High-pressure sales tactics
Complaint: First of all I am very glad to have your office which investigates the violations caused by big companies such as Toyota motor corporation which deceives millions of customers by selling defected cars as the results millions have been affected by the fraudulent tactic of dealers at care sales.
I have purchased XXXX XXXX XXXX in one of the XXXX dealership XXXX XXXX Minnesota in XX/XX/2018. six days after I purchased the vehicle, I have found out that the van I bought has a big mechanical problems. it does not accelerate as it should, noisy engine, consume gas more than it should. I reached out to the dealers and addressed the safety issues the car had. they advised me to bring the car for inspection. They checked and told me that the car did not have any problems and you should drive it. I then picked up my car and immediately after two days the same problems happened with the vehicle, it does not accelerate in a busy highway which is very concerning. the drives from the back can hit me or able to involve in the accident due to the fact that the car does not accelerate faster even if given gas. I have addressed the issue for the second time and request the dealers to change this car for me with out trading options because it is only less than a week ( 6 days ) after purchase for {$27000.00}. they said we can not exchange the car with out trade and you have to trade. I informed them that I could may not get approved from the bank and please help me to exchange this vehicle as it was not operating well and is dangerous to drive on the road. I then called Toyota financial services who loans the car and talked about the dealership experience. They also told me to contact dealership for resolutions as I purchased car from them. I contacted again if they able to help me with car exchange not putting trade on the table because this is strange to have a car which has only XXXX miles and inspected by dealer and I should return this vehicle back. XXXX XXXX XXXX used car manger who could able to solve the issue said to me that we can not help you with exchange even though the car is defected and said to me that you are responsible for the car payment. I gave up and left the dealership and have been divining the defected vehicle which is a safety threat to me and my family as of today. Toyota financial services and car dears has denied my request ignored me when they realize that the care is not safely operable in the high way and they still insist that the car is safe which I do know is not safe to drive. I have therefore, paid {$27000.00} and not been happy with my car and have been very frustrated and concerned so much about safety of me and my family.

Problem with additional products or services purchased with the loan
Complaint: On XX/XX/18 my wife XXXX and I entered into a lease agreement with Toyota Financial Services for a new XXXX XXXX for 3 years. At closing, I was asked if we wanted GAP insurance and given a price of approximately {$30.00} per month. I knew the price was high and asked if it was cancellable at any time. Finance Manager XXXX XXXX said that was indeed cancellable at any time. So I agreed to purchase this GAP coverage.
On XX/XX/18 my wife called the dealership inquiring into cancelling the policy. She was given an XXXX number, called it, and was given a fax number and instructions to hand write ( and sign ) a note asking the policy to be cancelled. Attached is a copy of that letter and fax delivery confirmation.
Now, Toyota Financial is saying that not only have they not received the request ( this is a minor concern, as I have reiterated the request through a secure message on their website ), but that upon receiving the cancellation notice, we will continue to pay the roughly {$30.00} per month for the GAP coverage for the duration of the lease. This amount will come off of the principal balance of the car at the end of the lease agreement.
1 ) I lose the time-value and interest on this money, which is of course outright robbery, that these finance managers at Toyota pretend not to even understand this concept.
2 ) When I asked if the GAP was cancellable, and was told yes, at any time any reasonable person would not assume that this monthly bill would continue on until the end of the lease. At a minimum this is highly deceptive and reckless ; what is very likely is that it's a scheme to steal from people through dishonest practices. At the very least, this arrangement should have been disclosed ( i.e. " yes, its cancellable, but you are locked into this exact payment, and we return the excess payments through reduced principal at the end of lease '', for example ), and if it had been disclosed and I was fully informed of the arrangement, I definitely would not have agreed to purchase the coverage. This lie, this deceit, changed my purchase decision entirely.

