Complaint: XX/XX/XXXX Prior loan from Westlake Financial that was charged off in XX/XX/XXXX, still shows a balance owed to thrm of {$1500.00} on my XXXX credit report. I discussed this issue with them in XX/XX/XXXX thru XX/XX/XXXX to get this mistake fixed and was told this charge off and balance would be removed due to car being sold at auction by them. Recently I applied for a personal bank loan and was denied due to this severely derogatory listing on my credit report.

Complaint: I was sold a loan I could not afford. After paying nearly {$13000.00} as a down payment on the vehicle westlake refused to work with me when my household budget collapsed due to my wife having our child prematurely. I even consulted and considered filing bankruptcy with an attorney to help with my situation. But I was told by westlake financial the vehicle was already up for repossession and there was nothing I could do. After receiving this information we sold the vehicle to XXXX not 6 months after we purchased it and only got {$110.00} in positive equity back despite putting {$13000.00} down on the car in cash in XXXX of XX/XX/2018. And now westlake is continually delaying the overpayment check being issued because I mentioned I was consulting with an attorney. I also verbally revoked my consent to be contacted on my cell phone by westlake numerous times, but was still called by collections.

Complaint: The company submitted a response that I am unable to contest to the submitted complaint below My dispute is with Westlake Financial Services at XXXX XXXX XXXX, XXXX XXXX CA XXXX. I had an auto loan with them and had purchased gap insurance. I was in a car accident and totaled this vehicle, and westlake financial made it near impossible to file a claim. When I managed to file a claim they denied my gap claim due to making late payments during the course of my loan. This provision was not in my gap policy upon purchasing. I have been unable to dispute this course of action for over a year. I can not call them without one of their agents, who speak english poorly, either hanging up on me or their automated system hanging up on me instead of transferring me to agents. I am tired of this being claimed as " Bad debt '' on my credit report. I am not satisfied with this response. This " gap waiver '' they are claiming was neither discussed or signed by me. As it was explained and required by law, I paid for the gap policy and they are required to follow through with payment of the rest of the loan. It is not on the condition I never have a late payment or extension over the loan. The company will either resolve my debt or I will take the next step legally for fraud.

Now further more on XX/XX/XXXX you updated my account again to show a balance of {$9100.00}. now there is a new dispute sitting at your company labeled XX/XX/XXXX waiting to be taken care of I also have not received my letter of payed in full from your company that I was to receive in 30 days from date of payment in full. Requested this again yesterday they sent a pay off letter. I requested it again today still have received nothing. Complaint: My car payment is due every month by the XXXX, I typically always pay half in the beginning in the month and the remainder before the XXXX of the month as I have a 10 day period before I am charged a late fee and that is what works for me. However every single day since the beginning of my laon, I get called every other hour by this institution asking me to make my payment if it hasnt been paid in full by the XXXX and they continue this every day until my payment is made in full and I feel it is harassment to call me this many times a day. I have attempted to have this resolved with the company but all they can offer me is being removed from the call list which I do not find fair because I should be able to have a reminder call Incase I do forget but I should not have to have that reminder every other hour of every day.

Complaint: I have used XXXX XXXX XXXX on more than one occasion. However, the present loan seems a bit out of sorts, since I have been paying more than the monthly minimal payment for over a year, but only a fraction of the payments have been applied to the principal. I understand that lobbyists in California, and maybe even Washington D.C., have managed to legalize loansharking by circumventing common usury laws whereby paving the way for predatory lending. However, sometimes laws need to be tempered with a bit of common sense and morality. I understand that XXXX XXXX XXXX has had issues in the past with the CFPB, if not some other financial regulatory body and I feel strongly that they deserve another look.
