Complaint: TCF Bank Charged me several overdraft fees on my account. The problem is that multiple transactions had been fraudulent. I attempted to call and file fraud alerts on my account on several occasions. Each occasion TCF refused to work with me or co-operate. I filed a XXXX case against TCF. In this case I requested that TCF provide proof that i authorized, signed for, initiated and or requested the transactions that caused the account overdraft. XXXX {$9.00} XX/XX/2018. XXXX {$9.00} XX/XX/2018. TCF refused to provide proof. They provided no supporting documentation, validation, or verification that said transactions were done by me and not fraud. I again requested proof as i had on multiple occasions advised TCF these transactions were fraud and TCF refused to act and expected me to be responsible for paying the fees directly resulting from the fraud accounts. TCF again refused to provide any proof other than a flimsy written statement that the transactions were valid. I called TCF yet again and spoke with a manager advising them this was FRAUD and that I DID NOT AUTHORIZE the transactions and that i demanded proof since they at this point sent the balance to collections, harming my credit over a fraud transactions i should not have to pay. TCF again refused. According to law if they can not provide sufficient evidence or proof validating ownership of debt and or authorization of transactions then they must comply and remove the debt. TCF has refused, going so far as to say that i have to prove it was fraud. Which isn't possible because i have no access to whoever initiated these transactions without my consent.

Complaint: TCF bank has used an unending practice of hitting my checking account with multiple fees. It has been going on for months. Last fall, I went to the bank and asked for assistance with my account and how to solve the problem with all of the OD fees. OD protection was not an option they would entertain. A personal loan for a bridge was not approved or even encouraged. Instead, the representative pushed me to apply for a credit card. I didn't do the application. It seemed odd that he kept pushing for a credit card and didn't jump on the opportunity to really assist a customer with budgeting and/or problem solving. Over the past several months, nearly all of each paycheck has been eaten up with, fees. Leaving very little for basic necessities and bills. It has pushed my issues with XXXX, XXXX and XXXX to be a debilitating aspect of my life.

Complaint: My family moved from XXXX to XXXX XXXX Michigan and there was no TCF Bank / XXXX XXXX in the town we moved to. We did a change of address because we still had a couple bank accounts open with TCF Bank / XXXX XXXX. They changed all of our accounts over however missed one. Somehow XXXX put some unauthorized charges through our account causing overdrafts and a negative balance. TCF Bank sent notices to our old address and there was no one living at that address so the mail did not get forwarded. By the time we knew about the account being negative TCF Bank had sent it to collections within a month. TCF Bank / XXXX XXXX never called us or anything, instead their rude obnoxious collections company was the first we heard of a {$260.00} negative balance. I called customer service and could have paid them right away, however they told me there was nothing they could do. They told me I could go through the collections company or I could go right to the bank branch and take care of it. Over our holiday break on XX/XX/XXXX, we drove 220 miles to the closest TCF Bank / XXXX XXXX. We paid the balance and got a receipt. The employees at the branch treated us very well, they were very nice at the branch level. Two weeks later, on XX/XX/XXXX we received notification that the " unpaid '' balance had been put on both myself and my wife 's credit! I called the branch and they said they would take care of it right away and for some reason our payment had not been applied. About a week later we were still getting calls about this unpaid balance from the rude obnoxious collections company. I called the branch again and they said it has been taken care of however it is still on our credit! See also my complaint on XX/XX/XXXX # XXXX to the CFPB regarding TCF Bank / XXXX XXXX. Maybe they are just incompetent when it comes to customer service at their main office, maybe it's coincidence, maybe they are targeting me and my family. My wife is XXXX and this is all very stressful! TCF Bank soon to be TCF Bank / XXXX XXXX has horrible customer service, deceptive bank products and gouges their customers with high unnecessary fees. I want this taken off me and my wife 's credit or we are considering talking to a lawyer.

