Complaint: Dear Compliance Manager ; This is driving me crazy now. I was just reviewing my credit and i noticed a vehicle that I turned in back in XX/XX/XXXX and noticed a " Charge-Off '' status on my credit report from last month ( XX/XX/XXXX). It's impossible!!! I have a new lease with Kia Motor Finance back in XX/XX/XXXX when I turned it the old one ... I have NEVER in my life missed a car payment because it's a draft from my bank account. This is totally wrong and the way it's reporting on my credit is a total violation of fair credit reporting laws. I thought consumer was protected under FCRA to ensure that the accounts are reporting accurately, with no inconsistencies. This has to be a computer error ... No human can blatantly make this type of mistake. Look at my credit report!!! The other lease from XX/XX/XXXX should've been terminated and stop reporting since I turned in the vehicle back in XX/XX/XXXX and the payment of new vehicle should start then ... NO LATE PAYMENT and I don't owe {$440.00} to Kia for any vehicle. Please correct and investigate this account. I like dealing with KIA MOTOR so far, but now I'm thinking twice about moving forward with any future relationship with Kia or any other affiliated companies.

Complaint: We had a lease with Hyundai XXXX which was paid in full as of XX/XX/2019. After the car was returned we received a bill for over {$600.00} which included not only a lease end fee of {$400.00} but also a ridiculous charge for a small scratch which we were told by XXXX XXXX XXXX XXXX Pa that there would be no charge due to faulty equipment and the size of the scratch. Hyundai also owed us {$50.00} for a promotional test drive which we took in XXXX but was never received. Hyundai just opened that promotion again. The {$400.00} lease end fee was never explained to us by the XXXX XXXX salesperson, and in fact we had prior leased XXXX in which there was no lease end fee or other problems. We did initial the contract small print while signing the many documents so legally we owed this money and paid it. We sent a letter with the amount billed stating that our check for {$350.00}. ( {$400.00}. minus the {$50.00} owed by XXXX ) was the correct amount due as per XXXX XXXX and if cashed would be paid in full. Next, Hyundai sent us a bill for the difference of over {$300.00}. They failed to recognize our complaint about the scratch and after this a neck injury caused by the faulty equipment. The most important fact is we paid the erroneous balance to protect of near perfect credit rating. Hyundai failed to remove an amount due and it still appears on our credit rating and must be removed. We are seniors and worked our entire lives to have superb credit only to be damaged by an erroneous charge and claim.

Complaint: On XX/XX/2019 I was involved in a auto accident that totaled my vehicle as determined by my insurer XXXX XXXX XXXXXXXX XXXX XXXXXXXX. Kia Finance was sent a letter notifying them that XXXX would be paying off the balance of the loan. Kia Finance sent me an email notifying me that I did not need to make further payments on the account. I called Kia Finance to discuss the email I had received and they assured me that no derogatory information would be sent to the credit bureaus during this process. It is now XX/XX/2019 and XXXX has not paid Kia Finance and Kia Finance has reported a late payment to the credit bureaus dropping my credit score from XXXX to XXXX. There consumer relations group is worthless in trying to resolve the problem. My next step is to file a Federal Fair Credit Reporting Act Lawsuit against Kia Finance.

Complaint: I turned my lease in on XX/XX/2019. To the Hyundai dealer. On XX/XX/XXXX I sent the vehicle return receipt to Hyundai motor finance, XXXX XXXX XXXX XXXX XXXX XXXX, Ca XXXX, to request an abatement on the property tax I paid. I sent in the plate return receipt on XX/XX/2019, I have talked to 4 people since then on XX/XX/XXXX, XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX. They say they have all the paperwork but nothing is updated on the system for a refund. The last lady I spoke with XXXX was very rude. She said it can take months to get a refund. That is unacceptable. I do not know what else to do. Please help. The personal tax I paid was XXXX. I know I will only get part of that back. Thank you XXXX XXXX

