Keepsreneging on an earlier settlement with the CFPB, and states my account was in cghharge off/collections, espite the fact that the account was paid and closed.toyota hadrefusedtomprocess my report to the gap coverage that I had earlier paid for ; it thereafter agreed tht I was entitled to gapcoverage and agreed to alter its prior credit report that the account had been charged off and in collection status.
As of this writing, the report on XXXX says the account has been charged off and in collection status. These actions are vindictive, wrongful and have impairedny credit.

Complaint: Toyota Financial charged {$780.00} for bodily damage and lost key when we returned our XXXX XXXX at the end of a 2-year lease. We received a detailed invoice one time only. We lost that bill, received missed calls from Toyota but I was able to eventually asked Toyota Financial to send me another invoice. I disputed the lost key item ( this was mailed back to the XXXX dealership within 1 week after returning the car ). We never received any updated invoices. Instead, we received a notice from XXXX XXXX XXXX XXXX. We are being threatened with credit reporting while the original problem with the bill ( the {$370.00} lost key charge ) has not been resolved. In order to avoid a negative effect on my personal credit, I paid the {$780.00} in full even though it should be {$410.00}.

Complaint: I leased a XXXX XXXX XXXX from XXXX of XXXX in XX/XX/XXXX. I purchased a Mechanical Protection Plan that provided {$5000.00} worth of insurance for damages to the car. I had called XXXX of XXXX and was told that this should be used at the end of the lease. My lease maturity date was XX/XX/XXXX. In XX/XX/XXXX, I realized that the expiration date to the insurance I had paid for over the past 3 years was expiring XXXX due to a mistake by XXXX of XXXX. Looking back through my paperwork, there were two items I signed for the insurance, one with the wrong expiration date, one with the right. They had messed up the initial form, but never sent the correct one to XXXX. Upon calling XXXX of XXXX in XX/XX/XXXX, they said that I should be okay as I had 60 days after the expiration date to make a claim and I would receive my final bill shortly after turning in the car. However, I had to call Toyota Financial Services multiple times starting in late XX/XX/XXXX and through late XX/XX/XXXX due to not receiving a bill. I finally received a bill today ( there is proof through the XXXX daily email my wife receives indicating what is delivered to our house daily that this was the first thing received from Toyota Financial in the month of XX/XX/XXXX or XX/XX/XXXX ). The due date was XX/XX/XXXX ( yesterday ) and upon calling they claimed that the bill was sent on XX/XX/XXXX and they won't extend my due date. However, I had called countless times in XX/XX/XXXX due to not receiving the initial bill they claimed was mailed to me and they confirmed this was in their notes. The letter I received was dated XX/XX/XXXX and they still refused to update the due date even though I had asked repeatedly for their help with not receiving a bill.

Since then, XXXX XXXX XXXX has delayed the lease of the lien, blocking the completion of my car sale over one month. I have contacted them several times, and they have made unrealistic and false excuses. The most recent excuse for this delay was that their request to release the lien was reject by the Virginia DMV, where the title is currently kept. Complaint: In XX/XX/XXXX our leased XXXX XXXX XXXX was damaged during the flood and we submitted a claim to insurance company that the car is irreparable. The insurance company honored the claim and paid the remaining value of the car to XXXX XXXX XXXX P.O. Box XXXX XXXX XXXX, IA XXXX ( " XXXX '' ) under account number XXXX : XXXX on XX/XX/XXXX. Both my husband and myself are listed as lessees on the account. XXXX sent us a letter dated XX/XX/XXXX indicating that we owe a GAP insurance deductible of {$150.00}, which is " due within XXXX days from the date of this notice '' and if not paid, " your account will be charged off and reported as such to the credit reporting agencies ''. I was overseas for work at the time, I did receive a call from them on or about XX/XX/XXXX, where they were trying to confirm if we received a letter and indicating that {$150.00} was due and payable. I asked them to send by email, which they did. I forwarded the request to my husband, who was in US and asked him to settle. My husband sent a check dated XX/XX/XXXX for the amount of {$150.00}, which cleared our checking account on XX/XX/XXXX. In meanwhile, XXXX reported the amount as charged-off. My credit history has only 1 account reported being late for payment, which is XXXX XXXX in XXXX with indication 30-59 Days Past due. Everything else is in good standing, no late payments, no defaults, no derogatory remarks. After this charge-off amount got posted to the credit report, our credit scores have dropped significantly.
On XX/XX/XXXX I have written to XXXX indicating that they placed an undue burden on us where this {$150.00} is creating undue limitations to our financial freedom and demanded that this record be expunged from our Credit Report. They responded that they did everything properly. Please note, nowhere in the contract that I had signed there is a clause that I would have agreed that XXXX IS awarded such right. I consider this frivolous behavior. Where does 20 days have come from, why is it 20, not 10 or not 30? is it 20 calendar or business days? I have opened several claims with XXXX, trying to explain and fix the issue. They made a comment on the report that the account was paid, but remained the CO remark and " XXXX XXXX Off ''. This doesn't help though. We have recently applied for a mortgage and were denied with comments " there is a serious delinquency on your credit report '' ; " delinquent account appears to be recent ''. At this time I am looking for assistance on legal remedies that are available to me. I am intending to bring a suit to court as this burden is so undue and has caused us substantial moral suffering. I am also looking for an instrument, where I, as an individual, can be awarded an equal right to place financial burden on XXXX at my discretion of 10, 20 or 30 days.

