Complaint: I am writing to dispute the reporting by HMF to XXXX of my liability for a late payment from XX/XX/2019. I will simultaneously be reporting this to the HMF and XXXX for further review. Grievance. 1. I allege my ex-wife fraudulently processed a chargeback on prior payments made on my lease to HMF. Upon learning this, HMF indicated that their systems had me requesting the chargeback, to which I replied with the allegation. I further asked that they respond to the chargeback dispute inquiry with XXXX to affirm the payment was legitimate. They refused. I was unsuccessful in convincing my ex-wife to make the payments and so they were two months behind with no warning. 2. When I began receiving calls from collections, I also offered to furnish evidence of the fraudulent chargeback. On XX/XX/XXXX, HMF collections called me with indicating that if I didn't make a payment that day, there would be negative reporting on my credit because we were " at the 40-day mark. I went ahead and MADE A PAYMENT THAT SAME DAY, XX/XX/XXXX. Because I was told this payment would avoid negative reporting, I am here alleging erroneous late payment reporting by HMF inconsistent with their own internal procedures and external communications to me. If they are exempt from disputing the chargeback, they most certainly should be held accountable for the communication regarding credit. There is more context to the situation that HMF is aware of and avoided answering the substantive issues above in complaint XXXX. Simply reviewing the payment record without listening to the recording of the collections conversation misses this vital communication, even if claimed as agent error ex post facto. It costs you nothing, HMF, to correct this error in your reporting. It most definitely costs you a customer if you refuse to correct the error. It shouldn't be my credit, in the meantime, that is the only thing impacted. There is an easy and just fix to this well within your power to redress. The software below is not processing attachments. Complaint: On XX/XX/XXXX co-signed loan on car with daughter. Vehicle was financed through KIA Finance USA for a total finance of {$28000.00}. In XX/XX/XXXX, while parked, in driveway the vehicle was totaled by XXXX the insurance company that I had insurance on through at the time. Before the vehicle was totaled, there were a total of nineteen ( 19 ) payments made. Seventeen ( 17 ) payments at {$550.00} a month totaling {$9300.00}. OnXXXX ( 1 ) payment made for {$550.00} and one payment made for {$560.00}. This was what was quoted to me on XX/XX/XXXX by a worker at the customer information center at KIA motors finance USA. I did not write down her name. I also asked that same customer service rep at KIA motors finance how much did XXXX pay when the car was totaled? She answered {$14000.00}. I asked how much did the GAP insurance pay? She answered : {$6700.00}. KIA motors finance also received refund of extended warranty of {$610.00}. That comes to a total of {$32000.00}. The total amount financed according to the copy of the contract that I have says {$28000.00}. Subtracting total payments made, insurance payoff, GAP insurance payoff and the refund of the remaining warranty shows a difference of {$3700.00} positive or extra monies that KIA motors finance received. KIA Motors finance USA is still showing I owe {$1300.00} on my credit reports. I say KIA Motors Finance USA owes me the overpayment of {$3700.00}. KIA Motors Finance USA has sent to several collection agencies for the amount of {$1300.00} and it needs to be removed from my credit reports because it is showing as negative credit on my credit reports. The KIA MOTORS FINANCE ACCT IS : XXXX. The contract date was : XX/XX/XXXX through XXXX XXXX XXXX XXXX XXXX XXXX now known as KIA of XXXX XXXX , Florida .

