Complaint: I have called XXXX XXXX at the end of XX/XX/2019 about when are they I'm going to report my auto loan to report to the credit agencies and KIA told me that there will report every three months, because I'm not current on paying my auto loan. That is not correct I pay every 25 days. I even pay the late fees just because of my payment schedule. As long as I am not 30 days past due this should not be an issue. The person I spoke with at XXXX XXXX very rude and disrespectful and hung up on me. How nice since I paid over 13 % interest. The car is almost paid off. On eight {$22000.00} dollars car i'll end up paying over {$44000.00}. And they can't even be nice. All I ask is for them to report every month like everyone else. Sincerely, XXXX XXXX

Complaint: I paid off my lease with Kia Motor Finance in XX/XX/XXXX. I purchased the car from XXXX XXXX XXXX in XXXX WA who set up the lease. I completed the odometer statement in XX/XX/XXXX. I've never received my title. I've called 3 times over the year and each person couldn't figure out why I haven't received it and said they would send it again. On XX/XX/XXXX the person said the odometer statement was denied. She reviewed the statement and said she doesn't know why it was denied because it's was completed correctly. She said she will email the odometer team. I have no faith that after my fourth 20 minute phone call that I'm any closer to receiving my title that should have been sent XX/XX/XXXX.

The insurance company paid XXXX for the vehicle, when the debt on the vehicle was XXXX. Therefore the insurance issued a check to me for the remaining balance of XXXX. Months later in XX/XX/XXXX/XX/XX/XXXX, as I am preparing to look at getting a mortgage. I come to find out that I was 30, 60 days delinquent on the account, Hyundai claimed I was delinquent on a remaining part. I called Hyundai and paid the amount and explained that I was not delinquent, but I wanted the problem removed from my credit history. Now the account shows as a charge off instead of paid ok.

Complaint: In my initial letter dated XX/XX/2019, to Hyundai Capital America, I specifically requested verification and proof of the alleged debt, including a complete account history. This information was not sent to me in the company 's response. Instead, I received an offer to resolve this debt from a 3rd party debt collector, XXXX XXXX XXXX ( XXXX ). The information I received from XXXX, didnt contain any evidence of the alleged debt, nor did it include a complete account history as requested in my initial letter to the company. Therefore, I mailed a second letter, but this time to XXXX XXXX XXXX, demanding verification of this debt and the companys legal authority in this matter, and proof that XXXX legally owns this debt and is authorized to collect this alleged debt. I have yet to receive any information from XXXX proving that I have a legal obligation to pay XXXX, yet, this company is continuing to attempt to collect an alleged debt without providing evidence of their authority to collect it. Why would I pay a debt to a company that is unwilling to prove they are the legal owner and are authorized to collect it? Debt collection agencies sell debts all the time, if I pay XXXX, what is to stop them from selling the debt to another third party debt collector after I pay it? Therefore, without proof of XXXX legal authority in this matter, it would be extremely unwise for me to pay a random debt collection company for an alleged debt they dont own. Secondly, in my original request to Hyundai, I specifically requested a contract or other instrument bearing my signature proving I was legally obligated to pay this debt and that it was my account. The company has failed to provide with this evidence as well. Instead, in a response I received from Hyundai Finance, ( not Hyundai Capital America ) dated XX/XX/2019, I was provided a copy of a contract which did not contain a date, nor my signature. Without a signed contract or other instrument bearing my signature that created this debt, the company failed has provide me with proof that I am legal owner of this debt. XXXX, Hyundai Capital America and Hyundai Finance have all failed to provide legal evidence of this alleged debt, yet continue to report this account to the credit bureaus. I am submitting this complaint because under 812 of the FCRA, furnishing certain deceptive forms ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. In addition, under 1692e, [ a ] debt collector may not use any false, deceptive, or misleading representation or means in connection with collection of any debt. 15 U.S.C.A. 1692e. Since I have not been provided with the information requested in the attached letters, I have reason to believe that Hyundai Capital America, Hyundai Finance and XXXX XXXX are willingly reporting inaccurate information to the credit bureaus, and may be engaging in unfair and potentially fraudulent debt collection practices. This is why I am seeking the assistance of the CFPB.

