Complaint: I paid this account off almost 3 years ago and it has not been removed off my credit report. I tried calling the customer service department this week XXXX - XXXX ( I can not recall which day ) to see if they could help me out by removing this off my credit report since it has already been paid off but they rudely said they could n't help me and that they would not remove it off my report. The customer service was very rude to me when I tried to talk to them and ask them if they could help me out by taking it off for me. I asked to speak to the manager but they also treated me very rudely and also said he could not help me out. I would like for this charge off to be removed because it would help increase my credit score and it would allow me to qualify for a home that I am trying to obtain for my family.

Complaint: On XXXX XXXX, 2017, Monterey Collections Sv. working on behalf of XXXX XXXX XXXX, signed for a certified letter of official dispute of their information of a collection account in the amount of {$19000.00} on my and my husband 's credit reports. The letter informed them that I was requesting validation of this debt pursuant to FDCPA and FCRA and corresponding local state laws. Competent evidence bearing my signature and showing contractual obligation to pay was requested as well. I also informed them that I was aware of the law and that they had 30 days to validate the debt, or the law required that they request that all reporting agencies delete the entry. After not hearing from them after 30 days and noticing that no notification of dispute was indicated on my credit report I sent a follow-up certified letter which they signed for on XXXX XXXX, 2017. This letter notified them that they were in violation of ( but not limited to ) FDCPA Section 807-8 and FCRA Section 623-b, and therefore I was demanding that the item be removed from my credit report, as required by law. I finally received information from them on XXXX XXXX, 2017, a full 55 days beyond what is allowed by law. In the letter, they informed me that I had 30 days from date of notification by them that the account had been placed with them to dispute the debt. However, I have never received such notice, they have failed to provide proof of such, and I was only aware of the issue when checking my credit report. On that same note, FDCPA states : " 809. Validation of debts ( c ) the failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer '' which does not excuse their legal responsibility to abide by the law in their reporting and validation when informed of formal dispute and request for validation evidence. I am also reporting them to the BBB today, as well as the Texas Attorney General before filing a small claims action.

Complaint: I have an issue with a company called Montery Financial Services. I have authorized them to on the XXXX of every month starting on XX/XX/XXXX to withdrawal the amount of approximately {$150.00} dollars from my bank account. However, for whatever reason for the first month the automatic withdrawal did not go through. Having me to call in an do a charge over the phone at the rate of an additional {$15.00} dollars per transaction. The contract I signed was allowed for {$150.00} per month an not the additional fees they tack on for their arbitration of refusal for payment. <P/> I called during the second month to see why it was taking my automatic payment so long to post. Only to be told it can take up to five business days to process the card. However during that interim they charge an additional {$10.00} dollars per day to the monthly balance over the amount agreed in the contract. Secondly, the person I spoke with stated my card was pending and I was given a confrontation number for my payment not given any indication my payment was declined. However when I check my bank and call back the previous day they informed me my card was declined yet I have no notification from Montery or any pending charge or notification from my bank. <P/> During the second month using the same card they accepted earlier they refuse to charge the account for the amount due. This makes the accout become delinquent. Then they proceed to charge an amount of {$10.00} per day for a late fee plus another {$10.00} per fee for declining my previously approved payment method. I have contacted them attempting to pay yet they still do n't process my payment and claim it is late. Can you help me?

Complaint: On XXXX/XXXX/17 I called Monterey Collections along with a financial counselor who is helping me with this case. We called because I discovered some fraudulent accounts on my credit report. When we called we spoke with XXXX XXXX ID # XXXX who basically accused me of giving my grandson authorization to speak on my behalf and said that I signed for a dog when I never did. When I would try to explain myself she would talk over me and would n't let me explain myself. I was trying to tell her that I never authorized anyone to purchase a dog and that I found out about this debt after I was contacted by the collection agency. She continued to say that I did authorized this dog purchase as I was calling to try to find a solution about this fraud.

Complaint: A collection notice was received fr om Monterey Collections, dated XXXX for the amount of {$500.00}. Notice indicated payment was to be received by XXXX , the day the notice was received in the mail. Called spoke to a lady named XXXX I tri ed to explain that I had never made that purchase. She indicated she hears this thousands of times and that because it was my name and address it was my debt. That she had proof in front of her that indicated it was my debt. ( invoice ) Once again I tried to explain and XXXX did not accept any explanations. Instead she threaten to report me to a legal institution and that my credit will be affected/ ruined for 10 years so that when I go ask for credit I will be denied. I understand that the same excuses are heard everyday but I do believe each individual deserves to be treated individually. At least listen.

Complaint: This was parent plus loan for my son. Someone kept calling and offering to consolidate my loan. I, contacted them the rep explained the way it would work so I did do everything on my phone i canceled the consolidation process. Loan, hero /Monterey sent ou t papers. I called them to inform them I had canceled the consolidation. She told me I would have to contact federal student which I did. He informed me I will have to pay the loan because I had 5 days to cancel. It 's not fair for me to be paying for a loan I have never received.

Complaint: In XXXX of XXXX I filed for a chapter XXXX bankruptcy which included XXXX XXXX XXXX as a creditor. XXXX XXXX XXXX continued to email me asking for payment and harassing me even with an automatic stay in place and after my attorney sent them the paperwork. Instead of updating the account with " included in bankrupty, closed, {$0.00} balance '', they sent the account to collections. The collections comp any Monterey Collection Services has put a collections account on my credit report further ruining it when they should not have received the account in the first place. I contacted Monterey asking them to re move the account and they said they will not. My attorneys have contacted them showing the account was included in bankruptcy but I am continuing to receive letters demanding payment. I want this account removed from my credit report.