Complaint: XX/XX/XXXX My father passed away a resident of Florida. I am his daughter and the personal representative of his estate. I live in Pennsylvania. He had a leased XXXX XXXX XXXX. The term of the lease ends XX/XX/XXXX. I called the Kia dealership shortly after his death to obtain options for returning the car and learned that the overall cost of returning the car could not be determined but was likely to be more than keeping it for the rest of the lease term. I continued making the monthly payments on time. XX/XX/XXXX The estate is running out of money, and I was in Florida taking care of estate matters so I contacted Kia Motors Finance to arrange to return the car. I spoke to XXXX who was difficult to communicate with because she spoke poor English. She told me that someone from their deceased dept. would call me in 3 - 5 business days, and I could not return the car until they call. I told her that I would not be in Florida in 3 - 5 business days and asked to speak to someone in the deceased dept. She said no. I had to wait for them to call me. I told her I would not be back in Florida until XXXX and asked if I could return the car to a local dealership. She told me that, if I did, no one would be responsible for it. XX/XX/XXXX Still no contact from the deceased dept. I again called customer service and spoke to XXXX who told me that no one from their company would ever contact me until they had my father 's death certificate and letters from the Court evidencing my appointment as the personal representative ( something that XXXX never mentioned nor requested ). I faxed the documents to their back office as instructed with correspondence telling the story and again requesting a response. XX/XX/XXXX Received no response to my faxed letter of XX/XX/XXXX. Called and spoke to XXXX who told me that the car can be returned to any Kia dealership. She transferred me to XXXX of their Lease End Dept. for more specifics about returning the car. He was very nice and helpful. He gave me the name of the dealership in XXXX where XXXX bought the car and instructions for returning it. He told me that if we return the car with payments owing, we must pay the remaining payments plus a {$400.00} disposition fee. I was told that the remaining payments are {$850.00}. He also said that, if we sell the car, we do not have to pay the {$400.00} disposition fee. He also said that, if we make all of the payments under the lease, there will be no disposition fee. I asked XXXX for the amount to be paid, and he told me {$15000.00} payoff, made up of {$14000.00} payoff plus the {$850.00}. He told me I had to speak to the billing dept., so he transferred me to XXXX who was not at all nice. Ultimately, she told me that we owed payments of {$190.00} for XXXX through XXXX ( 5 mos. @ $ XXXX. ) plus {$45.00} for overdraft ( closing of Dads XXXX account ) and {$18.00} of late fees for a total of {$1000.00}. XX/XX/XXXX I intended to pay the {$1000.00} now to bring the account up to date so I can surrender the car on XX/XX/XXXX and owe nothing more, subject to the inspection and mileage requirements. However, I had not gotten anything in writing ; and I did not trust them because in every call Ive made so far Ive gotten different information. I also received a notice in the mail from the collections dept. with conflicting amounts. So I called the number on the notice and spoke to XXXX who spoke poor English and whom I could barely hear. I was on the phone for almost an hour with her. I asked for someone who could speak English, I asked for a supervisor, and I asked her to speak up more times than I can count ; but everyone else was busy. Initially, she confirmed the {$1000.00} ; but when I asked for it in writing ( the whole purpose of my call in the first place ), she had to request it to be faxed to me in 24 hours - 48 hours at most. Since no one at Kia has responded to me at all since I called on XX/XX/XXXX, I fully expected that I would not be receiving this fax ; so I went through the numbers with her again to make sure I was paying the correct amount. This time, she came up with an amount of {$1200.00}. I asked and asked what the difference between the {$1200.00} and {$1000.00} was, and she would not tell me. She said I had to speak with the Lease End Dept. and gave me a completely different number than the one I called before. I found out that it was because she gave me the number for customer service, not lease end. I spoke with XXXX ( XXXX ) XXXX of lease end who told that information I was given earlier was wrong and that the {$400.00} disposition fee is always owed if the car is turned back in to the dealership for any reason, plus {$36.00} of sales tax must be paid. ( That is 9 %, but Florida 's sales tax rate is only 7 %. ) She also told me that we must pay sales tax on the residuary value of the car if we turn it back in to the dealer, which will be another {$980.00} based on an estimated residual value of {$14000.00}. She told me to pay all sums under the lease ( other than the disposition fee ), we must pay {$860.00} which is calculated as follows : Lease payments XXXX NFS when account was closed XXXX Late fee XXXX Total XXXX I mailed a check the same day. XX/XX/XXXX I called Kia Finance again this morning because more than 48 hours has passed, and I have not received the promised fax from Kia Finance. I was on the phone for about an hour, and I received no help other than an offer to transfer me to another dept. to start all over. I called the Lease End Dept. at ( XXXX ) XXXX. I got a round of recordings asking me for all kinds of information and then a recording that started providing information I did not want. I pressed 0 to get to a human being. The call was transferred, I received another recording, got put on hold for 15 minutes, and then it cut me off. So I tried calling XXXX whom I was told on XXXX XXXX was in the Lease End Dept. He had given me his extension, so I was hoping to bypass all the recordings and get to a real person. There was no option to enter an extension. It was the same set of recordings and then XXXX, another rep. whose English was not great, who would do nothing for me. I begged and begged her to transfer me to her supervisor, but she ignored me and kept asking for information she should have already had. She said she had to review the account ; but when she did, she still had no information. She told me that she could not talk to me because I didnt have authority to talk about the account. I told her more than once that I had faxed a death certificate and copy of letters of administration to the back office and gave her all of the specifics ( fax number, date of fax, and confirmation from a previous rep. ) so she could see that they had the documents. After about a half hour, she finally agreed that she would find a supervisor. She put me on hold for a while and then came back and told me that the supervisor was busy. After all this nonsense, she asked me if I was waiting for a fax of payoff information! That was the first thing I asked for when this lengthy call started. However, she said the only thing she could do was to transfer me to customer service. I told I didnt want to start the whole process of making this request again because I was on the phone for hours, and no one from Kia Finance has ever done what they said they would. I asked XXXX for a telephone number for the president of Kia Finance, but she said they dont have it. I asked for any number for corporate or anyone who could help me, but she didnt have any. I asked for an e-mail address, and she said they dont have that either. I finally terminated the call in frustration. At this point, I dont know what else to do. I just received a monthly statement from Kia Finance dated XX/XX/XXXX addressed to my father at his home in Florida. I had given them my information on XX/XX/XXXX, and they are still sending correspondence to an empty house. It took 10 days for that statement to get to me, and they added charges that I must dispute. It's very difficult to lose a parent. For a company to treat a grieving child like this is unconscionable.

