Complaint: My husband and I have a loan with Toyota Financial Services. My husband filed bankruptcy, the loan on the vehicle was included in his chapter XXXX. I did not file and per consultation with his attorney, I am protected as well as my credit invoked under the provisions of 11 USC 1301 ( Co-Debtor Stay protection ). The issue is, Toyota has reported two missed payments and the remarks show late in the notes on all three credit reporting agencies. Per his attorney, he called into the bankruptcy department at Toyota and was not able to resolve the matter. The resolution is still pending. This situation has dropped my score over 100 points and now caused my XXXX account to lower my credit limit further hurting my score. Since this matter is not getting the attention needed, I need the CFPB to step in. I'm also in deep conversations with a prosecutor who specializes in these type of co-debtor situations to pursue further legal action.

Complaint: Creditor Toyota Financial Services - Collection Department Spoke to " XXXX '' employee ID # XXXX - XX/XX/XXXX XXXX XXXX Spoke to XXXX employee ID # XXXX XX/XX/XXXX XXXX XXXX A Payment extension was requested on our Auto loan with Toyota Financial due to a major unexpected water damage and mold remediation issue in our home that caused us to be displaced from our home for almost 2 weeks. My wife contacted Toyota financial on XX/XX/XXXX advised of the hardship situation and that is was no resolved and making the payment going forward would not be a problem my wife was told her account did not qualify for a payment extension at that time. Toyota Financial stated they could not give her the details as to why the extension was denied but she would receive a letter stating why. On XX/XX/XXXX we received the adverse action letter from Toyota Financial stating her extension was denied due to information obtained in her credit report. This concerned my wife so we called the finance department/collections/account resolution department where we spoke to XXXX ID # XXXX where we were told that the extension requests did not require her credit report to be pulled and the decision was not influenced by the information obtained in her credit report. The Resolution specialist XXXX ID # XXXX then found the letter we had been talking about and said that he was going to escalate the matter to his fraud department and we should call back in a few days to see what the resolution is regarding the letter. I advised XXXX ID # XXXX that we had already requested a supervisor call us back when the extension was denied on the initial call back on XX/XX/XXXX and we still have not received that call and we want answers regarding this now. XXXX stated that they do not pull credit ever that the base their decisions off the original credit pull from the time the contract was originated. When we tried to read him the letter verbatim showing that a credit pull was indeed done he continued to talk over my wife and I becoming very hostile. He said he saw the letter but refused to acknowledge the part of the correspondence that clearly states the credit report was obtained on XX/XX/XXXX. XXXX then told us that he wanted the conversation to be kept professional with no interruptions as my wife was explaining the past situations where we asked for callbacks and they never happen, we asked for payment history requests it never happened and she was stating a situation that took place in XXXX, XXXX ID # XXXX repeatedly cut her off and started speaking over her in which at that point he termed the call when told him he wasn't going to talk to my wife that way. We called back and spoke to XXXX '' ID # XXXX and advised her the situation regarding the ADVERSE ACTION LETTER regarding the extension request, XXXX ID # XXXX told us that they dont pull credit as a deciding factor for an extension, XXXX ID # XXXX said she can request 1 or 2 month extension and can see if it would be approved, we gave her the reason the account was delinquent and that the matter was a financial hardship that was now resolved. We even offered to accompany the extension with a payment, we were told that both 1 and 2 month extensions were denied and said we would receive a letter as to why. Again I asked if the credit report information or score was a factor in the denial I was told no it wasnt by XXXX ID # XXXX. I went over the letter dated XX/XX/XXXX and that the extension was denied because of the information obtained in my wifes XXXX CBR dated XX/XX/XXXX. I asked why was her credit pulled a month prior to the delinquency and for what purpose when she did not authorize any new credit pulls, did not call or speak with Toyota in XXXX nor was she informed on XX/XX/XXXX that credit was a factor in the decision. XXXX ID # XXXX then changed her story to now credit is a factor in the extension decision process and if my wife CBR wasn't worthy of an extension thats why it was denied. I asked XXXX ID # XXXX to go over what factors then are used if the reason for delinquency was medical? Would she pull my medical records to prove if the issue had been resolved in order to approve or deny the extension. XXXX ID # XXXX said of course not. I asked her when and under what circumstances will Toyota approve an extensions. We tried to do this last week, we tried to do it XX/XX/XXXX, and XX/XX/XXXX and every time it was denied. In XX/XX/XXXX my wife lost her job and called proactively to get an extension before she received any late fees or accrued additional interest for being past due and she was told that the account had to be over 30 days past due in order to request an extension. Toyota confirmed to my wife that she should call back when she was 30 days past due. In XX/XX/XXXX the account was past due 2 payments because Toyota had misapplied her double payments to principle only instead of the billed principle and interest that was past due. We had a supervisor look over the account and he identified where the payments had been misapplied and said he would call back in 3 days or less to confirm the payments had been adjusted correctly. Instead of a phone call we had a repossession agent try to take the car siting that Toyota put the car out for repo for it being past due for 4 or more payments. Clearly the repo was unsuccessful as we still have the vehicle but we have yet to receive the payment history as requested in XXXX and in XX/XX/XXXX, we never did hear back from a single supervisor as requested. We ultimately had to borrow the funds to avoid a risk of repo while trying to get Toyota to explain themselves about the payment. Each time my wife would make the payments the representatives would confirm that she was not past due just simply paying ahead. It was not until the attempted repo did we find out that they misapplied her payments causing the loan to become past due. We recorded the last 2 conversations on XX/XX/XXXX which lasted over 40 minutes.

