Complaint: Wells Fargo violates cfpbs dual tracking laws by initiating foreclosure prematurely.
1 ) I was only 45 days late when referred to attorney to begin foreclosure.
2 ) during those 45 days I was put on disaster relief for 60 days.
3 ) immediately following the disaster relief, foreclosure was initiated without proper loss mitigation procedure as cfpb states it should be.
4 ) after disaster relief I was put in forebarance for 6 months with reduced payments. The 2nd payment was accepted by Wells Fargo held in a separate account to be returned, because they would only accept full payment due, because foreclosure had been initiated.
5 ) I worked with 6 different loss mitigation reps up until the lis XXXX was filed and for a year after. I asked repeatedly to pay to reinstate mortgage because my mom offered to help. I was ignored.
6 ) I was told repeatedly to send the same information over and over even though emails state they received all necessary documents.
7 ) cfpb prohibits a mortgage servicer from working on loss mitigation while simultaneously working to foreclose, much less initiating foreclosure when only 45 days late.
8 ) Wells Fargo assigned the mortgage in XXXX of 2019 to XXXX XXXX XXXX.
9 ) Wells Fargo told me they had no interest in the property and could not communicate, however, 6 months later it was Wells Fargo who petitioned the court to reopen case and ultimately sell my home AND purchase at foreclosure sale. Wells Fargo claimed this did not happen and that XXXX XXXX is the owner. XXXX XXXX claims the property is XXXX. XXXX claims it had the right to foreclose per terms in a pooling and servicing agreement, yet they didnt sell it, Wells Fargo did. XXXX now claims they have no interest and says that XXXX XXXXE owns the property.
The cfpb has allowed Wells Fargo to get away with this foreclosure by not having proper procedure to enforce violations of servicing errors as it pertains to dual tracking and default guidelines. The 2 previous complaints to cfpb received answers from WELLS FARGO. Both of those responses not only had conflicting information, but they both clearly state exactly what Im claiming the problem was. They admit the time frames for disaster relief and admit they could not accept payments because foreclosure was inititiated. Well if foreclosure was initiated prematurely then it seems that Wells Fargo made a huge error in denying my payments thus causing the foreclosure.
I have followed all of the correct procedures for filing complaints for said violations and the CFPB has done nothing more than require Wells Fargo respond, regardless of its a truthful or accurate response. The CFPB needs to enforce the laws it put into place to protect consumers like me, or shut down. If your process and procedures allow 1 person to be wrongfully foreclosed on, then it has failed. Enough is enough, stop these servicers ( claiming to be owners ) from making money off of innocent peoples inflicted misfortune.
Wells Fargo needs to be sanctioned for reopening the foreclosure without any interest in the property and for recording a fraudulent mortgage assignment. It states the security instrument was signed in front of a notary, but the security instrument was in the county clerks possession when they claim to have signed this and assigned ownership of it. This is fraud by definition You can see the XXXX payment that was denied and additionally only 1 month if late fees on the foreclosure amounts due and owed. How do I have only 1 late month if I missed payments?

Complaint: I was directed by the office of the Comptroller of the currency to file a claim with your department the case that was with that office # XXXX.
To whom it may concern my account was closed back in XX/XX/2019 with Wells Fargo bank. On XX/XX/2019 a refund went via my old debit card with Wells Fargo for {$2500.00} from merchant XXXX I informed the merchant that no longer had a account with Wells Fargo I was instructed the payment had to go back to that card. At the time I contact Wells Fargo multiple times XX/XX/XXXX to XX/XX/2019 in the beginning Wells Fargo informed me anytime the account is closed more than 30 days anything trying to come in or out of the account will be blocked. On XX/XX/2019 the payment came in Wells Fargo fraud department and was blocked on XX/XX/2019 it was picked up by Wells Fargo collections department. At the time of closure in XX/XX/2019 there were a few claims that I open regarding the negative balance with Wells Fargo I never received the proper resolution pertaining to those claims so they were re-open. I received a letter dated XX/XX/2019 Dear XXXX XXXX, we completed our research of the Inquiry about charges of {$2500.00} on your account. Based on the information available to us we have to determined the transaction was authorized or that a processing error did not occur. Please consider claim close.
Their decision is Vague and untrue. It not Concerning Charges it base on a merchant refund to a close account.

Complaint: On or about XX/XX/2019 I received a phone call from wells fargo, asking me the was unusual activity on my credit card. I immediately told the agent to cancel the card as all the transactions where made in XXXX XXXX, when i was in XXXX the whole time. Wells fargo has decline my claim stating that i responded to a text and verified this transactions. My XXXX Was missing with my credit card in the XXXX case. I never locked the XXXX because my kids used it. Well imessage was link to the XXXX and tex messages send to my phone number will also go to the XXXX and could be respond from there as well. Just to be clear the XXXX had its own internet service that i paid for and all the app and services were fully accessible.
This is over whelming Because this there is almost XXXX XXXX dollars charged to the account that i have to pay now.
I wish they had a little better fraud detecting system.

