Complaint: VW Credit is incorrectly reporting date of activity on my credit report for Husband, XXXX , and NOT MINE. My date of filing was XXXX / XXXX / 2015 - Date of discharge XXXX / XXXX / 2015 . VW Credit in violation of Chapter XXXX discharge reporting late after filing date. They are also in violation of FCRA and FDPCA since this has been reported several times and VW credit continues to refuse to correct the error they say they are correct and in their validation still show the wrong dates. XXXX At this point they are clearly indicating the error - see # XXXX .

On XXXX/XXXX/XXXX they sent me a XXXX balance letter an indicated that it would take 30-90 days for the credit reporting to take affect. <P/>The first of XXXX XXXX I contacted the Volkswagen Credit of America Toll Free number and was informed that they would forward to a special credit reporting group and send me a letter when completed. <P/>As of XXXX XXXX, XXXX the balance is still being shown as open by credit reporting bureaus. Since my loan was paid in full on XXXX XXXX, XXXX I wish to show the open balance of my account with VW Credit as XXXX.

Complaint: From XX/XX/XXXX to XX/XX/XXXX all of the transaction history of the lease billing and payments appears to be correct. The problem started on the XX/XX/XXXX billing statement ( with a due date of XX/XX/XXXX ). For an unknown reason, the XX/XX/XXXX billing statement displays a past due amount of {$1.00}. I called VW Credit on XX/XX/XXXX and spoke with XXXX . XXXX was not able to determine the reason for the past due amount. Even without an explanation or justification from VW Credit, I paid the amount listed because I did n't want to risk being delinquent. Even after paying the regular amount due and the {$1.00} past due, the same amount of {$1.00} past due appeared on the XX/XX/XXXX statement ( with a due date of XX/XX/XXXX ). I contacted VW Credit again by phone and this time spoke to XXXX . XXXX 's explanation was that VW Credit was having an issue with a data feed to a third-party statement producer and that the past due amount was incorrect, did not need to be paid, and could be ignored. I requested that the statement billing be corrected. The XX/XX/XXXX statement ( with a XX/XX/XXXX due date ) continues to display a past due amount. I contacted VW Credit now a third time, this time I spoke with XXXX on XX/XX/XXXX . XXXX did n't have an explanation but said she would request a transaction analysis from a support department within VW Credit and get back to me. XXXX has provided no follow up. I contact VW Credit for a fourth time today, XX/XX/XXXX and spoke with XXXX . XXXX and I were on the phone for nearly 90 minutes. We reviewed the billing and transaction history month by month, transaction by transaction since the lease inception in XX/XX/XXXX . All of our figures were in sync up to XX/XX/XXXX . Like the other VW Credit representatives, XXXX was not able to identify or explain why the past due amount was displayed for the billing statements in XX/XX/XXXX , or XX/XX/XXXX . I demanded that XXXX escalate the call to a Manager. XXXX said there were no managers available. I informed XXXX I would be filing a complaint with the CFPB. I also asked XXXX to provide a contact phone number for the Executive Offices of VW Credit and/or Volkswagen of America . XXXX said he did not have an external phone number he could share.

Complaint: Leased vehicle on XX/XX/XXXX. Made 19 monthly payments ( inclusive of the initial payment due at lease signing ), through XX/XX/XXXX. <P/>On XX/XX/XXXX vehicle was struck and rendered a total loss. <P/>On XX/XX/XXXX was contacted by the insurance company of the party at fault and was offered {$14000.00} which they said would satisfy the lien holder, VW Credit. I rejected their offer explaining that the vehicle was worth several thousand dollars more. Money which I had put down in order to lower the balance and resulting monthly payments. <P/>On XX/XX/XXXX I contacted VW Credit to advise of the situation at which point they advised me that they had ( on that date ) just issued a loan payoff letter guaranteeing title to the insurance company in return for the {$14000.00} offered ( and earlier rejected by me ). I asked how I would recoup my investment at which point they very abruptly answered " we 're satisfied, you 'll need to take up your concerns with the insurance company. '' On XX/XX/XXXX I contacted the insurance company and again disputed the amount of the settlement. I was advised to provide comparables supporting my claim of the vehicle 's value. I gathered and provided the comparable vehicles, as instructed, on that same date. <P/>On XX/XX/XXXX the insurance company finally conceded that their initial offer was erroneous and modified their offer to {$17000.00} plus taxes ( {$1200.00} ) and fees ( {$18.00} ), totaling {$18000.00}. <P/>I accepted on the premise that the amount offered {$18000.00} less the payoff of {$14000.00} would return to me {$4200.00} which was approximately the amount I paid into the lease at the start. <P/>I was then advised by the insurance company that the payoff amount had increased to {$15000.00} reducing the balance payable to me to {$2700.00}, a difference of {$1500.00}. I asked them to explain the increase in the payoff amount, which they could not. We contacted VW Credit together and was told plainly that if the insurance company had agreed to pay more then they wanted to collect more and therefore refused to honor their original payoff ( again, which was offered in writing ) of {$14000.00}. <P/>The insurance company ( indifferent to who they pay ) has since satisfied VW Credit in the amount of {$15000.00} and issued to me a check in the amount of {$2700.00}, effectively removing themselves from the dispute. <P/>VW Credit openly acknowledges that their demand of {$15000.00} represents the full balance of the loan ( {$13000.00} residual, plus 17 remaining payments of {$140.00} ) with no discount for unearned interest.

