Complaint: They are stating that I owe XXXX thats not true. Also I was in contact with the original creditor and on payment arrangements when this debt was place on my credit report. I have never done business with Monterey Financial Services. I do not have a signed contract with Monterey Financial Services. I have a right to demand that Monterey Financial Services furnish the signed contract between them and myself. Also this company is not licensed in the state of Tennessee. I would like this unfounded and unvalidated debt removed form my credit report. Per Tennessee Code TFDCPA 62-20-101 ( short title ) and 105 thru 127, Tenn Law emphatically states that " a collection service can not commence or conduct the business of collecting debts in Tenn without being so licensed and bonded as well as maintaining a " location manager '' who in turn is required to be licensed and bonded. in the State of Tennessee. UNLICENSED ACTIVITY IN THE STATE OF TENNESSEE POTENTIALLY SUBJECTS THE DEBT COLLECTOR TO CIVIL AND CRIMINAL PROSECUTION.

I eventually filed bankruptcy in XXXX of XXXX and Monterey Financial Services was included in the repayment plan. While under the XXXX XXXX, Monterey continued to place inquiries on my credit report monthly as well as the amount continued to increase due to interest. My Ch. XXXX was XXXX in XXXX XXXX and Monterey is reporting to my credit report as a collections account on XXXX XXXX XXXX.

I have tried to fix this issue with XXXX over the phone, in writing and most recently through XXXX, with no resolution. As a result of XXXX fraudulent entries on my credit report, I was denied a job working at XXXX Technology that required XXXX XXXX XXXX. I will be able to obtain an Affidavit from the hiring XXXX, where she specifically called out XXXX ' derogatory entries.

Complaint: I took out a small loan with Monterey Financial to pay for a course that I am taking. I have a payment book and every month, I pay my monthly payment, {$160.00} + XXXX ( fee for paying online or via telephone ) on or before the first of the month. Per the contract that I signed and the payment book that I have provided to me by Monterey Financial, a late fee is not assessed until the XXXX of the month. On XX/XX/XXXX, I made my payment online on the company 's website. Several days later, I received a collections call stating that my payment did not go through. I did not have immediate access to the account that I paid from to check so, I made a payment on my credit card. The company not only double charged my credit card but, the original payment that I made on the XXXX was indeed, withdrawn by Monterey Financial from the account. Another couple of days later, I received a collections call from a representative from Monterey Financial stating that my payment went through on XX/XX/XXXX but I owed a late fee. The woman became argumentative and disrespectful toward me when I read to her the portion of my contract and the payment book that states that your account is not considered late until the XXXX of the month. The woman then hung up on me. This past Thursday, my husband and I paid off the balance in full online. I received another threatening phone call from Monterey Financial. I am writing to CFPB because of three concerns 1 ) I did not pay any of payments late. All of my payments were made online and I received messages stating this. Monterey has a habit of waiting to collect the monies from the account. I feel that they are doing this to " justify '' collecting a " late fee ''. 2 ) I am concerned that Monterey Financial will overtake-without my permission- the full balance that I paid this past Thursday. 3 ) That Monterey Financial is falsely reporting to the credit bureaus that a late payment occurred when that is not the case. I am asking for intervention.

After a lengthy discussion with the account representative I was told that if the debt was paid they would then have the negative information removed from my credit file. I requested removal agreement in writing and I did receive an email from XXXX XXXX which I have included. The debt was paid yet the information is still reporting.

Complaint: Monterey Collection is handling an account that I had with XXXX. I do have a balance with XXXX but not the balance they are reporting. Also, they are reporting the wrong account open date. I have disputed this information with the three major credit bureaus and with Monterey Collection and they have not fixed it to this day. I would like for them to show correct documents of when I open this account or remove it from my report. When I open the account it was in XXXX. They are saying I open it in XXXX. They are reporting incorrect information.

Was put on hold for approx. 15 min before he came back on the line and transferred me to XXXX how looked up the extension and said it was a mistaken call.

Complaint: In XX/XX/2013, I was unemployed XXXX seeking assistance to find XXXX XXXX XXXX. I found a company online called XXXX XXXX. I submitted information and spoke to a representative, who stated that they worked with assisting executives with finding positions and would guarantee that they could find me a position in 13 weeks. They asked for {$630.00} upfront, which I paid and a copy of my resume. They had me complete a detailed survey online and then a " coach '' called me. I was then sent the contract for 6 additional payments of XXXX to begin in XXXX but was told that if I did not have results in the 13 weeks that I could cancel. I would lose my deposit but no further obligation. I received my resume back " prettied up '' but with numerous spelling and grammatical errors that also changed the core of my experience in several instances ; with cover letters and envelopes addressed to CEOs of 12 companies. I was told to mail these and follow up asking for an appointment to see if they would see me and possibly have a 'spot '' for me. This was not what I was promised when I spoke with the sales rep on the first couple of calls. I told them this. I did however, do what they asked and never got to speak with anyone at any company. I asked XXXX to discontinue my service. They said I had to do it online. I sent email but once I started being contacted by collection was told there was a special form I should have filled out. I reported there activity to SC Attorney General as Internet Fraud. They have since been hurting my credit score and compounding interest to this account and calling my phone constantly

