Communication tactics

Debt collection: Other (i.e. phone, health club, etc.)

Threatened to take legal action
Complaint: Received a call from Monterey debt collecting agency. spoke with XXXX first day, very rude. when she asked about me paying debt in whole I told her no she responded with " then what are you calling for XXXX XXXX '' I began to respond but then got frustrated at the way she was talking to me and told her she was a rude XXXX Today I received another phone call from her coworker XXXX who was just as aggressive and rude. and when I told her I was not able to make that payment in full she did not offer me a payment plan. I had to ask. She said yes what could you pay I told her {$5.00} dollars she said that is not good enough and as I was trying to ask her to help me figure out a reasonable payment she starts getting more aggressive and began to tell me when to speak and says that I knew I had to pay this and that this is my fault and a long list of other things. She asked me why I even have a debt and I began to say why she then cuts me off again after just telling me that I cut her off. Her communication tactics were to get me upset enough to say that I refused to pay. she said that she was going to mark this as a refusal to pay and terminate the call. after I asked her repeatedly to help me figure out a reasonable payment. She never helped me figure out a reasonable payment and just kept getting loud and talking over me. I asked her how is anything supposed to get resolved if you do n't even know how to talk to me. Her goal was never to set up payments because when I asked for solutions she kept being rude and repeating to me that this was my own fault. she terminated call. when I called back her coworker gave me the supervisors number and told me she did not need to speak to me. yes in the recording I called XXXX a XXXX for being rude and I had to talk over XXXX to even be heard. XXXX said that because {$5.00} dollars was n't going to help that I needed to pull out a loan and or get a credit card and pay today or they will report this as a negative on my credit. not once did she try to help me figure out a reasonable payment plan again that was n't even offered to me. I asked to be switched to someone else and she kept talking. nothing got resolved and I was disconnected. I believe I was put on hold and I had to hang up because I did not hear anyone which was her goal again to get me upset enough so she could mark my file as refusal to pay when I never said I would n't pay, I feel as though XXXX and XXXX should have better communication skills. Collecting a debt or not the way I was handle was not okay even after asking for help from XXXX to see what should I do her only response was fast talking me and telling me to get a credit card to pay today. I am currently at work I will not stop what I am doing to leave work to go get a loan or credit card I can not afford. I understand that debt collectors are trained to be aggressive but if Im asking for help to figure out a payment plan what was the reason for them being aggressive even after I allowed her to belittle me I asked can I speak now she talked over me and continued with saying {$5.00} dollars is n't going to do anything versus us coming up with a solution. I do n't believe she had the intent to set up payment arrangements at all

Complaint: I had a medical procedure two years ago and used XXXX to pay for my procedure. Monterey Financial created our loan. We have been paying our loan to them on a monthly basis. Monterey started showing on our credit report that we were past 30 days and we have only been past 30 days one time. I contacted Monterey several times asking for an audit and was not given XXXX. We disputed with credit bureaus and then received a contract to validatensure our debt. When we got it we noticed the amount financed on contract was not accurate. We contacted Monterey and was told the amount did not matter because we signed the contract and it was a binding contract and we were responsible to pay. Please help!!

Complaint: I changed banks and forgot to set up an automatic payment out of the new bank. I paid my payment when I realized the error, but the institution charged me a late fee. The next month I sent XXXX payments to make sure I was current but they started calling about the {$20.00} late fee obsessively. I paid the late fee and gave them a confirmation number and a date they will be getting the payment. The calls will not cease. They have been calling 3 times a day, 3 to 4 days a week since XX/XX/2016. I have called them 4 times and each time they assure me I am off of the call list. I also get massive text messages and e-mails.

Debt was paid
Complaint: We were scammed by a timeshare in XXXX. Most of what we were told during the presentation has proven to be false. The timeshare has been paid off and we have tried unsuccessfully for years to cancel our membership with XXXX and they refuse to cancel. We have also tried to sell or transfer membership to escape escalating yearly fees without success. We stopped paying the yearly maintenance fees in hopes that XXXX would cancel or terminate our membership but instead turned us over to Monterey Collections. Research showed some timeshares allow to " surrender '' membership but XXXX said they would not send a " surrender packet '' or discuss anything about the account until the past due amount and penalties of {$2200.00} was paid. It is also highly likely " Surrender '' is another Scam. XXXX used lies, deceit and unlimited alcohol to entice victims into a contract that they can not escape from. We have attempted to negotiate, they refuse.

Debt collection: I do not know

Debt resulted from identity theft
Complaint: This company, Monterey Collections, they are a dirty company. I submitted a complaint against them around XX/XX/2016. They removed the collection which was reporting a balance of {$1000.00} and reported it as a new collection for {$1000.00} ... oh and they still have not responded to my first document I sent them. I hope the FTC nails their CEO and fines these pety low lifes back where they belong. Sad imagine who else they 're doing this to. I have never bough anything from this company ( for like literally the 11th time ). Monterey Collections has severely violated the FDCPA, FCRA, and the FACTA on more than 1 occasion. I have all the docs I just have n't uploaded them in. I do feel good though sharing with the world how this company truly is.I 'm filing other complaints directly against their CEO and staff this afternoon. Thank you for assisting me

Complaint: I bought an educational package from XXXX in 2014 and got enrolled into a payment plan which was to continue for a period of 12 months, the educational service was to continue for 12 months. I was making the payments on time but decided to stop making payments due to the violation of Contract by XXXX. Part of the services which was weekly support call and were deemed an important part of the services by XXXX and XXXX who was the individual who signed up. Those services were not delivered and due to the lack of delivery of the important part of the program and services which were mentioned while I was being lured into the program, my condition has not changed and I do not see any impact on my development in the area. This issue was discussed by XXXX one of your supervisors end of XX/XX/XXXX. XXXX understood my resentment towards XXXX and advised that if I bring the payment up to date till XXXX then he will try to resolve my issue. I brought my payments upto date. After that he left a message on XX/XX/XXXX as he promised and told me that he tried Contacting XXXX but XXXX never responded back to him. This is how XXXX is they want to take people 's money and do not want to deliver the services. Their contract is pretty generic and does not mention any details. They just want to rip people off. Also I tried contacting XXXX 4 times and left him 4 voice messages to follow up but he never returned my calls. At this point I do not think I owe anything to XXXX untill and unless they straighten up their act and start delivering their services as XXXX assured. If I keep making monthly payments with out getting any services then it does not make sense. Also to charge individuals around {$2500.00} dollars just for 4 30 mins sessions and not deliver on the following weekly calls do not make sense and is a rip off. At this time Moterey has started charging me interest on the balance and this is affecting my credit. I seriously need help and need CFPB to intervene and help me out.
