On my credit reports it is still reporting that I have this open balance there is another amount of {$4800.00} from Kia as well showing on my reports. Ive had 3 leases with Kia and the only current correct one is may of 2019 for {$21000.00} having 3 Kia accounts reporting balances increases my debt which is wrong.

I was very happy my XXXX was the maker of the car Kia Motors Finace. Well XXXX, XXXX, XXXX a tragic event happened in my life and, our house caught fire. Evberything we had was lost encluding my brand new car that was in the gargage at the time of the fire. Our home was a two story home, so everything on the bottom story off the home was burnt encluding the gragagr as, thats where the fire took place it was a bad water heater, that exploded the landlord, never replaced the water heater the whole three years we lived there, and we were going to buy this home as, soon as, our lease was up. any how we have been trumatized we lost everything. All our things nothing was saveable. In the mean time I started the claim right away in fact Kia Motor finance started working with my Insurance XXXX right away cause I lost allo the paperwork in the house fire everyone was so helpful. I had full coverage Insurance Gap two extended warrantys on this car, we all agreed on this on a conference call if Kia Motors will look back at there calls. The loan was for XXXX at the time of the purchase that is what was financed to me in XX/XX/XXXX when the insurance and, gap plus the payments I made from XX/XX/XXXX IN THE AMOUNT OF XXXX you would think the car would be paid in clear,, nope I get a statement in the mail stating I owe Kia Motors Finance XXXX then the lady I spoke to was lieing about me having any warrantys cause at this point I told her why werent the warrantys appied there should be a credit balance thats what I was told when I spoke to Kia Motor Finance in XXXX on the XXXX, XXXX when we had a three way with my insurance. She told me owe sorry I found them but, you got to cancel them I canceled them when the fire happened back in XXXX when I filed a claim with everyone, I told the dealer to cancel them when I replaced the car after the fire. This car should actully be paid off without the warrantys even being applied. GREEDY PEOPLE PERIOD -- -- -- -- -- why did Gap only pay XXXX when my car insurance paid above the acv value? XXXX I never missed one payment the time I had the car not one. I even always paid extra on some payments. I just lost everything my home everything I own I have exhusted my accounts, to try and, live I live in a one bedroon right now with maybe a weeks worth of outfits, and underwhere but, you want XXXX, XXXX when I had two warrantys that were for XXXX and, XXXX that where never even used, and I only had the car not even 9 months with less then XXXX miles on it at the time of loss. This is insane that car is paid it was paid before you even got the warranty money.

