Complaint: In XXXX XXXX I purchased a XXXX vacuum cleaner from XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX NC XXXX. They got it financed through Monterey Financial Services XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX at 22 % interest, 36 months paying XXXX a month. I have made XXXX payments so far. In XXXX I went on line to make a payment using my credit card because I had n't worked all summer and I knew my bank account would be short. I did n't want a late fee so I payed it on the due date XXXX/XXXX/XXXX, but the payment on line was XXXX. I submitted the pay then called to let them know I had paid it. I was told by XXXX that I would still have to pay a return check fee of {$25.00} because they had processed for the check to come out of my account and it would be returned as insufficient funds. She told me the XXXX was to cover the online fee of XXXX and the payment of XXXX ( my payment ). I said why the extra XXXX. XXXX. She said she could take that as part of the XXXX rcf, and she would attach the balance of XXXX to my next auto draft. I said fine. My XXXX Payment was XXXX. The XXXX was satisfied. Today I got a call saying I still owed {$8.00} + change, and they were calling to collect a debt. I explained that I did n't owe anything other than my regular payment. They told me I owed processing fees and the rest of the {$25.00} fee. They told me I payed by phone which is {$15.00} not on line like I actually did. Plus there was nothing on the website that indicated a fee to pay online. I paid this bill to avoid the {$99.00} payment when you are late. This happened to me once when I was a day or XXXX late a nd I thought it was excessive so I did n't want this to happen again. When I said I refused to pay it because I paid the fee, XXXX the supervisor told me she would wave the XXXX dollars but I would still have to pay {$3.00} with a {$15.00} processing fee because the penalty for them not collecting the money directly from my bank account totalled {$99.00}. Regardless the figures just did n't add up. I am disgust ed with them. They are charging and over charging because at the time of purchase my credit was not good. I feel I 'm being robbed and cheated. I want to pay for this product but not with such harsh penalties and high interest. I am retired but still working to keep up my responsibilities. These people are crooks. Total cost of product {$1500.00}. But I still have over a thousand to pay.

Complaint: My vacation club account went into collection as I have had financial difficulty and have not been able to pay. I contacted my original creditor XXXX and they said they transferred/sold the account to Monterey Financial. Monterey Financial told me that I need to pay the full balance, OR that I would be sued, and lawyers will file claim for more legal action and my credit will be severely tarnished. I explained I do not have the ability to pay, and XXXX said I was stalling and lying. He stated several times that I am in breech of contract and that I need to pay the full balance, and there were no other options. I asked XXXX if he had the contract, and he said he did not. How can you collect on something stating I am in breech of contract when he does not even have the contract? He said he will mark my file as " Refused to Pay '' and continue with the legal process unless I have payment to him by end of this month XXXX/XXXX/16. This is the first time I spoke to him on XXXX/XXXX/16! I do not have the full balance, can not even get credit and I said I could n't afford that. XXXX said the only option is to pay the full balance. How is this not predatory? I am getting charged fees, high interest and more fees and then I have to pay the FULL balance? I have not received any letter from the collection agency, detailing any information either. What is not even clear to me is if I pay the full balance, do I even get my vacation club status active? It seems they are closing my account fraudulently, as I owe a significant amount less than what the value is on my vacation property.

Complaint: The call my phone 100 times a day. My boyfriend and I went through a financial hardship at the beginning of the year and we are trying to take the proper steps to resolve this debt. Complaint: I was extremely surprised and upset when I checked my credit report in XXXX 2016. There is a mark by Monterey Financial Services XXXX XXXX XXXX, XXXX, California XXXX. It is in regards to a disputed contract with XXXX XXXX over a misrepresented vacation package. I disputed the mark with XXXX and the collection mark remains and does note that it has been disputed. The problem is Monterey NEVER notified me in writing that I was going into collections. I NEVER had a chance to dispute the collection attempt until AFTER it was already on my report. I did notify Monterey in XXXX and they ignored my grievance, I still have not received a collection notice from Monterey.

Complaint: Outcome : I have a debt in my business name. All of the collection letters have been sent to my business. The collection company reported the debt to the XXXX reporting bureaus while I was refinancing my mortgage. My credit score dropped from XXXX to XXXX, costing me an additional {$10000.00} to close the loan. Details : I disputed the information with the XXXX credit bureaus. After a reported investigation, the credit bureaus notified me that information reported was validated by the collection agency. I closed on my loan and received a written letter from the collection agency that " they made a mistake '' and the debt did not personally belong to me. However, as indicated under the outcome, the erroneous reporting of the business debt to my personal credit report resulted in {$10000.00} plus in additional out of pocket expenses to close my loan.

Complaint: I purchased a timeshare and cancelled it according to the 5 day grace period. I sent a cancellation through email, fax and mail. However they said I did n't send it through register mail. I tried to work with company, but they would n't accept my cancellation. I did pay for almost 2 years but could n't pay anymore due to loss of wages. This debt was sent to a collection agency. They are not willing to close the case, even when I have sent them paperwork showing that the proper cancellation paperwork was filed.

Complaint: XXXX XXXX in XXXX, CA has been repeatedly calling my cell phone, even though I am paying/have paid my bills in a recurring and timely manner. They called my cell phone at XXXX XXXX/XXXX/16. When answered, the caller hung up. The numbers attached to this company calling my cell phone outside of legal hours is XXXX. I have asked them to resort to email communication if they can not follow the rules for contact via telephone set forth by the FTC. They will not comply, nor will they address the issue. I contacted them shortly after XXXX PST on XXXX/XXXX/16 to discuss this issue, and was met with aggressive/unethical collection tactics in regards to a bill I have been paying regularly and timely, which resulted in being hung up on by a representative.

Complaint: Monterey Collections Services representative XXXX XXXX has been contacting me about a debt. She calls me and if I do n't answer she immediately sends me an email. The debt charged off on XXXX with a balance of {$5800.00} as of today the balance is {$9000.00}. The debt in question has also been reported on my credit report for the past 6 months as an open account and is listed as with a one month term. If the account is open then it should not be in collections and should not have been listed negative on my credit report. Monterey Collection Services has XXXX negative accounts listed on my credit report. I have been denied credit due to this negative account. I do not have an agreement with this 3rd party collector. The collector has been very aggressive in their collection attempts as well as using deceptive and abusive collection practices. The Rep continues to use my credit report status in attempts to get me to pay this debt. She emailed me on XX/XX/XXXX talking about how the negative account will continue to be reported as an open account. She also stated how the negative item will impact my borrowing power and interest rates in future. The Fair Credit Reporting Act states that the a collector can not attempt to collect more than original amount on a debt. The Act also states that all information in my credit file must be 100 % accurate if not the item must be deleted immediately. This account shows as a joint account with my wife 's name listed as joint responsibility which is also incorrect. My wife never provided any of her personal information for this account. They have also called her personal cell number in attempts to collect this debt. I am requesting that this negative item be removed from each of my credit reports and that the collector cease all communication with me and my wife.
