Complaint: Hi, My name is XXXX XXXX. I have a Checking Account with the TCF Bank in Wisconsin. I have Overdraft Protection. My XXXX complaints are 1. The TCF bank has a " SELECTIVE OVERDRAFT PROTECTION '' and after that the computer pays the bill, then takes the money back, credits it back into your account and the then charges you a " RETURNED ITEM NSF FEE ''. The computer knows what your limit is. I have been reimbursed a certain amount of those fees, but I should be reimbursed all of the fees and all OVERDRAFT FEES as a penalty. 2. Up until last week, before I called them and filed a complaint and told them that I was going to file a complaint with the CFPB, the limit they let me " OVERDRAFT '' was approximately {$1100.00}. After I filed the complaint, I noticed that they lowered my " OVERDRAFT LIMIT '' to about {$500.00}. THIS IS VERY OBVIOUS " RETALIATION ''. This will lower my CREDIT SCORE AGAIN. Their overdraft protection is to pay bills that come into your account even though the money is not in the account on a " IF THEY FEEL LIKE IT BASIS ''. They KNOW that I get paid from XXXX different accounts monthly : {$3600.00} - Workmans ' Comp, {$900.00} - Social Security XXXX, {$380.00} - XXXX XXXX. This is something that the XXXX XXXX, which I would think, is programmed by a XXXX XXXX, does NOT REMEMBER. The computer " TCF BANK '' knows how to lower your CREDIT SCORE. Below is the OVERDRAFT PROTECTION POLICY of the TCF BANK. Look SPECIFICALLY AT THE LAST PARAGRAPH - THE " MAY '' that I CAPITALIZED. In other words, they 'll pay the overdraft if they feel like it. I was using the Overdraft Protection, but they let me Overdraft to a certain point, and up to last week, it was about {$1100.00}. What the Bank does, or should I say what the computer does, after you reach that limit, is pay the bill, then unpays the bill, then charges me a fee for the TRANSACTION OF NOT PAYING THE BILL. This past week, IN RETALIATION BECAUSE I TOLD THEM THAT I WAS GOING TO FILE A COMPLAINT WITH THE CFPB, they lowered the " OVERDRAFT PAY LIIMIT '' to approximately {$500.00}. In their commercials they 're the bank that will always help you, but what it 's done, when they do n't pay the OVERDRAFTS AND CHARGE ME FOR NOT PAYING MY BILL, IS IT BRINGS DOWN MY CREDIT SCORE, WHICH HAS SUNK UNDER XXXX. They offer an OVERDRAFT LINE OF CREDIT PROTECTION, BUT YOU 'RE CREDIT SCORE HAS TO BE XXXX OR XXXX. Option D : Overdraft Fee : {$37.00} for each item we pay that exceeds your available account balance. We also offer the option for an overdraft fee charged daily rather than per item. See Explanatory Note below. Maximum Number of Overdraft Fees per Day : XXXX - You will only be charged this number of overdraft fees per day, even if we elect to cover additional overdrafts. Returned Item NSF fees also count towards this limit. Minimum Amount Required to Trigger an Overdraft Fee - {$5.00} If you are overdrawn by this amount or less, you will not incur an overdraft fee. - {$1.00} If we pay an item that overdraws your account and the item is less than this amount, you willnot incur an overdraft fee. Extended Overdraft Fee {$0.00} Explanatory Note : We will decline one-time debit card and ATM transactions at no cost to you if they exceed your available account balance at the time you use your card unless you ask for ( opt-in to ) overdraft service for these transactions. " If you opt-in, we MAY, in our discretion, approve these transactions. We MAY pay overdrafts due to other transactions unless you opt-out of overdraft service for these transactions. If you opt-out, we will decline any transaction that exceeds your available balance. '' They are playing with the " FINANCIAL WELL BEING '' of their CUSTOMERS. Complaint: I bank at TCF Bank in Minnesota. I purchased a laptop from an international seller, which resulted in me being charged an international fee. When balancing my checkbook, I did n't account for the international fee which resulted in me being overdrawn by {$6.00}. I was then charged a {$37.00} overdraft fee on top of it. I went into the branch and called the customer service line and they just explained that the policy is to charge anything over {$5.00}. I VERY rarely overdraw my account, and thought the bank would take care of its customers in a better manner than charging {$37.00} for an overdraft of less than {$7.00}. In addition, I made a cash deposit the very next day to cover the overdraft situation because I do n't like ever being in an overdrawn situation. This seems outrageous, and I believe the Truth in Savings regulation should be updated to no longer allow any overdraft fee greater than the amount actually overdrawn.