Complaint: I traded in my lease for a XXXX XXXX at XXXX XXXX in XXXX XXXX . I only had 2 months left on the loan. XXXX XXXX was to pay off the vehicle and sent the info to VW credit. In XXXX / XXXX / XXXX I declared Chapter XXXX Bankruptcy. The vehicle was included because the paperwork to close out the lease had been lost, therefore, my attorney told us to include the car which was a lease. I have been disputing this since the discharge of my bankruptcy in XXXX and VW Credit continues to report erroneously the status of the account on all XXXX Credit Bureaus. They have passed the 45 day time frame & at this point I want the item removed since they refuse to correct. They are showing the last day of status as XXXX which in violation of Chapter XXXX which should not show any negative items on the credit report past the date of filing XXXX . Furthermore the vehicle was paid every month and traded in on time. VW Credit is intentionally attempting to damage my creditworthiness.

I now can not get my credit lines put back to where they are so it puts my utilization through the roof. <P/> Please help me. I do n't have money to go and hire a credit lawyer or anything like that. <P/> I have statements from VW showing that my account is in good standing and that it is paid off but they will not update my report. <P/> How can the damage that was done be fixed. Complaint: I have a diesel VW that is part of the VW Buyback settlement. I have an appointment at VW on XXXX XXXX to turn in the vehicle and receive the buyback for early lease termination. VW of America- XXXX My monthly lease payment is due on XXXX XXXX ( 3 days before I 'm turning in the car ), and I called VW credit to ask for a grace period, explaining that I have the appointment ( and can not get one sooner ), but they will not waive the payment. VW XXXX XXXX I do not think it 's fair to have to pay for a month if I only have the car for 3 days during that payment period. The VW XXXX XXXX XXXX XXXX says that I " MAY '' get a refund from VW Credit, but nobody can guarantee anything.

