Struggling to pay your loan

Vehicle loan or lease: Loan

Lender trying to repossess or disable the vehicle
Complaint: I bought a new car but with XXXX miles on it I noticed sensor lights on. I took it back to the dealer service department on XX/XX/2019 and was told not to worry even though I had great concerns. An appointment was set for XX/XX/2019. On XX/XX/XXXX while returning home from a VA Hospital appointment all sensors failed. The dealer wasn't available to help. upon getting home I called Hyundai Finance and Hyundai Corporate Offices in California. They told me to have it towed to the dealer, this was done on XX/XX/2019. I was given a case # by Hyundai Finance ( XXXX ). Nothing was done to repair the vehicle because I was told I had to pay for repairs even though the Hyundai Warranty, and a Carefree Car Protection policy had been purchased at the time of the car purchase. So the car sat in the dealers lot for over six weeks and since has been taken somewhere else. I still receive billing from Hyundai Finance for payments past due. The loan amount is {$23000.00} and the past due amount is {$620.00}. I haven't seen or had service of the vehicle since XX/XX/2019. I've tried to work with them but now get no response to my e-mail letters. I think that Hyundai has covered up an internal issue with my vehicle. I do know about the complaints and fire issues that this company is currently dealing with The Center for Auto Safety and Congress of The United States of America.

Complaint: I leased a car from Kia Motors Finance on XX/XX/2018. It was stolen in XX/XX/2018. My insurance company ( XXXX ) at the time deemed it as a loss and paid Kia Motors Finance over {$19000.00} ( the value of the car at the time ). XXXX took the deductible out of the final check that they paid to Kia Motors Finance and in turn Kia Motors Finance stated that I have a balance of {$1600.00} due to the deductible that XXXX took out of their final payment. I called them and ask about the GAP insurance that was included on this Leased vehicle and they told me that the deductible is not included for GAP insurance. I told Kia Motors Finance that XXXX is not asking for the deductible because they have been satisfied and I am curious to know why Kia Motors Finance is acting as a insurance company. Kia Motors Finance is now making me pay for my car being stolen even though it had GAP insurance and everything was taken care of through XXXX. I made a payment arangement with them to prevent it from going to my credit and keep it inhouse. Well it hit my credit report as a missed payment which made it go down by XXXX points. Then a week later they reported as a closed account delinquent with a balance which in turn made it go down another XXXX points even while being on a payment plan. I asked XXXX XXXX XXXX could they not hurt my credit because I am paying them as agreed. I can not finish my home project because of this and I feel like I am suffering for something that was beyond my control. The amount in question is {$1600.00}. I have paid them {$350.00} which should leave a balance of {$1200.00}. They have reported a balance of {$1500.00} and that it is delinquent.

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account status incorrect
Complaint: After being struck by another driver that ran a red light on XX/XX/2019, our financed vehicle was deemed undrivable and towed to an impound lot. The other party in the accident was at fault, but her insurance company took a long time to accept the claim ( finally accepting responsibility and agreeing to pay off our auto loan, plus additional compensation on XX/XX/2019 ). Meanwhile our car sat in an impound lot and the towing company, seeking to be paid, attempted to file a lien on the vehicle without contacting us. Hyundai Motor Finance, with whom we have a $ XXXX loan on the vehicle and to whom we have continued to make payments timely and in full, received notice of the lien. They then determined that the damaged vehicle was worthless, and declared it abandoned and placed our loan in charge off status again without contacting us. Until XX/XX/2019, we had no knowledge of the attempted lien or negative credit reporting. If we had known, we would have simply paid the towing company and/or Hyundai Motor Finance and sought recovery through insurance once the claim was accepted. We spoke with Hyundai Motor Finance ( XXXX ) on XX/XX/2019 and were informed that once they receive payment from the insurance company they will contact the credit reporting agencies to have that charge off removed from our record. Although they acknowledged the credit reporting needed to be corrected and that we have always paid in full on time ( the loan was never delinquent and is not currently in charge-off condition ), they will make no effort to correct this until they have been paid in full. We offered to pay in full to speed up the correction process, but they advised us to allow the insurance company to complete the payoff process that is already underway. Unfortunately, we are currently in the process of obtaining a mortgage ( primary residence ) and this negative and erroneous credit reporting could interfere in our ability to obtain that financing. We respectfully request your assistance in encouraging ( if not enforcing ) prompt and accurate credit reporting by Hyundai Motor Finance in this matter. If this is not remedied swiftly, it could have significant implications for our personal financial situation that are unjust and unwarranted.

