Complaint: Hello im currently an account holder for TCF BANK. ON FRIDAY XXXX XXXX 2016 I WENT TO AN ATM MACHINE TO WITHDRAWA FUNDS FROM MY ACCOUNT BY THE FUNDS NEVER CAME OUT OF THE ATM BUT FUNDS WERE TOOKEN FROM MY ACCOUNT AND ON TOP OF THAT TCF BANK HIT ME WITH AN OVERDRAFT FEE OF XXXX DOLLARS. I CLEARLY HAVE TOLD TCF BANK SEVERAL TIMES THAT I NEED MY MONEY BACK BECAUSE THATS MY RENT MONEY. AND EVERYDAY THAT I AM LATE ON MY RENT IM GETTING CHARGED XXXX DOLLARS A DAY. I was assured on XXXX XXXX 2016 that my funds will be back into my account on XXXX XXXX 2016 by XXXX. I have called tcf bank several times to ask them why have n't they put my provisional credit back into my account and all they are saying that its not their fault that i went to another atm thats not dmtheirs. And that i have to wait 10 business days before i get an answer. Thats not fair to me or any other card holders. I want to file a class action lawsuit against tcf bank. My rent have never been late up until this has happened. Please help because something has to be done with tcf bank. And they need to pay these late charges and fees plus give me back my money. And that 's all i want them to do. They could have simply avoided any lawsuits but they have choosen not to do the right thing. At this point im looking for lawyers to assist me in this matter on filing a class action lawsuit against this bank. Im closing down my checking and savings account. And after this is over i want nothing else to do with tcf bank ever again in life.

Complaint: We have a XXXX and XXXX mortgage with TCF bank. The XXXX mortgage has an interest rate of 6.40 % and the XXXX has an interest rate of 4.99 %. We have had both of these mortgages for a long time and our house is upside down in debt. All we are trying to do is get our interest rate lowered to a reasonable rate. I have, for the past 2 years, been dealing with several mortgage brokers at several locations who say there is nothing they can do, I ask them to pass the information on to their supervisor they take my name and # and I never get a phone call. We have been struggling to make the payments, but have been making them, it would be extremely helpful to get an interest rate that is reasonable.

Complaint: TCF Bank denied a valid Charge Back because of customer benefit. I tried to return the product back to XXXX XXXX XXXX three times. Two by email one by certified mail restricted delivery. The certified mail was unclaimed and mailed back to me. Under visa regulation E under chargeback Management guidelines for merchants. reason code XXXX : not as described or defective merchandise. I 'm only required to make a valid attempt to return per visa regulations. XXXX example is " an example of a valid attempt to return may be to request that the merchant retrieve the goods at the merchant 's own expense. Please see attached visa regulations. Two times on XX/XX/2016 I requested per email that XXXX XXXX XXXX. " I 'm requesting that XXXX XXXX XXXX come retrieve puppy ( took out name ) at your own expense. '' On XXXX XXXX, 2016 I requested per certified mail return receipt that XXXX XXXX XXXX. " I 'm requesting that XXXX XXXX XXXX come retrieve puppy ( took out name ) at your own expense. The mail was unclaimed and returned back to me. I followed visa regulations and fact is TFC wrongfully denied my claim. I 'm legally entitled to a full refund per visa regulation E guidelines that TCF bank is supposed to follow and simply does not. If this issue is not resolved here I will separately file The Claim Notice for Arbitration I do know my rights and they were wrongfully denied here.

Complaint: I filed a previous complain with consumer financial regarding Gateway One Lending and Finance, case number XXXX. Gateway One has sent representatives to MY HOME, contacted my sister ( as stated in my previous complaint ), however, now they have reached out to my best friend, informing her of my debt. In the company 's response to Consumer financial they insisted they would no longer contact family members, friends, or make harassing phone calls to me. They have not honored that agreement. The company has called me at least 10x '' s per day ( which I can prove with voice messages ). My husband has reached out to a representative named XXXX @ ext. XXXX informing him a payment would be made to satisfy the outstanding balance on XXXX XXXX, 2016 once we are in receipt of my husband 's monies withdrawn from his 401k. In addition to coming to my home and disclosing my personal information without my consent to my sister and friend, the company continues to make harassing phone calls, and came to my phone. I have had a car loan before and never have I experienced such harassing and aggressive action by a lender. Gateway one has also gone into my bank account without my consent or authorization, I was told representatives can hear me give consent for the lender to access my account for payment when a payment was made 2 days prior ( paid my XXXX and called representatives the same day to provide confirmation number ) to them attempting to withdraw monies. I have asked repeatedly to hear this recording, however I was told I needed to obtain a court order. I will have to take legal action if these issues are not resolved, this does not feel by their words or interactions with me, to be a legitimate lender as they often convey themselves in such an inappropriate, aggressive manner.