There was a negative remark reported on that account, because of been ag e 4 more plus years. I did not impacted my credit badly is is normally at first when having reported in credit file one 30 days late. I then research my records as I suspected I was not late in any of the payments on this loan. So they reported that on XXXX XXXX I was 30 days late. I like to say prior this car loan I have h ad 3 more loan wit h Volkswagen Credit and my current loan is with Volkswagen I have never been late in any of this loans putting it all together I have been a loya l costumer, but this time something was not right so I initiated a dispute with XXXX about the one time 30 late . Note : that the account has been closed since XXXX . And to some degree if was still have adown effect on my score. So having an error on their part it would have been not a problem to get it remove, but it has not been the case. They responded to credit reporting borrow as verified. Here were problem got complicate, so call then directly and ask that I would like to dispute th is 30days late report so they over the phone yes that was the case, I told them and ask if they any document to support that? I was told dont have to show me anything because the account has been closed and it did not matter. I say that there must be an error, they responded is impossible they say the error was not mine because I did not paid in time . Well things were getting ugly hangin up the phone talking in a abusive manner. I could believe or not get the person understand that if they dont have any record of it how was it reported back on XXXX XXXX or XXXX XXXX Note : I am not sure when it was reported but base on credit file account was last update when it closed which make cense. What was more disturbing is that they new I think that I was a long time costumer that never had any problem you thin k that may hav e help not at all. I would hate to think if you just new costumer what will be like. Net thing I did I call again and ask for all the records for the account I was specific what I needed they responded not be able to receive any of documents because simple they dont have it. They next thing I did was putting my request on writing with need a respond back from them. On the letter send to them I was very specific what I was disputing, why should be delete So the question was : Was there a late 30 day pass due payment received by you from me? yes or no if no to please delete the record, if it was indeed late to prove it to me as I told then that my bank statement prove otherwise they say they could not use my record I was not longer able to make any demands Wow! I also have say that any other issues arise from this dispute was not what I was disputing they only thing was this negative information Note : the account was closed and paid so that say practically there should not be any update on the account unless like in this case I discover a negative item that I was not aware place on credit file. I am going to summarized what took place the following day of me sending document. I got an alert from muy credit file saying that something change on my credit file. So what came in mind was oh good that must be the file that I have requested to be delete. To my surprise that was not the case, so what happen and what they did was far much worse before disputing b y two factor one they delete and then use XXXX XXXX as the new date or corrected they should have input then, but here is the deal I was not ever late on any month period have proof that they dont want to see or deal with XXXX and they would not give me any proof neither. So here is where it stand they would remove anything on the account that what they are reporting is accurate. I give up! Now as you have read this complain they are in violation in several aspect as I have received few documents from then that shown nothing more than a bunch of numbers on an exel file with not any document to back it up. So on reviewing that discover many more issues. Here few when requested for payoff amount what was ask what I send there was a big descripancy they should have return about {$990.00} dollars back to me. When I ask what is going on they have an answer for whatever it was so for them to say that there is not error. Complaint: There are times when I paid late. And of course a {$20.00} late fee is charged. The problem is that when I make the car payment and the additional {$20.00} late fee they dont use the extra {$20.00} I send to cover the late charge. Instead they apply the extra {$20.00} to the next bill reducing the next payment and carrying over the {$20.00} late fee. For example my car payment is {$350.00} when I send {$370.00} they pay the car payment and reduce the next payment to {$330.00}. And then carry over the {$20.00} late fee. The problem is that they start reporting the account as 30 days late to the credit bureau. And they done this multiple times resulting in additional 30 day delinquent marks on my credit. Complaint: I got married in the XXXX o f 2016 and am in the process of updating my legal name. I am currently trying to update my name, loan, title, and registration information with or throu gh Volkswagen Credit and after 2 me ssages with their online portal and 4 phone calls with 3 different representatives ( 4+ hours o f phone time ) I have been unable to get clear information on how to update my legal name on my title ( updated title information is required to get my registration updated in my state ). The first representative told me to wait until my car was paid off ( 2.5 years ) to up date my legal name and failed to give me name change paper work for my online portal and instead instructed me to send in my marriage certificate with out any accompanying paper work to update all my account information. I asked this first representative if this was the official process as it did n't seem sufficient to update my portal information and title/registration and I was assured it was fine. After I found my name was not updated correctly in the portal I called again, and my second representative, informed me there was official VW paper work for the process of name change for the online portal and title/registration. I was told I needed to fill out this new paper work, get it notarized, and then fax the paper work back in. When I asked if faxing the documents was sufficient considering a notary was required, I was assured this was would be fine. Two days later I received a call back from this second representative telling me I could n't fax the paper work it must be mailed. At which point I insisted someone must check the paper work I submitted via fax to make sure it was complete before I went through the trouble of sending in notarized documents. I was told she would call me back. She later emailed me blank forms that gave me no indication if my paper work was completed correctly. At which point I called back and spoke with a third representative. I spen t one mo re hour on the phone with the third representative where she was able to explain details of the paper work the second representative could not. Unfortunately, following many questions I had with the third representative I was still unable to clarify exactly what my next steps would be to finish the name change process for my title and/or registration.

Complaint: Volkswagon bought back my XXXX due to the emission scandal on XX/XX/2017 and I was told that they would be paying off my loan to the VW Finance Division within 5 days and that I would be receiving a check for {$1200.00} within 3 days from the buyback appointment. As of today, XX/XX/2017 the check has still not been issued to VW Finance and I gave them the physical address when I called them last week to find out the status and I also asked for a letter stating that I am no longer in possession of the vehicle and needed something stating that the loan has been taken over by VW or i have a XXXX balance so that I can purchase another vehicle and refinance my house. They have told me that they could n't do this and that I need to continue making payments on a vehicle that they have had for almost 3 weeks. The class action lawsuit states that they should have paid off the loan within 5 days of the buyback appointment. According to the representative I am speaking with right now as I file this complaint, there still has not been a checked issued to VW Finance and again I did provide them the physical address for VW Finance. I 've called the claims number over 20 times for other issues pertaining to the VW Scandal and they have been unable to solve the issue. I am currently speaking to XXXX a supervisor in the XXXX claims center. She stated that she did n't have an employee number that i could have and just refer to her as a supervisor in XXXX claims center. So far 35 minutes in my phone call nothing has been accomplished regarding the issues but I learned how to be more patient when been tossed around on hold.

