Complaint: On XX/XX/XXXX we purchase a XXXX XXXX XXXX from XXXX XXXX XXXX nothing that we had discuss prior was on paper and the finance charges and rate was and is super high, we didn't complaint because we needed the vehicle, We gave {$1500.00} down payment and we where promise 1st payment to be until XX/XX/XXXX. Vehicle was finance through Westlake Financial Services 1st payment was schedule for XX/XX/XXXX. Took us by surprise, we made payment on line XX/XX/XXXX for {$330.00}. During this time XXXX XXXX XXXX asks us to take car for smog because they forgot to do it. We pay out pocket and waist time doing their work. Now, XX/XX/XXXX received a text fro sales person asking me to bring car immediately to dealer to finish DMV registration that I needed to do it today. When car was there noticed sales person being like always and said that car was being repo because we failed to make payment for being negligent and not making my car payments ; my boyfriend drove car he had just recently gone through a major surgery in XXXX and is carrying a temporary bag. He tried to get them to understand but they where rude. Now, I am without a car were having problems getting to work and is costing us money. Payment was confirm through my credit card company.

Complaint: I took out a loan on my vehicle in XXXX of XXXX. I am not disputing this and I defaulted on the loan and owed this company and a late, repo was put on my credit reports which were valid. I called XXXX and asked them about the judgment letter I received that stated a judgment would not be reported it I made arrangements to pay. I called on XX/XX/XXXX and did just that. They never gave me proof as to what the vehicle was sold for only verbal proof, why would I trust these people to tell the truth. I was then told I had a remaining balance of XXXX in which I could make payments and it would not be reported as a charge off because I have satisfied my obligation. Even though I know this was still bad on my credit I didnt want to owe these people and have them out another negative remark on my credit report. I started paying right away and had paid almost {$800.00} dollars when I received an alert from XXXX saying that this company has reported a charge-off even though they informed me they would not if I paid and agreed to pay. I then called them that day and spoke with XXXX XXXX one of the Managers there. I told him my dilemma and he said, Ms. XXXX, if you make a deal with us and pay {$400.00} we will take ALL the negative information off your reports and it will be like they never existed. I was ecstatic and agreed, I spoke with an Attorney and he informed that XXXX could not delete these items form my report but what they could do is not do anything when I disputed them and they would fall off automatically with all three bureaus within 30-60 days. I asked XXXX XXXX for something in writing stating this was the case and he refused to ask me to just trust him. I told him I trusted no one at that company and this was a business transaction. They refused to put anything in writing even though I recorded XXXX on my cell phone with his permission stating that all the items would be removed for {$400.00}. This has affected me greatly not so much the repo and the late but the charge off they lied about. I was denied and apt I needed and my credit lines were decreased on some of my credit card accounts. As a result of this, I have been on pins and needles aggravated my condition of anxiety that I take medication for every day. I want these people to make good on their promise and get it in writing in the interim I am going to file a claim at the XXXX XXXX courthouse on XX/XX/XXXX for the maximum of {$7500.00}. XXXX XXXX has stopped taking my calls and wont call me when I leave messages. I dont think I should be liable for the {$400.00} since I have been through so much pain and mental suffering with this company. I have proof of all that that I stated above including bank records where they took payments from my checking account for the {$150.00} per week for 5 weeks which was never reported as being paid either to the credit bureaus, in fact, I have a letter from them on XX/XX/XXXX ( attached } stating I still owe the full amount which is incorrect. Complaint: Upon signing my loan I was told directly by a Loan consultant from West lake Financial of XXXX XXXX CA that I would be able to get into another vehicle after I made 6 payments. I have currently made a total of 8 payments and they have reneged on their promise. I have asked this company repeatedly to put me in another vehicle or lower my current interest rate. This is verbiage from the email i sent them : My name is XXXX XXXX a current Westlake Financial customer with account # XXXX, I want to speak to a representative in regard to when I originally negotiated payments terms I was informed I would be able to get another vehicle or apply to have my interest lowered. Since this has not happened I want to do a voluntary repossession. Now what can waiver my decision or cancel this action, would be for your company to lower my very high interest rate of 23 % to around 13 %. Please update my online account to reflect to a lower payment so that I will know my interest on this account has been lowered for the month of XX/XX/2019. If this action can not be done, please send paper work for me to relinquish/surrender/give back the vehicle. Please email me all electronic documents where I can provide a electronic signature acknowledging my voluntary repossession Also send a final statement showing the payment difference or final balance after the vehicle has be sold at your auction. Complaint: Westlake has listed a defaulted debt owed to their company on my credit report. I do not owe this debt. I requested an investigation through the bureaus. Westlake claimed the debt was valid. I requested validation of debt via certified mail XX/XX/2018. They failed to reply. I sent a 93A Demand notice via certified mail for failing to produce required documentation under federal and state law via certified mail XX/XX/2018. They replied with refusal to provide any information stating they were unable to locate the account. I sent them a third notice in the form of a 93A Demand with all of my information ( account number listed on my credit report, full name and address ). They failed to reply in any way. They have continued to report in attempt to collect this debt. It is illegal under both federal and MA law to attempt to collect a debt without providing proof of a claim.