Complaint: My leased XXXX XXXX XXXX was involved in a total loss accident. My insurance company XXXX got all the paperwork together and sent all necessary documents to Hyundai Finance who manages my lease. The accident occurred on XX/XX/XXXX and the paperwork was submitted on XX/XX/XXXX. Despite 5 phone calls and numerous emails, Hyundai Finance is refusing to supply XXXX Insurance with the letter of guaranty and copy of title. I received a letter from Hyundai Finance on XX/XX/XXXX stating that " monthly payments are not required after the date of loss '' but I'm still getting billed by Hyundai Finance to make lease payments. After calling twice to Hyundai Finance and speaking to two supervisors on XX/XX/XXXX, they hung up on me after promising to " escalate '' the situation and look into the matter. The first supervisor 's name is XXXX XXXX XXXX employee id XXXX - he refused to give his last name ) and the second supervisor did not give his name. They have no explanation for why they aren't sending the requested documents to my insurance company, and meanwhile, I'm being charged to pay for a lease on a totaled car that I'm not driving. When I ask Hyundai Finance why the requested documents haven't been sent and if I can speak to someone in their department, their response is " all we can do is send them an email request and there is no to physically speak to. '' After I called the number at the bottom of the attached letter, the supervisor said he was going to look into my account and ended up hanging on me. I feel there is definite fraud going on here. They won't send the documents to my XXXX insurance company so they can get paid the car value check, and they won't close my account. Meanwhile, I'm still being billed for payments and having my credit report threatened even as they send me correspondence saying I don't have to make any further payments. Please help! I just want Hyundai Finance to send over the letter of guaranty and close out my account. My complaint is with Hyundai Finance who seem to be behaving in a fraudulent manner. Complaint: 2016 Hyundai leased through Hyundai Finance was involved in an accident in XX/XX/XXXX. It was declared a total loss by the insurance company, who sent a check for the total cash value of the vehicle, less a {$500.00} deductible as expected. All Hyundai leases include gap insurance that is advertised to cover the difference between the value of the insurance settlement and the payoff amount, including the insurance deductible up to {$1000.00}. XXXX XXXX XXXX offers a description of the coverage. I had also made the lease payment for the month of XXXX prior to the date of vehicle loss, and am expecting that to be refunded. I received a letter in XX/XX/XXXX with a summary indicating that I was liable for the {$500.00} deductible. I called Hyundai Finance asking for an explanation why they charged me for deductible since it is covered by their gap insurance. They said they would get back to me with an explanation. I did not receive any correspondence or calls since then and assumed it was settled. Today I noticed a decrease in my credit score. I pulled copies of my reports and found that Hyundai Finance had listed this lease account as closed with a {$290.00} charge off. The account should be credited for the {$500.00} deductible and the {$200.00} over payment refunded to me. The false charge off needs to be removed from my credit reports. Complaint: I got a letter from XXXX XXXX telling me that I owe a balance with Kia Motors. I was very confused because this car was totaled out due to an accident and the loan had gap insurance. I reached out to XXXX XXXX, to see if they could prove me information on the account but they couldn't. All I was told by XXXX XXXX that he wanted XXXX a month for the payment plan and if I didn't agree to that then they were going to garnish my account on Thursday of this week. I can't afford that, I'm on social security and XXXX. XXXX XXXX was cruel and very mean. I hung upon him. I called my daughter and asked her to find out what was going on with this debt. She tried to contact them and got XXXX XXXX and he told her that she had to pay XXXX per month for the payment plan or they were going to just start garnishing her too. I just got the notification, how did I get sue on this account. The abuse I'm getting from this collector is ridiculous, over a XXXX debt, that I was told by the insurance company was paid off.

Complaint: Kia Motor Finance had an advertised finance special of {$1500.00} cash back and 2.9 % interest for 60 months with no down payment required. On XX/XX/XXXX, I purchased a 2020 XXXX XXXX from XXXX XXXX in XXXX, TX. The credit report showed that my score was at least an XXXX but I didn't receive the advertised interest rate, the rate I received was 3.9 %. When I questioned the general manager ( XXXX XXXX ) which is who processed my application his response was they just put the information in the computer and that's what it showed on Kia Motor Finance. I called back on XX/XX/XXXX to see if he could provide any explanation as to why I didn't qualify for the advertised rate was told he would reach out to Kia Motor Finance but I haven't heard anything back as of XX/XX/XXXX. On XX/XX/XXXX I contacted Kia Motor Finance to see if they could provide an explanation for me not getting the advertised rate and the response received is that it is up to the dealer ( manually inputted ) and any correction would have to come from the dealer through an updated contract. On XX/XX/XXXX I called the dealer back to follow up on my request for an explanation for the rate I received but haven't heard anything back. Know one seems to know and each side is saying it was out of their hands.

I have never been late and attempted to correct this information by sending Kia Motor Finance two letters on XX/XX/XXXX and XX/XX/XXXX disputing this information as inaccurate. Kia removed the XX/XX/XXXX late payment but states that the XX/XX/XXXX is being reported as accurate and refuses to remove the incorrect information. I also provided Kia with a copy of my payment history from their website with both letters and they still will not remove the incorrect information.

I have been trying to get the company to send the money back for about a month now. The company owes me {$330.00}, and I have no idea if or when I will receive the money back. Several representatives claim a check will be sent " Soon ''. I can never contact the company. The phone system is specifically designed to prevent reaching an agent. It is cyclical, and often it just says " Goodbye '' for no reason. Often when transferring to an agent, it states " Call back later ''.