Complaint: My car was repossessed by Kia Finance on XX/XX/XXXX. When I learned of this, I called them to find out how much was needed to redeem the car. I got the figure and he told me that it would remain in XXXX Fl for at least a week. Maybe a week and a half. I proceeded to find the resources to pay. The money was received yesterday, XX/XX/XXXX, so I called to settle the balance. I was given the phone number to call to work on retrieving the car. XXXX told me they were sending the release to the vendor and give it about 30 minutes. I called the vendor to trying to arrange getting my car back. They would tell me nothing except that they had not received the release yet. That was close to the end of their business day so I knew there was nothing more I could do. I called that vendor again today, XX/XX/XXXX when they opened. I was told they dont have the release still but the car had been sent to the auction house on XX/XX/XXXX. That I would need to call XXXX back to find out who I needed to speak with next. They told me it is with XXXX XXXX and they gave me the number. They told me they had sent the release to XXXX and give it XXXX minutes. I waited the 30 minutes and called XXXX. They told me they do not have the release but they also dont have the car yet .... which does not make sense if it was transported on XX/XX/XXXX. Which of course is not even a week by the way. They would not tell me anything more besides call XXXX again. So, I call XXXX again and they tell me they sent the release to XXXX on XX/XX/XXXX after The other vendor emailed back that the car was already gone. They told me they would send the release, by my count a third time. I tried to get them to do a three way call to try to figure this all out. The XXXX rep refused. I asked for a supervisor. I was told the supervisor would tell me the same thing. I pressed that I get connected with a supervisor. I was transferred to a voicemail box instead of a person. While waiting for the returned call, I called XXXX to see if any of the releases were received yet. Again, I was told no. I asked them to do a conference call with me with XXXX and they refused. I was told to call back tomorrow morning to try again. Through this process, I have been lied to from all parties. I have apparently only dealt with people who are unable to complete their job properly. I have been given the run around. I understand I did have payment problems that caused this initially. I own that. I have owned that in every conversation Ive had. But all three companies are being deceptive and provided unfair treatment as I have tried to resolve this issue. I managed to learn the city in which the car will be, which is over 4 hours away. And their hours on Fridays are only 9-1. So even IF I can get somebody to respond and acknowledge I fulfilled my obligation, the car will sit at least the three more days. At this point, I feel they are purposely trying to make this process go fully through auction instead of helping me resolve this. Going in, I knew there would be daily storage fees and Im sure a tow fee. But, now there are unnecessary transport fees that should not have occurred. There are going to be at least 3 more days of storage fees that should have been avoidable. And I see no way to even dispute this because NONE of the parties take responsibility to help or follow through. This process is deceptive and unfair to the consumer. I was clear with XXXX that I intended to redeem the vehicle. Yet they either accelerated the process to go to auction our willingly allow their vendors to make these calculated moves to increase the fees I will be required to pay.

Complaint: There's a due process system which this country title court proceedings in this case. However the courtsystem in XXXX; hasn't been just Or fair for all persons. Kia motors and Hyundai are two separate entities. My contract is only binding to Kia Motors and no others. XXXX XXXX XXXX still remains within the parameters of her contract with Kia.... The vehicle defectiveness and maintenance problem should be repaired by Kia Motors in XXXX.1) due to warranty obligations2) because that's the contract enter in3) all complaints hasn't been repaired4) retaliation due to the complaints do not justify the removal of the vehicle from the XXXX parking lot unjustly. XXXX XXXX and XXXX XXXX aren't representative of Kia. No default has occurred since the purchase. Why do we have unauthorized personnel driving the vehicle; has it been repurchase since XX/XX/2019? No; if yes then I do not have any further obligation to Kia or the vehicle. As veteran and retiree I reserve the right to express and voice consumer issues as they pertain to safety, effectiveness and efficiency !!!Consumer problem with maintenance and high attention to detail.. Still under maintenance contract...The vehicle still has not work to my expectation especially as a brand new purchase.

