Complaint: Since XX/XX/XXXX I have requested to the financial institution a letter of pay off. They have said that they have sent the letter since that day. And today I called to reassure of the letter and they do not want to send me the letter by email. They are saying that they have sent the letter by mail. To me it is very important to have this letter in my possession that states that I owe nothing to Westlake Financial and to make sure that the balance is XXXX in my account. So it can be reported to the credit bureau. Today I received a Marshall to reposes the vehicle. Which I understand is incorrect. This case me XXXX because Westlake is not working on the right way. The first thing they had to send that letter it was me. The person that I spoke today of the compliance dealer told me that they had nothing to do with that. When as of right now I do not have any evidence that in reality the dealership repurchased the contract for the vehicle.

Complaint: I purchased a XXXX XXXX XXXX XXXX XXXX from a car dealership and financed it with Westlake Financial in XX/XX/XXXX. The term is 48 months. I have a hard time understanding how I'm getting late payment on my report and my insurance company XXXX wrote this company a XXXX dollar check. However, I was responsible for XXXX. I had gap insurance but the company they dealt with only paid XXXX dollars. My complaint is : a company should not put inaccurate information on a person credit report. My term is 48 months and I'm not behind on my payments, I have several years to pay this loan.

Complaint: Westlake Portfolio Management , LLC ( Westlake ) has refused to reimburse funds from over-payment amount of {$7200.00} to XXXX XXXX XXXX XXXX ( XXXX ). And correct and close my account to paid in full with {$0.00} balance. When Westlake knowingly cashed two cashier checks {$7200.00} on XX/XX/XXXX then Force-paid the claimed loss cashier check on XX/XX/XXXX {$7200.00} in total {$14000.00} cashed under false pretense of ( 1 ) auto loan initial payoff amount {$7100.00} is unconscionable conduct and needs to be investigated. On XX/XX/XXXX I contacted Westlake to get a payoff quote for refinance purposes with XXXX. I was at XXXX and had the loan specialist speak to Westlake representative ( rep ) and was told the payoff quote amount is $ XXXX.After being approved for the auto refinanced loan at XXXX, Westlake was again contacted to confirm exact mailing address for the payoff check to be mailed. Westlake/Rep stated to be sure to add the per diem expense for the days in the mail to the payoff amount or the check will be insufficient funds. A cashier check dated XX/XX/XXXX in the amount of {$7200.00} was sent to Westlake for my auto loan payoff. On Thursday XX/XX/XXXXI contacted Westlake after receiving a bill for past-due payments owed for XX/XX/XXXX-XX/XX/XXXX car payments. After speaking with Westlake Supervisor/XXXX stating they ( Westlake ) never receive cashier check {$7200.00} dated XX/XX/XXXX. I immediately contacted XXXX and spoke with XXXX Supervisor/XXXX and placed all parties on conference call to alleviate this matter quickly. With Westlake/XXXX repeating they never received any payoff cashier check in amount {$7200.00}. XXXX/XXXX stated let her try and follow-up or try and locate the cashier check {$7200.00}. Westlake/XXXX stated the fees and dues may still apply, but if we ( Westlake ) at fault and got lost in mail it will be waived and not charged to your account and Westlake will honor the original cashier check {$7200.00} as payoff I have to go. XXXX/XXXX stated she will place a block on the initial cashier check {$7200.00}, don't worry just sign a declaration of loss so I can get you a replacement cashier check for payoff to Westlake. XXXX/XXXX directs me to go to my branch/bank and pick-up the replacement cashier check for payoff to Westlake. On XX/XX/XXXX I returned to bank and as directed got the replacement cashier check in the amount of {$7200.00} withdrew from my saving account at XXXX for auto loan payoff to be sent to Westlake. On XX/XX/XXXX again I contacted Westlake to see if they received the replacement cashier check {$7200.00} for payoff and close my account paid in full and send my Title to XXXX. Westlake Supervisor/XXXX XXXX did confirm Westlake recieved and cashed the replacement cashier check {$7200.00}. However, Westlake/James states they have located the initial payoff cashier check {$7200.00} dated XX/XX/XXXX. But I need to contact XXXX to give Westlake permission to cash with ( XXXX ) letter head on the letter, since your loan payment for this month XXXX is due amount of {$330.00} is your remaining balance everything else on your account is paid off and your Title will be sent after you pay this last payment.On XX/XX/XXXX I contacted XXXX and spoke with XXXX Specialist/XXXX and expressed what Westlake Supervisor/XXXX stated to me needing XXXX authorization to cash the initial cashier check {$7200.00}. XXXX/XXXX informed me that Westlake has already cashed BOTH cashier checks back-to-back the first was {$7200.00} on XX/XX/XXXX and the claimed loss check or they suppose never received cashier check {$7200.00} was then Force-Paid on XX/XX/XXXX at XXXX XXXX in XXXX XXXX at XXXX XXXX. I contacted Westlake again and spoke with Westlake Supervisor/XXXX XXXX and let him know that XXXX Specialist/XXXX was on the conference call to confirm not only the cashier check {$7200.00} was not lost in the mail but Westlake cashed it and cashed the replacement cashier check {$7200.00} making total amount {$14000.00} cashed for ( 1 ) auto loan payoff initial amount {$7100.00}. Creating over-payment and reimbursement {$7200.00} needs to be mailed to XXXX immediately. Westlake/XXXX confirmed and stated the reimbursement funds will be mailed to XXXX and got the XXXX XXXX XXXX XXXX from XXXX/XXXX to exactly where to send reimbursement funds. Westlake openly refuses to send reimbursement funds {$7200.00} to XXXX and have stop billing me for an account that has been paid in full and needs to be closed, immediately. Westlake knowingly doubled paid themselves in the amount of {$14000.00} for ( 1 ) payoff initial debt amount {$7100.00} and continue to charge bogus fees to the same account is unconscionable conduct and fraudulent behavior that is unacceptable and the Federal Trade Commission ( FTC ) needs to sanction and alleviate such company actions expeditiously.I contacted Westlake Portfolio Management LLC ; Westlake/Group President/XXXX XXXX ; Westlake/Chairman of the Board/XXXX XXXX, via phone and emails all to no avail. Once Westlake knowingly or should have known cashed the checks for payment is considered to be Acceptance of the Offer and extinguishes the debt, not in some but the debt in entirety.

