX , and have not received any letter, bill of sale, etc. This was an attempt to settle a debt and this company is totally non-compliant with my request.

I paid bothXX/XX/XXXX and XXXX 's payments on XXXX2017 to the lien holder of Westlake financial accruing to the total of {$450.00}. On XXXX/XXXX/2017 at approx. XXXX XXXX My vehicle was repossessed by the seller, being XXXX XXXX, who was not the lien holder at that time, or currently, yet they are telling me that the finance company is forcing them to buy back the car. But when I spoke directly to the finance company they told me they would not do that for one late payment, especially when it had been paid. When the dealership has been paid and is only the seller and has no legal claim to the vehicle in the state of Florida as the only party that can order a repossession is the lein holder.

Complaint: T o wh om it may concern, Attached is a copy of an extension agreement that was signed and com pleted on XX/XX/XXXX . I 'm not sure why my account this agreement has not been applied to my account, but I was told that I was eligible for an extension, and was given an extension twice. <P/> I originally applied for the extension in XX/XX/XXXX , but that extension was not applied to my account. When I called to make my monthly payment in XX/XX/XXXX I was told that my car was about to repossessed for non-payment. <P/> I asked and qualified for the extension, I also had to record my name saying that I understood that the procedure of the extension agreement, but still no extension was applied to my account. Problem with the interest rate
Complaint: Loan amount on XXXX XXXX Loan amount on XXXX {$10000.00} total paid towards principal {$2200.00} total paid towards interest {$5400.00} in alm ost 2 yrs and that 's with {$420.00} a month payments. To date I have paid {$8600.00} on this car. Some of my payments went towards interest only, see attached itemized photo of my charges. I was trying to get my credit up and they are doing nothing but bringing it down! I was told that i could change the payment date to the date i needed and then it was changed to a date that is not good for me so i tried to change it back to original date and they wont. I am now always 3 days behind since they refuse to change my payment date to the XXXX and from the XXXX !!!! They charge a $ 7+ charge a d aily in addition to your APR in addition not just a late fee and that accrues interest of course. I had a late payment and was trying to give them a credit card for a future dated payment that is 3 days past the day they want it and they refuse to work with me. Calls daily threatening to reposes for a {$130.00} late payment. They are rude and unwilling to help even 2 years in my loan. You do the math this place is meant to milk you and steal from you. I 'm sure if they let me get to the end of the loan they will just find a way to reposes! ALL THEY WILL DO IS SAY TRY AND GET REFINANCED.

Loan balance remaining after the vehicle is repossessed and sold
Complaint: I had this SUV for maybe about a year, prior to it being totaled in an accident. O n XX/XX/XXXX , my SUV , tha t was financed through Westlake Financial, a XXXX XXXX XXXX , was in a rear-end collision that caused minor to moderate visible damages, but caused major computer and electrical damages-from the car that hit us, going under my SUV, whi ch eventually caused it to no longer run. When taken to shops, I was told several different stories- from it needs a programmer, to it needs a new engine. When I to ld Westlake this, they said they did n't want to repo the vehicle, since it does n't run, and that they did n't loan me the truck, they loaned me the money, so that 's what they wanted. As I said- we are still in the process of a settlement for this accident, meanwhile, I had to purchase another vehicle, so I could work everyday, get my XXXX kids to school, to practices, to games, to the grocery store, and what if there was an emergency? I live XXXX miles from the nearest hospital. I explained to the very rude rep at Westlake, t hat I could not affor d to continue to pay {$500.00} a month, for this SUV that is no longer operable. They offered no solution or assistance and put the full remaining balance on my credit report and left the vehicle in my possession but never sent the title. Then, they sent just out a repo person out today- 2 years later?? I 'm confused and very frustrated- this charge-off on my credit report has prevented me from getting anything- a home, a person loan, or any kind of debt relief. I do n't feel this is fair because, even if I paid the full amount to them, they still have the truck repossessed, and sell it at auction? and then I still have the bad report on my credit for the next 7 years? I explained to several of the reps that ca lled from Westlake, th at I planned to pay them off, using the settlement money, if enough, and try to buy another SUV like that one that runs, or another engine, and try to fix it- I re ally liked it and it was great sized for my family, taking kids to school, carpooling with other moms for school pick up, games, etc. They offered no reduction in the amount, no assistance of any kind, and now I ca n't get a straight answer out of anyone there- they know nothing about anything going on, or why they recently re-opened the repossession ticket, in the end of XX/XX/XXXX , this year, 2 years after they wrote the debt off and put it on my credit report. I would like to keep my SUV and c ome to a much lesser settlement amount- since the vehicle is totaled- and have them remove the negative report from my credit reports. I thought that is what normally happens, after an accident that totals the vehicle, the insurance is supposed to pay off the vehicle- I had full coverage insurance and so did the guy that hit me- but the guy was from Florida, where we were on vacation, and Florida is a no -fault state, so his insurance- XXXX XXXX -refused to pay for the damages that were not visible. They only repaired the rear bumper. The tow package was messed up, the frame is bent, the suspension no longer airs up in the front, and it wont stay running, it spits and sputters, and shuts off. It was that way when I went to pick it up from the repair shop and the guy said XXXX XXXX was aware but denied payment. The other driver was clearly XXXX and allowed to leave the scene. My insurance paid for everything else- my medical bills, my husbands medical bills, both of our physical therapy, and my rental vehicle. There were many problems with the accident, and then the way we were treated-by XXXX XXXX plus XXXX , and even the repair shop. That 's why we are still in the lawsuit, to try and correct the problems, but I do n't understand why I should have to pay the full price for the totaled vehicle, plus the repo it to sell at auction, plus my credit is ruined for 7 years? All because some XXXX driver rear ended me, at a red light, and I get all of the negative effects, while the at fault driver, gets to walk free and have nothing done to him- and he got a new car from his insurance after the accident! This has definitely not been fair and needs to be addressed by someone of more authority than myself. Thank you for your time and assistance with this matter.

Complaint: Multiple calls have been made to Westlake and their attorney XXXX XXXX for information on the homeowners case to see if they post poned the sale due to the filed arbitration complaint and lis pendens. The rep XXXX at Westlake said they didnt have the previous TPA submitted and asked me to email it to her. She refused to let me conference in the homeowner who has been desperately trying to get an update on his foreclosure. The assigned attorney for Westlake refused to also give us or the client an update on the sale date. She said on the phone even if I get your TPA I will not provide you any information. A QWR was submitted and the lender has failed to respond prior to the sale date of the home.