Complaint: I leased a XXXX XXXX XXXX in beginning XXXX of XXXX. I made 36 timely lease payments for {$450.00} due on the XXXX of every month. All 36 lease payments were made on time. The last lease payment which was due on XX/XX/XXXX was paid on XX/XX/XXXX. Technically I had until XX/XX/XXXX to turn in the car but I turned it in early on XX/XX/XXXX. There was a disposition fee of {$400.00} due 60 days after your official turn in date which was XX/XX/XXXX. On XX/XX/XXXX I received a letter from Hyundai ( see attached letter and for other info ) saying that I owed {$400.00} for the disposition fee plus {$680.00} for wear and tear and {$75.00} for taxes. All totaling {$1100.00}. I sent the letter back saying that I was disputing the wear and tear fee for now but I will pay the {$400.00} disposition fee. Sometime in XXXX I received a call from Hyundai Recovery Department asking if I was going to pay the {$1100.00} and that I only had until XX/XX/XXXX before it was considered late. I said that is wrong because officially I should have until XX/XX/XXXX. Hyundai was penalizing me on the time because I turned the car in early. On XX/XX/XXXX I called and paid to a Hyundai Representative over the phone {$400.00} out of my checking account for the disposition fee. ( see confirmation number ) Hyundai asked for the balance but I said it was being disputed. We went back and forth over the month of XXXX and finally on XX/XX/XXXX we settled for the amount of {$430.00} because they had over charged me ( see attached letter and payment ). About a week later I get a call from Hyundai saying that I still owed {$100.00} for the balance due and I said no that is wrong, please listen to the recorded tapes and notes. They checked them and found out I was right and they said they would make the adjustment. My wife and I are applying for a home mortgage and when we checked our credit scores they when from around a pristine 800-825 credit score for both of us down to the mid to high 600 's. The reason being is that not only did Hyundai report to the credit bureaus ( XXXX, XXXX & XXXX ) the {$100.00} as a charge off, which it wasn't, they also said we had a late payment of over 60 days which is not true. When you are disputing a charge with a company, that is NOT a lease payment, ( as stated before all lease payments were made on time ) and they were wrong on the amount they wanted charge me, and you settle for an agreed amount, that should not be counted as a late charge. It was in dispute! Over decades, my wife XXXX XXXX and I have had a perfect credit and credit scores and we have always without exception have made on time payments. I called the Hyundai Recovery Department to straighten out the {$100.00} charge off reporting error and the late payment situation. They said they would clear up the {$100.00} charge off part but that I would have to write Hyundai customer service to dispute the late fee situation with the credit bureaus. ( see attached letter ) I sent a letter to Hyundai on XX/XX/XXXX explaining the situation asking to please remove the late remarks. I have heard nothing from Hyundai about removing the late fee remarks and the {$100.00} still shows as a charge of on our credit reports.

Complaint: I have filed a complaint before back in XX/XX/XXXX about Kia Motors Finance. After I filed that complaint the company took the negative marks off and even the debt itself like they said they were. Well they putt is back on in XX/XX/XXXX and this time they put that it was 30-59 days late in XX/XX/XXXX and them 60-89 days late in XX/XX/XXXX on my XXXX report. On the XXXX report they have reported closed and charged off as bad debt. On XXXX, they reported closed deragatory charge off. Those late payments and bad remarks have caused my credit score to go down over 150 points. I spent over three years to get my credit score over 800 and now it is XXXX. I am hurt because credit is everything and you cant do nothing without it. I had to once again put my home improvement project on hold because of the bad hard hit to my credit by Kia Motors Finance. When I reached out to them they told me that because the payment was due on the XX/XX/XXXX of the month and I paid it on the 1st cause them to report 30-59 day and 60-89 days late on my credit and that is so wrong and messed up on so many levels. I did not ask for my car to be stolen or anything to this nature but Kia Motors Finance is making it their priority to hurt my credit and I have been sticking to the payment plan that they gave me. I started with XXXX and now the balance is XXXX but they still feel the need to hurt my credit while I sticking to the payment plan. I know everything has policies and procedures but my car being stolen out of my driveway was very unexpected and i didnt have XXXX laying around to pay in full. That is why I put myself on a payment plan with them. Every time I call them its new information given to me and new things they keep telling me that I never knew in the beginning. The car was stolen in XX/XX/XXXX and I am still dealing with this and its like Im still getting punished for something that was beyond my control. Now when I ask them why did they put it back on my credit after they took it off and they could not tell me why. I am really sick of this. The next payment of XXXX is due on the XXXX. I am not trying to get out of paying. I just want them to report what is correct and have a little XXXX for people that this happens to cause we dont ask for this to happen to us at all.