Complaint: I previously filed a complaint against TCF bank on the same issue that they are now being sued. My case number for CFPB is XXXX. My complaint has not been included with this lawsuit and I have not been contacted by TCF bank. The over draft fees that they charged me for an amount under XXXX was over {$400.00} in a matter of a few days. They say they mailed the OD information but it was hidden in the bank statement and was never referenced on the on line banking feature which I used frequently. Who would want to pay {$400.00} for a 20.00 charge? If I had known about the od changes I would have closed my account immediately rather than gifting them the extra funds,. My complaint was responded to by the bank by only saying saying, since the account is closed they can not refund my fees. I am asking that my complaint be revisited. thanks

Complaint: On XX/XX/XXXX I requested a refund of a duplicate payment I made to XXXX XXXX XXXX XXXX XXXX XXXX I had submitted two payment on my vehicle auto loan on accident in the amount of XXXX I requested a refund on one of the payments I was not late on my auto loan I submitted all the paper work they requested and the representative told me I should not have any problem getting my money back On XX/XX/XXXX the representative contacted me back and informed me i should be able to receive my money back into my back account as an update well today XX/XX/XXXX I received a phone call from XXXX XXXX and he was very very unpleasant he denied me my money back after I was told several times I could receive it back I explained to him due to the government shut down I was having a hard time paying my bills and supporting my children he did not care he told me I had to leave the money on the car not and he was not going to refund my money back to my account I ask to speak with a supervisor he claim he was but he was not this was the worse customer service ever this company from the dealer to them got over on me I payed double for a car that is only worth a small price blue book value I been having problem since I purchased the vehicle and for them to not want to give me my money back after I told him I needed to support my children is wrong please help me take action on this company and this employee so he want treat another customer this way

I have been monitoring my credit report for any changes since my several dispute letters, but I am yet to see the correction that I asked for and desperately need. I requested to generate me personally with a detailed description of the procedure designed to verify the account is " real '' but as of the moment no information received. I had also requested the actual proof, physical firsthand documentation of the payment history but I did not receive what I asked and these violations persist on my credit report.

Complaint: I lived in Illinois for 40 years and had a tcf account for about 4-7 years. I was so overcharged by TCF bank- Over {$500.00} plus prior I have constantly overcharged hundreds and hundreds of dollars. I finally dumped them and they gave me a bad credit report. My son had an account only for a year or so and he received a check.I should have received a substantial check as they milked me out of more than {$1500.00}. Plus the hours I spent talking to c.s. and going to the branch to try and work things out - which never prevailed. I should have been on this - was it because I moved? Thanks - XXXX XXXX

Complaint: I got a mortgage in XX/XX/XXXX from TCF Bank, I signed up for the " Command Protection '' which was explained to me as a job loss protection insurance policy. My mortgage person explained to me that in case of job loss TCF would make payments until I had obtained other employment. Of course to an extent, but it was some assurance that if something did happen and I did lose my job TCF would work with me. The charge for this was {$32.00} per month. Well in XX/XX/XXXX the unthinkable happened. I was a XXXX XXXX for ten years with a local Michigan department. I was unlawfully terminated by a corrupt police administration. If you doubt me there is a current court case against the department brought on by 3 XXXX XXXX who were unlawfully terminated by our department. I applied for unemployment however myself and other officers were denied by my XXXX XXXX department. My family was in a tough spot, however we still made our mortgage payments. In XX/XX/XXXX I called to ask if TCF could help us with making one mortgage payment and to see if some of our late fees could be waived. At first the customer service rep said not to worry that we were covered by the command protection. She said I could get some fees waived and I could get back on track no problem. She gave me a number to call, however I left repeated messages and never got a call back. After a week I called back the original person I had talked to. She now said I didn't qualify because I wasn't on unemployment. Well I explained to her that I was denied. Luckily around the same time, someone made an offer on our house and we sold it otherwise we probably would have gone into foreclosure. I complained to TCF about why I was paying {$32.00} per month for something sold to me as job loss mortgage payment protection, and then when I need it I did not qualify! I asked for my money back since XX/XX/XXXX because since it seemed like a scam and I couldn't use it anyways, they said no way would they give me any money back and in fact charged me {$32.00} one more time before my house sold! I want all my money back for this useless " Command Protection '' product and the public should know that it's almost impossible to get any help from TCF Bank if you run into problems paying your mortgage. If they would have helped us out on just one payment, it would have meant the world to me and my family, but they couldn't even help us one bit. I want all my money back. Over the course of my mortgage, I counted up {$6100.00} in " Command Protection '' fees that I paid for a service / protection policy I could not use. TCF will lie and say it's not " insurance ''. My mortgage rep called it insurance and sometimes on my statement it was described as insurance. This " Command Protection '' was explained to me as a protection for me and my family NOT an extra income stream for TCF Bank. I have my statements to show the charges that I can email. The statement was too big of a file to upload here on this page.