Vehicle was a XXXX XXXX XXXX o My lease had approximately 5 months remaining and I was already at or over my mileage limit for the full lease agreement. o During the course of the negotiation, XXXX XXXX representatives promised to pay-off the remainder of the lease payments, pay any early lease termination fees and pay XXXX XXXX XXXX fees for mileage overages. o I agreed to purchase the XXXX XXXX in good faith that this would occur and turned over the leased XXXX to XXXX o XXXX XXXX pilled on a large volume of paperwork which I later discovered had hidden fees which they built into the loan which put the burden of the remaining lease payments into my load. This is not what I had agree to and there was no explanation of the charges. Since I was rushed into signing the deal late into the night, I didnt notice it o I was only provided with one key to my now purchased XXXX XXXX XX/XX/XXXX o I returned to XXXX XXXX to turn in my spare XXXX key and handed it to the sales representative on duty. I explained the that the key needed to be handed to the manager and my salesperson, so it could be turned in with the XXXX A few months later, Ive begun receiving collections call from XXXX XXXX XXXX XXXX, Toyota Financial Services and many other collections agencies for approximately $ 1.1K. They state that I owe money for 3 things : o Missing hubcap for one tire o Missing XXXX key o Mileage overages on the lease Im willing to discuss the cost of the hubcap although I havent seen proof that it was damaged or missing ( despite my requests for documentation ), however, the key was turned into Mossy and the mileage should be paid by XXXX. Ive decline to pay any of those charges Since then Ive been harassed by Toyota Financial and multiple collection agencies. Multiple phones in a day, calls to my personal cell phone, calls to my place of employment, calls to my wife None of these calls have been authorized and I consider them a violation of my FDCPA rights. Additionally, Ive received multiple letters which use threatening language towards me if I dont take action to resolve the account. I consider these letters also a violation of my FDCPA rights. They did not contain proper validation disclosures, substantiation of debt or physical evidence to support the debt claims The two debt collectors at fault are : XXXX XXXX XXXX XXXX and Toyota Financial Services

