Complaint: on or about XX/XX/XXXX, I contacted Ditech with regards to applying for a HARP on my first mortgage. Ditech is the servicer for my first and second mortgage. My first mortgage is owned by XXXX XXXX. On or about XX/XX/XXXX, Ditech informed me that the subordination review on the second mortgage was requesting and appraisal or a XXXX XXXX XXXX ( XXXX ). I contacted a licensed Realtor in the XXXX area and they completed and submitted the documentation to XXXX, my Ditech Loan, Processor. I continued to stay in contact weekly with Ditech via my personal email account. I spoke with supervisor in XXXX about my concerns of the continued delays of the HARP refinance. I was communicated that it would be reviewed and things rectified to move things forward. Ditech services the second mortgage. I am now writing you on XX/XX/XXXX, as I was informed earlier this week that the XXXX was not accepted in the format submitted which was reviewed with Ditech prior to the submission in XXXX. The impression I am getting is that Ditech does not want to approve my HARP on my first mortgage. The subordination will not jeopardize the mortgage position of the second. I have met the underwriting guidelines, credit score, HARP requirements and I have agreed to pay 2 points given the combined loan to value calculation inclusive of the second mortgage ( which was addressed in my bankruptcy ). I am at a loss and have some frustration.

Complaint: On XX/XX/XXXX, Green tree servicing offer a loan trial modification. I respectfully accepted the offer and made all trial payments on time. Sometime on XX/XX/XXXX, the servicer provided two sets of loan modification agreement, the contract was executed by me and was sent back to the servicing company as per their specification and/or instructions. I continued to make the monthly payments timely in accordance with the contract signed and the servicer received all monthly payments for the years to come. On XX/XX/XXXX, I received notice that the debt was transfer or sold to XXXX XXXX and that all payments must be made to the new company starting on XX/XX/XXXX. Pursuant to the notice of servicing i made the attempt to make the monthly payments to the new servicing company, however XXXX XXXX decline to accept our payments and stated that we green Tree Servicing never sent them copy of the loan modification agreement and therefore could not honor or process my payments. I contacted Green tree and demanded a copy of the executed agreement. According to Green tree servicing, a loan modification agreement was sent and was never executed. This statement is false, green tree had me executed two separate agreements and requested that i sent the original. Green tree Servicing made the promised to sent a copy of the agreement executed by them and never did. It is obvious that the servicer has engaged in deceptive and unlawful banking practices while in violation of the Department of Treasury HAMP program. Ones a loan modification agreement is executed and the servicer takes your payments for two years is clearly an indication that the account has been resolved. It took us by surprise that after servicer took our payments for two years to suddenly claim we never had an agreement whenthey sold the loan. XXXX XXXX has refuse to accept our payment and have defaulted the account on purpose thus no fault of our own.

Complaint: DiTech is my loan servicer. I have been over the 15 day grace period and charged a late fee. When paying the full payment plus the late fee after the 15day grace period they provide zero options to pay the late fee or put notes for the overage to be applied to the late fee. They keep putting the overage on the escrow or principle balance instead of the applying to the late fee. They claim the process is to call in and have them re-apply to late fee after the payment is made on line. Even after calling them to verbally have the overage re-applied to the late fee they do not provide any confirmation number and they still don't re-apply the overage. This has happened on several occasions. If a mortgage company is to take online payments I find it concerning they do not offer the ability to pay a late fee, and when calling them, it is still not re-applied.

Complaint: In XX/XX/XXXX Di-Tech reported to all 3 credit bureaus that I was over 30 days late on my mortgage payment in XX/XX/XXXX. I have emailed them twice with attached documents of proof as well as talked to customer service. I have also called all 3 credit bureaus. Di-Tech still has not corrected this. They have also taken payments and applied them to a " unapplied account ''. Instead of applying them to my mortgage payment as I directed. This happened XX/XX/XXXX. I wrote a separate check for late fees XXXX It was split up. Part put into a unapplied account and other towards the principle.

Complaint: I had an original XXXX XXXX XXXX Loan for my primary residence that subsequently serviced by several loan servicers. During the 2008 recession and financial and housing crisis my mortgage became insolvent and thus I applied for a HAMP and TARP loan under the direction that I would be able to get relief. I was wrongfully denied a loan modification and have since been in litigation with the loan servicer for the past several years. Per TARP, HAMP and Federal Law. This was not supposed to affect my credit but however my loan servicer still reports this as a derogatory mark not only damaging my personal credit but my livelihood as well. They have also subsequently taken payments from me during a trial modification period. I made all payments timely and with good faith and was denied once again. They pursued the foreclosure breaking HAMP and TARP requrements. We have had a written settlement agreement that they have refused to honor. They did not act in good faith and I am pleading for relief.