On XX/XX/XXXX I had a mortgage payment XXXX and online shows I was XXXX short/negative on " running balance '' to this date running balance did not change, I called customer service about this overdraft fee and response is ( different amounts of ' account balances- after mortgage payment went through - I said " It's obvious here that you see on your screen- completely Different amounts from what I see online-and I asked to have fees waived- response from bank representative is " No we can not waive the fee_ I then asked ( why not ) response ' Because ( you ) have a history of over drafts '' I said because I filed complaints in the past ' she then Hangs up the phone. I have seen complaints from other TCF customers who also have stated " Seeing Different Amounts on customers online banking compared to Bank reps on the phone- I feel discriminated by bank teller " my history '' I have a Right to file complaints '' and here again- I have enclosed copies of my retail purchases along with TWO Notices of overdrafts another XX/XX/XXXX **By Comparing these Two Notices- Proof Stands Out -as Duplicates of XXXX and USPO charges with " Balances- BEING- Totally Different " Showing FRAUD Deceiving Misrepresentations/Abusive Conduct/Practices*** Most recent Court case against TCF in UNITED STATES DISTRICT COURT OF MINNESOTA CASE XXXX ( XXXX ) filed XX/XX/XXXX Judgment entered- *This is Substantially Same Facts /Same Conduct '' Continually Happening '' ( HERE is Proof- of Mishandlings- Intentional Acts ). It's obvious that TCF Deceptive/Abusive/Manipulations of Dates Amounts Transactions Notices Are All IN TCF CONTROL- Regardless of " Following Court Orders '' To Prevent '' any REOCCURANCES of Same Issues-Plus I have OPT-OUT On Overdrafts Fees '' There are No Justifications for Overdraft Fees- my " online banking " shows '' Differently and Bank Teller on Phone `` States again different amount and the Notices are Completely Different * So what is " ACTUAL PROOF ''? Complaint: Based on the information contained in this complaint I feel that XXXX XXXX is not acting in good faith with its current customers regarding the above referenced settlement. My daughter just received a {$45.00} check from XXXX XXXX for overdraft charges stemming from XXXX through XXXX when she had an account with them. She no longer has an account. But we still have an account and XXXX XXXX made no such offer of repayment to us, even though weve paid far more fees in overdrafts when my husband complained many times about how they intentionally manipulated their system to create overdrafts by using the online system to provide one balance and then manipulating presentment of checks to create the overdraft. XXXX XXXX letter to us regarding this settlement merely covers our freedom to revoke our opt-in overdraft services. Please investigate their failure to act fairly with current customers and if you find that they have again acted willfully please award their current customers monies and fines over and above the refunds they were initially due.

Complaint: Some time back my account was fraudulently charged mutliple times, I never gave authorization for these charges. I contacted TCF multiple times by phone, even spoke with a manager. TCF completely refused to work with me, to discuss the fraud activities and even refused to investigate them. I should not have to pay for charges i did not authorize. I trusted TCF to look into this and resolve this, instead they were completely and utterly inept, incompetent and completely unwilling to help me. They refused to file disputes, they refused to look into the transactions i told them were fraudulent. Furthermore they are trying to charge me for transactions that they technically didn't even cover. While they did waive half the balance bringing the new amount to about {$68.00}. They did not resolve the issue and expect me to pay for something that i never initiated or approved. This is borderline fraud from TCF. They have not only done that but placed my account in collections harming my credit score. I want the full {$68.00} balance on the account removed and the account removed from collections. If TCF is not willing to comply I am willing to sue them for unethical business practices, fraudulent activities including fraudulent extortion attempts, and personal damages, and i will make sure that they pay a lot more than the false {$68.00} they are trying to extort from me.