Billing problem
Complaint: XX/XX/XXXX I noticed two negative credit marking on my XXXX Consumer Credit Report from Kia Motor Finance. I spoke with an agent after multiple transfers and hold times for almost an hour in reference to my dispute. I was advised by the dispute department to submit a credit reporting dispute due to the late markings being charged from an Insufficient fund fee which was taking out and applied to the fee and not as a payment transaction. Kia 's online system allows you to view the payment transactions, but not the breakdown of how payments are applied. I requested a pay history which shows when the monthly payments posted to the file. No payment was missed. I was never called to advised any fees had not been paid and was unaware of any issues, even though I am the primary customer on the file and my XXXX XXXX XXXX is co-maker. I reviewed my credit this morning XX/XX/XXXX which decreased my XXXX score more then 30 points now that there is a 60 days delinquency now showing from Kia Motors. No payments have ever been over 30 days delinquent and it is unfair that my efforts of being a good standing consumer is now in jeopardy due to this matter I called Kia Customer service at XXXX XX/XX/XXXX to ask to speak with the dispute department regarding credit reporting and I was refused to be transferred due to payment which was due on XX/XX/XXXX has not been posted to the account. Even though it is and arrangement on the file for payment of XXXX for XX/XX/XXXX. I asked to speak with a supervisor and was placed on hold for more then 25 minutes before a team lead XXXX ( employee # XXXX from XXXX XXXX location ) took the call. I again requested a contact number or department that could asset with my dispute/complaint and he as well stated their is no number to contact that department. He advised that I should mail my complaint to Kia Motor Finance at XXXX XXXX XXXX XXXX XXXX CA XXXX. I asked how would I be able to follow up once I submitted the letter. He advised to include my name and call back number but still gave no instructions for resolution.

Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Termination fees or other problem when ending the lease early
Complaint: I have a gap waiver addendum to my lease contract from Kia stating that in the event of a total loss ( which occurred on XX/XX/18 ), once full proceeds from the insurance company, based on a fair and reasonable determination of the vehicles actual cash value ( ACV ) less any subtractions from that ACV by the insurer ( my deductible ) have been received, I will have no further financial liability. My insurer confirmed that Kia/Hyundai would work with the actual cash value ( ACV ) as provided by my insurer. The insurer issued Kia a check for the ACV less my {$500.00} deductible. This check was cashed, thereby ratifying the contractual agreement. Kia insists that I owe them XXXX. They refuse to provide either myself or my insurer any documentation of why they feel entitled to bill me for an amount over and above the ACV of the vehicle. My contract does not list any exclusions to the gap insurance other than past due lease payments. I had none. My insurer and dealership staff have all said that they have never heard of anything like this before ; that gap insurance covers everything. Additionally, I financed a replacement lease, through Kia Finance, with my dealership stating that the totaled vehicle had been paid in full. I only found out that Kia was billing me for the totaled vehicle when I erroneously tagged the lease payment for my new vehicle to the old account. I had to request a billing statement to find out what I was being charged for. I have tried multiple times to resolve this with Kia/Hyundai Finance, with the assistance of my insurer and my dealership. Kia Finance has been unwilling or unable to provide any documentation of language in my contract which allows them to bill for amounts over and above the ACV. They have been uncooperative, rude and unprofessional throughout this entire time. At this point, my credit is being negatively affected. I believe I am being harassed and upon the advice of my insurer and lawyer, I have already submitted a claim to the XXXX and will submit claims to both state and federal CFPBs.