Complaint: I was sent a loan modification application by my mortgage servicer, Ditech in XX/XX/XXXX. I promptly completed the application and provided them with all of the request documentation including pay stubs, bank statements, signed tax returns, etc. on XX/XX/XXXX. Ditech assured me that a decision on my loan modification would be made within 30 days. It is nearly XX/XX/XXXX and no decision is made and my foreclosure case continues to proceed in court. I call Ditech weekly and ask for an update on the status of my loan modification application. XXXX XXXX from Ditech is very polite and indicates that the " underwriters '' are still reviewing my application for modification and that they will contact me when a decision has been made. It has been far past the promised 30 day decision turnaround and I am growing increasingly frustrated with the tactics of Ditech.

Complaint: In XX/XX/XXXX we applied for a line of credit with XXXX XXXX XXXX. The Line of credit was for {$40000.00}. In XX/XX/XXXX, my wife was diagnosed with XXXX and level XXXX XXXX XXXX. The line of credit we had only spent {$13000.00} of the total amount. And fell behind on payments and was in the process of negotiating with XXXX to settle for {$5000.00} to pay off this line of credit. The line of credit went into default and was written off. ( The loan was then sold to XXXX XXXX Prior to Default, which merged with XXXX XXXX XXXXXXXX XXXX. Ditech has written of the debt but not claims we owe then {$45000.00} with no explanation. I have mentioned to them the amount we spent and requested payment history. I have requested payment history of the line of credit and noticed something on the payment history that said amount XXXX balance XXXX with a description of former RL. which I questioned and asked for proof which we have never received. I am attaching the payment history and a letter I sent Ditech in XX/XX/XXXX. I have circled the item in question and have not ever been told or given proof of the phantom item. My wife is very ill at this time and I am trying to get this matter settled. I have offered to pay the XXXX to settle the debt. even in XX/XX/XXXX of this year, I have offered to settle the debt for XXXX just to get this matter behind us. And have heard nothing from Ditech. the so called supervisor of our case her first name is XXXX. and would never provide her last name or I do not remember it. We desperately need help to get this matter settled and removed from our credit report. I am at my wits end on this matter and Ditech will not settle this matter nor help to reach an agreement. I have asked for proof of the monies spent and they can not provide anything, to verify the money we spend or the balance of what was left on the line of credit before it went into default.

Complaint: I am now {$20000.00} in the rears with my mortgage with Ditech i have been behind since XXXX.. I had XXXX XXXX in XXXX.I lost my Job of 10 years because of losing time from work. That is how i became behide. I now I am able to pay my mortgage and have submitted a Modification 2 time. Both time they were denied with Ditech. The reason that they denied me is because of the programs that they have to follow. This is where the problem comes in. I have attached the 2 denials for your review. What i have a problem with is that being that i am a Certified XXXX XXXX myself I have seen the Modifications that lenders offer clients.My interest rate is 6.75 % and has been so since 2004 rates are much lower now. Most modification that I have seen come across my desk have lowered the rate to 2 % 3 % so that the # s would work. I have since them also give a Balloon Payment of 15 years. This would give the mortgagor time to get on their feet. This option was not offered to me. I know that this option is available but the lender is not trying ever possible option to keep me in my home. Again my rates in 6.75 %

Complaint: Trying to pay down loan to 78 % equity to cancel PMI, we submitted payment of {$42000.00} in XX/XX/XXXX and another {$10000.00}, soon to be {$20000.00} in XX/XX/XXXX. Instead of applying payment amounts to principal and current month payment, the servicer, Ditech Financial, has applied our payments to future mortgage payments both times. They even ignored additional payments I had scheduled and never posted them! On top of that they refuse to cancel PMI since we are already at 78 % equity of the original loan ( originated in XX/XX/XXXX ) unless we pay for a new appraisal and they get an official request. By law they are required to cancel PMI automatically when we are at 78 %.

Complaint: My son and daughter in-law desire to assume the mortgage I have on a property. I requested and received communication from ditech on XX/XX/XXXX with instructions and paperwork that needed to be filled out and returned. All paperwork was completed and returned on XX/XX/XXXX. I called ditech on or about XX/XX/XXXX to inquire what was happening. ditech representative asked me to call back in 2 weeks as they didn't know. I called again on XX/XX/XXXX and was told that assumptions of loans was not permitted which is clearly false information as both my original note and the ditech website say that loans are assumable ( borrower must qualify ). My son clearly falls under the guideline of qualifying as a borrower subject to his and his wife 's credit. On XX/XX/XXXX I called again to follow up and was told they can't find any of the information that I sent them. Very deceptive as they will not allow me to talk to anyone in the processing dept, loan assumption dept or anyone other than a generic phone representative. They refused to give me the name of the mangers, or any supervisor that I could contact.
