Complaint: I'm going to lose my home. My Mother passed away from XXXX XXXX last XXXX. Her name was on the checking accounts, debit cards etc. Her name was on the mortgage. I was unemployed as I was taking care of her. Now, I'm going through Probate Court. I was supposed to put a notice in the paper about for her creditors but I couldn't afford to put it in the paper as I had other expenses and bills and obligations to take care of. I do have a part time job that I started a few months ago. The thing is I can't afford these mortgage payments. In fact, I haven't paid the mortgage in about 9 months. I just couldn't afford it. They know this is as I have been corresponding with them for the past 9 months about this. They said that they can't really help me because I'm not on the Mortgage Account. Now, I have been going through this throughout the year. In XXXX, I was named XXXX of My Mother 's Estate. Also, I think it was in XXXX, I spoke to somebody from The IRS because My Mother had to pay almost XXXX dollars to The IRS but she had passed away by then and I couldn't afford it. They told me to call them in XXXX to get an extension, I think. I think it was for an extension. Today, I called my Mortgage Company and told me that I have to fill out and fax a Mortgage Assistance Application. The bank is suing me, The IRS and The Probate Court. I've never been sued so I believe that is right. I just don't know what my next option is. I would have paid the mortgage on time if I had the money. I just haven't had the money and not only that but I have had no where to go. Also, I have a Severe XXXX Illness that I'm trying handle but this doesn't help. Can somebody please help me? I'm very worried and very scared.

Complaint: Ocwen has not ceased my PMI and my LTV is at 65 %. I have approached them thru email and they continue to send letters in the mail that state I need an appraisal. I understand the law is at 78 % LTV PMI is automatically to cease. My last email states this and I have no choice but to gain protection.

Complaint: In XX/XX/2018, I First received notice from Ocwen loan servicing stating that my condo insurance expired. I immediately contacted my Home owner association and submitted proof of insurance online. A few weeks later I received another mail that they did not receive my insurance coverage and that they were going to buy insurance on my behalf. I called in and spoke to agent who said I do have insurance but my hazard insurance has expired I explained to him that my overall coverage included hazard insurance. The agent put me on hold and called the insurance company who confirmed that hazard coverage was included. The agent then told me not to worry about it and everything would be taken care of. A month later I received the same letter that my insurance has expired Then I called in again and got confirmation that its been taken care of. Then a month later I got another email saying the same thing. This time I called and asked to speak to a supervisor and recorded the conversation as it was stated in the beginning of the call that this call may be recorded for training purposes. The supervisor who seems to be from XXXX put me on hold and then the call got disconnected and never called me back. I then submitted a claim to XXXX but didnt hear back Then on XX/XX/XXXX I received another certified mail saying my hazard insurance has expired and if I dont provide proof of coverage they will purchase it Talking to the agents have been very tiring and not so helpful. Theyseem to have a really strong accent and dont understand what we say. This is still not resolved.

Complaint: We have been trying to get a reverse mortgage but we do not have enough equity. We requested Ocwen to accept a discounted payoff. At first the request was denied ang on XX/XX/18 I received a letter from Ocwen that they would accept a 90 % of principal balance payoff. Ocwen stated that XXXX XXXX, the trustee, had requested the discounted payoff. When we tried to move forward and asked for the discounted payoff letter from Ocwen, we were informed by Ocwen that because of the status of the loan, it was not eligible for a discounted settlement. The status being that the loan is current.

Complaint: My mortgage accoun was approved for Streamline Modification on XX/XX/XXXX. Yesterday I received my XXXX payment back and OCWEN 's portal is now saying modification was not approved. My monthly payment {$700.00} was enrolled for Monthly Automatic Draft on the XXXX of every month and has been in effect since XX/XX/XXXX. Ocwen has been auto drafting my monthly payments. Yesterday I received XXXX payment via check dated XX/XX/XXXX. My account on XX/XX/XXXX was showing next payment due XX/XX/XXXX. Today my account is showing next payment due date as XX/XX/XXXX with {$350.00} due but the monthly automatic draft is still in effect for XX/XX/XXXX. My principal balance is incorrectly showing as {$180000.00} when debt was discharged in bankruptcy. OCWEN reported to the government in XXXX form XXXX a Cancellation of Debt in the amount of {$110000.00} and in XXXX form XXXX Mortgage Interest Statement reported my mortgage principal as of XX/XX/XXXX {$65000.00}. I also pulled my credit report from XXXX and XXXX and my mortgage which I've had since XX/XX/XXXX is not listed or being reported to the credit bureaus.