Complaint: Good afternoon, In XX/XX/XXXX I leased a XXXX XXXX XXXX, in XX/XX/XXXX, XXXX months before my lease was up I was notified by the dealership that I could turn in my lease early, if I was interested in leasing another vehicle. I went to the dealership, turned in my leased vehicle, and did a new lease on a XXXX XXXX XXXX. When I first least the car, in XXXX, I was called back into the finance office, as they stated there was a problem with my lease, I re-signed new paperwork, and never looked at the lease again. XXXX XXXX XXXX, when I did the new lease, again, I was called XXXX weeks later in XX/XX/XXXX, as there was a problem with my lease paperwork, I went back in and re-signed paperwork again. Approximately XX/XX/XXXX I was notified By XXXX XXXX XXXX XXXX, that XXXX XXXX over {$3000.00} in excess mileage for my lease. I specifically, asked for, demanded, a XXXX-year, XXXX mile per year lease, this is the XXXX lease that I have had over the past XXXX years, I have never had anything lower than XXXX miles per year. The dealership is now stating that that is not what I signed, I am working with Hyundai Motor finance. XXXX, who have a greed to deduct half the charge as I have done my due diligence with proof of photographs from the day I purchased the car, my dollar amount per month with the added dollar amount for extra miles, however, the dealership is absolutely unwilling to work with me. In addition, today I went to the dealership as I was promised a three-year maintenance service contract with the new car, and came to find out today that there is no service contract on my paperwork, again, I was lied to by my sales person/finance manager Hyundai Motor finance. corporation has an open case pending, and recently sent us to collections, my father, was a cosigner on the first lease they have threatened to take our homes if we do not make this payment. I would have made the payment, if I had all signed up for XXXX miles a year, the sales person lied, the finance manager lied, in both instances and they are not willing to except responsibility. I need some assistance in trying to sort this out Hopefully without obtaining an attorney, or blasting them on social media, yelp, the Better Business Bureau, I am beyond frustrated and need some assistance.

Complaint: The total balance of {$4900.00} of the remaining loan on the vehicle was paid off on XX/XX/XXXX to Kia Finance. I was told that I would receive the title to the vehicle within 2-3 weeks, and I have yet to receive the title. I have called about three to four times between XX/XX/XXXX and the first week of XX/XX/XXXX. The first time I called in XX/XX/XXXX, I was told by a customer service representative that Kia Finance had sent the DMV notice that the loan had been paid off and that the title should be transferred to my name. The second time I called, I was told the same thing and told to contact the DMV. In early XX/XX/XXXX, I contacted the DMV and was told that Kia Finance never sent notice that the loan had been paid off. I then called Kia Finance again and was told that the DMV was refusing to release the titles because Kia Finance owes the DMV fees or taxes. Kia Finance lied on multiple occasions by telling me that I would get the title to my vehicle within a few weeks and is refusing to do what needs to be done on their end so I can obtain the title to my vehicle which is completely paid off.

