Problem with a credit reporting company's investigation into an existing problem

Vehicle loan or lease: Loan

Their investigation did not fix an error on your report
Complaint: I recently got a copy of my Credit Report and noticed that in XX/XX/2018 Toyota marked me as being late. Toyota also somehow took me off of autopay without even notifying me. They also didn't notify me prior to inserting this information that gives no regard for accuracy. I am requesting that Toyota not contact me by telephone and communicate by USPS mail only. I am also represented. I have attached to this complaint a copy of the inaccurate Credit Reporting.

Problem with the interest rate
Complaint: In XX/XX/XXXX, I contacted Toyota Motor Credit Corporation Settlement regarding Toyota Motor Credit Corporations dealer compensation policies resulting in XXXX, XXXX, and XXXX XXXX buyers paying higher interest rates than non-XXXX XXXX buyers, without regard to creditworthiness. Toyota Motor Credit Corporation, while neither admitting nor denying the claims, voluntarily agreed to pay up to {$21.00} XXXX to repay eligible buyers. I explained I completed all the required documentation and submitted it well before the XX/XX/XXXX deadline. I verified with the employee that I am in fact entitled to a portion of the settlement and was told a check was mailed to my home address on XX/XX/XXXX in the amount of {$320.00}. I explained the check was not received and was told they will put in a request for the check to be reissued and it will be at least 7-10 business days before I will receive the check in the mail. My address was verified and again I was told the check will be reissued. I waited 12 business days before calling back to check the status at which time I was told the account was simply documented but no action was taken. This time the rep advised they were going to have the check reissued asap and again to look for it within 10 business days. These conversations took place between XX/XX/XXXX - XX/XX/XXXX. On XX/XX/XXXX I received an email from Toyota Motor Credit Corporation Settlement advising the following : From : info_tmccsettlement <XXXX> Sent : Wednesday, XX/XX/XXXX XXXX XXXX To : XXXX ' Subject : Toyota Motor Credit Fair Lending " Thank you for your phone call.We sincerely apologize for the delay in your check reissue, and have contacted the processing team to confirm that your reissue request is in progress, and we are working to send you a new check as soon as possible. We anticipate that your new check will be mailed within 10 business days. Regards, XXXX XXXX. Toyota Motor Credit Corporation Settlement Administrator '' Today, XX/XX/XXXX I sent a follow-up email to XXXX XXXX. at Toyota Motor Credit Corporation Settlement just to verify whether or not my check was processed and mailed : My Email : From : XXXX Received : XX/XX/XXXX XXXX XXXX To : XXXX Subject : Re : Toyota Motor Credit Fair Lending Good morning XXXX, I'm writing in follow-up to the email below. Can you please confirm whether or not my check has been mailed to my attention to-date? I look forward to your response. Cordially, XXXX XXXX XXXX Email response received from Toyota Motor Credit Corporation Settlement : XXXX Fri XX/XX/XXXX XXXX XXXX Dear XXXX XXXX XXXX, Thank you for your email. Yes, we will begin the process to reissue your payment to the address we have on file. Please allow 10 business days for your new check to be mailed. If your address needs to be updated, please contact XXXX XXXX to request your reissue and address update. Alternatively, you may send a letter, signed by you, requesting an address update and reissue. Please include both your former and current mailing address with your request, and send it to : Toyota Motor Credit Corporation Settlement Settlement Administrator XXXX XXXX XXXX XXXX, OR XXXX Name Change If your name has changed, please provide documentation showing this to be the case, which can include documents such as a marriage certificate or court papers indicative of a name change. Deceased Class Member In order to reissue the check in your name, you must submit documentation establishing proof of authority. Please complete and return a Third Party Authorization Form, along with the required documentation indicated on the form. You should also include a letter requesting a reissued payment, and the original check you received, if possible. You can find the form on the settlement website www.TMCCSettlement.com, or one can be mailed to you on request. Incapacitated Class Member If the claimant can not act on his or her own behalf, acceptable documentation is a Power of Attorney, or guardianship or custodial paperwork. You will also need to complete and return a Third Party Authorization Form. You can find the form on the settlement website, www.TMCCSettlement.com, or one can be mailed to you upon request. Regards, XXXX XXXX. Toyota Motor Credit Corporation Settlement Administrator After receiving the response from XXXX XXXX and feeling once again that I'm getting the run around, I responded to his email, see below : Good afternoon XXXX XXXX, Your email is very vague just like all other responses I have received from your department. I have been in contact via telephone and email with this department since XX/XX/XXXX and continuously receive the run around. As you can see in the email below, I was told back on XX/XX/XXXX that my check was going to be processed and mailed out. Now you are telling me I need to wait another 10-days for the check to even begin being processed. This is unacceptable and appears to be unfair labor practices. I have been given the same lame excuse for the past 30+ days and as requested on several occasion provided no proof of re-issue or even the initial issuance of my check. I followed all required guidelines and submitted my settlement paperwork well before the deadline date and to no avail have tried to get information regarding the processing of the settlement amount and check I am entitled to. Instead, you and your fellow co-workers, the employees of this department have continuously given me the run around. I have asked for the contact information to file a written complaint regarding this matter and have been told several lies as well as not being provided with accurate information. At this point I have no choice but to contact CFBP and DOJ as well as the Principal Deputy Assistant Attorney General XXXX XXXX, Head of the Civil Rights Division to try and get some resolve to this issue. Unfortunately, your department is not professional enough to be honest and provide the customer service the buyers are entitled to. ~XXXX XXXX XXXX I thought It was time for me to do my own research to see who I can file a written complaint to. I read CFBP was involved in the initial settlement proceedings and thought I'd start by filing a formal complaint with this department. I will also send a written complaint to DOJ as well as the Principal Deputy Assistant Attorney General XXXX XXXX, Head of the Civil Rights Division to try and get some resolve to this issue. Any assistance you can provide will be greatly appreciated. Thank you, XXXX XXXX XXXX