Complaint: On XXXX XXXX I was contacted by a woman via text message who found me on XXXX, a babysitting site, saying that she wants me as a nanny for her son, XXXX. She said that she would like me to work Saturdays and Sundays only and was willing to pay me $ XXXX/hour for up to 7 hours each of these days because she wanted quality care for her son. In total, I would be making {$420.00} per weekend. XXXX said that she is an XXXX and is currently living in Texas as a single mother with her son XXXX and would be relocating to XXXX XXXX, Minnesota for 8 months for a project that she was assigned to for work. XXXX said XXXX specialist advised her to get him a powered wheelchair and she asked me to help her with this process. She said that she would be sending me a cashier 's check for {$2800.00}. {$2400.00} of that check would be going to the wheelchair business and {$420.00} I was to keep for myself and would be used as my first week pay in advance. On XXXX XXXX, 2016 I received the cashier 's check for {$2800.00} in the mail via XXXX. XXXX asked me to go the bank and deposit the check. After depositing the cashier 's check into my TCF bank account, XXXX asked me to withdraw the {$2400.00} and take that cash and deposit it into the wheelchair person 's bank account, which is an account at XXXX XXXX. After making this deposit and with the new {$420.00}, I now had {$1700.00}. The man at the XXXX counter that cashed my check said that the check right away went through and he cashed it for me. I also went online later that day to check my balance and it said the same thing, that I had {$1700.00}. For the next couple days, I use my debit card for a total of 5 times and on the sixth time that I try to use it, my card got declined. Not understanding why my card got declined, I go online to check my balance and it said I have $ -XXXX The reason why my balance was negative was because I finally found out that the check that the woman sent me was fake. Instead of contacting me immediately saying that this check was fake and that I have a negative balance, TCF decides to mail me a letter which I do not receive until a week later. They also decide to charge me {$37.00} for each time that I used my card when I had a negative balance. In total, they are charging me {$180.00} in overdraft fees. I filed a report at my local police station about the check fraud and they told me to contact my bank ( TCF Bank ) and the bank of the scam artist ( XXXX XXXX ). When I talked to XXXX XXXX, they told me to file a fraud report with my bank and to have them immediately contact XXXX XXXX so that they can put a block on the scammer 's bank account. I then go to my bank, filed a check fraud report, and asked them to contact XXXX XXXX so that they can investigate the scammer 's bank account. A week and a half later I receive XXXX letters in the mail from TCF. The first letter says that they are unable to consider this a check fraud, the second letter says that they are sending my $ -XXXX to a collection agency. When I called the TCF Bank Fraud department to discuss their decision, the lady was very rude to me and told me that she is not going to contact XXXX XXXX. Here are my formal complaints : 1 ) I found out later that TCF Bank was not supposed to cash my check in the first place because I did not have matching funds. The check I was cashing was worth {$2800.00} and I had far less in my bank account originally. Had the banker followed the rules and not cashed it from the start, it would have saved me a lot of trouble. 2 ) TCF Bank NEVER contacted XXXX XXXX or made a report to them in an attempt to catch the scammer or help me get my money back. 3 ) They charged me {$180.00} in fees when I was using my card without being aware that I had a negative balance. 4 ) Instead of helping me at all, they hurt me further by sending the $ -XXXX to a collection agency.

Complaint: TCF Back returned XXXX items on XXXX/XXXX/16 even though the money was in the account. Their reasoning for returning the XXXX items that total {$89.00} was because I had a pending item that as of today XXXX/XXXX/16 still has not posted. They charged me {$140.00} in overdraft fees even though my account balance was NOT negative. Their reasoning was they authorized the payment at XXXXCST on XXXX/XXXX/16 so since the charge was authorized, it MIGHT overdraw my account. Out XXXX check was deposited on XXXX/XXXX/16. Even though the bank was closed and the cut off time for my XXXX payment had passed and was not going to post. So in essence I was charged XXXX % more than my actual items. TCF Bank is raping their customers with this unfair practice. A pending item may or may not post, it could have been cancelled, it could be a temporary hold. You can not return items on speculation. I contacted TCF customer service and they were rude. They would only refund {$50.00} so I am still out {$98.00},. This unfair business practice can not be legal.