Complaint: I have a car loan with Kia Finance for a car I bought new in XXXX XXXX, FL. I have made every payment and, about 2 weeks ago, I requested and received the payoff amount from them and used their site to transfer that amount from a bank in Virginia to my account at Kia Finance. However, in checking my online account since then I can not see any evidence the loan has been closed, my payment history does not reflect the payoff, and the bank says they have received no transfer request from Kia. I have emailed them from their web site asking about this a total of 3 times. While I received automated acknowledgement emails back with a promise I would hear from a rep in a couple of days, that has never happened. Today I called their customer service line during their stated business hours. After going through multiple automated menus and hearing the same account information that I saw on their web site ( without reflecting the payoff ), I selected the option for " other issues. '' An automated voice said, " A representative will be with you shortly. This call may be monitored for ... '' Then, the same voice said, " We are not available right now. Call back some other time. '' The same thing happened when I called their Collections line. I called a third time and instead of choosing an option I pressed 0. This time the voice simply said, " Good-bye. '' I must ascertain the status of the loan before I try and transfer this amount again. But how can I do that if I can't get Kia Finance to communicate?

Complaint: Back in 2017 I went to XXXX XXXX XXXX XXXX with a friend she was trying to buy a car. As i was sitting there with her the salesman asked did I need a car? I said yes but I dont have much income nor a driver license. He said how much income you get a month. I .told him after I pay rent I have XXXX left till the next month. He asked for documents I gave them to him and he got me approved for a brand new car with a poor XXXX credit score and XXXX a month income SSI after I pay my rent XXXX left. I asked the salesman. How did I get approved he said enjoy your new car. All my family kept asking how did I get approved. It was a no brainer the dealership falsified my income. I have since asked the dealership and the finance company for proof of income that was submitted to get me approved. Hyundai motor finance said they didn't have it. Only a contract which is useless we need application with debt to ratio income. And proof of income that was given. Because both entities want provide information to show this account was falsified. I am requesting removal of Hyundai Motor Finance from all 3 credit bureaus.

Complaint: XXXX XXXX has entered vaguely described erroneous charges on my lease upon termination after I have turned in the vehicle at the end of the lease period. They have violated the lease contract in three distinct ways. I have both called and written to them pointing out the error, disputed these charges, and asked for a clarification of the charges. They failed to note that the account was disputed and have reported my account as delinquent without giving any response to my inquiry. They have sent demand letters from different locations, each time with different contact information. They have threatened to turn the account over for collection without ever contacting me to discuss the charges or explain exactly why they are charging me. The car was leased in my wife 's name, but since we turned in the car she has passed away. She did sign our dispute letter that was sent to the company soon after these charges were billed, and before her death. The company has made no attempt to resolve or even discuss our dispute.

Complaint: I have had the lease on this new XXXX XXXX for two years in XXXX and have been notified that I had to make an extra amount added to my payment for personal property taxes, which I have sent to them. I received my personal property tax for my owned cars and thought, I wonder how much I am paying for the leased XXXX XXXX comparatively. I thought it was a bit high and wondered if I was getting the Virginia tax break that we all get. So I called them and asked for a copy of the tax bill that XXXX county sent to them since I have leased the car. I had to call several times and finally had someone send me what I thought was the tax bills for the year and a half that I have leased the car. They only sent me the first half of 2019. I called them back and explained the situation and was told that they would contact the right department and have them send them to me, to no avail.

Complaint: Upon reviewing my credit report to prepare to purchase and speaking with my lender it was found that Kia Motors Finance has inacurately reported a late payment in XX/XX/2018 upon my credit. Contacted Kia to inform them of the discrepancy and the representative as well as the manger i spoke to advised it was nothing that could be done unless i disputed it. I advised to them verbally that I dispute the inaccuracy. They both refused to take my dispute and said that it had to be in writing or just do it through the credit bureaus. I know this to be inaccurate, I know that per the FDCPA I as a consumer am able to verbally dispute matters and it must be accepted and noted as being disputed. Again after explaining this to both the rep and the manager they still both refused.

