Complaint: Wells Fargo removed and withheld at least 11 months of what was originally intended and agreed to be prepaid monthly interest and principle taken by automatic payment from my bank account. The monies were applied toward advance monthly payments contrary to the intention to pay down the mortgage principle and interest.
The monies applied to advance payment were based on a bimonthly increase above the regular XXXX. This bi-weekly payment was an increase of XXXX each bi-weekly payment.
Due to the calendar variation, there were some months three bi-weekly payments were made in one month.
I discovered this on XXXX when I received a letter from WF advising that my automatic payments can only pay your account ahead by one payment. I was confused and telephoned that day and was on the phone for about three hours. In that time three times the telephone call dropped and I thought it was my telephone service. Three agents advised me that my account was prepaid 11 months but also all three assured me that the principle had been paid. Each time I insisted that it was not possible that my money could show in both ledgers. Each time I advised that I never authorized advance payment of my mortgage. Each time I was told to hold on. As I listened to music, each time, the phone call dropped, hence three agents before reaching a supervisor, XXXX and finally, XXXX from the executive office. XXXX informed me that advance payments of three months could be applied and that anything in excess of that is returned to Wells Fargo investors. Both identified 11 months advance payments. XXXX agreed to open a dispute. She advised that I would receive a call on XXXX and provided number XXXX as a reference dispute number.
I have not yet heard from their office.

Problem with fees
Complaint: On XX/XX/XXXX, I went to my local credit union to take out a personal loan to avoid interest on my Wells Fargo credit card. The interest was to begin on the XXXX of XXXX. We finalized the loan on the XXXX of XXXX and had the letter sent to Wells Fargo, which was to be there over night. The amount to Wells Fargo was {$3200.00}, to bring my account to a {$0.00} balance.
I spoke with an associate at Wells Fargo on XX/XX/XXXX, who said that my letter was sent to the wrong building at Wells Fargo, and that in forwarding the letter with the personal loan check would not be deposited in time. Thus I am stuck with the remaining {$1500.00} in interest because of a problem on their behalf.
I called back and spoke with a manager named XXXX, whom said a record didn't exist of me calling previously and the letter with my check was just late. Also he said they could take off {$300.00} of the interest, but since it was my fault I am stuck with the remainder.
Because of a mistake they made, I am now stuck with a personal loan of {$3200.00}, and interest to Wells Fargo of {$1500.00}. This is unacceptable and no one at Wells Fargo wants to assist me.

Problem accessing account
Complaint: This issue took place once I requested a Medallion Signature Guarantee regarding me updating my name on my XXXX account. The individual who had the authority to provide me with the Medallion Signature Guarantee started questioning me regarding the XXXX account, he was hostile and demanded to know how much money was in the XXXX account, what I was investing in and what did I need the Medallion Signature Guarantee for. I advised him it was for a name change form that was sent to me via XXXX.
After he refused to provide me with the Medallion Signature Guarantee even though I had my decree letter in hand which was what I was advised needed to be presented and with the court seal on it he still refused to provide me with Medallion Signature Guarantee. I then decided to closed my account with Wellsfargo due to the horrible customer service.
Even thought I closed the account I requested access to pull up both XX/XX/XXXX and XX/XX/XXXX account statements and was advised that they should be accessible, but they are not because my access had been limited.
Wellsfargo has been contacted numerous times regarding the access to the account so that I could have a copy of all my transactions performed during my time as a Wellsfargo account holder. The has emailed me several copies of the XX/XX/XXXX statement but not once have I received the XX/XX/XXXX statements and I have requested them three times now. Nor can I login and pull them down as a PDF file on my own.
I believe this act was caused due to me complaining on the man who could have provided me with the Medallion Signature Guarantee.