Complaint: Step 1 : Toyota Financial Services added a delinquent payment into my credit report without EVER contacting me about this late payment. Their claim is that my number was on a " Do not call '' list ( which I definitely didn't request to be on ). I am a co-signer for my mothers account. I was unaware that she had missed a payment. Toyota has my number on record and failed to call me in order to charge this payment, because of their excuse I was on the do not call list. So Instead, they submitted this late payment into my credit report, which has subsequently greatly damaged my credit. Step 2 : I have since signed up for auto-pay with my bank information so that a late payment will never happen again ( and my mother is now paying me monthly ). I also wrote a letter to Toyota explaining the mishap and kindly asked to remove my late payment from my credit report. ( Especially since Toyota 's negligence has greatly impacted by ability to currently obtain a mortgage ). Step 3 : Toyota responded with a letter stating " we have researched our records and have determined that the information reflected in our records is correct and are reporting your account to the credit reporting agencies '' Step 4 : Toyota Financial Services never offered me a chance to make this payment. They never called, emailed, or wrote me a letter about this payment, yet they still reported me to the credit agency. I would like Toyota Financial Services to fix what was wrongly done. Complaint: I paid my account every month on time and had autopay set up. I have always paid and continued to pay even after my car was totaled and everytime I was asked to pay i paid. When it got totaled they told me to wait until the insurance and gap company paid so I know the amount that I needed to pay. Because it took so long because I was driving for XXXX and was online and the insurance company I had denied the claim and I disputed it again and then XXXX 's insurance ended up covering it. But there was a deductible of {$5000.00} which I asked do I need to pay it all? They said no just wait until the gap insurance pays. So I waited and then i get a call from a collector saying it was charged off when the entire time I told them I had the money to pay and they kept telling me to wait. Now I have a charge off on my credit when I have never had a mark on my credit ever. Please assist me in getting this fixed/resolved.

In the process of this loan there appear to be more then 36 mos of payments and the amount for down payment and first month payment is not included. Also the down is not reflecting the amount and trade value is not included. I also want to address the warranty is being denied by XXXX and my car have mechanical problems and is under warranty and they refused to service my car based on the agreement I signed with this lease. XXXX, ( XXXX XXXX XXXX ), accepted full responsibility for the accident and negotiated a settlement with Toyota Financial Services - which Toyota accepted. I had nothing ot do with the negotiation. Toyota financial devised me that the settlement - $ XXXX didnt cover The amount due XXXX the lease and th at I still owed {$5200.00}. I submitted the claim to Toyota Motor Credit for GAP Coverage. IN XXXX XXXX, Toyota Motor Credit advised me that I had to submit a report justifying Toyota, s acceptance of {$30000.00} in settlement f the claim, This Request, though patently ridiculous, was nonetheless passed on to XXXX XXXX XXXX an d it then repeatedly sent to Toyota all the documents it had regarding the settlement. Toyota repeatedly said that. The reports were insufficient, but failed t address th e insufficiency, After a while, Toyota elected to stop trying t collect from its own subsidiary Nd then reported that I was a delinquent debtor under the lease and that it had referred the matter ot collections. When I protested this, it then reported that it had charged off the debt and thereby damaged my credit. Its. Actions were vindictive, wrong and ignored my GAP Coverage fr hwic I had overpaid at the time I firs leased the vehicle. Thy have persisted in this stance sinceXXXX and ave refused t o properly secure payment from their own subsidiary.

Complaint: In XXXX, we returned our lease vehicle to XXXX XXXX XXXX XXXX ( RI ) that was leased through Toyota Motor Credit Corporation ( TMCC ). A few months after turning in the vehicle and being told that because we were leasing another Toyota vehicle we would not be charged any wear/tear fees, we received an invoice for {$720.00} for wear/tear/tax and other miscellaneous receivables. We fought this invoice but ended up paying the {$720.00} through XXXX XXXX XXXX and that check was cashed on XX/XX/XXXX. A few weeks ago I was contacted by XXXX XXXX XXXX stating that I owed an outstanding balance of {$260.00}. I advised them that I had cleared up my balance with Toyota and requested a copy of the bill they claim I owe. I received a " Validation of Debt '' from XXXX XXXX with a letter from them stating the balance they claim I owe and a copy of the {$720.00} invoice ( that was already paid ). I spoke to representatives at both XXXX XXXX and TMCC and neither company could verify this amount in their systems, TMCC representative XXXX on XX/XX/XXXX stated he was unable to see this remaining balance in the system and the only amount he could see was the {$720.00} that was paid. I advised both companies that I would pay the invoice if they are able to provide me with an actual invoice outlining what the charges are for. I have requested XXXX XXXX to cease and desist contact with me and my relatives and will be sending a letter to TMCC demanding a letter stating that my account is paid in full and no future collection agencies will contact me, and to update my credit bureaus, if in fact this was reported to the credit bureaus.
