Complaint: We filed for chapter XXXX bankruptcy inXX/XX/XXXX. Since that time the mortgage servicer stopped sending me monthly statements showing the dates my payments were received and how the amounts from each payment were distributed. I attempted many times via phone call, email and letter to resolve this. They stated that since we were in bankruptcy they were not allowed to send us any billing information, even if we requested it. They would also not contact me for any reason. If i called and asked for a return call they would not respond, when I asked for them to send me a document showing how my payments were posted they would not respond. My attorney and I both sent letters giving them authorization to call, mail or email me so they would be exempt from the bankruptcy rules and they refused. The court agreed to exempt my first mortgage from the bankruptcy so we had to reaffirm the loan at the beginning of the bankruptcy and we made the payments to the servicer ourselves, not through the trustee. With this information their representative told me that no one is able to exempt any creditor from a chapter XXXX bankruptcy and that it was my trustee that made the payments. It was not the trustee. Finally about one year ago they sent me documents showing how they had applied my mortgage payments over the preceeding couple years. It was a spreadsheet that any average consumer would not be able to interpret let alone an accountant. Since we filed for bankruptcy in XXXX they had referred our account to their " bankruptcy department ''. Whenever we would call we would have to wait to be transferred to their bankruptcy department which is not their regular customer service group. In every attempt to reach our account representative we would have to leave a message and would not receive a call back. They also restricted what we were allowed to do on their website such as not being allowed to make payments online or download statements that showed how they had applied my monthly payments.
The last time i talked with the account representative he stated that in order for them to remove us from post bankruptcy status and restore everything to normal which includes sending complete monthly statements we would have to provide another reaffirmation. They have been informed that the court does not require other than the first letter at the beginning of the bankruptcy as my lawyer has indicated and yet they still tell me I and my lawyer are wrong.

Complaint: During this loan modification attempt, DiTech had repeatedly asked for a XXXX form in several different ways on a dozen different occasions. We provided this to them within a days time each time. This, in turn, flagged the IRS and we had to order a verification of non-filing directly from the IRS which of course took forever. There were times when I called to get updates on this application and representatives had not even seen any supporting package documents. DiTech then turned around and said that they closed the mod due to time lapsing. We had been advised this a week before the clients sale date.

Complaint: Mortgage company paid for homeowners property insurance twice the wrong amount in excess of {$7600.00} after I instructed them not to issue check because the final amount of the policy wasn't known yet. Mortgage company issued check for {$5400.00} on XX/XX/XXXX. Then issued another check on XX/XX/XXXX, same policy, for {$5400.00} The actual cost of the policy was {$3100.00} This resulted in s shortage of {$7000.00} which the mortgage company intended to collect from me. In reality, As of today, XX/XX/XXXX, I should have an escrow balance of plus {$1300.00} Mortgage company has increased my monthly payments from {$650.00} to {$1400.00} starting on XX/XX/XXXX. Then, on XX/XX/XXXX, the company that provided the homeowners policy refunded the over payment of {$7600.00} to the mortgage company which has NOT credited my account. This problem has been going on now for three months. I need your help.

