Complaint: Hello - XX/XX/XXXX - At the advice of my tax advisor I prepaid my XXXX real estate taxes due to XXXX XXXX for my property located at XXXX XXXX XXXX XXXX, XXXX, MN XXXX / PARCEL ID XXXX. TRACKING # XXXX XX/XX/XXXX - XXXX XXXX deducted {$2800.00} out of my XXXX XXXX account for the payment of the XXXX real estate taxes.
XX/XX/XXXX - I spoke with Ditech Financial ( XXXX ) customer service to inform them that the XXXX property taxes were paid in full and inquired as to the procedure for requesting an escrow analysis and subsequent refund as my escrow account is significantly over funded. Much more then one-sixth ( 1/6 ) of the estimated total annual disbursements from the escrow account. Customer rep at Ditech provided a fax number of XXXX to send a request for analysis.
XX/XX/XXXX - Drafted and faxed letter to Ditech along with my supporting documentation. Fax confirmation came thru and is attached in the PDF.
XX/XX/XXXX - Receive letter from Ditech via US Postal Service dated XX/XX/XXXX denying request for escrow analysis.

Complaint: To be brief, around XXXX of XXXX, I informed Ditech that I was unemployed at the time and that I was worried about my mortgage, since by that date I was perhaps two months if not more, behind. I was assured not to worry and that things could be worked out. I was told that if I could make payments on XXXX and XXXX of XXXX and XXXX of XXXX, then they would give me a loan modification. If memory serves, either late XX/XX/XXXX or first part of XX/XX/XXXX, I informed Ditech that I was still unemployed, despite applying everywhere and still looking daily for work. I was informed that as long as I make a payment, things could be worked out. Next thing, I receive a letter informing me that my home has been scheduled for foreclosure on XX/XX/XXXX. I was denied unemployment benefits, so even making a partial payment was out of the picture. All that XXXX wasted XXXX time talking to Ditech and being given, what I would now call false hope, just to lose my home anyway. In essence, it appears and feels as if I was just strung along until there was only one thing for Ditech to do and was to foreclose. We have no where to go.

Complaint: To whom it may concern. This is an extension of the complaint that I filed against Ditech Mortgage on XX/XX/XXXX. Please revert to that complaint for your reference. After my last complaint I was contacted by Ditech and was finally approved for a deed in lieu on XX/XX/XXXX. Since then I have relived my year long battle/nightmare with Ditech. I have tried to sell my home. I have tried to short sale my home. I have tried to do a deed in lieu. All of this started in XX/XX/XXXX. Ditech took responsibility in their response to me in the last correspondence I had with them, i.e. there constant foul ups lasting a year. I have applied for a short sale 3 times, then deed in lieu an additional 5 times. Reason being the account reps would either not know what they were talking about it when discussing my application or the account reps would flat out lose my application. That being said I was relieved on XX/XX/XXXX when I finally got a letter from Ditech stating that I was approved for a deed in lieu. Of course I had to be able to provide marketable title. I began my relationship with the deed in lieu department and a rep named XXXX. We started off great and she was professional, and that all changed Friday XX/XX/XXXX. I had spoken with XXXX right before XXXX and she alerted me that there was a lien on my property and I needed to clean up before my deed in lieu could be processed. I said no problem and contacted my property management company to find out what this lien was and how much I owed. When I spoke with XXXX XXXX XXXX, they explained to me that there was a loan taken out by our condo association from XXXX XXXX XXXX to put up new vinyl siding about 5 years ago. I asked them how much I owed and was told that I owed XXXX dollars which I paid off that week. XXXX in the deed in lieu department then told me that I needed to get a partial release from the lien holder in order for XXXX XXXX to sign off on my deed in lieu. XXXX then said that it had to be recorded in a county courthouse as well. This is when all the problems started. I am not able to get such a letter. The reason being is that even though I paid off my portion of the loan on my condo, the lien/loan is spread across all 82 unit owners in my association. Obviously I can not force all 81 other owners to pay off there portion owed. Therefore, the condo association could only give me a letter saying that my portion of the loan was satisfied. XXXX XXXX XXXX can not give a partial release because the loan is not satisfied due to the other homeowners still owing for the loan. When I explained this to XXXX it seemed like she was working with me up until XXXX. Then the communication stopped. She finally called me back after weeks of calling on XX/XX/XXXX and rudely and unprofessionally explained to me that I was in a " catch 22 '' and since I could not provide what XXXX XXXX wanted that there was nothing else I could do. She also told me I was done and could not speak with anyone else in the department because she handed of my file to the closer. I am incensed. No one can make a call to XXXX XXXX or the title insurance company and explain this to them? I am sure it is not the first time this has happened. It is absolutely ridiculous to me the way that everyone I have come into contact with at Ditech is incompetent or just not interested in doing the right thing and helping someone who is clearly in financial hardship and needs help. I am hoping someone uses common sense here and helps me out. Now I call all around the deed in lieu department and no one calls back. Please help.

