Complaint: My home was in foreclosure, I filed bankruptcy in early XX/XX/2017 and my home was saved. I was advised by my attorney to just pay {$990.00} to the Dtech mortgage company and I have been doing so since XX/XX/2017 when my bankruptcy cleared. Now Dtech is trying to XXXX me over again, they are stating I owe them {$2000.00}. because of my ESCROW account yet I have not received one single statement, one single bill, phone call, email, correspondence ( nothing ) at my home. My daughter created the account for me online and it shows the mailing address as XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX that is not my home address why are my statements and bills going there for my home. This has caused me yet major problems for now they say i owe {$2000.00} and i have tried calling to speak with someone to help me and nobody takes the time they just bounce me around from rep to rep. I will be hiring another attorney to assist me with this FRAUDULENT ACTION and decided to start by filing a complaint! I have record of everything

Complaint: On XX/XX/XXXX I was provided a modification from Ditech with arrears deferred and first payment of {$460.00} was due on XX/XX/XXXX. Ditech did not uphold their agreement of the modification and placed my account in foreclosures before payment was even due. My house was about to sell so I had to filed bankruptcy with Attorney XXXX XXXX on XX/XX/XXXX only to save my home. Ditech said I owed insurance fees back dated from XX/XX/XXXXand the Bankruptcy trustee said that they had to dismiss my case due to I will not be able to afford it. My attorney advised me to come into the office so that we could get the bankruptcy straightened out. In between me getting to his office I had an medical emergency that caused me to be hospitalized for about 10 days and My car also was repossessed due to the mishandling and misleading information. A escrow account ending in XXXX is on my account that I never received any information about or payments that was due to me. The last analysis was did on XX/XX/XXXX. A total amount of XXXX was paid out of the account to insurance on XX/XX/XXXX, XX/XX/XXXX, & XX/XX/XXXX. After looking through my payment history I see several large amounts being distributed to insurance over the years of my account starting XX/XX/XXXX. I filed a claim to have house fixed but claim was denied by XXXX XXXX insurance company provided by Ditech replacement insurance. They also have had my divorce decree on file since XX/XX/XXXXto update my name on file but have not did so as of yet.

Complaint: Ditech Financial has been trying to collect on a 2nd mortgage in the amount of {$100000.00} from me since my ex-husband filed bankruptcy. It began on XX/XX/XXXX with a letter informing me they were attempting to collect a debt. Since then it has escalated to multiple phone calls per day, as well as threats they could sue, seize bank accounts or put liens on my property. The 2nd mortgage went into default in XX/XX/XXXX. It appeared on my credit report in XX/XX/XXXX, and was removed from my credit report in XX/XX/XXXX, because of the statute of limitations. In Colorado, the Statute of Limitations to collect a mortgage debt is 6 years. On XX/XX/XXXX, I spoke with a Supervisor named XXXX, extension XXXX. He stated they have a right to collect this debt until the year XX/XX/XXXX. The phone calls continue, with the threat that if I don't pay something to them, they could escalate seize bank accounts or property. They also said I signed paperwork that said they could collect this debt up to the year XX/XX/XXXX, which I never did. I asked for the specific paperwork, and they said they couldn't mail it to me.

Complaint: This e mail is in reference to complaint number XXXX. As per that complaint I have had ongoing problems with my mortgage company in that they were paid extra money to set up my mortgage on an automatic withdrawal from my bank account. As previously stated they have Ditech has on several occasions not taken the money out on the pre-determined date or attempted to take extra money causing my bank account to accrue overdraft fees. the last time this happened last summer I spent several hours on the phone with various representatives and sent them all the information the requested in order to recover the bank overdraft fees which they freely admitted was their error. This was a lie as several months later another representative with Ditech said that they would not refund my overdraft fees. My mortgage payment is set up with my bank such that Ditech is authorized to take out {$1000.00} every two weeks. This include the amount of the mortgage payment due and an extra {$120.00} X 2 every month that is designated to go towards the principal. On the XXXX of XXXX Ditech was scheduled to take out {$1000.00} which they did not. Because they did not take the money out and thus did not get paid they assessed a {$30.00} non-payment fee. After several phone calls I was assured that yet again that this was a " Computer Glitch '' and that they would correct it. Later the next week the assessed {$60.00} more in fees for non-payment. Again I spent several hours on the phone with them and they assured me that they would correct the problem and that correct amount would be withdrawn from my account. I was even told the exact amount of money that they would be taking out of my account in order to " Catch everything up ''. The next day I received a collection notice from Ditech in the mail. It is my opinion that these people are attempting to set me up for a fraudulent foreclosure. way back in XXXX when I logged onto my bank account I discovered that amount of money they attempted to take out of my account was not only incorrect but greater than what was quoted. An amount that they placed back into my account as a credit. Yet again the mortgage was not paid as a result of their error. Yet again I have incurred another {$27.00} overdraft fee as a result of their error. After numerous phone calls over a month and a half ( During which DiTech mysteriously lost all my payment information, causing me to have to resubmit all my information again ) Ditech did refund my bank overdrafts and waived their internal fees, however 4 months later they still have not allowed me to successfully set an automatic withdrawal on my bank account. The reasons cited for not doing so is that I have had returned payments which they freely admit is because of their mistakes subsequently which has locked me out of their system. Over a period of three weeks I have left numerous phone messages with multiple supervisors at Ditech to try and straighten this issue out, to no avail. A quick search on the internet reveals that Ditech has a habit of improperly foreclosing on people and given the amount of equity we have built up in our house I am in fear that that is what they are setting me up for. I need help with this issue. Please, Please have a representative call these people and put some pressure on them. The representative that has been most recently assigned to me to set up my automatic withdrawal is named XXXX and her phone number is XXXX extension XXXX. Complaint: There has been a serious and ongoing issue with DiTech. When applying for a loan modification, DiTech advised on XX/XX/XXXX that the application went to underwriting. Throughout the process we have provided documents and clarification in a timely manner as requested by underwriting. On XX/XX/XXXX we were advised that the package was deemed complete and we needed no further explanation or documents on our end. From that day on, we called almost every other day for updates on the package. We were advised on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX that our package was complete, being reviewed, and was still in underwriting. On XX/XX/XXXX, we were told that this case was being escalated because we should have had an answer by now. Then, on XX/XX/XXXX we were told that DiTech was still looking into it. Finally, on XX/XX/XXXX, the home was sold to a sheriff sale. Why is it that no one at DiTech was able to advise us of a sale date? DiTech gave us the impression that the modification package was not only complete, but actively being reviewed with underwriting. This is someones home and DiTech obviously does not do their due diligence to ensure people are being properly taken care of. We could have taken the proper steps to prevent this had our lender, DiTech, done their job.