Complaint: I never had an agreement or contract with this company Monterey Collections XXXX but started receiving calls from them stating I owe them money for a closed and old debt from a company that was taken out in XXXX that never contacted me since I can remember. I started receiving the calls in XXXX and my credit report was hit in XXXX. They 've since then been adding {$1.00} a month to knock my credit score down tremendously. It 's frustrating because I 've since worked in my credit and cleaned it up since I 've retired due to the financial struggles I experienced while on XXXX XXXX not by choice. How can a company I have no agreement, contract or any dealings with do this? Being threatened over the phone to sue me and attack my score until I pay them in full has really affected me mentally and physically. They 've kept there word with the " affecting my score threat! '' It 's also odd they have my old address but I was never contacted by the original company. I 've even gone through a debt consolidation company that included this past debt called XXXX XXXX XXXX XXXX. I 've had enough medical and life issues I 'm dealing with daily and these people are n't helping me or my situation by harassing me or others. Please help.

Complaint: On XX/XX/XXXX 2015 I went to a store " XXXX XXXX XXXX ''. I talked to salesman by the name XXXX. He sold me a mattress, and a box spring for {$280.00}. The address of the store was XXXX XXXX XXXX XXXX, XXXX, PA, XXXX. He took my information and told me about a free program through the government that helped low income people get a new and better bed. I did n't even need to fill out any paper work. Turns out this was a fake program. He used my information to take out a loan in my name. Furthermore, he shipped me a cheaper bed than the one I picked out out and paid for. Also, please note, He set up automatic payments for this bed. But it is linked to an account at a bank I have never used.

Complaint: I responded to a sales call about a XXXX XXXX which I later found was a unwanted timeshare contract. I requested that my membership be cancelled but the company called XXXX ( XXXX XXXX XXXX XXXX ) would not cancel the service. They kept part of my deposit and are reporting a {$10000.00} debt on my credit report. " I am disputing a purchase charge to XXXX because the merchant will not voluntarily refund money I paid for a membership in a travel club. On XXXX XXXX XXXX the XXXX XXXX promised me a membership that promised me several weeks of stay time at a low rate. When I called to book a week stay room at that rate they informed me that lowest priced room was unavailable and I needed to pay more and upgrade room. Second they told me that the alternative low rate mini vacation rate was also unavailable. Last but not least they told me that I could only take advantage of the low one week rate once a year. I called XXXX XXXX to discuss the terms of the contract on with XXXX XXXX and was not satisfied with the terms. On XXXX XXXX I explained to her that they did not fully explain the contract and I wanted a refund but they will not refund the money. I called my credit card company to dispute the contract that day. I also Faxed a rescission contract that day. They asked me how I knew about the rates because my ID had not been issued yet and that is because they offered me two free vacations that I could not book for 2 months and I wanted to vacation before that time. So I called the XXXX XXXX XXXX they provided to me and told them that I wanted immediate booking and they gave me my rate info. Complaint: Monterey Collection Service is reporting a collection account to all credit bureaus as a collection account that 's in the status as open, it 's also reporting a high balance and a balance owing and the balance goes up each month ... How is this possible when the account is supposedly a closed collection account. Instead of updating the account with " included in bankrupty, closed, { {$0.00} } balance '', they sent the account to collections. The collections comp any Monterey Collection Services has put a collections account on my credit report further ruining it when they should not have received the account in the first place. I contacted Monterey asking them to re move the account and they said they will not. The account was included in bankruptcy but I am continuing to receive letters demanding payment. I want this account removed from my credit report.

Complaint: On multiple attempts dating back to XX/XX/XXXX I have disputed multiple unverified accounts with Monterey Collections with account number : XXXX XXXX and XXXX. Each time this item was disputed with XXXX the collection agency responded with account verified. On or around XX/XX/XXXX/XX/XX/XXXX I called Monterey Collections and spoke with a rep that was unable to locate an account with my social but a similar account with the same or similar name/DOB. The representative would not provide me with any additional information although she mentioned an address ( apartment ) in XXXX or XXXX, GA that I have never lived or been associated with. At that time the rep advised I should dispute again with the credit bureau and stated that the account should not be reported if the information did not match with what the credit bureau report. Well, just the other day I received a debt letter from Monterey Collections which states it was a response to the dispute received and pursuant to the debt validation requirements set forth in the Fair Debt Collection Practices Act. Also, in the letter it states that I had 30 days from the date I was notified by Monterey that an account had been placed with Monterey Collections, to request to dispute the debt. They also state that they notified me of the accounts XX/XX/XXXX which could n't be further from the truth. I have used my current address over 10 years and have never received any communication from Monterey until it was reported on my credit report back in or around XX/XX/XXXX. This practice completely contradicts the standards provided by FTC and creditor should be reprimanded for these practices.
