Complaint: OnXX/XX/XXXX, I had driven my car to the local gym midmorning for a quick workout prior to lunch. After grabbing a great workout, shower and fresh change of clothes, I walked down to the parking garage only to find my car had been repossessed. I was not given any warning that this was happening and spent the night on the street, XXXX, since my phone charger, laptop, keys, wallet and all my other belongings were in the car. I was over 1,000 miles away from home, my rental lease was over and I had nowhere to go with no method or payment of communication. Literally would not wish this experience on anyone ever!
I finally found a means to charge my phone at a local coffee shop and then spent the next two days locating my car. It took so long as the customer service department for the financing company is so terrible, that all one can do is sit, wait on hold for hours at a time ( no joke here ). After I figured out where the car had been towed, i realized it was over 50 minutes away north of where I was and no one at the towing company was willing to cooperate with me in order to get my belongings that the first time.
At this point in time, my only alternative was to sleep on my couch in my storage unit since I still did not have any method of payment with my wallet being in the car. The next day I was able to find some spare cash, just enough to get a ride north to the towing company. When I arrived, I had turned in my keys in exchange for my personal belongings.
Now, in doing so, I was under the impression of several different matters, which is the point of this dispute letter. One, I was told by the credit company that I would be notified in the mail as to ( a ) how to make payment to obtain the car back, ( b ) I would be given a receipt of the collection, repossession, towing, etc. and the total billed to my name, ( c ) I would then be sent a letter of my deadline to complete payment. Well, I never received any letters in the mail, never received them at any forwarded addresses and was never granted the option to send them to another address, even though I asked multiple times.
Next on the agenda is addressing more failed communication. I am writing this letter on XX/XX/XXXX, to date, I still have not received any letters from the creditor. I have not received a warning letter, I have not received a letter of receipt of repossession, I have not received a letter that was postmarked 5 days after the event, I have not received a letter postmarked 10 days after the event, I have not received any letters in reference to auto auctions, new vehicle ownership, or anything in reference to this car.
Currently, the creditor, VW Credit, is reporting to all the credit bureaus a debt in the exact amount of {$11000.00} with notes of being charged off as bad debt. I have not received any notice of these charges and to my understanding, they have completely failed to properly communicate within the necessary timeline.
According to the Fair Credit Reporting Act, Section 609 ( a ) ( 1 ) ( A ), any creditor is required by federal law to verify - through the physical verification of the original signed consumer contract - any and all accounts they post on a credit report. Otherwise, anyone paying for the reporting services could fax, mail or email in a fraudulent account.
I demand to see the repossession removed from all three credit bureaus, XXXX, XXXX, and XXXX since the original creditor failed to present Verifiable Proof ( an original Consumer Contract with my Signature on it ) and failed to properly communicate 100 % during this entire process since XX/XX/XXXX and the date of writing this letter.
They failed to positively verify these accounts which had dramatically hurt my ability to obtain credit, obtain an apartment, obtain a new car and negatively affected my life since this event occurred early this year. Under the FCRA, unverified accounts and creditors not in alliance with the FTC must be removed and if they are unable to provide me a copy of verifiable proof, must be removed immediately.

Problem with paying off the loan
Complaint: I want to terminate my lease earlier than when the lease is supposed to end and return the vehicle to Volkswagen.
They have told me that this is possible and that they can give me a payment plan for the amount I will owe instead having to pay the entire balance at 0 % interest ( one reason I want to do this payment plan ). I estimate I will owe them {$2400.00}.
However, they will not show me or write to me in writing how this payment plan will affect my credit report and how the lease is currently being reported.
I am concerned that doing this payment program could negatively affect my credit history but they say that this would not be the case.

Complaint: I leased a 2014 XXXX XXXX. During the leasing process I was told that absoluted all fees were paid upfront and then all I needed to do was pay the monthly fee and return the car in an acceptable condition. Upon completion of the lease, with the car in perfect condition, and with the car with far far fewer miles than contractually allowed, I was charged a {$380.00} disposition fee because I didn't choose re-lease another XXXX. This was never disclosed to me. It was buried in a giant contract which I was told was standard and unfortunately I signed without fully reviewing or referring to legal counsel for review. I was told it was standard and I had been told of all fees. XXXX threatened my credit. They had a collection agency come after me for this. I tried to speak with supervisors. They told me the CFPB has no jurisdiction over them and that they are not aware of any rules regarding properly explaining hidden fees to customers.
I would also add, I chose not get another XXXX because the dealership was over-billing me for service and attempting to commit insurance fraud. Claiming it would take some insane amount of labor and excessive parts expense simply because they could convince an insurance adjuster to approve it. This made me very uncomfortable. This coupled with the generally terrible service was enough to turn me off the dealerships closest to me and the brand in general.