Complaint: Three months after my son died XX/XX/XXXX. A man came to my home saying he was sent by Ditech Financial LLC to take a picture of me and my home. Which scared me. My daughter told him to get off our property. He handed her a note from Ditech to call them immediately. The man continued saying. '' You better call them immediately! They mean business! They are going to foreclose on you if you dont pay them now ''. XXXX my daughter told him that we do not have a loan with Ditech. The man said, " Well someone does and this is the address! They don't care how young or old you are they will sell your home out from under you and kick you out into the street! They are ruthless and they dont play around. You best pay them! We were shocked. It had to have been my son who financially exploited me for 27 years stealing my XXXX year life saving of over 1 million dollars. He left a complete 27 year paper trail of evidence proving his guilt, incriminating himself and his sister XXXX. XXXX called Ditech at that moment. The lady that answered was rude. She would not give us any information about the loan because we are not on the loan! Only the deed. They wanted to know who was the information of the executor along with legal documents, death certificate, which XXXX had sent.
We have no access to that info. We do not speak to my sons children because they are exactly like my son. I made every mortgage payment as shown by my bank statements and cancelled checks, He never paid XXXX XXXX on my home since the purchase date XX/XX/XXXX. no upkeep, no repairs no utilities nothing. My son never made a payment. He kept refinancing my home several times as shown in the evidence XXXX found in his many different files in my home after she had him removed by ex parte XX/XX/XXXX. I allowed him to move in with me in XX/XX/XXXX. He would not leave my home. He was very abusive and I was too scared to tell anyone. In XX/XX/XXXX XXXX came to care for me and began to see and investigate the financial exploitation.
An insurance agent came and took pictures of my home and said we better call our mortgage company right away. We have no mortgage company. It was my son who has a {$50000.00} plus loan against my home he got XX/XX/XXXX. We found a transfer from XXXX to Green Tree. Then found a XXXX XXXX insurance policy to Ditech. My son knew he was XXXX of XXXX of his XXXX the doctors in XXXX told us on XX/XX/XXXX for a while. He could have stopped drinking but refused. XXXX himself! He knew how far XXXX had investigated his exploitation and knew he was going to prison. He had 7 life insurance policies. That Ditech needs to go after, Not us.
XXXX XXXX is XXXX, XXXX years old she was never taught to read English. XXXX was suppose to care for her and have a fiduciary relationship with our mother. Which he violated with extreme abuse and financial exploitation. She had no idea any illegal actions had taken place against her. Until I her youngest daughter came to care for her after XXXX tried to XXXX her in XX/XX/XXXX. Then I found the abusive and illegal action and paperwork to validate all his crimes against his own mother. I have Durable Power of Attorney given to me by my mother. Please note that on page 5 XXXX was not or is no co-signer, co-borrower or co account holder. I had to mark something in order to add our information to this complaint. I will sent a copy of my POA when I am notified where to send it. I also have photos of Ditech 's note, Insurance police, Letters from Ditech and more needed for this complaint, but could not upload. Please let me know where to send them. This calls for immediate action. My siblings stole everything they could from our mother. I can not let her lose her home, Please keep me informed on what I need to do to save my mother ... Thank you

Complaint: Three years ago I received assistance to pay my mortgage for 2yrs. This should have ended XX/XX/XXXX. My mortgage company stated I was behind because I didn't pay XX/XX/XXXX. I determined that the last few months or so of the assistance the mortgage company Ditech increased my mortgage. I was unemployed and fell behintd on my mortgage. I asked for a modification and qualified. In XX/XX/XXXX I received loan modification paperwork from Ditech. I was able to make my 3 lowered monthly payments on time and qualified for the modification. I completed the paperwork and sent it back to them. I never heard anything from them. This concerned me. I attempted to call them to speak on the matter. I was continuously transferred to different people and voicemails. XX/XX/XXXX I received a notice that they were going to foreclose on the home. I called and after being transferred 3 times I spoke with a young lady who was able to assist me. She stated that my modification paperwork was incorrect that my notary signed in two places. No one called or sent documentation to inform me of this mishap. I was unable to make a payment because I was not sure how much to send. The young lady sent a second set of papers I completed them and mailed them back. The young lady stated the amount I should make my future payments for. She stated that Ditech was at fault by not contacting me to advise of the incorrect paperwork. I called XX/XX/XXXX a month after sending the documents back and spoke with XXXX. I received another foreclosure letter. She asked why it took 3 months to send the modification paperwork back. I advised her to review the notation. She apologized and said that Ditech was working on the issue and was waiting for XXXX to agree to the terms. That XXXX was backed up and they could not proceed forward without them. She also advised me to disregard any foreclosure documents sent because it will take a minimum of a month to process the modification. On XX/XX/XXXXI received another foreclosure notice. I called and could not get anyone until XX/XX/XXXX. I spoke with XXXX who stated I should review XXXX hosted by XXXX XXXX. I advised that I wanted to speak to someone about loss mitigation. I had a representative named XXXX. At this point I do not know where I stand. I am unclear if they are going to attempt to foreclose on the house. The initial loan modification didn't occur due to their negligence. I feel they want my home and a purposely not assisting to ensure they have the property. They hard to reach, uncooperative, elusive, and do not return calls or voicemails. I truly feel that others must be experiencing the same issues with Ditech Home Loans.