Complaint: I received correspondence from Wells Fargo in regards to a complaint that I filed and much of the information Wells Fargo mentioned was and is inaccurate. For Example : wells Fargo stated that my loan was not in Foreclosure when they received the loan. However, I have a letter from ASC stating that the loan was in foreclosure. Secondly, Wells Fargo has yet to address the claims mentioned by the XXXX XXXX XXXX which stated that my loan was intentionally denied a modification from XXXX XX/XX/XXXX because of intentional computer glitch which created and/or created inaccurate NPV calculations which denied me an modification. Wells Fargo attached hundreds of thousands of Dollars to the arrears once they did offer a modification in XX/XX/XXXX. Also, upon not completing modification I applied for a tier 2 modification and I was informed by ASC that I did not qualify in XXXX. However, that was inaccurate according to XXXX XXXX /HAMP because I provided evidence that I converted my home to a 2 family which increased the Hamp guidelines from {$720000.00} to {$920000.00}. I also provided rental income to substantiate a tier 2 modification. It is blatant discrimination according to the Justice Department, XXXX XXXX and XXXX XXXX XXXX. I was informed by Congresswoman XXXX and Congresswoman XXXX that if I foreclose and the property is sold my case will be discussed dealt with because of the 10 plus years of neglect and abuse. It's unheard of .... I am asking Wells Fargo to offer me a modification. In conclusion MERS does not have legal claim because Wells Fargo does not Possess the ACTUAL ORIGINAL NOTE OR SETTLEMENT DOCUMENTS BECAUSE XXXX DESTROYED ALL RECORDS. THEY FORWARDED ME THE LETTER STATING THAT THEY DO NOT HAVE ORIGINAL DOCUMENTS. I FOUND THE LETTER THIS WEEK AND WILL FORWARD THE LETTER TO THE JUSTICE DEPARTMENT AND LOCAL CONGRESSWOMAN. THE SETTLEMENT DOCUMENTS ARE DIFFERENT THAN THE ORIGINAL NOTE AND DOCUMENTS.

Complaint: We have been to court, on numerous occasions, for approximately two years, with legal counsel, in attempt to have the mortgage payments that are in arrears added to the end of the mortgage ; every attempt was denied. In order to re-instate our Loan, we were also in court to trying to negotiate if the money in arrears could be paid over a period of three ( 5 ) years but unfortunately, were denied. During said time, we consistently made payments to the Bankruptcy Trustee for eighteen ( 18 ) months and have proof to authenticate it. Although we had legal counsel and were still in court proceedings, we were unaware that the payments we made was for the back payment and was not our mortgage payments ; our legal counsel did not inform us of same. During the middle of XX/XX/XXXX, we started receiving telephone calls from investors and realtors informing us that our home was up for auction ; we were quite oblivious and very disturbed by this news. We immediately contacted our then legal counsel and she was also oblivious.
After making personal inquires at the court and numerous telephone calls to Wells Fargo Bank, we were informed that the payments we made to the Trustee was for the money in arrears and not the mortgage payment. At that time, we were also told that we should have also made mortgage payments separately. What is very dis-heartening, inhumane and unfair to the XXXX Family is, our attorney, at said time, did not guide us well by informing us and Wells Fargo Bank did not send us any payment notifications/requests for the monthly mortgage payments. We immediately tried to seek assistance from Wells Fargo because our attorney appeared nonchalant. Wells Fargo denied communication with us because we had a legal counsel. We were now in limbo so we had no choice but to release our attorney, who refused to return our numerous telephone calls as we seek her assistance, in order to be able to speak with Wells Fargo directly. Thank God, we are able to postpone the Auction in hope of an ability to negotiate further on our own to keep our home. Our personal plea has been with Wells Fargo since we released our attorney, but no success to date. We contacted several public officials including our Assemblywomen XXXX, who assisted immensely by contacting Wells Fargo on our behalf yet, no success for us. Every attempt we made, Wells Fargo insisted that they wanted all of the money owed which is approximately One-Hundred and Forty-Six Thousand Dollars ( {$140000.00} ).
We are currently on our second case holder Mr. XXXX XXXX. It is very difficult to get in touch with the case holders. We have called several times to get updates and was told he would contact me before the end of the business day, but that was in vain. Each time our case was reviewed, we were denied and informed approximately one week before the slated auction date. I called our new case holder several times and twice last week, but was again told he would contact me before the end of the business day ; again vain. Each time we were denied, we were told that Wells Fargo did not receive any payments from us for three ( 3 ) years which baffles me since we made monthly payments to the trustee from XXXX, XXXX to XXXX, XXXX totaling XXXX XXXX Dollars ( {$48000.00} ). I would like to know who received these payments and where were they allocated. We also informed the Bank that we have {$60000.00} in liquid cash to pay them immediately and will make double payments monthly until we are caught up with our arrears ; again, we were denied.
My family and I are now at the mercy of God and I am again appealing for help. I trust that you or someone will be able to assist us. It is contrary that the Banks say their intention is to keep the homeowners in their home but, yet my numerous appeals are ignored ; I would like the Bank to honor that. I am fighting for our familys abode as my husband and I used our life savings to invest into our humble abode. It is just unfortunate for us, but we are willing and able to remedy our shortcomings. When our Loan is re-instated, we are even prepared to arrange automatic monthly withdrawal payments if this will appease the Bank. Please feel free to contact me should you need any more information regarding my plea. Thank you in advance for your anticipated assistance.