Complaint: VW Credit is reporting a delinquent account when in fact the account was in dispute. Because VW was unable to successfully repair the brakes after more than 4 attempts, I was directed by their dealer to turn in the vehicle and terminate the lease early. Months later, VW Credit began billing me for early termination without warning. I provided them documentation in writing that I was disputing the charges in their entirety. In the period where these charges were being disputed, VW Credit is wrongfully reporting me as delinquent in payments. Now that the account has been settled, they will not cooperate and advise XXXX or other credit reporting agencies to amend the record.

Complaint: I contacted the company to extend the loan. The representative stated I had to pay a fee that was deducted from my account and my next payment was not due until XX/XX/XXXX. When I called on XX/XX/XXXX the recording said my payment was 32 days delinquent I spoke to a representative who stated I was suppose to complete a form within 15 days I advised we never received a form and I wasn't told I needed to fill one out. We have been on time with our payments and catching up to trade it in and they are ruining my score purposely so they dont have to trade it!! Complaint: On XX/XX/XXXX, I leatned that VW Credit assessed my acvount which was paid erroneous fees listed as other ( {$9.00} on XX/XX/XXXX and {$250.00} on XX/XX/XXXX ) listing them as Other Fees. ( VW Credit defines Other Fees as pay by phone fees, collection fees, title/registration fees, personal property tax fees, reschedule fees, NSF fees, or parking fees of which I had none of the aforementioned fees that could be charged as the claim was paid in full. ) On XX/XX/XXXX, I over paid {$440.00} to VW Credit as VW Credit stated they would repossess my car because the Chapter XXXX Trustee had not sent a payment. I contacted VW Credit ( XXXX ) XXXX ext XXXX and requested a refund because the court clerk stated that the balance owed to VW Credit was being paid by Chapter XXXX Trustee. VW Credit ( XXXX ) stated VW Credit would not refund the money and it will be applied to the VW Claim being paid by the bankruptcy court tefucung amount that the court needed to pay.
On XX/XX/XXXX, The Trustees Report of Receipts & Disbursements for the period of XXXX XX/XX/XXXX indicated that VW Credit claim amount was {$2600.00}, was paid {$38.00}, total paid {$38.00} and owed {$2500.00}. I contacted XXXX at VW Credit XXXX ext XXXX and inquired why the overpayment I made XX/XX/XXXX of {$440.00} had not been applied as a payment. He hung up.
On XXXX, I contacted VW Credit ( XXXX ext XXXX ) and requested a refund of my overpayment of {$460.00} paid on XX/XX/XXXX as it was not applied to the VW Claim as stated. VW Credit responded they would not refund the money stating it was applied to the VW Claim filed with the Bankruptcy Court.
On XX/XX/XXXX, The Trustees Report of Receipts & Disbursements for the period of XX/XX/XXXX through XX/XX/XXXX indicated that VW Credit claim initial claim amount was {$2600.00} and that the Chapter XXXX Trustee paud paid {$2100.00} during this time frame snd that a total paid XXXX was {$2100.00} leaving a balance owed of {$450.00}.
On XX/XX/XXXX, I sent a letter, a copy of the extension agreement from VW Credit dated XX/XX/XXXX, proof of all payments by myself and the Chapter XXXX Trustee paid XX/XX/XXXX - XX/XX/XXXX. I requested my vehicle title as well as refund of overpayment.
I paid {$440.00} on XX/XX/XXXX VW Credit stated they applied overpayment to the VW Claim being paid by Chapter XXXX Trustee.
The balance of VW claim : {$450.00} less payment of {$440.00} on XX/XX/XXXX less Chapter XXXX Trustee monthly payment XX/XX/XXXX of {$43.00} equals ( - {$36.00} ) which indicates the car is paid in full and a refund of {$36.00} needs to be forwarded to Trustee or returned to me.
On XX/XX/XXXX, l contacted VW Credit ( XXXX ) and requested update on status of refund and title release was informed told it was being processed.
On XX/XX/XXXX, VW Credit reported that {$120.00}. 20 was owed as VW Credit charged my account {$9.00} on XX/XX/XXXX and {$250.00} on XX/XX/XXXX listing them as Other Fees. Complaint: My name is XXXX XXXX. I have been a customer of XXXX XXXX from XXXX through XXXX. My account number is XXXX.
During this time period, for the XX/XX/XXXX payment, i was going to be out of the country and therefore, a payment was mailed in instead of the normal online payment.
However, upon my return in XX/XX/XXXX, I became aware that XXXX XXXX had in fact not received my mailed in payment for XX/XX/XXXX and therefore, they placed a negative reporting on my credit.
A second payment was also made at the time of my return to ensure that we would not be late until they figured out what had happened to the first payment.
At this point today, I am trying to buy a house and this incorrect negative reporting is affecting my approval for the loan to purchase the house.