Confusing or misleading advertising or marketing
Complaint: On the day I purchased my car from Huyndai dealership in XXXX XXXX, Ca on XXXX XXXX I had already been pre-approved by my bank for a car loan. The financial Manager, XXXX XXXX, promised me a lower payment and interest rate, he was very pushy and would not let up until I went with his institution. He did not provide me with any person copies at the time of signing and just pushed me to sign without explaining what I was signing. He stated that I would get an email with a copy of the agreement because his dealership no longer provided paper copies. I did not receive any email and I even checked my spam folder. It was until a month later that I received anything. The agreement showed that I had a larger payment and much higher interest rate. I attempted to solved the issue with the Huyndia dealership and with XXXX XXXX but he was very rude and raised his voice while I was attempting solve my issue and even made fun of how I spoke English which is not my first language.

Incorrect information on your report

Vehicle loan or lease: Lease

Account status incorrect
Complaint: In XX/XX/XXXX I returned a car that I leased from XXXX XXXX in XX/XX/XXXX to lease from a different car manufacturer and was under the impression I owed nothing else. Prior to leasing my new vehicle, I called Kia Motors Finance to get the remaining balance due on my car so the dealership could pay off the active amount due. I was given the amount of {$1000.00} and that amount was paid by XXXX XXXX XXXX and from there assumed the car was paid off in full. Seven months later, XXXX XXXX, I received a letter in the mail from KIA stating that I am being put into collections due to a balance that is owed on the car. I called the customer service line at Kia Motors Finance and asked for a brief explanation on the balance and was told that it was due to the lease end balance that was owed on the vehicle, items like wear and tear etc. Kia states they mailed a bill to me in XX/XX/XXXX, however that bill was never received and I lived my life thinking nothing was due. Also, upon speaking with the representative at Kia, I was informed that they only submit a Bill once to the consumer and if there is no response to it Kia does not submit any other letters or phone calls asking for payment. I paid the amount due from Kia after I requested to have the bill sent to me to review. They did send it but with this being the first time I saw it the damage was already done on my credit report. I paid the balance to prevent myself from being sent to collections ; however my account with Kia Motors Finance remains sitting on my credit report as greater than 90 days late and will remain until XXXX per my free credit report paperwork. Since I never received the initial letter I am asking to have my credit report be back dated to when Kia claims they mailed the initial letter in XX/XX/XXXX. I have never missed a car payment with Kia and my credit report supports that. This situation is most likely due to an error/issue with the lease end and I would hope that my positive credit report with Kia could help support my claim. I contacted the attorney general regarding this issue after filing multiple credit report appeals with XXXX with no budge from Kia Motors Finance. They opened up a case file for me in XX/XX/XXXX and have been working diligently to help correct my credit report. Kia motors finance will not budge and as recent as XX/XX/XXXX they claim that my dispute with them is " inaccurate ''. I firmly believe that I was never late on any payments as I would have called and paid the claim as soon as I would have received the bill. The attorney general from XXXX, NY states that they can no longer assist me with mediation on this issue and suggested that I filed a complaint through the Consumer Financial Protection Bureau. This false report is hindering me from obtaining approval for a new financial lease for a car and has left me with many sleepless nights. I appreciate any help in this matter.

