Complaint: I, XXXX XXXX XXXX XX/XX/XXXX, am writing a letter of complaint. I got a loan in the amount of XXXX USD in XX/XX/XXXX. I paid amount of approximately XXXX USD a month every month until XX/XX/XXXX. I reached out to creditor in the time of my financial hardship and they unwilling to work with me. They call me so much that this has caused alot of stress on me, so much that my health is declining. I shouldn't owe no more than 2,000 USD. The is a predatory lender & loan. I paid OVER 3 years at $ XXXX which means I paid over $ 10k for a medical debt. I had a financial hardship due to a loss of income and additional medical issues. I reached out to the lender BEFORE the loan was late. They were unwilling to work with me. I only borrowed {$5300.00} and NOW they're reporting to the credit bureaus that I owe almost {$12000.00}. This has caused me to NOT be able to secure new housing or employment. This is unfair & inaccurate reporting. They are claiming VERY excessive fees, late charges and interest which is just untrue. Reporting a medical debt like this is both a FCRA and HIPPA violation. They call nonstop which has caused additional emotional stress which is unfair when I've already paid them well over the amount borrowed. I'm attaching my credit report from XXXX that shows I paid this loan ON TIME with NO late payments for YEARS and the balance owing at that time was ONLY {$5700.00} in XX/XX/XXXX with NO default. Complaint: This is my third attempt to have them remove the inaccurate information listed with the credit bureaus. I am still disputing this based on the law they used a stall tactic the first time and failed to meet the 30 day requirement to send me physical verification. A violation. That was grounds for them to remove info. I asked for info on how/why they are charging 12 % and reminded them they didn't send verification the first time. They answered again. The contract they sent showed clearly that 10 % is the correct amount. They have failed to follow the law. They failed the original request to validate within 30 days, They have the wrong amount showing, which is a violation and grounds to remove it. How is this possible under FDCPA. The FCRA requires you to verify the validity within 30 days. You didn't you are obligated by law to remove your inaccurate derogotory information. You also stated you are charging me 12 % wrong interest rate another reason you are obligated to remove it. You leave me no choice but to sue you for actual damages and declaratory relief under the FCRA. This regulation states I may sue you in a qualified state or federal court including small claims court in my area. I look for a swift and amicable resolution. They are falsely stating they are following the law.

Complaint: The original contract with XXXX XXXX XXXX XXXX XXXX XXXX is listed on my credit report allready. The account Monterey Collection services shows in collection is a duplicate account of XXXX XXXX XXXX XXXX XXXX XXXX. This is my second request written request to have them remove the duplicate.The amount shown does not match the original amount, they have negatively reported on my credit report. I asked for physical verification plus they remove duplicate their duplicate account. They have never sentThis appears to be a stall tactic which has hurt my ability to obtain credit. Also I'd like them to send me physical verification where the 12 % interest they are charging me I agreed to. They threatened me and you can see it by the tone in their response to you. They have NOT provided me with a physical copy of any original documentation required under Section 609 ( a ) I demand under FCRA that the unverified duplicate account be removed. If Monterey collection is representing the original. Section 611 ( 5 ) ( A ) of FCRA -your are required to " ... promptly DELETE all information which can not be physically verified.The Law is very clear. Complaint: I discovered an account on my credit from Monterey Collections. I thought is was odd because I have lived at my current residence for 7 years and have had the same phone number for the same amount of time- I was never notified about the debt. That said, I reached to them a few times in writing and finally received a response back from XXXX XXXX ( a representative of the company ). She advised me that I needed to dispute the validity of the debt within 30 days ... .. and since I had not done that- they did not need to validate the debt- they would move forward with their collection efforts. However, they would report the account as disputed on my credit report. I don't understand how I was offered the opportunity pursuant to the FCRA to dispute the debt if it were mine if I never received a collection notice?

