Complaint: I have been receiving several calls from Westlake Financial everyday of the week. Sometimes it seems like all day. I do not have any business with them nor have I. The final straw was when I had received a call from them on Sunday and I tried to contact them and let them know this, and they were closed. But the message said that I could contact them that day. I have received several messages from them on Sunday, and every day of the week. When I did answer the call to talk to someone it is always an automated system to push buttons. I finally did contact them during the week and they ask me did I have a relative that may have used their services. I said I may, but they have nothing to do with me and my phone number, caller ID & answering machine being hijacked with so many of their calls. I called on two different occasions and spoke to live representatives and requested for them stop calling me, but the calls continue. I just received another one, on this day Sunday, XX/XX/17, and I have had enough. Please contact them and let them know to correspond with whoever they are after in writing.

Complaint: In XXXX 2016 the vehicle broke down. A tow company took the vehicle out of my hands. I signed a bill of sale and he took over the title. He said he would pay balance and not too worry. The car no longer in my possession. It 's been long gone for a year now and they keep calling me, harassing me and my friends. Going to their houses and harrassing them, then saying they have a judgement against me, throwing papers at them, going through their mail to try to find me. I lost my job, went thru divorce and became homeless for 4 months. I get on my feet again, only to repeat the process. I live a clean and peaceful life and tired of the calls. They do n't listen and I sent letters which they said they did n't receive. And a copy of the bill of sale for XXXX dollars as well as to the DMV. Wilshire Consumer Credit is the worst.

Complaint: To Whom It May Concern : I was reviewing my credit file I noticed that Westlake Financial are in possession of a collection account that I have no knowledge of, and for which I never received a notice of debt from the company prior to reporting this information as required by FDCPA, 15 USC 1692g Sec. 809 ( a ). This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION. I respectfully request that Westlake Financial offices provide me with competent evidence that I have any legal obligation to pay them. I am willing to excuse this violation as an oversight on their part, yet now that I am aware of this alleged debt, I am exercising my rights under FDCPA, 15 USC 1692g Sec. 809 ( b ) and put Westlake Financial on notice that their claim is hereby disputed and validation is requested. Be advised this is not a refusal to pay, but a notice that Westlake claim is disputed and validation is requested. Under the Fair Debt Collection Practices Act ( FDCPA ), I have the right to request validation of the debt they say I owe Westlake Financial. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation that is binding on me to pay this debt. At this time, I will also inform Westlake that if their offices have or continue to report invalidated information to any of the three major credit bureaus ( XXXX, XXXX, XXXX XXXX ), this action might constitute fraud under both federal and state laws. Due to this fact, if any negative mark is found or continues to report on any of my credit reports by the company or the company they represent, i will not hesitate in bringing in legal actions. If Westlake Financial offices are able to provide the proper documentation as requested in the following declaration, I will require 30 days to investigate this information and during such time all collection activity must cease and desist. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with an attorney to pursue my legal options. This includes any listing of any information to a credit-reporting repository that could be inaccurate or invalidated. If Westlake offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.. Ive asked Westlake Financial to provide the following below and have not heard anything back. Agreement with your client that grants you the authority to collect on this alleged debt. Agreement that bears the signature of the alleged debtor wherein he/she agreed to pay the creditor. Any insurance claims been made by any creditor regarding this account. Any Judgments obtained by any creditor regarding this account. Name and address of alleged creditor. Name on file of alleged debtor. Alleged account number. Address on file for alleged debtor. Amount of alleged debt. Date this alleged debt became payable. Date of original charge off or delinquency. Verification that this debt was assigned or sold to collector. Complaint: On XXXX/XXXX/XXXX, I purchased a XXXX XXXX XXXX, VIN # XXXX, through Westlake Financial Service via XXXX # XXXX. Sadly, after less than 2 weeks of owning the vehicle, it become completely immobile and I was never able to drive the vehicle again. Although the dealership that I purchased the vehicle from, guaranteed to repair the vehicle, they did not live up to their guarantee either and Westlake Financial Services forced the dealership, XXXX XXXX XXXX XXXX, to buy-back the loan via the Dealer Compliance Department. XXXX XXXX XXXX, in the XXXX XXXX Department was my point of contact through out this process as customers were not allowed to communicate with the XXXX XXXX XXXX directly. I was notified that the buy-back officially was finalized as of XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX, I spoke with XXXX XXXX XXXX with Westlake Financial Services after receiving a copy of the re-assignment letter which states that Westlake Financial Services is no longer my lienholder and indicates that my dealership, XXXX XXXX XXXX XXXX is now my point of contact. My concern with this promulgated form was that it was very general and did not notate the reason for the buy-back so I asked XXXX XXXX if there was a way to modify this form to add the reason. XXXX XXXX indicated that unfortunately it is a standardized form and that they were not allowed to modify the letter, but that in his opinion, he felt that I had more than enough evidence to support the reason for the buy-back. He further mentioned that the reasons for the buy-back would forever be records within the notes of my account should we ever need to reference them and that the buy-back is labeled as " merchantability issues & mechanical breakdown ''. He further continued by asking me if I wanted the loan deleted from my tradeline and extended an offer to finance another vehicle to me in the future since he understood that this was certainly nothing that I had caused. Westlake Financial Serivces records all of their conversations as indicated prior to any customer service representatives answering their calls, and I recorded this conversation as well and have an audio file of this very conversation to support all of this. Unfortunately, I am continuing to have problems with the dealership, XXXX XXXX XXXX XXXX, and am presently suing them as they have possession of my vehicle and my {$7000.00} down payment. I requested a copy of my records of this account yesterday, XXXX/XXXX/XXXX, from XXXX in the XXXX XXXX XXXX and according to her, per XXXX XXXX advised her that I would need to have a subpoena to gets these records. Unfortunately, I am handling this civil suit pro XXXX at a XXXX level because I can not afford an attorney because I have lost so much money already because of this fiasco and I mentioned this to XXXX but she continued to hold her ground and would not release the records. So in an attempt to possibly fix this, one more time, in good faith, I reached out to XXXX XXXX XXXX, Chairman of the XXXX XXXX Westlake Financial Services yesterday, XXXX/XXXX/XXXX and explained my situation. I told him this information is imperative to my defense. Instead of helping me, he elected to maliciously attack me and the route the I have taken against the dealership. He defended the dealership and told me that the dealership paid off the loan because I refused to pay for the vehicle. All of this was via email. So ... I, one customer ... have the power to do all that in one month of owning a vehicle? I think not! I do n't think he expected me to have an audio file of the conversation that I had with one of his employees to prove why the buy-back happened. I emailed him a copy of that audio file and he has yet to do the right thing. I need this information. It is imperative that I get it as the dealership is claiming that they were forced to buy-back my loan because I was in default ... which could not be any further than the truth. I have the phone call ... but the notes on the account and all of the history behind it would be all the more proof that the dealership is the bad guy and not me! Westlake Financial Services was fined by CFPB a few years ago {$4.00} XXXX dollars and ordered to payback {$44.00} XXXX in fees for illegal practices. It looks as though ... .their staff is a reflection of their leadership and things have n't changed much since then. I should n't have to hire a lawyer to get records that belong to me. This is n't right.

