Managing the loan or lease

Vehicle loan or lease: Lease

Billing problem
Complaint: XXXX XXXX XXXX sent our end of lease statement to an old address. the only way I found out about it a few months later was a negative impact to my credit, which was otherwise excellent. I called the customer service in XX/XX/XXXX and spoke to a representative who took my new address in order to send the statement to me. On XX/XX/XXXX I called customer service since I had not received the statement and the customer service representative said that the information had been inputted incorrectly by the previous representative, which is why I had not received it. In the meantime my credit had decreased another 52 points due to their error. I wrote to the credit dispute department on that day, XX/XX/XXXX, appealing for my credit to be restored. I also made a payment toward the balance at that point. I heard back 4 weeks later that they had denied my appeal. On XX/XX/XXXX I reached out to customer service again, as I still had not received my end of lease statement. I found out at that point that making payments toward the balance was not mitigating the negative impact to my credit, so I paid in full. I wrote another appeal to XXXX XXXX XXXX XXXX Department to have my credit restored due to their mistake. They wrote back 4 weeks later again denying the appeal. I have yet to receive the statement, and have always paid every bill on time, but their negligence in not inputting the information correctly and getting me a copy of the statement prevented me from resolving this issue, and they are not taking responsibilty for it to date.

Problem with fees charged
Complaint: I submitted a complaint # XXXX on XX/XX/XXXX. Subsequently on XX/XX/XXXX I received a fax of notice of toll violation previously unreported to me by XXXX XXXX ( attached ). on XX/XX/XXXX I received a message from XXXX the manger I had been speaking to saying that per my instruction they received the notice of this violation but did not pay. She also informed me they would pay if they received another notice. I was able to reach her by telephone on XX/XX/XXXX. The recorded call call was around XXXX. I told XXXX that I was taking care of the violation per instruction of Delaware Dept of Transportation. I asked again why a notice dated XX/XX/XXXX took so long for them to receive and why I never got a copy. I also pointed out that this was a " Final Notice of Toll Violation. '' The notice she had faxed me on the next day 's violation was just a " Notice of Violation '', meaning there are at least two notices and perhaps an earlier notice before administrative charges accumulate of which I never received notification. the copy of the violation she had previously faxed me me was for {$54.00} but they paid {$91.00}. It is unknown to me whether they were issued a Final Notice invoice for {$91.00} or just paid the new total since they " received it after its due date. She had previously blamed these delays on the mail, but I was told that that the notices went from their office in XXXX XXXX, MD to XXXX to XXXX XXXX, TX and that is where they are marked " received ''. That is 4 weeks. Clearly the delays ware internal to them. She also told me that it took time for them to identify who the lease belonged to as the violation only lists the tag number. I was incredulous and asked if she really wanted to tell me that on a recorded line- that there was an arduous process to match my tag tag number with my identity. I asked if I could talk to her supervisor who could explain in detail this whole process and also explain why they quoted that paragraph in my lease as justification to pay a violation on my behalf without even notifying me, and she said there was no one else to speak with but her. I then informed her that I had filed a complaint with you and would wait until I heard something before I took additional action. She then threatened my credit- yes, on a recorded line. I responded that if that happened I would engage counsel. On Saturday, XX/XX/XXXX i received a letter ( attached ) form XXXX XXXX XXXX with a copy of this last notice in question. You can see it is marked " received " by them on XX/XX/XXXX. Interestingly they were able to mail this to me for me to take care of. I have no idea if this is because I told them not to pay it when I learned of it quite by accident o=r not. That said you can see that even on the back of this final notice there is a page which allows me to correct the mistake and pay the original toll- if XXXX XXXX had given me the chance. Again, all of these issues are the result of a faulty transponder. XXXX? Hyundai had no right to withhold these violations from me, pay violations with added administrative fees and then demand payment from me and threaten my credit. I hope you will act and resolve this on my behalf.

Complaint: This credit dispute is in regards of account number XXXX for a XXXX XXXX XXXX. This account was assigned to XXXX and XXXX XXXX. We created autopay so we would avoid any late payments. When autopay was set up they did not inform us about the last payment not being accepted by autopay. In which the last payment on XX/XX/2018 was missed. If this would have been stated, we would have made that payment to avoid any negative reports sent to the credit bureaus. During our account we have not missed any payments, so our history demonstrates that we had a good credit standing until the last payment.

Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: I have a problem with XXXX XXXX on our final bill. When I turned the car in, it was in perfect shape. I've always leased my cars ( 45 years ) and always turned them in in great shape. I've never been told I owe any thing for ware and tear. I was told by XXXX that I owed {$510.00} for ware and tear. They said I had an accident and I would have to send them the repair bill. It was repaired by a reputable company, so I sent them copies of the repair paperwork. They told me if I sent them the paperwork they would adjust the final bill. They said it was to old and they wouldn't except it. I told them it was from when I had the accident, and they said it was to long ago. They sent me a letter stating they would accept a lower amount, which I declined. By that time they had already ruined my credit. I not only don't owe the {$510.00}, I want my credit restored. It was XXXX before this.

Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: We were leasing 2 XXXX vehicles and the maturity of that lease was on XX/XX/18. Last XXXX we received letters from Hyundai that close to the date of the maturity of our leases we had to contact them, and we did call them only to be told that was too early and that we could visit our dealership when we were going to be ready for the purchase. I need to mention that we were going to purchase both of the vehicles because of extra mileage. So on XX/XX/18 we drove both of our cars to the Faulkner Hyundai dealership on XXXX XXXX ( the XXXX. XXXX location ) as one of our cars was scheduled for an oil change at their serv. dept. We asked to see the sales manager so we can talk about the purchase of both cars, he asked us if we wanted to look into a new purchase and we told him that we -couldn't- because of the extra millage on the leased cars we had. He told that we could work out a better deal if we buy 2 new cars instead of those old ones. Of course again -our biggest concern was the extra millage and the fee that we were going to have to pay- but the sales manager told us that it was not going to be that big of amount and that we could work a payment settlement with Hyundai Finance when they'll contact us. One of the leased cars had some manufactures issues that we were dealing with through out the last 2 year with the same dealership and the sales manager was aware, still he persuade us that, that was the best thing to do. To return the old defected car and the other one, and get 2 brand new ones on a good deal and work out a monthly payment deal on top of our purchase payments for the extra millage fees. Once again, we were asking how much more it would be and why the amount could be included in the new purchase, but after consulting with the Financial Manager we were told that Hyundai wont finance us due to our credit and they looked into other financial companies ( Needless to say that they never mention to us that doing something like that meant that we had to pay a {$400.00} fee per vehicle for disposition plus excess wear and use, plus taxes on everything and on top of all we never signed anything regarding inspection for the returned cars, they never gave us paperwork regarding the returned vehicles, nothing regarding the millage and the excess wear cause there was no inspection done while we were there ) A month later we received 2 letters ( one for each returned car ) for outstanding fees as they call them. They are asking for {$16000.00} for one car and {$5400.00} for the other, when the sales manager said with certainty that it was not more that {$18000.00} for both cars. Again, he or the financial manager, never said anything about extra fees. When we called the Hyundai Finance dept. and asked about these fees and to arrange a settlement to pay, we were informed that such thing is not possible! That we have until the XXXX of XXXX of 2018 to pay in full the amount for both cars -or- they'll send it to collections agency. I did try to explain to Ms XXXX ( the person on the phone ) that its not possible for me to pay all this amount of money in such a sort period of time and that we were told otherwise from the people in XXXX XXXX dealership on the day of return of those vehicles plus that we never received any paperwork for an inspection done on those cars and the answer was that it was MY responsibility to know what to do and that the people in the dealership could have had forgotten to mention the details. That I should had call the Lease Maturity dept. to find out how exactly i had to return the cars before going to the dealership. I asked to make a monthly payment deal, even for 12 months and she said that is not possible either. that the payment can be extended to the fullest of 120days from return which is the date she gave me XX/XX/18. She also told me that i can pay by debit card over the phone or mail a check of any amount I want but if the total amount is not paid off till that day, then the rest is going to be send to collections agency and that will ruin my credit! As I mentioned before, we wanted to purchase both of the vehicles and that was the reason of our visit to the dealership ( besides the oil change ) that day, but we believe that the misleading and manipulating ways of those people drove us into this rabbit hole. We are unable to pay in full almost {$22000.00} till the XXXX of XXXX 2018, we need to arrange a monthly payment plan so we can pay off those outstanding fees. We need more time not 4 weeks.

Struggling to pay your loan

Vehicle loan or lease: Loan

Lender trying to repossess or disable the vehicle
Complaint: There is a letter attached that explains my dilemma and the substantiating paperwork. Additionally what is briefly indicated in the letter is a prior complaint I had as it relates to their not honoring the extension promised after I paid all the late fees. I included copies of the confirming fax that I sent several times which claimed to have not received. I spoke with several representatives as indicated. There seems to be a systematic web of deception. This complaint is regarding my car having been repossessed and retrieved by me. They are still claiming I owe two payments. I have attached the proof that I paid.

Getting a loan or lease

Vehicle loan or lease: Lease

Fraudulent loan
Complaint: I went to the XXXX XXXX dealership on a Saturday a few weeks ago to get aXXXX XXXX XXXX XXXX. They didn't have the options I wanted and called another dealership that had the VIN of a car that matched my specs and negotiated a swap. XXXX XXXX had me fill out the paperwork for that VIN and told me they would get me the car the next morning. They then submitted that paperwork to XXXX XXXX even though the car was not in their possession. Sunday came and they were not returning my calls asking what was going on. Finally, at XXXX I got a call back that the other dealership sold that VIN already but they found another match at another dealership to do a swap with but would have to come back in and sign more paperwork. Frustrated that they had lied to me and wouldn't return my calls all Sunday I told them to cancel the deal as it was invalid anyway. I am receiving bills though. I contacted XXXX XXXX and they claim they can not do anything. I have an open case with their Customer Care department which has not done anything for 3 weeks. I contacted the dealership directly and have emails from their finance manager who created my deal saying they would resolve this more than a week ago. I called XXXX XXXX again today and was told I'm in collections because my bill is past due. I called Customer Care today and talked to a supervisor and this has been escalated to a national office, but I can not contact my case manager and have not heard from them. I have to wait and hope that they actually contact me themselves.

Attempts to collect debt not owed

Debt collection: Auto debt

Debt was paid
Complaint: After reviewing my credit report, this company has reported to all credit bureaus that this account has been charged off as bad debt. Before any erroneous reporting was done, I had a payment plan established ; pay balance in full before XX/XX/2018, and everything will remain in good status. I paid this account in full, and also verified with the company. They never added my payments towards balance owed, and this was paid in full way before XX/XX/2018. I sent multiple letters to the credit bureaus requesting that the credit agency send me information on how this account was verified ( which they said was ). Nothing was sent to me and this is still on my credit report. They have not complied with the Fair Credit Reporting Act.