Complaint: My issue is with Ditech, and the servicing of my loan. On XX/XX/XXXX, Ditech paid the flood insurance on my home in XXXX XXXX. The amount paid was {$560.00}. My premium amount was {$450.00}. When I called Ditech on XX/XX/XXXX, they told me that Ditech paid my insurance premium without receiving any documentation from my insurance company for the amount old. The supervisor in the insurance payment division further told me that someone from Ditech called my insurance company on XX/XX/XXXX, and requested the premium amount over the phone, and the insurance provider said that the amount was {$560.00}. Ditech was unable to provide me with any record of this phone conversation when I spoke with them on XX/XX/XXXX. I have a statement from my insurer datedXX/XX/XXXX ( the same date that Ditech says they talked to my insurance company ), saying that my insurance premium is actually {$450.00}.
I don't believe that Ditech contacted my insurer. I don't believe that they made any attempt to know how much my premium was supposed to be before paying my premium. I can't believe that they would pay my insurance premium without some sort of paper trail or documentation stating the amount of insurance owed.
This is my second issue with Ditech. Last year, Ditech paid two different premiums on two different hazard insurance policies covering the same house. They did so despite my insurance broker notifying them that one policy had been cancelled, and that I had a new policy. I saw my mortgage payment spike, and had to devote a significant amount of time and effort to retrieving my money -- through no fault of my own.

Complaint: Im writing to you today hoping you can stop the bank from taking the house that has been in our family for over twenty years. My mother was living in the home when she passed away and left it to me. My brother and I worked hard to pay off the mortgage, but this past year has been difficult.
Rays struggled with medical issues, being on a fixed income myself, and XXXX XXXX, I did what I could to make up the difference. I repeatedly tried working with the bank, explaining the situation, but it was a slow process and when I was finally able to get caught up, they told me it was too late. They demanded the full amount, and wouldnt take any more mortgage payments. The fees and these payments just kept to piling up.

Complaint: We began the application process back in XXXX but because the company continued to ask for new and additional information it necessitated what they called rate lock extensions, and for each of these rate lock extensions they would add additional fees. These fees were not disclosed to us or discussed with us until the last couple of weeks and therefore it was too late to try to get a loan with another company., ( due to the recent increased rates ), It seems to us an unfair business practice to change the documentation required and then charge additional fees because of the time added due to these requests. This lender knows that if we apply for a loan now the new interest rates are higher than the ones that were available when we began the process so they know they have us between a rock and a hard place so they are unwilling to waive any of these fees.

Complaint: According to my credit reports, Ditech is reporting the following negative information to all major credit bureaus : 1 ) Late Payment - XX/XX/XXXX 2 ) Late Payment - XX/XX/XXXX I have never been late on payments. With regards to the supposed late payment for XX/XX/XXXX, on XX/XX/XXXX a representative of Ditech stated that the late payment record ( XX/XX/XXXX ) will be removed from all credit bureaus and any fees associated with the late payment record will be refunded/credited as the payment was never late.
With regards to the supposed late payment for XX/XX/XXXX, that payment was never late. The late payment record was caused due to Ditechs fault because of the following : For the month of XX/XX/XXXX, I mistakenly initiated a double payment. I made the mistake of making a payment twice. Because of this I contacted my bank to make a stop payment request for one of the duplicate payments. After that I contacted Ditech to notify them of the double payment and to inform them that I contacted my bank to stop the duplicate payment. Ditech assured me that this wouldnt be an issue and that they will take care of it on their end to make sure that I dont incur a returned payment fee. Well it turns out that Ditech refunded me for the payment that was not going to be returned by my bank ( the duplicate payment was stopped by my bank ) without my authorization. Because of this, not only did I incur a returned payment fee by Ditech, I also incurred a late payment fee by Ditech because Ditech refunded one of the duplicate payments without my authorization. I believe Ditech did this on purpose in order to charge me 2 fees ( returned payment fee and late payment fee ). As soon as I learned that Ditech refunded 1 of my payments without authorization, I made a payment to my account since it was considered past due because of Ditechs unauthorized refund of one of my payments.
I DID NOT REQUEST DITECH REFUND ME FOR ONE OF THE DUPLICATE PAYMENTS.