I even received a refund check from the company for overpayment. How can they charge off an account I overpaid? I have requested them to update my reports and they are stating that the charge off is correct. If this was charged off, why do I still have my vehicle?

Complaint: On XX/XX/XXXX after reviewing my credit report I noticed an delinquent/collection account, of which I had no previous knowledge of appearing on both my XXXX and XXXX credit report. The balance owed is reflected as {$1700.00} while XXXX reports the debt type as 'credit card, ' XXXX reports the debt type as 'installment. ' I immediately sent correspondence dated XX/XX/XXXX, ( see attached correspondence ) to the Wilshire Consumer asking them to follow FCRA requirements and validate the debt with a 'wet ink signature. ' I also requested any and all documents pertaining to the account that would further validate the debt in question. Additionally, I disputed the account with XXXX and XXXX. The results of the dispute returned as 'updated, ' as if Wilshire simply updated the account information. Unfortunately as of XX/XX/XXXX Wilshire Consumer has surpassed the 30 day timeframe instituted by FCRA, I 've received no response from Wilshire Consumer. Likewise, I contacted Wilshire Consumer via phone on XX/XX/XXXX and spoke to XXXX XXXX ( XXXX ) to request proof of the debt owed. I was told the information requested was available, however, 'originals ' would not be made available for my review.

Complaint: Owing a final balance of {$600.00} as per my recorded telephone conversation in which the final balance was disclosed I advised XXXX XXXX XXXX loan company that I would be requesting a payment reduction or payment arrangement because due to the loss of my home I would be experiencing financial hardship for a short time and on discussing this, the company proceeded to initiate an illegal repossession of the vehicle and on top of it are claim XXXX more than what was owed as I only had ( XXXX ) payments to make before the vehicle was paid off in full. I inspected a copy of my credit reports and find that XXXX XXXX are reporting inaccurate balance owed as I only had ( XXXX XXXX payments to complete the purchase which does not add up to the balance they are reporting. I request full debt validation from this company included conversation logs as per literate the companies telephone procedure for incoming and outgoing calls. I find XXXX XXXX XXXX business practice to be dishonorable at the end of their contracts and they have integrity for this reason along with counsel i will do my own investigations into the balance owed as a result to their illegal repossession of my vehicle.