Complaint: The lender failed to calculate the payments according to the terms of the loan documents. This was a negative amortization loan and they failed to do the calculation in pursuant to the terms of the loan. The problem was till XX/XX/2014. They failed to provide a complete payment history from the day I took the loan. I requested again by sending a QUALIFIED WRITTEN REQUEST. ( QWR ). THEY IN TURN STATED WE HAVE TO DO A APPRAISAL. Before we can comply with your request. The Appraisal have nothing to do with the payment history. I strongly feel they missed payments which i made and need accounting

Now they offer a loan Modification & haven't heard from them their letter dated XX/XX/2018 is attached when I'll be faxing this to you.I 'm demanding some answers from them but they play the same game as the last time asking for more Documents I've sent them in three times no reply. I'm asking can you put some fire at them I've already had a lawsuit at them but it seems the judges went against me. I've represented my self in this matter with all other cases that were filed against Owcen. Their are son many cases against them in other states but it seems NY has good well scripted Attys that they overlook the truth. The loan to value is far below the 78 % and the payments are made by electronic transfer. They sent one letter back that said they will send another letter stating that they will drop the PMI. This was two months ago and they are still charging PMI on the loan.

Complaint: Sad to inform that XXXX Bank along with XXXX XXXX XXXX that Today is Ocwen 's are taking care ff my loan .Therefore when the economy meltdown of 2008 happened, My business of more then 15 years felled apart as well, leaving me among many homeowners at the mercy of my bank institution. Since beginning of my nightmare I perceived that would be hard to get any help from them. On the contrary as i stated before along with the company they hired to handle my loan. They tried to sell my home even before 21 day required by law. By accident I found out and fighted in court about this injustice that was about to happen and the sell was stopped. There was lots of discrippency that happened in my loan that cost some home owners have their foreclosure case stopped. But now it looks like some states the law changed to accommodate their wrong doing. Such as They tried to foreclosure me would out proper papers in court Such as : XXXX Assignment of the mortgage ( it was done 2 years after the case went in foreclosure ) I mean they could had sold my house even with out the assignment of the mortgage been in court. _when they filled the assignment of my mortgage it was done improperly, They had hired the Lawyer XXXX . He became well known lawyer who allegedly filing false and misleading mortgage documents.When you look at my assignment of mortgage you will see all over signature of XXXX XXXX. They presented him as officer of MERS..On my papers it shows him as the one who signed the assignment of my mortgage, but had not position, or authority to sign any legal assignment of mortgage. As many court case stated and some even won on those arguments. _ at time in court lawyer XXXX stated they had lost the mortgage note and had no knowledge of it whereabout. Now out of the blue, the note is there, Many time I requested a forensic of my note and they have ignored me. But now more then all, I have though the years requested a modification. They had ignored or when they gave me was a modification that could not help due to enormous amount of money they wanted me to pay even though my monthly income was lower then the mortgage monthly payment they were giving to me. My financial situation has changed drastically. And now I can afford to pay my mortgage I requested a modification. and look what they told me Please be advised that the modification was denied as we are unable to offer you a proprietary modification as the owner and/or insurer of the loan did not approve the loan modification request So now XXXX bank does not want to help me .and they are the trustee or the owner of the mortgage, Which I'm not really sure if they really are, because my mortgage was sold so many times in the XXXX XXXX, i believe that is the reason they don't have the actual note. They don't know who is the investor. I requested My PSA so I could compare with what I have and they ignored me totally as well. At one time they said they were sending me one and it has been more then 2 month and they never send me a copy.Because if you look at my PSA it has nothing saying the investor has any saying on a modification .If it is not true I ; m requesting from them to show me the prove that the PSA says investor does have a say on a loan modification. If you decide to act in a good conduct please tell your associate to let my house to be modified. Otherwise, basically they are doing as always whatever they want and have no regards for the law. So, my question is when some one will stop them? It has been years after year XXXX Bank has done some much wrong with the home owner. They have enriched them selves at the cost of many americans like me loosing their home. I need some one to look at this and help me. I have the money to pay my mortgage. Do they prefer to give my house to someone else instead of me the owner? How cruel is that? Is that fair? Why they don't want to work with me? Are they trying to make more money out of my house as they did before?