Complaint: Westlake Financial responded to an initial complaint file through XXXX with inaccurate information. Westlake Financial stated that they emailed paperwork, for a differed payment that they proposed, to my email address and stated that they had not way to get in touch with me to follow up. Westlake financial did not send anything to my email address and only responds to emails with an automated response. As a result of this, they are now claiming that my account is 57 days past due ; making it also virtually impossible for me to pay my account as they have denied me online access. Westlake financial has my address on file as well as my email address and could have used either to contact me.

Complaint: Westlake Financial must send a letter that they have repossessed the vehicle ; and that the car will be sold at either a public or private sale ; and that the sale will be conducted on or after a certain date and must give me given opportunity to redeem the vehicle prior to that date. Westlake is reporting on my credit report that it is a charge off for XXXX. If the vehicle is sold, the sale price must be applied to the balance of the loan. They have not sent me any letter stating the car has been sold. If they have kept the vehicle in satisfaction of debt, they were supposed to send me their proposal to do so in writing. They must have my consent. I have not received any such letters. Westlake Financial has not followed the law by repossessing the vehicle or in their disposition of the vehicle after deposition and I have a attorney ready to act in my defense if Westlake Financial does not removed inaccurate false account information from all 3 credit reports due to the lack of Westlake Financial unethical practices immediately.

The third party company sent me a letter making a claim that they will be servicing an account. The notice included : IMPORTANT NOTICE ABOUT YOUR RIGHTS : Unless you dispute this debt or any portion of it within thirty days after receipt of this letter, the law permits us to assume that the debt is valid. You may notify us that you dispute the debt or any portion of it in writing, or by telephone. Within days of 7 days of this notice I sent an email, called, and mailed a letter request of debt validation under : Violation of the Fair Credit Reporting Act, Violation of the Fair Debt Collection Practices Act, Defamation of Character, Cease and Desist notice. Include within this letter I stated : If your office fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent immediately. Do not contact me at my workplace for any reason as well as attempt to collect any debts on behalf of the Alleged Creditor that sold this debt until proof of debt has been validated. The Alleged Debt Collector did not nor can not legally prove a valid balance on the account still exists under penalty perjury. The third party company made several attempts to call me to collect payments and act on the behalf of a servicing company. Without notice the third party company has repossessed the vehicle from my workplace after the cease and desist notice was sent months ago. I have made several attempts to get my belongings from this vehicle and was denied by the repossession company.

I paid the full amount and I have been disputing this for years through the XXXX and Westlake financial services. I have provided all the documentation as proof of this to XXXX and Westlake financial services. This has and continues to impact my credit and interest rates. Westlake financial services refuses to correct the information that is being improperly reported to the credit bureau. Complaint: This is the second complaint I have filed against this company since XXXX, and I believe this latest tactic is a retaliation for the steps I have taken. Westlake Financial was contacted in XXXX after our issue was settled with the help of your office. During our conversation they offered to defer my XXXX payment until the end of the loan. I agreed to this. That should have negated my XXXX payment and made me only responsible for my XXXX payment. My XXXX payment was due on XX/XX/2018 and is scheduled for XX/XX/2018 of this month. I received a letter on XX/XX/2018 ( dated XX/XX/2018 ) that stated the following : " Your account is in serious default. Please be advised that your account has not reached the stage where definite action must be taken. We have begun a review of your account to determine what further collection efforts are required. Those actions may include steps to protect our interest in the secured vehicle, up to and including repossession, according to the terms of your contract. '' I find this amazingly aggressive for a 15 day delinquency and feel this is absolutely a response to my asking for my records to prove that they did not harm my credit as they threatened to when I refused to answer their question regarding why I was late. I was told that they would put that I was non-responsive to their claim, when that was not true. The resolution was that they told you they didn't have that in my record and would not release any part of my file without a court order.

So I get transferred and I've been and the lady told me that I was calling the wrong number gave me another number and she said I do have gap insurance and transfer me to another number wich I was on hold for 30 minutes and nobody answer what can i do?????????? She said there was still {$35.00} that was 50 days past due? Once again I asked her how when I gave them {$530.00} in XXXX she couldn't give me an answer.