Kia Motor Finance ( hereinafter " KMF '' ) knows the lease agreement of XX/XX/XXXX, is not valid. Please see my attached fax of XX/XX/XXXX, to KMF. 3. However, KMF committed many crimes to enforce the invalid lease. 4. Furthermore, KMF reported fraudulent information to all the credit reporting agencies and severely damaged my credit score. 5. Complaint: I paid off my lease in XXXX of 2017. At that time I faxed the odometer reading and bill of sale. I contacted them a few months later and they indicted they never received either so I faxed them again. Since then, I honestly didn't think about it until the beginning of this year as I am looking to purchase a new car. I contacted Kia Finance at the beginning of this year and they indicated they received an odometer reading but not a bill of sale. Since my initial call this year, I have sent them both the odometer reading and bill of sale 4 times. The first 2 were regular mail, the third was 2 day priority and the 4th was certified mail and returned with a signature. I have called numerous times and each time, they indicate they haven't received the bill of sale and can't release my title. I have begged them for help asking if I can send to someone directly that can be accountable for getting it processed, they indicated no. I asked to talk to the title department and customer said they didn't even have a phone number or contact in the title department that they could only contact them through their internal communication system. I even asked who their CEO was so I could contact them directly and customer service told me they weren't allowed to give out that information. This has effected me both emotionally and financially. I missed out on end of month deals on other cars because I did not have my title. I have cried out of frustration while on the phone with customer service reps. There is no option other than to keep resending the same information hoping that someone will do the right thing.

Complaint: I was attempting to buy a Kia XXXX at XXXX XXXX XXXX in XXXX XXXX, MD on XX/XX/2019. We had agreed on a price of {$20000.00} with a loan amount of {$18000.00} ( after a {$2000.00} down payment ). My husband and I both filled out the credit application. The dealer contacted us soon after our credit application was filed demanding more paperwork from my husband- pay stubs, proof of employment, questions about his recent immigration status and our marriage. The dealer said they could not confirm his new temporary social security number. We told the dealer that my husband had legally obtained and used his social security number to find employment and obtain a driver 's license. Finally the dealer agreed that they had enough information and were going to go ahead with the loan. I was doing a final inspection of the car outside of the dealer 's office for about 5 minutes while my husband stayed inside speaking with the dealer. When I returned the dealer had changed the conditions of the deal demanding more documents and stating we would not be able to get the car loan until we provided the extra documents. With this change in the deal and the apparent interrogation of my husband while I was outside, resulted in us withdrawing our credit application and not buying the car. We perceived the dealer as XXXX or XXXX. Regardless, I received a letter from Kia Motors Finance dated XX/XX/2019 that stated I was denied credit, despite my withdraw of my application and credit score of XXXX! On XX/XX/2019 I successfully obtained credit through XXXX financing for a car loan for {$17000.00}. I believe the dealer did not withdraw my credit application and Kia Motors Financing subsequently denied my credit, potentially affecting my future credit.

Complaint: After the lease ended, we decided to purchase the car. We refinanced the car with our local credit union on XX/XX/2019. A few weeks later, the credit union reached out to say that they did not receive the title. I first reached out to Hyundai, on XX/XX/2019 via the internet. I was requested to follow up via the phone. I called XX/XX/2019 to ask about my title status. After being on hold for over 1/2 hour, I was told it was because the odometer statement was never submitted to them. ( They never sent an odometer statement in the first place. ) So they agreed to send it to be docusigned. The statement was signed and sent back to them. I called the following day to verify if they received the document. They told me that they couldn't verify it because it hadn't been three days yet, so to call back. At this time, I asked that the bill of sale be sent as well. They said that they could email that to me. I called back after 4 days ( I gave them an extra day ), They said that the document signed didn't work because they accidently clicked a box on the form that they sent me. ( There was no followup from the company to me to let me know this. ) The form was signed again and sent to Hyundai. We requested that they send the title and bill of sale at this time as well. They promised that the title would be released within a week and the bill of sale would be mailed and we would get it within 5-10 business days. We received the title release as of XX/XX/2019. We further waited the end of the 10 days, with no bill of sale from Hyundai. We called again and were told they would email it to us within 5 business days. At this time, we verified the email address again. 5 days has passed again and we have not received anything. We called again today and they said they would have it to us within 3 days. They received our payment at the beginning of XX/XX/2019. It has now been two months, of dealing with this company with no results. Within our state, we have 30 days to register and pay our sales taxes. I can not complete this without the bill of sale on the vehicle. That window of time has passed and every additional day we are charged interest and penalties on the taxes due. We ( my husband and I both ) have spent an exorbitant amount of time ( hours ) attempting to fix this and Hyundai seems largely unconcerned with helping us resolve this issue.