Complaint: In XXXX, XXXX, after making all of the payments required, I returned a 2015 Hyundai XXXX that was leased back to the dealership. When I turned the car in, I asked the gentlemen if they needed any information from me or payment and they said, no, we dont need any other information from you, you are good to go. This was an opportunity to verify my address, phone and additional contact information. No information was collected from me while turning in the car. Sometime in the early XX/XX/XXXX, I received a call from Hyundai collections department claiming that I had an outstanding balance for the lease turn in. I had advised them that this was the first Id heard of this and that I had received nothing in writing from Hyundai nor any calls. I asked for the information in writing so I could see the breakdown of costs. I received the breakdown via fax on XX/XX/XXXX at XXXX XXXX. After reviewing the breakdown, I paid the amount on XX/XX/XXXX in the amount of {$710.00}, check # XXXX. The check was posted / cashed on XX/XX/XXXX. Furthermore, the collections person was extremely rude and continuously argued and talked over me the entire conversation. I made 3 years worth of payments, fulfilled my obligation and should have been an exceptional customer to Hyundai. Had Hyundai contacted me sooner and given me the opportunity to make the payment, I would have settled payment within a reasonable period-of-time, much like the timeframe of the final settlement outlined above. The result of reporting me delinquent to the credit agencies has resulted in financial loss ( roughly {$8700.00} - the difference between 4.25 % and 4.375 % new home loan ) via the interest rate I received from my mortgage company. My credit score dropped over 80 points. I sent a letter regarding the same XX/XX/XXXX asking Hyundai to correct my credit report. After waiting 30 days from the sent date, I called Hyundai and spoke to a manager. She stated that they will fix the credit reporting. I received a letter ( see attached ) stating the same. The letter stated to allow 30 to 60 days for processing. I placed a 60 day calendar to follow up with the credit agencies. I called XXXX and XXXX on XX/XX/XXXX to see if they had received any information from Hyundai. Both agencies claimed they didn't receive any information from Hyundai Motor Finance. I filed disputes with both agencies. I called Hyundai on XX/XX/XXXX to discuss the matter and to obtain status. After speaking to another manage, she claimed they updated " late payments '' but they would not be removing the delinquency which is impacting my credit score. The letter Hyundai Finance sent on XX/XX/XXXX acknowledged my letter, the dispute and stated they would update it. This was deceptive in that they acknowledged my dispute but stated they would not correct the delinquency. It appears they have violated FCRA requirements and did not update the credit agencies even though their letter clearly stated they would. Their deceptive practices has caused me financial loss.

For some reason, I realized that there was a late payment on my credit report, I called HYUNDAI MOTOR FINANC and they said their system automatically put me on paperless billing, which I did not request. I was awaiting letter in the mail all this time just to find out their system had an error. As you can see, I have always had a stellar payment record with this company. I tried contacting Equifax and HYUNDAI MOTOR FINANC with no successful resolution. Equifax only reporting me 30, 60 and 90 days late. There was an error on their part. I was never 90 days late.

Complaint: In XXXX of XXXX I purchased a car from Hyunadi Capital America for the amount of {$23000.00}. I made payments of {$430.00} every month for four years. Sometimes I was late or didn't give the full amount but I always got caught up. Sometimes I gave them the payment early or an extra payment. In XXXX of XXXX my car payment money was taken out of my account by a family member who had my pin number. So when Hyuandi went to take it out it was rejected for non payment. I got some of the money back and gave them what I had. I made arrangements to make more payments to get caught up, like I have done in the past. The young lady said she couldn't promise anything. The next day at XXXX in the morning they came to take my car. I cried for days, I never ever had a car repossessed. I paid off many new car loans and I had every intention of paying this off. I had one year to go and it would have been paid off. ONE YEAR!! I didn't have the money to get it from them in the two weeks they said, so I had to let it go. The next few days I was watching TV and there were ads for a Hyuandi Program selling used cars that were under 50,000 miles in great condition. I realized this is why they were so eager to take my car as it had only XXXX miles on it and it was like brand new. I was in the middle of getting the brakes done and detailed. They just took my car because they wanted it for their program. They didn't care about what they did to me, so why should I care about the bogus amount they want from me. They took my car and lied to me. Then I got the paper work from Hyuandi explaining that they sold my car for only {$5000.00} dollars and that I owed them {$4100.00}. The remainder of the loan was {$9000.00} and some dollars. I asked for a bill of sale to prove to me that is how much they got for my car that was like brand new and had under 45,000 miles on it. They sent me this bill with all these fees attached, I know that they got more than {$5000.00} for my car, it was like brand new. I am disputing this on my credit report because it says it is closed. I refuse to pay {$4100.00} on a car that they sold and got way more for it than they told me, they had to. Why would Hyuandi tell me exactly what they got, all these corporations want to do is rob the little people like me. I had one year to go, I paid on it monthly all the time, but sometimes it was difficult. I am asking Experian to take it off my credit report. I can not give them this reason on their website so I thought maybe you can help me get it off my credit report. I will try to get up enough nerve to call Hyuandi and tell them to remove it. But I fear that they will just lie to me again and tell me I need to pay this. They repossessed my car because of the program they were having, USED CARS UNDER 50,000 MILES!!!