Complaint: Repossession expense totalling {$3700.00} I have contacted Westlake Financial various times asking for an explanation. My husband had an accident on XX/XX/XXXX and passed away while driving, the vehicle was a total loss. I informed XXXX, my insurance agent and they immediately paid off the car but we did not have Gap insurance and therefore a balance of {$3800.00} remained unpaid ( please see attached payment history ). I immediately called Westlake and they informed me that I could continue making monthly payment until account was paid in full, I have made monthly payments every month since XXXX. In XXXX, XXXX I noticed an " unpaid other fee '' of {$1000.00} I immediately emailed Westlake inquiring about fee, I later received a letter in the mail ( see attached letter from Westlake ) where they explained they were charging me this fee because those were fees charged to Westlake from a third party vendor for removal and disposing of car. In my XXXX, XXXX statement the " unpaid other fees '' went up to {$3700.00} I again contacted Westlake and this time I spoke to XXXX XXXX & XXXX XXXX ( Supervisor ), they both informed me the car was still at an auction and as long as the car was not sold I would continue to pay the monthly fee. I called XXXX & XXXX sent me & Westlake proof ( see attached ) that XXXX had picked up the car in XXXX, XXXX paid whatever was due and XXXX sold the car XX/XX/XXXX ( see attached proof from XXXX ). XXXX XXXX told both me and the representative from XXXX they would escalate the case and I would have an update in 24/48 hours. Last conversation took place XX/XX/XXXX, I have called several times and each time I get someone else on the phone and keep getting the runaround. Westlake said these were third party vendor fees, I asked them for receipt and they said they did not have available. Please help I don't know what else to do. Thank You XXXX XXXX XXXX

Complaint: I am financing a car from a dealer and was approved from westlake financial for XXXX with an apr of 24.99 % with 66 payments of {$410.00}, which is really high for me for a first time and they provided me a credit score from FICO and when I called them to ask for an extension they said I needed a 4 payments to obtain an extension and they said that it is from the company policy which I ask to provide a proof and they were denying that request to provide me a proof, and when I payed one of the month it says the interest and principal, when I took out the car they recommended me a GAP in order to drive the car paying {$200.00}

When I contacted the dealership on Saturday they stated that they had no contact with the financial institution and that they did not agree to anything. Complaint: The car was originally financed with XXXX XXXX, from my knowledge the company is no loner in business and Westlake Portfolio took over our loan. The XXXX XXXX XXXX I purchased from XXXX XXXX XXXX XXXX XXXX in XXXX, GA came with numerous problems making it a Lemon Car. Within the first week of purchase the car had a {$1200.00} transmission issue I was able to get the place of purchase, to correct. 2 months later another issue with the catalytic converter arose making the car not passable for an emissions test, along with wheel bearing issues appearing all with in 2 months. The value of the car was drastically cut a year later making it only valued at {$4000.00}, half of what the {$8000.00} loan was for. With already {$5300.00} invested in a lemon car and taking a huge loss I could no longer afford to invest payments in a car I could not drive on the road and voluntarily gave the car back XX/XX/XXXX. I personally called their towing company and handed it over. I was willing to pay the difference of the value of the car and what I've already invested in the car since the purchase in XX/XX/XXXX. They sold the car for {$2400.00}. They've received double the value of the car from me already. I presented Westlake Portfolio a settlement offer and they refused to provide me a letter before I paid on the agreement we came up with stating if I paid they would remove the debt from my credit. They wanted me to pay first, then they'd send me a letter via DocuSign stating what we agreed to. After being persistent they provided me with a vague letter stating they'd report it as settled. Not the agreement for " settled, paid for deletion '' we came up with. I've had to deal with numerous rude reps who like to think they know more than the consumer and being threatened by XXXX XXXX, a supervisor in the charge-off department on XX/XX/XXXX who said " they have ways to get the money from me '' I had to remind him that debt collectors are not allowed to threaten the consumer for wage garnishment, send harassing phone calls etc. I disputed the amount owed with Westlake and do not take ownership of the debt account in anyway. I have come with a settlement amount with them and WAS willing to settle this debt just to be done with them as long as they provided me with some assurance before I paid them. The trust between me and this company is gone and I will not pay on a debt I do not agree I owe unless they provide me with a letter stating they'll do as they say because they've already threatened me.