Complaint: WESTLAKE contacted me about a payment arrangement I which they were not I favor of but during my contact, I told them I contacted couple of dealership in favor of a trade in. The very next day they went and put the vihicle as a repossession at the credit bureau. I did not know until one of the dealers showed to me. First, so if you put it up for repossession why am I getting extremely upsetting calls with threatening tactics even after XXXX XXXX. I refuse to talk with them. I have consulted a bankruptcy attorney to proceed with court case. They are listed at XXXX XXXX XXXX # XXXX, XXXX XXXX, CA XXXX and TH all came at XXXX they need to Tran their people better in the laws of collection. The vihicle has two recalls and a front end issue that I was trying to resolved before my next payment was due, since the cost was {$1500.00} dollars or greater. They need to have a person to speak with for issues like this not some collection person who think they can anything that is very threatening to the consumer. Complaint: I was 14 days late on my payment due to being in the XXXX and unauthorized charges on my bank account. I notified Westlake Financial of the issues. I made my payment on XX/XX/17 the XXXX day and then next morning when I went to get into my car it was gone. The police told me it had been repossessed but the Finance Company ( Westlake Financial - XXXX - XXXX ) said they had not issued a repo order on my car but that the loan is under review and they might not continue on the loan. The dealer where I purchased the car ( XXXX XXXX, XXXX at XXXX XXXX XXXX XXXX, TN XXXX XXXX started sending me threatening text messages and calling my references telling them that he was checking to see if I was dead or alive. I have my receipt. I also found that Westlake Financial is not registered with the XXXX XXXX of XXXX to do business in TN, they applied but was not granted a business entity number.

Complaint: I signed for my boyfriend at the time to get a loan for a XXXX XXXX XXXX on XX/XX/XXXX. My boyfriend at the time was making the payments every month as assigned i was the cosigner, until i was going to make a payment over the phone in XX/XX/XXXX or XX/XX/XXXX payment XX/XX/XXXX and was told that my account was being reviewed at the moment by the state of mass all of the mass accounts were. I guess they were being sued. Therefor I was told i did not have to make a payment until they finished reviewing the accounts. So I found it odd but i went with it. I called again just to verify it was not going to hurt my credit. I asked for something in writing and they could not send me anything i had to call several times until i got a letter stating they would not report anything to the credit bureaus. Anyhow in XX/XX/XXXX they started to send the bill to start paying, but an emergency had came up with my boyfriend at the time not being able to pay for the car because he had to leave town for about a year for an emergency. I then called westlake to voluntary surrender the car, they took very long to come get the car maybe about a week or 2 not sure can not recall much from now. They did not have specific date to get it they said. finally picked up the car. The issue is that he only had the car for a year until i surrendered it voluntary. they sold the car for {$730.00} for a car that I financed {$8000.00} k plus and only had the car for a year. It does not make sense at all so now i have a debt of $ 5k plus on my credit report and it is still showing open. mind you i surrendered it in XX/XX/XXXX. I called them every week after I received the letter stating that i have a balance of $ 5k plus which i truly believe it is unfair to me as a consumer. They are ripping me off not only me but others as well. That is why the state of mass was on their case. They want me to pay for a car that was unfairly sold at a price that is uncalled for. I kept calling them and they never seem to know anything about it. I kept asking to speak to a supervisor and they were never around. One time they asked for my number so that a supervisor would call me back and i never received the call. I then told them they are ripping people off they dont know how to treat people or answer to people but to take their money. Then they sent my account to collection when i received a letter from the collection agency right after the last call, but in the mean time they still have my record and never reporting appropriately to my credit report. My credit report still showing i owe all that money. I believe I should not have that huge balance remaining after all that trouble and not being able to communicate with manager or supervisor at all times. They never knew anything. Horrible customer service. XXXX XXXX XXXX sold for {$730.00} is ridiculous. I will not pay for this and or I will take this to court like I told them on the phone. They treated me very unfairly. They also did not have paperwork of the car being sold at that amount when i asked them. They never returned calls. That is when they sent my account to collection. Please help us consumers doing the right thing when Financial institutes are taking advantage of us. I do have rights.