Complaint: My checking account was garnished by a third party for a judgment debt. The bank charged my account {$110.00}, then charged me {$74.00} more because it paid off XXXX of my charges that did not go through for the very reason that the bank had frozen MY funds and then also assessed that garnishment charge ( which I never was made aware of or agreed to at any time ). Pursuant to Minnesota garnishment law I mailed the bank my signed notice of exemption form proving that all of the funds in the account came from sources ( social security and pensions ) exempt by state and federal law from garnishment, along with 60 days of bank statements. More than six business days have expired. The judgment creditor did not send or serve any objection to my notice of exemption to me or the bank. Minnesota XXXX XXXX XXXX ( 2015 ) ( the garnishment law ) expressly states " All money claimed to be exempt shall be released to the debtor upon the expiration of six business days after the date postmarked on the envelope containing the executed exemption notice mailed to the financial institution, or the date of personal delivery of the executed exemption notice to the financial institution, unless within that time the creditor interposes an objection to the exemption. '' All of the preconditions to releasing my frozen funds have occurred, yet the bank refuses to release MY money. I called TCF twice, and spoke with a " supervisor '' XXXX times. They refused to connect me to any XXXX higher up, or to the bank 's garnishment department, or to the bank 's legal department. Even though I read the Minnesota statute to them out loud, the both said they would not release MY MONEY without a court order. They XXXX told me there was no one else at the bank they would allow me to talk to, and that there was nothing more I could do except deliver the the bank a court order. I complained in person to my local branch office. The person there told me that the bank had already paid my exempt funds to the garnisher, and I would have to get my money from them!! The bank has completely ignored its statutory and fiduciary duties to me by ripping my exempt money from my account and giving it to a creditor, and added insult by charging me almost {$200.00} for the favor of their victimization. I have proof that the bank timely received my exemption form at the address they provided.

Complaint: Over the past several months beginning in XXXX Gateway One Lending and Finance has been making repeated harassing phone calls to me. I had spoken to a representative informing him I was in the process of moving because of my husband 's car accident. I informed the representative I was actively looking for employment, however my next payment would be late. Once I became employed in XX/XX/XXXX, I again contacted gateway one, this time informing them I had become employed, however I would not not be able to make a payment until XX/XX/XXXX as the employer held the first to weeks that would be made available XXXX I left the job. I was instructed to make the payment via XXXX once I got paid as the payment was already late, to which I agreed. As agreed upon I made a payment to Gateway one on XXXX/XXXX/XXXX. However, gate way one although telling me to make the payment via XXXX proceeded to try and withdraw the monies from my bank account without my consent. I have never had my car payments automatically withdrawn from my account, but when paid online ( which occurred seldomly ) I would elect one time payment. Although the site insists the information is not stored it had been and my account had been illegally accessed by Gateway forcing it to close as I had not monies in that account. Gateway one insisted I had given a representative permission to withdraw the monies from my account and the conversation had been recorded. When I asked to hear the recording or receive a copy I was told I needed a court order. For several months I have been receiving aggressive and harassing phone calls from Gateway, multiple times a day. I was even receiving calls at work although the payments were being made. I requested several times that Gateway refrain from contacting me and my employer, however the calls continue. My position was later eliminated and I spoke with XXXX XXXX a Manager at Gateway One informing him I was actively seeking employment. He informed me I needed to make a payment, which I told him I would be trying to borrow the monies to make the payment on XXXX/XXXX/XXXX ( I was able to borrow the monies and make the payment ). I reminded him I had requested the telephone calls stop as I was engaging in job interviews and although my phone was on vibrate, representatives continued to call during the interview. Gate way one representatives have also come to home, and began calling my sister ( XXXX/XXXX/XXXX ) insisting that I had given them the ok to reach out to her and discuss sensitive information. I have never given representatives my sisters number and want to know how the number was obtained. I would like some intervention with this company as their behaviors and tactics have escalated far beyond simple debt collection, but intentional, manipulative, embarrassing, and aggressive harassment.
