Complaint: After seeing on my XXXX credit report that I had an outstanding balance of {$19000.00} through Monterey Collections, I called the collection company on/about XX/XX/XXXX. They did not have my social security number in the system or connected to any account. I had never received anything in the mail from the company. ( They told me that correspondence had been sent to ... my ex-mother-in-laws home which I never lived ). I told them this as well as the fact that my ex-husband is solely responsible for the XXXX timeshare. I have no paperwork, no information since our divorce in XXXX when he was awarded the XXXX and held solely responsibly via court documents for all payments with me being held indemnified and held harmless ( see section XXIV attached ). They told me I would still be responsible. I told them I had court documents stating otherwise. I went through XXXX to dispute and included my divorce decree in that documentation. The collection company still refused to delete from my credit report and instead added a note that it was a joint account with my ex-husband ( even though the court papers state I am not responsible for anything that was joint- he is ). After the fact, I contacted our state Attorney General 's office and was told that legally I am not responsible for any of it and they can not come after me in any way. It would not hold up in any court. I am going to file a case through our state 's Attorney General 's office as well. I need this deleted from my credit report and for them to not contact me about this in the future for any reason.

Complaint: In XX/XX/XXXX I filed chapter XXXX bankruptcy I included Monterey collection services they were sent notice this has been a long court case they are stating that I owe XXXX on XXXX dollars and half has been paid, they have ignored all bankruptcy proceeding and I am currently due back in court with them on XX/XX/XXXX for them to answer for this account making threating phone calls and threating to destroy my credit. They were served this month with legal actions in regards to this and they are able to look up all bankruptcy information.
they have this as an open account that they will not be collecting on due to my bankruptcy. by law, they are not to contact me or attempt to collect a debt that is in bankruptcy. disputed this with the credit bureau also. because they continue to report it as a debt. Complaint: On XX/XX/XXXX my car needed repair so I took it to XXXX XXXX XXXX and they charged me {$2800.00} for repair when car was picked up XX/XX/XXXX. The technician told me I could make payments so in order to pick up car I needed to pay XXXX that would leave a balance of {$2500.00}. I have made payments of {$3200.00}. I got a call today that I still owe {$2800.00} that I was in a lease for my repair bill with XXXX XXXX XXXX and the company that is collecting is Monterey Financial. I was not aware that I was in a lease for a car repair. I thought I was making payments for the repairs and now am being told that I am in a lease and if I do not pay the additional {$2800.00} that legal action would be taken. I have received messages at my work and on my cell phone from this collection company. I would like to have this resolved. I have paid the amount of the repair and do not plan on making any additional payments. I feel like I have been taken advantage of this is a high interest lease that I was not aware of. I did not sign a lease and would like this resolved and closed out. I do not feel that I should need to pay any more than the repairs.

Complaint: I disputed this debt a couple of times on the grounds that I did not owe the debt to no eval. I began working with XXXX to resolve some discrepancy on my credit report. With the assistance of my case worker we requested validation of debt from Monterey Collections and disputed the debt. On XX/XX/XXXX received the attached letter stating in pursuance to the debt validation requirements set forth in the FDCPA was enclosed required proof of debt. The only thing enclosed was a original contract with XXXX XXXX XXXX minus the paper work regarding the loss of income insurance my chef had required me sign up for before he would ok the loan at origination. I called Monterey and requested any other information the company had showing that i still owed this debt and if so what i still owed on it. I also requested a full copy of the original contract. On XX/XX/XXXX I received the attached marked XX/XX/XXXX and an exact copy of the contract with the original loaner.

Complaint: I have contacted the XXXX XXXX XXXX XXXX XXXX about this on several occasions and sent a written communication that we have no interest in being part of their vacation club and the contract was signed under duress. They refused to cancel it and sent the claim to Monterey Collections around XXXX, XXXX 2018. We were then harassed about owing + $ XXXX until I spoke to an attorney and sent a cease and desist letter to Monterey Collections. They were soliciting the money through emails, calls, and then the US Postal Service. I told them that this was not a valid debt and to continue to request money through the mail was extortion.
This all stemmed from duplicitous practices by XXXX XXXXXXXX XXXX, where they told us lies to convince us to tour their resort ( which we later learned it hadn't started construction yet ). We were told that there was nothing to purchase, it was not a Time Share and that we would just go 10 minutes from our resort and would be back within an hour. That was not the case and it took ~40 minutes to get there with a driver that I could only communicate with in XXXX and then once we arrived, we were not permitted to leave. During XXXX separate instances, we received veiled threats from their employees which I have recorded. They kept warning us to not say certain things, including telling us that we couldn't leave in time for our friend 's wedding rehearsal ( which was the entire purpose of the trip ). They said we must go through the whole process and play the game. We were in a very secluded location without roads and had no cellphone or WiFi service. We were completely at their will and the driver never came back at the time we requested. He didn't show back up until 5 hours had passed and we had long missed our friends wedding rehearsal. Considering the tensions between US and XXXX during the trip, and the news about gang violence against tourists, I began to become fearful for the safety of my wife.
As the time drug-on, I tried leave the premises with my wife ( prior to signing paperwork ) by saying we could not use the current credit card due to limits and they encouraged us to get another card. Since we were the only ones left in the building ( besides 5 male employees ), I agreed in hopes of getting back safely to the resort and escaping the situation. Unfortunately, their employees refused to give us back both of our Driver 's Licenses and my credit card, which they held as collateral to ensure we had to come back. We went back to our resort to get my wife 's XXXX card for the sole purpose of the companys strong fraud protection department.
When at the resort we mentioned the situation to one of the resort concierge and he didnt know what we should do beyond signing and then disputing it afterwards. The card I left in their possession during our +1-hour drive back-and-forth had fraudulent charges on it when we arrived back stateside. I was forced to cancel that credit card and dispute the charges made by whoever stole my information while it was out of my possession. Shortly after arriving home, we contacted XXXX to investigate the situation and filed a dispute. The charge for ~ $ XXXX was fortunately removed by their fraud department. The contract is not valid due to signing under duress. It was also not penned in my actual signature due to the circumstances.
In addition, they recently removed their rating on XXXX because their business practices had so many unresolved complaints, they were at an F rating. Looking at XXXX XXXX will also show that dozens of other people have encountered these same types of threatening practices. They offered me a deal to cancel the contract by signing a gag order and paying them ~ $ XXXX. I could not afford that type of ransom money due to my company going through lay-offs which I also told them about. I was so XXXX out with their phone harassment and emails, my XXXX XXXX spiked and I had to get on XXXX medicine. Ours is not an isolated occurrence and this company needs to be investigated and held accountable for its business practices.