Complaint: On XX/XX/XXXX, I was approved for a trial period modification with Ocwen loan servicing. Under this trial period term, I needed to sign and return the Acceptance for the trial period plan terms letter and my first trial period payment of {$1700.00} by no later than XX/XX/XXXX. On XX/XX/XXXX, I received a letter stating my account was no longer eligible for the loan modification offer because I failed to return the signed trial plan agreement within the required timeframe. I appealed this decision using the evidence I provided which supported my claim that Ocwen Loan Servicing received the executed Trial Period agreement and my 1st trial period plan payment on XX/XX/XXXX. One day before the XX/XX/XXXX deadline. On XX/XX/XXXX, I learned my appeal had been denied because ( based on the original Deed of Trust ) my husband did not sign off on the Plan agreement. However, in XX/XX/XXXX, a recorded Quitclaim Deed was provided to Ocwen Loan Servicing for a loan modification for which I received and was awarded without my husbands signature. Furthermore, the modification appeal review that was conducted by Ms. XXXX XXXX details and contains an entire list of fraudulent details pertaining to the Trial Period Plan Payments and the dates it was received. On XX/XX/XXXX, I reached out to Ms. XXXX XXXX to advise her of the errors made with her repeal review. After placing me on old for more that 15 minutes, Ms . XXXX returned on the phone to advise she was unaware of the Quitclaim deed on file, and after I informed her she reviewed my XXXX modification records and she did see where my husband 's signature was not needed with that modification but she would need to obtain clarification from another department. Ms . XXXX went on to state that she would be out of the office on Friday XX/XX/XXXX, but would return on Monday XX/XX/XXXX, and at that time she should have heard back from that department. She said she would contact me as soon as she has received word. On Friday, XX/XX/XXXX after telephoning Ms . XXXX on countless occasions and receiving only voicemail and leaving message with no return response. My call was finally answered by the office assistant. The office assistant advised that Ms . XXXX was not available at this time and she would be happy to accept the message and have her return the call. I stated that I wished to speak with her Manager since she has not returned my calls since XX/XX/XXXX and I have been receiving foreclosure notices based on an error that she caused and I want it fixed today. After being placed on hold forever, suddenly Ms. XXXX is now available to accept my call and the manager was in a meeting. Ms . XXXX joins that call to advise she is still waiting on this other department to reply to her ; that she is not the one that makes the decision. I stated that while you are playing games with people 's lives, I am receiving foreclosure notices in the mail. Ms . XXXX stated that she placed a red flag on my account, so my home would not be foreclosed on while it still being reviewed. But, it would not stop the foreclosure process. I informed her that my home should not be in the foreclosure stage because of the modification trial plan I was awarded was being followed as indicated before she failed to properly perform her job. I further advised that if I lose my home over the error she has failed to correct, I plan to sue her and Ocwen Loan Servicing for intentionally rejecting claims based on fraudulent beliefs.

Complaint: I was behind in payments and contacted ocwen for a payment plan. That plan they offered me was {$1200.00} a month for a {$500.00} a mo th mortgage. I asked what else can we do and ocwen told me a modification so I filed for that on XX/XX/XXXX. On XX/XX/XXXX I was told by ocwen the modification was held up by fha so let 's just do repayment and I said fine let 's just get mortgage current. Then I called ocwen on XX/XX/XXXX to confirm I can pay the 1st payment of payment plan on XX/XX/XXXX and ocwen had no idea what o was talking about and said I must apply for repayment plan. Ocwen reps are rude and not helpful and each rep lies. I am 3 months farther behind because ocwen can't figure out the repayment plan.

Complaint: I was hit by hurricane Irma in XX/XX/XXXX and never recovered and applied for a loan modification and sent in a complete package of 31 pages on XX/XX/XXXX before there was a sale date scheduled. As the review went on a sale date of XX/XX/XXXX was set. I was not worried because I had already submitted my documents and knew in the past Ocwen was very helpful in loss mitigation options. I was asked to send in more documents and sent in 13 pages on XX/XX/XXXX then they asked for more documents and I sent in 3 pages on XX/XX/XXXX. All was still well because on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX I was being assured that once that package is complete the sale will be placed on hold so they could review my package for workout options. On XX/XX/XXXX at XXXX XXXX I went to the escalations department and they confirmed my packaged was deemed " complete '' I breathed a sign of relief. On XX/XX/XXXX I call in and it's a whole different story, they claim I still need another document which was not asked for before and ignore the " complete package '' determination I had the day before. On top of that they claim since I was less than 7 business days from a sale date they were not going to review me anymore? I escalated it to the Ombudsman department who is trying to resolve it now especially since I was deemed to have a complete package on XX/XX/XXXX at XXXX XXXX and assured my multiple agents the days prior that the sale would be stopped once I reached that designation.