Complaint: I agreed to have my credit checked by the XXXX XXXX XXXX dealership on XX/XX/2019, however, I was not informed that they would give me at least 6 different hard inquiries on my credit score. This has brought my score down and prevented me from being approved for a credit card, solely for the reason of having too many hard inquiries. Getting a loan or lease

Vehicle loan or lease: Loan

High-pressure sales tactics
Complaint: I would like to report XXXX XXXX in XXXX XXXX for what I think seems to be an unfair treatment towards me and my mother. On XX/XX/2019, around XXXX, I visited XXXX XXXX in XXXX XXXX asking permission to gain CCC ( Care, Custody, and Control ) of my mom 's car as I will be driving it and paying for the auto insurance. I asked them per the suggestion of XXXX to ask the lender first. Since I intend to drive it to XXXX, Florida, where Ill do my PhD studies, I asked whether it is also possible to register the car under my name with the DMV. My sole intent was to help my mother as shes old without much income. She had also had some issues with the same dealership in the past which I will narrate later. However, during the whole process, I feel like they did not even bother understanding the situation. They jumped right into recommending that I trade the car and sign for a new one. They even told me that the price is going to be the same for a better car given my credit score. Trying to be polite, I considered listening to what they have to say. They borrowed my car keys for appraisal. That was the last time I got a hold of my car keys the sales representative seemed to have prevented me of going to the car by myself even if I asked for the keys three times. He always escorted me. After they looked at my car, the salesperson did not even bother explaining what the numbers are during the appraisal. To add, it even seemed like the whole time I was there the conversations I had with the sales representative was rather quick and lacked explanation. As I thought they close around XXXX, I thought this was the reason why the sales representative was running around most of the time. He never fully sat down and explain things thoroughly. I will explain more of this in a bit, but what I want to emphasize is that the salesperson made it seem like that the only option I have in order to accomplish my goal of relieving my mother with her financial burden was to purchase a new car. This was the impression I got since he was being too pushy with the sales. I tried calling some friends for advice, but he tried to interrupt me when I tried to make some phone calls saying that the car is yours with the deal thats on the table. Later, Ive found out from my mother that another sales representative of the same dealership told her that this is possible. Since both my mother and I were under pressure, this did not occur to her at the moment. I have a voicemail from the other sales representative to prove this ( In the voicemail spoken in XXXX, the other sales representative also used expletive language directed towards my mother ). As I have said, the sales representative did not bother listening to what I have to say nor provide an in-depth explanation of the whole process. He kept running off and showing different numbers each time he came back to talk to us. I believe this just added to the confusion. On multiple occasions, for example, I asked whats the value of the new car, and what he kept giving us is the total price of the payments. This limited my ability to gauge whether the value of the car and what I am paying per month is reasonable. Multiple times, the guy ran off and said hes going to run, either talking to his supervisor, running my credit score, or what have you. I have not received the results of my credit report. I even asked him where they were, but this had been kept from me. He just gave me the total scores. Like I said earlier, I thought that they were closing and so I ran with it. The sales representative also offered a lot of discounts and lowering the APR. But upon seeing the final contract ( after the fact ), the discounts are not annotated. The guy kept asserting that I know one of the managers even if I repeatedly said I don't. However, this has been continuously ignored. I told him that I worked hard for my credit score, thus, it will be unreasonable to give me a high APR rate. Yet with all discounts and with a close to 800s credit score, they've given me a 5.9 % APR. The sales representative said he will bump this down to 3.9 % but this is not shown in the contract, as I will still have paid " less than what I'll pay for in total ''. The next thing I know, the " new '' car is getting a carwash and I'm signing papers that will add thousands more to the value originally offered by the sales representative. It was around XXXX and everyone seems to be in a hurry. I, myself, also want to be out of there. Another person, at this time of the day, started selling us additional packages. And since it was late in the day, along with fatigue and confusion, some bad decisions were made. The total payment I'd have to do for 6 years is close to {$45000.00} for a {$24000.00} car and {$250.00} more of what my mom was paying for her monthly payments with her original car. I also asked how much the actual value of the car, repeatedly. Yet the finance person stated, " I won't be able to tell you how much! ". However, under close analysis of the numbers in the contract, it was in the printed contract all along. I'm also unsure how they determined I'm qualified for such payments as I've repeatedly said I am unemployed and is a graduate student. I also said that my income is only coming from my stipend. I also said I am moving to XXXX soon. One of the said managers there said, dont tell the bank that as they are thinking you have stability here. Yet, this is unclear because I only placed 1month for my history of residency. I even emphasized that I am not paying for the current place Im residing since I am coming back from living in XXXX. This has been the story the whole time and I repeatedly told them I am going to XXXX, yet they seemed to have ignored all these details in order to sell me the car. My mom also suffered the same fate beforehand. The other sales representative, from what I have heard, seems to have falsified my moms salary. Making XXXX/hr who just recently purchased a house should not be eligible for a new car. But since she struggled to make ends meet, she tried to fix the deal and get something for cheaper. Whereas they first gave her a XXXX XXXX, they exchanged it for a XXXX XXXX. She was convinced by XXXX XXXX that that move would help her resolve her financial difficulties. However, what turned out as a decrease in the monthly payment, in exchange, prolonged her payment from five years to six years. XXXX XXXX is also supposed to refund my mom with {$1000.00} promised within 2-3 weeks from last XXXX. However, its almost XXXX and we have not received the said refund. I tried to do what I thought a good son will do for her mother who just migrated to this country. Unfortunately, I fell prey myself. What I intend to do was get a CCC, and because of their sales tactic, I ended up almost 45 thousand dollars in debt. I am unsure how I will pay for this. Thus, I think that my mom and I were taken advantage of this dealership. Thinking Id get a cheaper deal since I have a higher credit score ended up terribly and in a much worse position. I honestly do not know how dealerships operate. And I think those like me wouldnt know too. I am a veteran who spent years out of the country. A high credit score, unemployed, and learned politeness while serving in the XXXX, made a perfect target for these types of what I think unethical sales practices by million-dollar businesses. I hope that youd be able to help me. I do not want to be another statistic. I do not want to potentially be another homeless veteran. I have tried to talk to them 10hrs after the sales were done, and I have only driven 6 miles, yet they would not even want to hear me out. Instead, they have been passing me around to different departments or people. Hence, the purpose of this letter.