Complaint: Back in XX/XX/2019, I got a call from This business with a man name XXXX on the phone. Calling about debt with Kia for a car I co-signed with my son. He went on to explain to me since I have a current car with Kia, they have offered a deal. A deal of XXXX instead of the full almost XXXX I explain to him I did not have that amount on me. He asked if I could pay 10 % then they would lease XXXX I would only have a balance of XXXX. I did not have the money then. I told him that the day wasn't a good day for me. My father had a XXXX XXXX and XXXX. He went on to tell me how I did not want to look as if I was refusing to pay and then it would hurt my credit. He goes on to offer a monthly payment plan he lowered it to XXXX and once the XXXX another XXXX would be reduced since I'm paying my current Kia account on time. I said ok it would hurt me but once I made the XXXX I'm good and I can then chip away at the XXXX. I requested proof to be mailed to me. Made XX/XX/XXXX and XX/XX/XXXX payment. Today XX/XX/XXXX something isn't feeling right to me about the payment plan, other than I have no money after making the payment. I called today and spoke with XXXX ( XXXX is no longer with the company ) she tells me she doesn't see the offer. she does see where the company offered the XXXX but nothing about the XXXX in payments it would reduce it more. That I did not have a set time to pay this amount. XXXX also wanted me to pay with a portion of my tax return. ( I don't even get refunds ). Everything he told me was a lie ; I was thinking about making these payments I could have less debt reporting on my credit report and pay that large amount down. so I stopped paying other debts to take care of these. This is why I don't answer unknown numbers. I feel like he took advantage of me during a time my father was sick and I was there, and me not trying to be rude.

Complaint: On my credit report Kia finance reported a late payment in XX/XX/2019 as well as XX/XX/2019. Neither of those months I was late. I contacted the company in XX/XX/XXXX about setting up an auto pay. XX/XX/XXXX the auto payments began. I asked over the phone in XX/XX/XXXXif missing XX/XX/XXXX would be ok, or effect anything and she told me no. Ive contacted Kia and they reported the only way to resolve this matter is submitting a written request. I submitted but was told it usually takes up to 30 days processing time. I also contacted the company back in XX/XX/XXXX to ask why and was given money back, as well as hung up on by multiple representatives. With no answers as to why they are saying Im late. And no answer why they gave me money back. When I was told to pay XX/XX/XXXX bill I paid it as soon as I found out. I was never contacted about a missed payment even though I had been to a Kia building to get service done I still was never told. My contact info was not up to date even though most companies verify up to date info when you call them. I was never late in either XX/XX/XXXX or XX/XX/XXXX. And this has negatively impacted my life through my credit score dropping dramatically.

I am not sure how this happened, I believe that I had made my payments to you when I received my statements. My only thought is that my monthly statement did not get to me, or the payment was not applied as fast as expected. I check my bank account and noticed that you deducted the money out of my checking account that on the month that you marked me late on my credit report.

Complaint: In XX/XX/XXXX, my XXXX XXXX XXXX was stolen over the holidays. I kept in touch with Kia Motor Finance throughout the entire ordeal to inform them that there would be a balancing remaining after the insurance and GAP mailed payments. The remaining balance was over {$13000.00} and I requested in writing a payment plan. I was given over the telephone a payment option of {$2100.00} per month for 6 months. I requested numerous times to speak to a supervisor so that I could make other reasonable payment arrangements so that my credit would not be damaged. Within a period of time, my account was charged off and reported negatively on my credit. As of XX/XX/XXXX, I initiated arbitration with Kia Motor Finance and XXXX XXXX. I was told that XXXX XXXX was collecting for Kia Motor Finance and the debt was not sold. XX/XX/XXXX, Kia Motor Finance did not answer to arbitration and XXXX XXXX sold the debt to XXXX XXXX XXXX. I was again informed that Kia did not sell the debt. XX/XX/XXXX, I received a call from XXXX XXXX XXXX XXXX inquiring about arbitration. I was informed by XXXX XXXX that his law firm was attempting to collect and he would ask his employer ( Kia Motors ) to delete the trade line from my credit report if I could pay at least half of the balance and make payments. What I was unaware of at the time, was that XXXX was also hired to collect on the balance. I decided to settle with XXXX on XX/XX/XXXX. I have attempted to make contact with Kia Motors Fiance to request that the trade line be deleted from my credit reports as I have settled and paid in full. I have already suffered from the affects of the negative reporting by Kia Motors Fiance and I have settled for the amount that Kia Motors authorized XXXX to offer.