Complaint: VW Credit of America CAN NOT resolve their system upgrade issues they had few months ago and they consistently say that I am {$0.00} past due even that I over pay by about a dollar or 2 every month. I have made every effort and talked to supervisors to resolve but I am not getting anywhere. If you look at the attached statements, you will see that i overpay what is being asked from me and yet consistently I get {$010.00} tacked on as PAST DUE. This is not right and they need to fix it. So, I need your help to have them look into my account. Thank you

Complaint: VW Dealership took my Trade In ( XX/XX/XXXX XXXX which was paid off ) and rolled my equity over as NEGATIVE equity into my new Car Lease for a XX/XX/XXXX VW Jetta. I have been paying $ XXXX/month on a Car Lease that ends XX/XX/XXXX. I have made attempts to buy out the Car/Lease and Trade In but have not been able to because the entire Loan and Residual Value via VW Credit are skewed. Now within the last 90 days of the Lease I am being harassed and the car has been wrongfully repossessed. TIMELINE XX/XX/XXXX 1st trip to XXXX in XXXX ( ALL the following pts. below are documented ) Put down {$4000.00} ; told Sales Rep that my budget was no more than {$350.00} in monthly payments Discussed XXXX, only Why not XXXX? Why not a purchase w/ a $ XXXX down payment XX/XX/XXXX 2nd trip to XXXX in XXXX Signed a lease agreement 4 years ; $ XXXX down payment at signing $ XXXX monthly pmts with VW Credit XXXX was the Salesperson as documented XX/XX/XXXX : 3rd trip to XXXX in XXXX XXXX (? ) Leased not approved by VW Credit Lease sold to XXXX ( *Across the Street from Dealership ) Additional {$1500.00} of down payment ( Current total cash paid {$5500.00} ) Put into an OPEN-END COMMERCIAL LEASE In the name of XXXX XXXX ( XXXX years old recently XXXX from college in XX/XX/XXXX ) Paid for 61 Months - 13 months beyond term Could not reach Bank nor Dealership to determine what to do at the end of lease ( called every month for nearly a year ) NEVER TOLD BY XXXX THAT A 3RD PARTY LEASE WOULD NEGATE MY ABILITY TO TURN IN MY LEASED CAR FOR ANOTHER VW FOR THE STANDARD {$350.00} TURN-IN FEE XXXX actually hand wrote on new contract that my " term '' was still 48 months ( see. Exhibit TOTAL PAYMENTS = {$25000.00} + {$6000.00} = {$31000.00} XX/XX/XXXX ( XXXX ) Went to XXXX VW in XXXX, VA ; Goal to turn in leased XXXX for another VW and monthly lower payments ( XXXX VW ). Spent 10 hours at Dealership. Specifically told Salesperson that monthly payments were too high, did not need a XXXX because it was too big for a single young female, and expressed that my budget was $ XXXX/month or less. Not considered a " Lease Exchange '' due to outside banks involvement Told by Dealer that trade-in allowance would be {$12000.00} ; in reality trade-in allowance given was only {$4000.00} Dealer ( XXXX ) stated remaining lease owed of {$8100.00} even though paid XXXX additional payments @ {$420.00} ( {$5400.00} ) Instead of {$12000.00} trade in allowance, actually had {$4100.00} applied to the lease ( as negative equity ) increasing amount of lease and payments as well as residual value Dealer did not pass on ANY incentives VW customer loyalty ( see Exhibit Dealer did not provide advice on how to handle remaining " lease '' due to overpayment to bank-wanted to make a sale =Could have kept XX/XX/XXXX XXXX and had lower payments and/or dealt with it the appropriate way with VW/Dealer/Industry Leader help/advice ATTEMPTS TO BUY OUT CURRENT LEASE ON XX/XX/XXXX VW XXXX