Complaint: We were holding " interest only '' mortgage for more then five years and paid monthly charges in amount of {$1300.00} including taxes and insurance ( see attachment ) This is an amount we could afford and we never missed a payment. Our credit history is good.The payment varied each year depending on a rate change but never changed to much. In XX/XX/2018 we received notification from Ditech financial that our program would changed to ARM starting from XXXX and monthly payment will be {$2100.00} ( see attachment ). We can not afford this amount. We addressed the company and spoke to a loan officer XXXX XXXX XXXX # XXXX on the phone regarding possible refinancing with smaller payment charges. We were denied on the basis of insufficient income.
What is the option then- to sell the house? Why Ditech changes the rate program without our permission? It is going to ruin our budget.

Complaint: Ditech began servicing my mortgage in XX/XX/XXXX. One of the first things they did was refund me nearly {$1000.00} from my escrow account. I assumed they knew what they were doing and cashed the check. In XX/XX/XXXX they did an escrow analysis and stated that I was short due to the refund that was a mistake on their part and my mortgage would go up {$100.00} for the next year to make up the shortage. That much I understood. However, in XX/XX/XXXX they did another escrow analysis and stated I was now {$2300.00} short. I was given the option to send in a lump sum of {$2300.00} or spread the payments out over the next 12 months increasing my mortgage from {$650.00} to {$840.00}. My payment in XX/XX/XXXX was {$570.00} and the property taxes have not changed since XX/XX/XXXX. Being that my taxes are $ XXXX/yr and home owner 's insurance is $ XXXX/yr I fail to see how my account could be In the neighborhood of {$3400.00} short in just a couple of years. My taxes have never been late or increased since they began servicing the loan. I am a real estate salesperson and appraiser so I have an intimate knowledge of property taxes and mortgages. For the life of me I can't get an answer or reason how my account could be this short. The mortgage all along has included an escrow payment of {$190.00} which is the exact amount to cover the taxes and insurance.
I started in XX/XX/XXXX making calls trying to get an explanation of what was causing the shortage. Since then I've made at least 6-8 calls speaking to all different departments, if they didn't transfer me to no one, with not a single answer. They have promised on more than a few occasions to get back to me or have an expert look into it again with no results or phone calls.
Please help me end this egregious over step of power.

Complaint: I contacted Ditech on XX/XX/XXXX to verify that payment for XX/XX/XXXX and XX/XX/XXXX due to the fact that Ditech had reported negatively on my credit. After checking with XXXX XXXX and confirming payments for my mortgage had been sent to Ditech for XX/XX/XXXXand XX/XX/XXXX, I realized they were getting the payments and not recording them. Then they reported on me negatively to the credit bureau. I have since learned this is not the first time Ditech has done this and in at least one case it resulted in a house being put for sale even though XXXX had been making payments. Please help me to resolve this problem with Ditech.

Complaint: I went through a divorce this past summer. My ex husband was paying the bills but come to find out when he left I was behind on my mortgage. When I got noticed of the sale date XX/XX/ I was shocked to find out what was going on. I'm not able to come up with the full reinstatement however I'm able to afford the contractual payments. I submitted a modification package and I've been following up with Ditech and the foreclosure attorney daily to get updates. On XX/XX/ Ditech advised me that a request to postpone the sale was sent to the foreclosure attorney and the mod package was sent to the investor. You can verify this call if you listen to the call that took place on XX/XX/. TodayXX/XX/XXXX I call Ditech and was advised that they will not postpone the sale but they still have a complete mod package. I feel that Ditech should honor their word and postpone the sale to allow the underwriters time to review my modification request.I feel that Ditech is holding up the review so they can take my house away from me. I'm requesting help and need assistance. Please listen to the calls because Ditech tells me on every call that the call is being recorded. They should honor their word and postpone the sale.

Complaint: My home in XXXX XXXX Florida was declared a disaster area after Hurricane Irma. As such I was able to take a 90 day forbearance and was explicitly told by the lender, Ditech, that I would have no negative marks made against my credit. During the forbearance I sold the home and the mortgage was paid off in its entirety on XX/XX/2018. I entered into contract on a new home purchase today and when my credit was examine my score had dropped from XXXX to XXXX. The very same day I went under contract Ditech reported I was 90 days delinquent on the account. I am now unable to find the loan due to the huge impact their mistake had on my credit. PLEASE HELP!

Complaint: I received an annual escrow account statement indicating of yet another shortage on my escrow account with a shortage amount of {$7200.00}. This is not the first escrow shortage on my account in the span of two years of our stay in the property prior entering the loan. The first escrow shortage was caused by an error on Ditech 's side which they admitted wherein Ditech was paying a different parcel number/property with my escrow account that resulted to having my property put on tax lien and my escrow account into a negative ( for reference I have my initial CFPB complaint from last year Case number : XXXX ). Ditech settled it by disbursing a check to pay for the delinquent property taxes and taking my property off tax lien, I thought all is good after that but I was shocked when I saw a {$7200.00} shortage on my account again this year. Now my question is what happened to my starting escrow amount/buffer ( please see attached document ) after the initial error occurred? To figure out what happened I tried requesting for an escrow analysis from XXXX since my online account only shows an escrow analysis for XXXX and XXXX but the customer service agent ( XXXX ) resisted to provide, in which I don't understand because I started my loan back in XXXX. Please help cause this is causing so much stress on our family, I tried settling this with Ditech by phone in multiple occasions but none of those interactions was helpful in fact each of the customer service agents I have talked to was just adding confusion into the mix and leading me to believe that I have entered the loan with a negative balance on my escrow but can not provide proof, if there are other documents needed please let me know.