Complaint: On XX/XX/XXXX, I leased a XXXX XXXX from XXXX XXXX XXXX, a local dealership. On XX/XX/XXXX, I was rear-ended by a third party driver. I always had maintained insurance required by the lease with XXXX, but a claim with XXXX was not necessary as the other driver and its insurance company XXXX admitted 100 % fault and agreed to pay for the damages. I soon called Hyundai Capital America ( dba Hyundai Motor Finance or HMF ) to report the accident and to assist HMF with making a claim with XXXX The HMF representative told me that HMF will take care of everything and that I would not need to do anything. I soon drove the car to a local body shop approved by XXXX to get the car repaired, but XXXX declared the vehicle a total loss. XXXX adjuster subsequently told me that HMF and XXXX had settled for the full payment of the vehicle and that the matter was closed. In late XXXX, XXXX, I received a surprising demand/collection letter, dated XX/XX/XXXX, from HMF ( attached ) stating that I owed HMF {$970.00} for prior damage/condition adjustment of the vehicle. HMF falsely claimed that there was an insurance deficiency of {$970.00} for condition adjustment, even though the lease agreement does not require for such payment by the lessee. HNFs claim is also flawed as it decided to deal directly with XXXX and exclude me from the settlement process. When I called HMF on XX/XX/XXXX to ask for a copy of the settlement agreement between HMF and XXXX, HMF refused to provide a copy. I had to call XXXX to obtain a copy of the settlement agreement ( see attached ). Section 25A of the lease agreement ( see attached ) states that the lease is terminated in the event of a Total Loss, and that the lessee would owe the Total Loss Early Termination Charge outlined in Section 22C. Section 25B states that if the lessee maintained the insurance required by the lease, HMF would waive the Total Loss Early Termination Charge, when HMF receives the insurance proceeds for the vehicles actual cash value. There is no dispute that the there was a Total Loss or that I maintained the insurance required by the lease. The only dispute raised by HMF is that I owed {$970.00} to HMF for condition adjustment. XXXX stated in its settlement summary with HMF that the amount of wear and tear/damage is consistent with its age. In HMFs settlement letter to XXXX dated XX/XX/XXXX, HMF agreed to an insurance payment of {$17000.00} from XXXX as the full proceeds of the insurance policy covering said vehicle. In the settlement summary between HMF and XXXX, the Actual Cash Value for the vehicle was shown as {$17000.00}, which HMF accepted as full proceeds of the insurance policy covering said vehicle. In many calls with HMF, I explained that I do not owe {$970.00} to HMF. HMF refused to listen and HMF has recently placed a negative credit information on my credit report with the major credit reporting agencies. I have always paid my lease payments on time.

Complaint: We began a lease with Kia Motor Finance with a first payment date of XX/XX/2019. Several days earlier we made our first payment and set the account up on auto withdrawal from our checking account thinking the first auto withdrawal would be XX/XX/19 because we had already made the XX/XX/XXXX payment. On XX/XX/XXXX, an additional {$470.00} was taken out of the account. I called customer service on XX/XX/XXXX and asked that the {$470.00} be refunded to me. I was advised that it would take approximately two weeks. When I did not receive the refund I called back on XX/XX/XXXX and was told that the check had just been cut and should arrive at my house at the end of the week. On Friday, XX/XX/XXXX I again called and spoke with a supervisor who advised me that the check had not been sent yet and that the right course of action was to stop payment and have it applied to my XX/XX/XXXX payment. I was told this would take 2-3 days to complete. On Monday XX/XX/XXXX, I called again and spoke to a supervisor that advised me that the notes showed the request had been sent and that by the time my payment was due on XX/XX/XXXX, I should see a credit on the account. On FridayXX/XX/XXXX I called back and was told that I had been lied to previously and that it takes 16 business days to have the payment stopped and applied to the account. My payment will be counted as late on XX/XX/XXXX and I will be assessed a fee. I have lost all confidence that anyone there can handle this request and feel as though I have been lied to in multiple occasions. Their internal systems prohibit any person to person contact between the customer service department and the payment processing department, so no individual human being can physically call someone to expedite the request. They simply submit and email to the payment department and hope and wait that someone handles it. Clearly they are not handling it.