Problem with additional products or services purchased with the loan
Complaint: On XX/XX/XXXX I leased a XXXX XXXX XXXX at XXXX XXXX located at XXXX XXXX XXXX, XXXX, CA XXXX. Upon closing the deal, F & I Manager XXXX XXXX sold me XXXX XXXX XXXX XXXX XXXX Agreement # XXXX XXXX for {$430.00} and another one called Appearance and/or Windshield Protection for {$350.00} both for 4 years. On my 3rd year of leasing, I noticed I never got a policy to read at all. So I called XXXX and inquired to where I can call about the service agreement about a dent repair because someone or something scratched my car. I even went there beforehand to inquire how I can get it repaired using my Service agreement. That was the only time I was told that it has to be a size of a credit card and therefore, it does not qualify for repair. This was not explained to me when I was sold the product. I called the company called XXXX and asked for the policy to be cancelled since I feel that I got decoyed into buying it believing that if my car get scratched, I'm insured. XXXX told me it's not refundable and emailed me the policy which I don't understand why now I can't find it among my email inbox. On the 1st week of XXXX I emailed XXXX XXXX, Manager of XXXX XXXX discussing my situation that I am on BK XXXX and that will the dealership allow me to extend or lease another vehicle. XXXX XXXX responded and met with him XX/XX/XXXX. I filled out an application and submitted my W2s only to find out they turned me down because of BK XXXX So I gave up. Went to XXXX XXXX XXXX to get another car because my XXXX lease is expiring in XX/XX/XXXX. They agreed to help me even with BK XXXX and possibly pay the last 2 months of my lease. Unfortunately, they are asking for payment history. I called XXXX XXXX Account # XXXX at XXXX to get my payment history but they refused to email me the payment history but only to my lawyer. I do not understand this. I ended up losing the deal with XXXX XXXX XXXX. Up to now, XXXX XXXX does not want to give my my payment history and I don't understand that since it is my own record. From the very start, they decoyed me about selling useless service agreements and which I'm not allowed to cancel. Now, the XXXX fXXXX is giving me a hard time getting my own record so I can apply at another dealership for a replacement car. I had been faithful paying XXXX XXXX in the past. I filed for BK XXXX because I had been in and out of the hospital and was forced to retire due to my illness. Now I am stuck and after I turn over the XXXX car, I have no car to go back and fort to the specialists since I could not even get my own record from XXXX XXXX.

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Problem with personal statement of dispute
Complaint: I used to live in XXXX. I leased Lexus car my payments used to {$490.00}, never missed a single payment. I then moved to XXXX, sale tax has increased by XXXX dollars. I did not receive any note or letter or notification asking me asking to pay XXXX dollars more a month. I continue to make payments for {$490.00} via automatic debit, Lexus continued to debit $ XXXX month.I XX/XX/2017 I was shocked that I was reported for late payment even though I always paid the XXXX via automatic debit, Lexus stated that I had to pay {$500.00} ie XXXX dollars more.It would have been easy for me to pay the XXXX had I known about it. Have never in my life missed a payment. I believe that this is unfair practice since any logical person can realize if I am paying {$490.00} i could have easy been able to pay the who {$500.00} had I known that this my about due .I never intended to delay in payment just dd not know. When I new form my credit report I immediately pain the deference, I beige is unfair to label my credit report with late payment where I clearly paid the money ( {$490.00} ) every month via automatic debit, for very brief time the amount was XXXX dollars short just because I did now. I contact Toyota /Lexus they wot even talk to me and refused to work with me on that. I disputed this but was unable to change this.

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: To Whom it May Concern ; I filed a Chapter XXXX in XX/XX/XXXX. I had purchased a 2010 XXXX XXXX, through Toyota Financial Services. I kept the XXXX, and the bankruptcy court paid the truck off in full. I have all the documents from my attorney supporting this. When they paid the last payment, the title was sent to my attorney, and when the bankruptcy was discharged, I received my title. The problem is Toyota Financial Service filed this with XXXX, and will not get it corrected. We sent them a certified letter on XX/XX/XXXX, explaining we felt that this was a violation with the FCRA. They responded on XX/XX/XXXX, with their records are correct, and they are reporting to the agency in a manner that is consistent with their records. I'm going to attach all the documents to this letter, so you will see what we are up against. There has even numerous disputes filed, due to we hired XXXX XXXX to help us with this. We are now trying to also handle this, by doing what we can to get this corrected, along with XXXX XXXX. Everything has been cleared from our credit report, except something that was paid in full, our truck through Toyota Financial Services. Kind regards,