Complaint: Your company refuses to take accountability for the errors in your online system as well as your customer service reps and for that reason my credit has suffered tremendously. I got into a wreck and totaled my car on XX/XX/2018. My insurance paid off the account in XX/XX/XXXX, there was a minuscule balance showing on the account for {$5.00} for the next 2 months and I called to verify this was correct and get the account resolved. I was told a different amount ( {$64.00} ) not showing on the online account and they mentioned taking it from my account, I agreed to have it taken out, upon logging in to your online system I noticed the same balance of {$5.00} and 2 weeks later after not seeing it being taken out, I called and they told me there was a late payment of {$64.00}. I never would have known about this balance if it wasn't for my due diligence. I never received an email notification, letter, phone call, NOTHING about the remaining balance. My only reference was the online account, which clearly showed a balance of {$5.00}. I wrote a letter disputing this as I was never, ever late on a payment, even paying early at times on the account for the past 3 years. This error has caused a huge sore on my credit report, I am in the middle of buying my first home and this affects me and hurts me tremendously. I wont be able to purchase my home if this erroneous late payment is not removed. I called your customer service line and was told there was nothing they could do, and an " automated letter '' was sent by your credit dispute department ( which has no direct phone line or supervisor to speak directly to ). I am angry, hurt and extremely disappointed in your company for your lack of research and accountability. I was a loyal customer for 3 years and your mistake will cost me my home that me and my XXXX boys worked so hard for.

Complaint: I have filed several disputes with XXXX, XXXX, XXXX and CFPB regarding Toyota Financial Services inability or refusal to report my payments accurately. Each time I file a dispute/complaint they remove on time payments from my report and they now say no data. This has greatly impacted my credit history and score. At this point, it feel retaliatory. Across the three major reports XX/XX/XXXX, XX/XX/XXXX and XX/XX/2018 on time payments are not being reported with variances. Some reports have three payments missing and some have 2. They sent a long letter a list of payments of my last complaint and that still is not fully resolved. The same situation exists. Across the three reports, they have different two months reporting late between XX/XX/XXXX and XX/XX/XXXX or XX/XX/XXXX and XX/XX/2018. As I stated, I feel that this is retaliatory. Ive have contacted them directly and filed numerous disputes over several months. It is exhausting and time consuming. More importantly, it is adversely impacting my other credit. Account limits have been decreased or I can not move toward a goal due to score not being reflected properly for missing payment information.

Complaint: I am writing to complain once again about Toyota Motor Credit. Below you will find my original complaint and their response. I feel that their response is still unjust and I will continue to file complaints until they take proper action. The fact that they can damage my credit report negatively for 7 years over one written attempt which I did NOT receive is absurd. As the co-signer on a lease with Toyota Motor Credit how can it even remotely be a fair practice to collect a debt through one letter and ZERO phone calls if that letter was not acknowledged. Now i'm left with a damaged credit report thanks to their lack of due diligence. I am right in the process of home buying and this is basically killed that. I want Toyota to take responsibility for their lack of attempt at collecting this debt and REMOVE this unfair charge-off report from my credit report. They claim they are are required by law to report accurate information and I would hardly describe their attempts as and this " Charge Off '' as accurate. You have the power to remove this do so! Otherwise, i will continue to complain, and even seek legal representation if need be for such unjust business practices and reporting. Hardly the intent of the FDCPA to say the very least.