Complaint: -My wife and I signed a contract with XXXX XXXX XXXX XXXX XXXX XXXX timeshare in XXXX . - The contract was subject to misrepresentation, and fraud. We had already paid {$3300.00} US dollars, which represents a 40 % of the entire amount, and never received any services, because they couldn't provide what we were promised at the time of the signing. - When we tried to cancel the contract, XXXX XXXX XXXX didn't answer. - Now, this foreign Company that doesn't comply with XXXX contract standards, is using a US Company, Monterey Collections, to collect money for services they didn't provide. This is what happened : On XX/XX/XXXX, we signed a timeshare contract with XXXX XXXX XXXX XXXX XXXX XXXX. At the presentation, we were five adults and two small children. The first thing they asked was if we were American Citizens, because the opportunity they were offering was only for the US market. We were there from the morning to the end of the afternoon, they offered alcohol to the adults and games to the children, and they promised several benefits, until we all agreed in the terms of the contract. The main selling point was that we could adjust 7 nights in a single room, to 5 nights in a double room, to accommodate the whole family. For that, we only had to use what they called " preferred points '', that were available in low season, without additional payment. All 5 adults made emphasis in this, because our main driver was for the whole family to share vacation together. Like I said, this was the biggest selling point. On XX/XX/XXXX, we called to make a reservation, just to find out, that there was a {$450.00} fee for using the " preferred points ''. Such fees were never mentioned by the sellers, and they are not written in the contract. After several calls, one of the agents told us that the contract is governed by the Book a Rules.This book was given to us after the contract was signed, with other brochures and timeshare information. After several calls, they wouldn't provide us what they had promised the day of the signing. So, on XX/XX/XXXX we emailed XXXX XXXX XXXX, expressing our intention to cancel the contract, they didn't respond. We sent the same cancellation letter through certified mail, and it was returned to us, unopened. We continued receiving emails and calls from a company named XXXX XXXX , XXXX, based in USA, in charge of collecting payments, but when we asked them about the contract and cancellation intention, they just said they are a third party, and that we have to contact XXXX XXXX XXXX directly. XXXX XXXX, XXXX has several complaints in XXXX for the same problem with XXXX XXXX XXXX 's fraudulent contract. On XX/XX/XXXX, we received a pdf document in our personal email, and have been receiving collection calls, and voice-messages in our personal cellphones during working hours, from Monterey Financial Services, trying to collect the debt to XXXX XXXX XXXX XXXX XXXX XXXX. What steps can we take to protect our good standing credit records, and dispute this fraudulent debt from a foreign Company, accused by several American consumers of having misleading and dishonest contracts?

Complaint: I sent the first debt validation letter requesting for Validation not Verification to this collection agency on XX/XX/2019, they responded on XX/XX/2019 by stating that they don't have to have a license to collect debt in North Carolina and also Monterey collections said that I had 30 days from the date I was notified by them but I never received any letters from this company. Then I sent them a second debt validation letter on XX/XX/2019. In this letter I stated : I have previously sent you a request to validate my debt under the Fair Debt Collection Practices Act and all I received was an itemized list of the alleged charges you claim I owe you. This does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation. They responded on XX/XX/2019, by stating the same thing they stated in the first letter, but this time they said they want respond to any more letters that I send to them in the future.

Complaint: On XX/XX/2018 I placed an order for a make up product with XXXX XXXX advertised on TV. I called the following day XX/XX/2018 and cancelled the order. I was advised the order was being processed. I never received the product. Nonetheless, the following month in XXXX XXXX XXXX attempted to charge my card and it was disputed with my credit card explaining the order service was cancelled. XXXX XXXX continue to bill my card for months after requesting service to be cancelled. Now they are trying to collect {$200.00} after I cancelled the service and never received their product. They have transferred the account to Monterey Collections. I had block the merchant because they continued to bill my card after I had requested the service to be cancelled. Even after disputing the charges and advising XXXX XXXX to cancel service they continued to try charging my credit card. According to their advertising I can cancel service at anytime. I have explained the situation to Monterey collections and they have not investigated this matter. I have done everything in good faith to resolve this matter and seek assistance since I do not owe the amount in question. Finally XXXX XXXX is indicating a balance for {$140.00} and the collection agency is trying to collect {$200.00} in addition to the charges made to my credit card. I would imagine this is done too thousand of other people. I do not owe either amount. I have attached the charges made and disputed with my credit card, product order, and collection agency notice.