Complaint: Wife and I are XXXX XXXX military and both received orders from Texas to XXXX. We have two vehicles financed through Kia Financed. We requested permission to ship vehicles to XXXX XXXX XXXX for the duration of our assignment ( 3 years ). Immediately we ran into issues with customer service giving us bad information. We were told to send approximetly 10 documents to include their Vehicle Transport Checklist with our miltiary orders, insurance, etc ... However, they lost the documents on three occassions, and gave us incorrect fax numbers for submission of three occassions. We were able to get one vehicle shipped through pure luck. However, the other vehicle is in XXXX at a storage facility as we can't legally ship untily they give the approval. I called them again a few days ago and the customer services rep was unable to give me any information on the where the approval letter is or what we need to do for approval. At the end of the day we have one vehicle sitting in XXXX, and we're renting a vehicle in XXXX to get to and from work while serving an assignment in XXXX. Kia is horrible at getting us answers. The office responisble in processing the application has no ability to receive calls form the customer, and more concerning, is the customer service rep we do call at KIA, is unable to cal them or message them as well.

Complaint: XX/XX/ To Whom It May Concern : My wife and I are senior citizens who reside in XXXX, Virginia, and who drove our XXXX leased XXXX XXXX to XXXX XXXX, Utah, last winter on vacation. While there, we decided to turn in our leased vehicle ( which was under mileage ) and replace it with a new XXXX XXXX XXXX XXXX. The dealership ( lessor ) was XXXX XXXX of XXXX XXXX XXXX, XXXX XXXX, Utah. At lease signing we paid {$11000.00} to XXXX XXXX for the residual fee on the old car and the down payment on the new model. Our new monthly payment was negotiated at {$310.00} for 35 months, to be paid to Hyundai Finance on the XX/XX/XXXX of each month beginning in XX/XX/XXXX. I can provide a copy of the lease agreement and all further documentation as requested. When we returned to Virginia, we also paid the necessary state taxes on the new lease. Following the submission of our XX/XX/XXXX invoice we began receiving letters and phone calls from Hyundai Finance that they were not receiving payments on our new car, nor had they received the residual balance on the old car. I have called the dealership multiple times since XXXX when I first began to get the phone calls and correspondence from Hyundai Finance. My wife and I have personally spoken to the General Manager, the Salesman who arranged the lease, and the Finance Manager at the dealership multiple times over the past six months ; all who have repeatedly reassured us that the problem has been resolved, explaining to me it was a miscommunication between their dealership and Hyundai Finance. And yet EVERY MONTH, and again this XX/XX/XXXX, we continue to receive phone calls and letters from Hyundai Finance telling me my account is in arrears, and who are now accruing interest to what they say are our post-due payments! I have also personally replied via phone calls on multiple occasions with the operators at Hyundai Finance and have discovered that our payments have been credited to our old account ( the XXXX XXXX ) which, to my understanding has not, to date, been closed out, and not credited to the new account ( XXXX XXXXXXXX XXXX XXXX ). However, the miscommunication persists, with no resolution from either the dealership ( who has told me the matter has been handled ) nor from Hyundai Finance to the point where I am now receiving phone calls from collection agencies hired by Hyundai Finance to collect on what they insist is my past-due account! In my last phone call with the Hyundai Finance accounts receivables department, XX/XX/XXXX, I requested a copy of all my payment history to date to be sent to me from Hyundai Finance. After that request, I was told by the clerk that if I would just start submitting hand-written checks as opposed to on-line payments through my bank, that maybe the problem could be resolved!!!!!!! This has ended any further correspondence I will ever have with Hyundai Finance or their agencies. I have spoken with my attorney and my banker at the XXXX XXXX regarding this matter. XXXX XXXX, who has paid all monthly payments to Hyundai Finance since I leased the car ( based on my on-line bill-pay instructions ) and who has provided me all the documentation of my transactions with Hyundai Finance detailing each monthly payment, the correct address of Hyundai Finance, the date the payment was deducted from my account, the date the payment was received at Hyundai Finance and the correct Hyundai account number written in the payments memo column. Both my attorney and my banker have advised me to contact you, as well as the California AGs office and the XXXX XXXX XXXX to communicate the incompetence and on-going pestering and abuse which has escalated over the past six months. At this point, I do not believe I am capable to solve this issue on my own without your professional assistance. Many thanks in advance for what you can do to bring about a satisfactory resolution.