Complaint: case # XXXX Lender made a direct false statement and committed and action against the statement they made as below " quoted from Gateway 1 '' please see below in quotes ; " Please note that Gateway has already submitted a request to the consumer reporting agencies that your account be reflected as in dispute. In addition, Gateway has ceased all collection activity associated with your account as we attempt to resolve the situation with the dealership in question. '' Gateway 1 has made the " claim '' that in addition to reporting my case to credit bureaus as in dispute, that Gateway 1 would, " in addition cease " all '' collection activity associated with my account. '' Well, that 's proven to be a blatant lie, and false statement, as they have not only not ceased collection activity, they 've acted on collection activity by physically " repossessing '' my vehicle on private property and allowing extortion activities to commence by the company that repossessed my vehicle. Company name that repossessed my vehicle is XXXX XXXX XXXX. I had to call the policing authorities to stop the extortion activity of XXXX XXXX XXXX. My case in point is, this Lender continues to make false claims, continues to deny my resolution to return my money and losses due to a Predatory Loan initiated by them, the lender continues to neglect sending me written notices via mail of any proceedings, actions, resolutions, resolved, findings of investigations of my victimization, cooperation of any kind. Gateway 1 has done nothing but continue to purposefully lay a heavy burden on me as a victim of a crime and they continue to deny assistance in a loan they initiated, undertook in their discretion without doing their due diligence on the collateral they issued payment for in form a loan, and are now putting 110 % of their " mistake '' and " incompetence '' as a lender licensed, on a Victimized consumer, myself, XXXX XXXX.

Complaint: This complaint is a follow up to a previous complaint filed against Gateway One Lending. As stated previouslyXXXX and XXXX XXXX had the odometer rolled back on the vehicle I purchased 14 days before I bought the car. XXXX XXXX XXXX has numerous complaints and Gateway One has multiple complaints from other victims as well. In Gateway One 's partial response to my previous CFPB complaint, they stated that the account is currently in dispute. Today, XXXX/XXXX/2016 at aproximately XXXX, I witnessed a tow truck pull in front of my home from my patio. I quickly ran out barefoot and stood in between the tow truck and my car. I asked him why is he trying to take my car. He did not say anything to me. He then began pulling out his vehicle lift underneath me and my vehicle. I asked him repeatedly what this was about as he lifted me and my vehicled up. XXXX and I began to yell for him to stop. He didnt. My children were watching and screaming in terror as he pulled off with me and my vehicle suspended inot traffic. As the tow driver pulled off ran into a parked vehicle on the other side of the street. As numerous bystanders watched, I yelled at him to stop and that he is going to kill me. As he pulled off into a busy intersection with me stuck on the back. He then stopped as police saw the situation and intervened. The XXXX officers that showed up on scene initially asked the driver to present documents of the reposession. I told the officers that the driver iterallly took my car right under my feet. XXXX the officers never asked me if I needed medical attention. The only thing they said was for me and my kids and wife to stay away from my car. I informed the officers that this account was currently in dispute and he had no viable means to take my car. I asked if I can get at leat my children 's backpacks with all of their schoolwork out my car. The officers left it up to the tow driver. He said that if I gave up the keys he would let me inside to take out my children 's schoollwork and if I dont, Gateway will charge me {$200.00} for another key. My family then watched screaming and crying as the officers stood by and let a entity hired by gateway one strong arm us out of our only family car. I have not only lost thousands of dollars due to being a victim of a predetory loan and odometer fraud, I have at this point been financially, emotionally and physically abused. I will have to now seek medical attention from the XXXX I sustained which is going to be another financial hit that I will have to take due to my dealings with this scam artist dealer Gateway One. and My kids have no way to get to school and I now have no means to get to work. XXXX1.Lender put in writing their plans for resolution but didnt say taking my work vehicle was part of that resolution. 2. I a victim of lender fraud initiated by dealer and a predatory loan. lender not offering any assistance whatsoever instead trying to increase my burden and victimization by creating xtra hardship. 3. I had to make repairs to car constantly and informed lender true mileage issue and mechanical problens due to odometer fraud. Still no resolve and they took the truck with no intentions of consumer protection or loan adjustment. 4. At repo police offered XXXX assistance to my rights to my personal possessions and repo man threatened me in front of police that he would make sure ur possessions would be taken and u wont get anything out of my car. 5. lender has been informed by XXXX regulatory authorities of complaint and have admitted in writing that their has been proven fraud that they saw themselves and had no reason to seek anymore causes to heavy the burden of victimization to the consumer due to lack of due diligence of lender in lending on extremely under valued collateral.

Complaint: have an ongoing case ( XXXX ). I am a victim of a fraudulent car loan. The vehicle I purchased throu h have Gateway One Finance is a Lemon vehicle and is not sellable. The partial response received from Gateway One through CFPB was the first written response to my situation with the lender. I was told as I stated in my previous complant filing by XXXX at Gateway One that they do not send written notification of a fraud investigation and their findings to their customer. In Gateway One 's response, they sated that they have been reporting to the credit bureau that my account in a dispute status. This is absolutely not true. This instuition is now damaging my credit report by reporting late payments. The statement that the representative wrote in response to my CFPB complaint is about reporting dispute status is just another deceptive practice used by this institution and is steadily causing damage in my financial and credit situation.

CREDIT SCORE BELOW XXXX, MORTGAGE IS MORE THAN 120 DAYS PAST DUE, TOTAL DEBT TO INCOME RATIO OVER 50 % AFTER RESTRUCTURE AND IF THE MORTGAGE WAS N'T REAFFIRMED IN A CHAPTER XXXX BANKRUPTCY. MY CREDIT SCORE IS BELOW XXXX AND I AM MORE THAN 120 DAYS PAST DUE.