Complaint: As of XX/XX/XXXX I had a past due balance of {$1200.00}. On XX/XX/XXXX, I contacted Hyundai Motor Finance to make a payment of {$630.00} XXXX plus processing ). While I was on the phone with Hyundai, a 3rd party provider working with the company proceeded to take possession of the vehicle. At that time I was still on the phone with Hyundai, and when I told the agent that I was no longer in possession I was told that they would no longer be able to take a payment through my past due balance and that I would have to contact their collections department. At that point I ended the call with Hyundai Motor Finance. On XX/XX/XXXX I contacted the collection department to reinstate my loan, at that time I was told that I had past due amount of {$1200.00} and that I would need to pay that amount plus repossession & processing fees before I could reinstate my loan and regain control of my vehicle. I proceed to set up two payment from two different accounts to pay the total amount due given to me of {$1200.00}. And at that point I was told that my loan was reinstated and that I would be able to pick up my vehicle from the lot. After that call I found out that the original payments of {$630.00} that I had called to schedule on XX/XX/XXXX had already been taken from my account and that as of XX/XX/XXXX my actual amount due was {$600.00} plus the cost of repossession instead of the {$1200.00} stated by the collections agent, in violation of the Fair Credit Practices Act. At that point I contacted Hyundai Motor Finance and was told that they would not be able to refund my payment as it was done with a debit card. I was then told to contact my bank to reverse the transaction with them instead. I proceeded to contact my bank who told me that they could not reverse the transaction until it had cleared with the bank, and that I should be speaking with Hyundai Motor Finance as this was an error on their part. I proceeded to call Hyundai back, and when I asked to speak with a manger to work to refund my payment I was told they were in training and could not speak with me. At that point the agent said there was not much more they could do and requested that I ended the call unless I had further questions. Due to the over payment to Hyundai Motor Finance my checking account balance as of XX/XX/XXXX was around {$19.00}. Due to this overcharge I am unable to report to work as of Thursday XXXX as I no longer have access to the funds required to cover the cost to get to work and I am forced to take a day off at a cost of {$350.00}. I will likely need to take the same on Friday with the same cost. If I am unable to have these funds refunded to me by Monday I will not have any more personal days available to be used with my employer and risk termination.

Complaint: The company I'm addressing is ( Kia Motors Finance ) On XX/XX/XXXX my XXXX XXXX XXXX engine shutdown as I was driving on the freeway.I didn't have any warning light such as the engine light come on it just started knocking and shut off. I had myself and my daughter in the car. The next day I had my car towed to downtown Kia in XXXX XXXX there was a recall on my vehicle that had to do with the catalytic converter which it states in the recall can cause engine failure Kia has various class action suits against them for this issue they kept my car for a little bit over a month they refused to fix it because they stated I didn't have proof of Maintenance receipts which I did show them what I had they didn't accept those then they tried to give me a deal stating they will take XXXX off repair of engie ... the engine cost {$6000.00} they tried to do this secretly via text after they said they weren't going to fix it. They stated the pictures that were taken of my vehicle they found sludge but refused to show me. I was unable to work for XXXX months I ended up having to get my car back from them and get it towed elsewhere because they threatened to start charging me storage fees. After about XXXX weeks my car was repossessed and now I have it on my credit report. They also did not fix the recall on the vehicle they did nothing for 2 months and now they sent me a letter stating that they're going to sell my vehicle I was going to trade my vehicle in however they put the full price of the XXXX XXXX XXXX on top of whatever the new vehicle was so I declined. I believe there was contractual fraudulent activity along with poor service. This situation created an extreme hardship for my family and I because I wasn't able to work even though my husband does we have XXXX kids and it cost us to almost be evicted during that time.

Complaint: The vehicle was at the creditor dealership getting maintenance. The mechanic left the oil cap off, causing the motor to seize. It was under their responsibility and will not claim it. They originally said they would take care of the loan. However after returning the car, they still reported it as a repossession and this is incorrect information as they assumed full responsibility. They will not return phone calls nor will they return emails.