Fraudulent loan
Complaint: On Monday, XX/XX/2018 I went into XXXX XXXX in XXXX XXXX to purchase a XXXX XXXX. Before going to the dealer I had already gotten approved for a car loan with XXXX XXXX XXXX for 60 months at 2.64 % for $ XXXX. After finalizing the price on the car and trade-in with XXXX XXXX and XXXX XXXX I was provided a credit application from the dealership through Toyota. I declined as I informed them from the beginning that I had already obtained financing through XXXX. They came back a few minutes later with the application claiming that I had to fill-it out as they legally needed to collect that information, but assured me my credit wouldn't be run ( I was still financing through XXXX ). This morning ( XXXX XXXX ) I received an alert from a credit monitoring service that two hard inquiries had been processed with XXXX XXXX and XXXX XXXX XXXX through XXXX. I called XXXX XXXX spoke to XXXX who put me in touch with XXXX ( one of the finance guys ), I told XXXX how I upset I was, he told me XXXX had entered the inquiries, I told him to have XXXX XXXX call me. In the meantime I emailed the GM, XXXX XXXX outlining what took place and I've received no response as of yet. XXXX XXXX then called me back shortly thereafter and told me he was doing me a favor trying to get me a better rate. I informed him that he wasn't doing me a favor and that he had no right to run my credit. He told me that it didn't hurt my credit, which is factually inaccurate based upon my conversation with XXXX at XXXX this morning. XXXX at the end claimed ignorance claiming he just got here and did his job. XXXX XXXX and every person I dealt with their used fraudulent inducement to get me to fill-out that application knowing all along that they were going to run my credit and try to gain the financing business. My credit has been damaged due to this fraud and they need to make restitution.

Complaint: I have a loan with TOYOTA MOTOR CREDIT CO XXXX Balance {$14000.00}. I have always made my payments on time. For some reason I realized that there was a late payment on my credit report. As you can see, I have always had a stellar payment record with this company. I tried contacting both XXXX and TOYOTA MOTOR CREDIT CO with no successful resolution. XXXX only reporting me late. There was definitely an error on their part. I was never 30 days late.

Attempted to collect wrong amount
Complaint: I have been fighting with Toyota since XXXX to report my payments accurately. They have been misapplying my payments since XX/XX/XXXX. Applying full payments and/or partial payments to the principle balance without my consent or approval and therefore reporting me negatively on my credit report. They have gone so far to try and repo my car when I was 15 days past due in XX/XX/XXXX. Luckily the truck driver agreed to NOT take my car that night and would come back tomorrow after I explained it was NOT correct and Toyota had NO right to try and take my car. The next day Toyota confirmed they were in the wrong, waived all late fees and explained the account would be updated to show the loan was current and all would be right.
They proceeded to do collection calls to my cosigner and XXXX year old grandmother telling her the loan was 3 payments past due and scaring her into making a huge payment to bring the loan " current '' even with a DO NOT CALL on file. They continue to call and harass her every chance they get. every time I call they confirm that yes there is still a DNC on file yet they keep violating that!
On XX/XX/XXXX I called and spoke with XXXX employee number 2NDC who reviewed the file and agreed that YES they were in the wrong, and I ONLY was due for the XX/XX/XXXX payment and that THEY were applying payments to the XXXX payment and I would have a CREDIT of {$13.00} for XXXX. That being said they continue to show me being due for some days 2 payments, some days 3 payments. They called my grandmother again on the XXXX and told her the loan was due for {$2400.00}!!! Thats 4 car payments. The damage this has caused my family is irreparable. The damage to my credit score worse. This prevents me from licensing for my job as a XXXX XXXX XXXX. I have been denied state licensing due to their continuous errors.
I do not have another 2 years to fight with them to get this resolved. I need help 1. They are not applying my payments properly since the start of the loan 2. They refuse to honor the DO NOT CALL on file and continue to call myself and the co-signer demanding payments 3. They refused to send a copy of the payment history that I have been requesting since XXXX until XX/XX/XXXX XX/XX/2018