Account status incorrect
Complaint: I entered into a 3 year lease agreement with Hyundai Motor Finance on XX/XX/XXXX for a 2016 XXXX XXXX. At the end of my lease term in XX/XX/XXXX, I turned my vehicle back into a Hyundai location. Hyundai did not allow me to pay my termination fee at that time and said they would send a bill. Hyundai also refused to allow me to make this payment through their online portal. Upon receiving a bill of {$790.00} from Hyundai in XX/XX/XXXX for my termination fee plus excess wear and tear costs, I mailed a check to Hyundai on XX/XX/XXXX. Hyundai waited to cash my check for another 4 weeks on XX/XX/XXXX. Hyundai also converted the check to an electronic check so I can not show an image of it with the date XX/XX/XXXX written on it.Then another month passed with no additional communication from Hyundai and my account showing as paid off in full and closed. Then on XX/XX/XXXX I received an alert from my credit monitoring agencies saying that Hyundai Motor Finance had reported my account as more than 30 days past due and delinquent on my account. I have reached out to the credit reporting agencies and Hyundai multiple times and they have updated the status of my account to closed but have refused to remove my 30 days past due designation. I filed reports with Hyundai and the credit reporting agencies both in XXXX of XXXX and again in XXXX of XXXX. Hyundai has reported back to me on XX/XX/XXXX saying they believe the credit reports are accurate with the 30-59 days late status on my report. I believe that I have acted in good faith and made all of my payments on time and in accordance with the agreement that we laid out. I ask please that the CFPB ask Hyundia Motor Finance and the credit reporting agencies to please update my credit report to remove the delinquency from my account and the 30-59 days past due status.

Complaint: In XXXX of XXXX my XXXX XXXX XXXX caught on fire while I was driving. I contacted Hyundai because there apparently was a recall on the engine. During that time I needed a rental car that I would have to pay out of pocket for. As a XXXX veteran, I could not afford to pay both a car note and a weekly charge for a rental so my payments for the car fell a few months behind. I received a letter from Hyundai saying that if we did not pay by XX/XX/XXXX, they were planning to charge the car off. I ended up paying the amount due as well as past due before the deadline. By the end of XXXX the car was paid off and the account closed. I went to XXXX to purchase a used car in XXXX of XXXX and was told that there was a charge off on my credit report. I ordered my credit report and saw that it said it was paid off as well as charged off. I contacted Hyundai immediately and they explained to me that it was a mistake and that they would fix it. They said it would take 30 - 60 days to be fixed. I checked a few months later and it was still on my credit report as a charge off/paid. I disputed this with the credit bureaus and Hyundai did nothing to fix it. They have the proof of the vehicle being paid off in full, not charged off. Not only did they not fix the charge off on my credit report with all 3 credit bureaus, but they completely erased the car from my husbands credit report. It is now XXXX and I can not get a car without a co signer.

Billing problem
Complaint: I began this loan in XX/XX/XXXX with Kia Motors Finance- my car payment is {$460.00} monthly. I have always paid more than my car payment on every payment I overpay at least $ 400- {$1000.00} Yet..I have been unable to access my online account with them since late XX/XX/XXXX. This is the ONLY platform I can pay my car payment without a processing fee. Therefore I have to ALWAYS pay a processing fee even when I want to pay fee free online because they refuse to give me access to their online account. Additionally XX/XX/XXXX I was offered a deferment on payments with a 14 day window from XX/XX/XXXX ( even though they claimed to have emailed it on XX/XX/XXXX ) toXX/XX/XXXX return the paperwork which I NEVER received. My email address and mailbox at my home has never received anything from them for this extension whatsoever. They still however reneged on it saying it expired being I didnt return the forms ( that I never received ) in 14 days. When I asked today, XX/XX/XXXX, if I can apply the extra money I've paid over the years ( they put toward principal ) toward the current balance of {$930.00} I owe currently I was told they can not even speak to me or do anything with my account until I make one payment. Mind you my last payment was XX/XX/XXXX of {$200.00} and before that was $ 2,200+ in XX/XX/XXXX enough for 5 months. I am currently out more money than I owe to this firm but am being treated like a crook. I loathe every interaction with them as they take NO accountability for any of their errors and hold customers responsible for them and even charge them fees just out of being unable to correct or explain why you cant pay online. Please help me.