Complaint: Ditech transferred my mortgage to XXXX XXXX XXXX ( XXXX ) XX/XX/XXXX. I did not receive the goodbye letter nor the hello letter, but they did transfer my payment that were set up on bill pay, per RESPA, for the first 60 days. However,XX/XX/XXXX, I called Ditech to get my 1098 information, which was the first time I was made aware my loan was transferred. I then began contact Ditech to track down my payment, and request for it to be sent to XXXX. To date, I have contacted DitechXX/XX/XXXX, XX/XX/, XX/XX/, XX/XX/, XX/XX/, XX/XX/, and today, XX/XX/, sometimes more than once a day. Each time I was promised this would be escalated to a supervisor for a call back to me within 24 hours. I have NEVER received a call back, I receive conflicting information each time I have called, from being told it will be received by XXXX no later than XX/XX/ ( still hasnt happened ), to they will will wire to my bank account and took my bank information ( which I was told on XX/XX/ they dont return directly to customers accounts, so now they have by routing and checking account number ), to it takes 30 days to get the funds to either XXXX or me, depending on who you speak with. In the mean time, I had to borrow the money to make the XX/XX/ payment to XXXX so this would not negatively impact my credit. In the meantime, Ditech is holding me and my money hostage, and I am not receiving good customer service. They are just hoping I will go away, which I will once the payment is returned to me or XXXX. Every Call Center I have spoken with is pleasant, except the one that disconnected me when I said I would hold for a supervisor and not wait for the call back that would never come, but they do not seem to have the proper training, nor the procedures in place to know how to handle these types of calls.

Complaint: Hi my name is XXXX XXXX SS XXXX loan # XXXX I apply for loan modification last year bacause Im passing a hard economic problems and with me son going to university and the extra experience I was forse to ask for help On XX/XX/XXXX my mortgage company direct help me with the modification and quality In XX/XX/XXXX I started my 3 months of prove and on XX/XX/XXXX I finally got my modification paper to finish all the process. On XX/XX/XXXX I notarized all papers and send them back to them but they called me to said they dont have the paperwork They resent me another set of papers to notarized again which I did and send them back again Now I get a letter saying that my modification was canceled because they did not receive the paperwork. I talked to the supervisor on duty and she said that I have to re aplay again And because I dont have proven of being send the paperwork now is canceled I want to safe my house Im been pay it for XXXX I did all I was told to do and only because they said they dont have my paperwork Im loosing all I need you help and I hope you can help me My cellphone is XXXX XXXX