Complaint: I am over 12 months behind on my mortgage. I have tried calling, emailing, leaving messages ... no one will return my calls or email. ( Ditech financial is the company ). Literally the 2-3 times I have actually gotten to talk to someone they have been rude and no help. One lady even laughed at me while I was on with her because I was so far behind. I bought this home new in XX/XX/XXXX, I have raised my kids here and I owe less than $ XXXX on it and I am going to loose my home because they refuse to work with me. The couple time I spoke with someone they told me that if I could not pay the WHOLE pastdue balance dont bother sending anything at all because they would still foreclose!!?? Complaint: I currently have a mortgage with XXXX XXXXXXXX XXXX. Which h was GreenTree Financial. In XX/XX/XXXX I.quired to lower my more.thly payments. Found out the diy a loan modification and added {$37.00}, XXXX to my XXXX amount XXXX did a ending mortgage data of XX/XX/XXXX. I did not sign into this contract they have me and my wife 's. Singatures but I would never sign a 40 year mortgage and give them {$37000.00}. I would have took out a second mortage. I have my own notitary to notarize things as our signatures are fuzzy looks photo shopped or something. We started the Mortgage started with XXXX for {$110000.00} back in XXXX now in XXXX we owe " XXXX. We would have known a out this if we did not want to sell our house.

I am not sure you can help us but thought I would ask. We recently attempted a modification from ( 2nd time due to medical reasons, we had been approved for first mod., but had a medical emergency happen & hence a 2nd try for another modification ) of our Fannie Mae mortgage thru Ditech . We had got behind in payments due to medical bills that came up due to a medical emergency with my husband. In XX/XX/XXXX we met their representatives for a mediation & agreed to us doing an application for a modification. Then mid XX/XX/XXXX we began a modification that was drug out for almost 5 months. All along the way, the Ditech representative reassured me that everything looked good & that we would be just fine. It was never easy to get through to this representative & we always had to leave a message. We were continually asked for documents several times, as they would claim they never got what I sent. This one representative also told me that she alone had over 1000 modification applications that she herself was processing. At the end of the XX/XX/XXXX month, the representatives phone extension became non existent & I could not even call into the company as my calls were rejected automatically by the phone co. I used a friends phone & called & asked for the lady whom I had been working with for those 5 months & she no longer existed. All along this 5 months & before that, Ditech was adding all kinds of large fees to our account. Our mortgage balance went from $ XXXX to $ XXXX., My husband is XXXX & receives a pension & social security. This is a classic case of American Greed in our opinion, we are the little guy being squashed by corporate America. Have you heard other stories like ours? Anything your company could help us with? I know this is a long shot but saw an ad by your company.

Complaint: Due to my having to file for XXXX due to a sudden XXXX of my XXXX XXXX from XXXX XXXX for XXXX XXXX, & now experiencing XXXX XXXX XXXX in my XXXXXXXX XXXX XXXX XXXX ; I sought modification relief on my home of 38 years with my first lender, XXXX XXXX starting in XX/XX/XXXX. I was granted a modification for that loan in XX/XX/XXXX, & have maintained an excellent repayment status.
Subsequent to receiving a modification on the 1st mortgage, I immediately applied for modification on the 2nd one, with Ditech, then GreenTree, then back to Ditech again. The interest rate on that loan is@ 8.5 % ; and Ive had the loan since XX/XX/XXXX. For the past two years, I have submitted several loan modification applications, have spoken to my local Housing Partnership service, have acquired a lawyer from my county law service, & have had a hearing in our county offices regarding resolution. Ditech consistently loses the applications, lets them 'age out ' so they expire, & has attached thousands of dollars in legal fees & late fees resulting in the loan being nearly doubled from its origination. After the hearing in XX/XX/XXXX, my lawyer emailed, & then mailed all the info they asked for. Now my lawyer says they let yet ANOTHER app 'age out. ' This is the ONLY blemish on my credit report. Please, please help me resolve this problem.