Problem while selling or giving up the vehicle

They even called financial to know how much is the balance .I believed them because its not the first time i did trade in and never had problem in the other car company. But after few months, I received a call from toyota financial that they sold car to auction and they want me to pay the balance. I tried to contact them many times to find out what happen but everytime i try to know whats going on they immediately transfer me to collection agency. I asked personally the dealer if they pay the balance They said yes and they cant help me too to solve my problem. And this financial already reported to credit which affected my chance of loan for my kids in college They have no conscience While checking mails i found a bill from toyota that dealer paid the balance and i only have to pay 1month of balance Please try to analyze what this financial did to me They sold the car without letting me know whats going on Want me to pay balance of auction and they send me one last month bills of balance on XX/XX/XXXX after they sold the car They are too unfair for an honest innocent customer like me They are too quick to report to credit which really affected my credit report If you will check all my debt I never pay late for my bills but they still report late and report as bad debt collection I tried to contact financial that im willing to pay the last month bill but they never listen to me that i was not aware what happened They still want me to pay the auction balance Its a nightmare for me and my family and my friend to get car from toyota again

They talked to me about the difference buying and leasing a car. I told him I had never leased a car and wanted to know how it worked. The guy said it was better because the monthly payment would be significantly lower and I could return the car whenever I wanted and I would just be off the hook with the car. ( He even did he motion where you wipe off your hands when you are done with something, indicating there would be nothing left to do. ) I went in to that same dealership in XX/XX/XXXX to see if I could trade the car in or how it would work. I was told the remaining balance of the lease would be added to whatever car I wanted to get and the value for the trade-in would only be {$13000.00}. I told them that was not how it was explained to me when I first leased the car and I thought my original trade-in, which I was given about {$5000.00} towards the new Toyota would still count towards another car once I decided to get a new one. I told them I didnt want to do anything yet and I would just wait until the lease was over. About 2 months ago I received a call saying my lease was almost up and they wanted to go over next steps. I asked how much it would be to buy the car if I wanted to keep it, they told me it was the agreed amount at the time I leased the car which is a little over {$16000.00}. I told them I was told in XXXX the car was valued at about {$13000.00} so why would they still sell the car to me for {$3000.00} more? She said that was the agreed amount and there was nothing she could do. I let her know I wasnt happy with my experience and I did not want to keep the car. She told me if I didnt buy the car or another car with Toyota I would pay a {$350.00} re-stocking fee. I became upset and told her that was never disclosed to me and it was unethical. She said it was part of my agreement and it would be in my paperwork so I had to pay it. I told her I would rather pay the {$350.00} than do business with them again. A few weeks ago I received another call from a guy that works at the dealership. He said he wanted to go over the terms of the lease since it was almost over. I let him know a lady from Toyota Financial had contacted me and went over it with me. I expressed my dissatisfaction with him about how my whole experience had been. I said I do not want to continue business with them and the {$350.00} fee wasnt disclosed to me when I signed the paperwork. He said he couldnt do anything and basically disregarded how upset I was. I looked through a few regulations and even though the fee is in the paperwork it was never disclosed to me verbally, which it should be. They are violating UDAAP and Truth in Lending by not disclosing the fees and misleading me into signing a lease for their car. I just had another employee reach out to me about the terms of the lease. I explained to him I have talked to a few people recently and expressed my dissatisfaction to him as well. I told him I wanted to return the car and if I just needed to return the keys. He said they had to evaluate the vehicle, he told me about the restocking fee, and other fees that would be charged depending on the condition of the vehicle. I let him know about the conversations Ive had with other people and how I am not happy with Toyota. Even after expressing my dissatisfaction different times to different people they did not do anything or even apologize. Instead they all had attitude with me, said it was in my paperwork and there was nothing they could do. More than anything it feels as if they are pressuring me to keep the vehicle by them telling me over and over about all these fees I will be charged if I don't keep it or get another car.

Complaint: I called Toyota Motor Credit in XX/XX/XXXX explaining that I had my information on auto pay and as result that I did not want to lose out on payment date and receive late days. I wanted them to be aware to work with me, as I had gone through some financial issues outside of my control and was trying to build back up so I may continue using service freely and as mentioned I am back on track with my payments. Except for late payments reported for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. I expected this to occur as my information was purged and everything was set up on auto pay this is the account number XXXX