Complaint: On XX/XX/XXXX I submitted my application for a loan modification to Ditech. I was told that within 30 days I would receive a response from Ditech with a decision by mail. I waited and waited. I called Ditech each week and spoke frequently to XXXX XXXX in the loss mitigation department. He assured me that my file was complete and the underwriters were still reviewing my application. I had waited 102 days to receive an answer from Ditech on my loan modification application. I grew increasingly frustrated and my local bank recommended that I file a complaint against Ditech. It wasnt until I filed a complaint with the Consumer Financial Protection Bureau on XX/XX/XXXX, that I heard from Ditech regarding my loan modification application decision. They sent me XXXX letters that were date marked on the letters XX/XX/XXXX but ironically not received by me via United States Postal Service until XX/XX/XXXX. In the letters ( both marked with the same date ) the first indicated that my file for loan modification was indeed complete and to expect a decision within 30 days. In the second letter, it indicated that I was not eligible for a loan modification. I strongly feel that my denial of a loan modification was the result of retaliation after I filed my complaint with the Consumer Financial Protection Bureau. Furthermore, my reason for requesting a loan modification was due to divorce between my husband and I. I have negotiated a settlement with him that will allow me to keep the home and resume making on-time mortgage payments in the previous amount owed each month. I am requesting that Ditech add the outstanding payments to the end of my loan or spread the amount overdue over the course of several months to allow me to become current again. Finally, the value of my home as established by Ditech ( AVM ) was found to be {$220000.00} when in fact, I have an appraisal for {$350000.00}. This creates nearly {$120000.00} in equity that can be used to help me re-establish my loan through Ditech rather than pursue foreclosure, short sale, or deed in lieu of foreclosure. It is my intention to keep my home and I am willing to do anything to make that happen. Respectfully submitted, XXXX XXXX

Complaint: ever since ditech took over my loan I have had nothing but headaches with this company. I was sent an escrow surplus check on XXXX for XXXX. I e-mailed ditech in XXXX to apply the check to my escrow. It is now XX/XX/XXXX and they still have not done so. Then I get my mortgage bill and ditech said I was short XXXX and raised my house payment. I keep getting form letters in the mail but no one is fixing the problem. 2nd complaint in XXXX they took my taxes out in the middle of the year, I filed a complaint with y'all they told you they had fixed the problem well they lied they never fixed it and turned around and did it again in XXXX ditech says on their web site they collect taxes 20 days before due date. The due date for taxes in XXXX NC is XX/XX/XXXX. They sent me an e-mail in XXXX saying they had paid my taxes so I went to the tax office my taxes had not been paid. And ditech proceeds to tell me that I was short. Well duh! If they had taken my taxes out like they were supposed to I would not be short. The ditech check was a XXXX XXXX XXXX check. ditech is a predatory lender. They also gave false information on my XXXX form. They say they have had my loan since XXXX, which is false.They tell me they have paid out my taxes and insurance when in fact they have not they change the dates to reflect something else. They sent me an e-mail that taxes were paid in XXXX and then I get an escrow statement that says they were paid XX/XX/XXXX which is not true. They do this in order to make looke like I was short and to raise my house note. Where I come from that is called stealing. Something needs to be done about this company they are crooks and commit mortgage fraud on a daily basis then lie and say they have fixed the problem which they never do. There are so many RESPA laws being brokenand no one is holding ditech responsible. If call them on the phone they talk in circles which I thought they were supposed to fix the last time the attorney generals office took them to court. They are not abiding by any of the mortgage laws. Now I pay my house payment on time every month. I DO MY PART make them responsible for their part and just because they tell you they have fixed the problem they really haven't and your office needs to check up on them to make sure they have followed through NEVER take ditech 's word for anything.

Complaint: Due to the change in property tax law put into place for XXXX, thousands of homeowners paid their taxes in XXXX. I contacted Ditech initially to see if they could release the funds but they were unable to do it prior to the end of XXXX. They instructed me to pay out of my own funds and send them the verification the taxes were paid, and they would refund me the appropriate amount. I dutifully paid the taxes due and sent Ditech the verification. Weeks passed and I received refunds from my 3 other mortgage servicesr, but nothing from Ditech so I reached out again by phone and email. They promised to get back to me and never did. To date, I still have a message in their apparently worthless message center fromXX/XX/XXXX that remains unanswered. I called again and was told they would do an escrow analysis -- still no call or email. I just went on line and the brilliant conclusion by the band of roving XXXX is that my payment will not be increasing! No Kidding?! Meanwhile they still are sitting on my over-funded escrow account doing nothing. I just called again and after 15 minutes on hold, the call was answered and I was forwarded to an automatic survey which then hung up on me! It seems curious that this company with nothing but complaints continues to exist. Completely XXXX customer service and frankly illegal activities to hold my funds in excess as they have been for the past 3 months!

Complaint: With the new XXXX Tax Law I considered paying off my mortgage due to fact that my Standard Deduction will double. A {$50000.00} principal payment was made on XX/XX/XXXX. This payment was made via check from XXXX XXXX to Ditech Financial LLC ( " Ditech '' ) XXXX, XXXX XXXX XXXX, XXXX XXXX, SD XXXX on XX/XX/XXXX. Ditech cashed my check on XX/XX/XXXX. The allocation of the principal & interest was not processed until XX/XX/XXXX. I have tried to resolve this issue with Ditech since my first phone call to Ditech on XX/XX/XXXX. After this initial call I have had 9 additional correspondence with Ditech. The last call made XX/XX/XXXX to Customer Service said I wouldn't receive an answer until possibly the end of the month. Each call to Ditech never initiated a return call the rep mentioned and/or promised. I always had to call back and talk to someone different and review the entire scenario all over again. My wish and/or request is to simply apply what principal amount I have coming and that has yet to be completed.