Complaint: I was the primary signer on two business vehicles from XXXX XXXX XXXX ( VW ). They were both Turbo Diesels ( TDIs ) and due to a fraud in their emissions claims, the government forced VW to buy back the cars from consumers due to the major fraud and massive value drop of said vehicles. My company used two for servicing our customers and the main reason was that the TDI models received " Green Car of the Year '' awards and all of that went out the window once news of VW cheating emissions came about. We were caught off guard and offered a settlement which entailed signing documents accepting a certain dollar amount to return the cars. Once I signed the documents with a local notary we took the cars off of auto payment because it was assumed by my company and myself that the cars were going to be dealt with and VW Credit, who's parent company is VW XXXX XXXX, would be informed. Well, 2 months later the cars were still waiting in our lot for VW to pick up them up, we were not using the said cars as we were told it would possibly make them ineligible for returning at the dollar amount we signed for and accepted. Soon after I found out that I had been reported for being 60 days late on each vehicle and then were forced to pay the past due balances to avoid further late fees. Then, 3 months after legally signing the cars back to VW, we had to return the cars to a VW local dealer and then a settlement check was issued to VW Credit from another department owned by XXXX XXXX XXXX, their TDI Settlement Team. So it seemed that we overpaid on the vehicles we both longer could use but it turned out that VW Credit ended up sending the overpaid balance in separate checks to me at a later date. This whole process was bizarre and not ever brought up as a possibility when we bought the cars originally. The TDI Settlement Team did not indicate that we would need to keep making payments, nor can they produce the proof or signed documents that show that and insist that I should have kept the documents. The TDI Settlement Team can not provide the original documents I signed and can not even send out communications whatsoever due to the legal aspect of the major lawsuit regarding the fraud. VW Credit tells me that have nothing to do with XXXX XXXX XXXX other than being owned by them and using their name however, they repeatedly have transferred my calls to XXXX XXXX XXXX to help me. VW Credit says that all I need to do to fix this is have VW Customer Care or the TDI Settlement Team to send a letter saying I was not informed that I needed to make payments on a car I couldn't use which I already agreed to a dollar amount to return. The problem with this is that, as I stated, the TDI Team is barred from sending outbound communications, such as letters or emails, and the three departments, VW Credit, Customer Care, And TDI Team, all owned by XXXX XXXX XXXX, can not share or see each other 's notes. When they try to call each other on my behalf, which happened at least 3 times, the hold time was so significant that they just tell me they can't hold any longer and that I am just out of luck. The Customer Care department learned that the TDI Team can't talk about the TDI settlement issues so they took the same stance and refused to speak with me further about anything TDI related. I am uploading their " stance letter '' to show how uncooperative they are. I can sum this up by saying I was sold two cars that became unusable and then was mislead by 3 departments within XXXX of XXXX and now, due to their legal issues, am barred from getting any support. I have been swept under the rug and my credit suffers because of this and I don't think it falls under the " fair '' credit reporting act because it's such an unforseen issue with VW Credit and XXXX XXXX XXXX claiming they only share a name and the documents I signed were with the TDI Settlement Team and not with either of them but the TDI Team and them are all owned by XXXX XXXX XXXX. There is no way to reach XXXX of XXXX ... Only VW Customer Care who, as the uploaded letter proves, could help me but won't for legal reasons. VW Credit holds their stance that my payments were late and refused to look at the big picture. The cars were paid via auto payment every month on time, as everything else on my report, until we were told otherwise by what seemed to be the same company ... And technically it was the same company regardless of how they are managed because they are indeed all three owned by XXXX XXXX XXXX.