Complaint: We are two retired XXXX, XXXX & XXXX XXXX, who have had our own charitable project working with 1500 families of XXXX patients in XXXX XXXX since XXXX, through XXXX XXXX XXXX, a nonprofit organization registered with the IRS. We use mostly our savings, with help through small fund raising events and from our family. My sister, XXXX XXXX, an XXXX XXXX XXXX, donated the total of {$20000.00} to our cause through 4 checks of {$5000.00} each. The checks were payable to XXXX XXXX, XXXX XXXX XXXX. We received 2 checks ( 1st and 4th ), but were away for a short trip between XX/XX/XXXX to XX/XX/XXXX. When came back, we found no mail in our curbside mail box, which was odd! We also were waiting for a debit card from Wells Fargo Bank, which we never used it except for access to our Wells Fargo ATM machine.
On Wednesday XX/XX/XXXX, my sister received a voice mail from a lady named XXXX, from Fraud Prevention Office of Wells Fargo. She asked if XXXX XXXX wrote 2 checks to XXXX XXXX, XXXX XXXX XXXX, as someone was attempting to cash them at a Wells Fargo Branch. We told her I never cashed any check ( including the one I had received ) yet, and requested to cancel the checks ASAP. Just a few minutes later, she called back and said they checks were cashed. My sister issued the checka from her XXXX XXXX XXXX. I incidentally happen to be a Wells Fargo client as well. I immediately notified the police of XXXX XXXX County where I live, spoke to Officer XXXX XXXX, case # XXXX on the same day, XX/XX/XXXX.
These are the problems we have with Wells Fargo : - They clearly made a mistake to notify us ONLY AFTER checks were cashed for " suspicious activities ''. The person who signed in the back of the checks identified himself as XXXX XXXX, endorsing to himself posing as " XXXX XXXX '', left with {$10000.00}. On the upper left corner of the check is the clear sentence : " Please post to XXXX XXXX ''.
-The lady XXXX ( XXXX ) XXXX at Wells Fargo who notified us, refused to give us ( myself and my sister XXXX her whole name or title. She refused to give me the exact location of the branch and time stamp when checks were cashed, to provide to officer XXXX as instructed by him, claiming she had to protect the privacy of Mr. XXXX. The best she could do was reading out the signatures on the back of the checks as XXXX XXXX. It was very hard to contact her, even offer XXXX had the same problem. We would mostly run into her recorded message with first and last name hard to decipher.
-She told us to call " Legal Enforcement '' number at ( XXXX ) XXXX, who in turn told us they only take care of bank robberies or bank alarm system, and who told us to speak to Customer Services of Wells Fargo . We were passed around like hot potato!
-I spoke to XXXX XXXX at Customer Care , Executive Office : ( XXXX ) XXXX, who told me he could not release the exact location where the checks were cashed or time stamped " to protect the privacy of XXXX XXXX '', just like XXXX had said. He demanded my sister XXXX XXXX ( who was giving me {$20000.00} for XXXX XXXX and who issued the checks ) to establish a claim with her XXXX XXXX XXXX, to get the compensation from XXXX XXXX XXXX.
-My sister is setting up a claim with XXXX XXXX XXXX , although clearly the fault was with Wells Fargo in the first place.
- On XX/XX/XXXX, Wells Fargo informed us that our Debit Card was being used at XXXX XXXX, at XXXX and XXXX. He was declined at XXXX, but at XXXX he got away with {$440.00}. Again, we have no idea how he could activate a stolen card from a mail box. We set up another claim and expected us not being responsible for {$440.00}.
We have been customers of Wells Fargo for more than 30 years. How they handled the case was heartless, irresponsible and lack of empathy. We feel abandoned after the mistake they made. We will fight for the sake of 1,500 families of patients of XXXX, who are still waiting for the money.

The person goes by the name XXXX, and he claims that there was a " soft close '' on my account and I still owe {$300.00} plus interest ( {$700.00} ). They had my last 4 digits of my social security number and had contacted my parents about the Civil Suit. The number I have is XXXX and the case number he gave me is XXXX. Complaint: On XX/XX/2019, I mailed ( per instructions from WF ) two checks that represented IRA rollovers in two separate Priority Mail envelopes to the address provided by the Wells Fargo ira savings representatives. The delivery of both packages occurred on XX/XX/2019 at XXXX, and both envelopes were signed for by the same person. On XX/XX/2019, my IRA savings account was credited for one of the checks, {$22000.00}, but not the other check in the amount of {$120000.00}.
I phoned Wells Fargo on XX/XX/2019 to inquire about the missing deposit, and was told that they do not know where the check is, and that they would escalate the issue and that I should call back on Wednesday.
This is completely unacceptable as a transaction, first because both envelopes were received on MOnday and then a credit was not done until Thursday, and second, because the credit was only done for one of the checks. Both checks were payable to Wells Fargo fbo .. ( insert my name ).

Complaint: I have two WELLS FARGO store accounts and they are incorrectly reporting that I have disputed the accounts which I HAVE NOT. The credit bureaus are telling me that every time they remove the incorrect remark from my credit report that Wells Fargo reports it again each month when they report my payments. This is absurd and this needs to stop. Wells Fargo has been found guilty of creating fake accounts, they have been found guilty of costing people a mortgage and now they are making false, unverifiable statements on my credit reports each month. I am attaching a copy of the credit report remarks as proof as well as a scanned copy of the two account cards that are verification of the accounts in question. I simply want the remarks to be removed from my account permanently and for them to not put them back on my account when they report each month.
If they do not want to honor my request then I will have the State Attorney General to step in and investigate and I will have no choice but to sue them. This is disgraceful that they would do this to me each month and I want it to stop.
I am paying you guys each month, you have closed the accounts so why are you trying to harm me. I am trying to get a mortgage and can not do so as long as you are putting these negative remarks on my credit report.
