Complaint: We received a late fee notice dated XX/XX/XXXX. Ditech Financial changed our payment amount but did not inform us. On XX/XX/XXXX I called to ask them to waive the late fee. I spoke with XXXX at XXXX and he was unable to remove the late fee. I also spoke with his supervisor, XXXX, and she was also not able to remove the late fee. I am asking for a refund of the late fee off {$56.00}. I'd also encourage you to investigate Ditech 's billing practices. This is the second time this has happened to us in a year and it appears Ditech may be failing to send new payment notices or sending them disguised as frequently disposed of marketing collateral in the hopes of increasing revenue through late fees. We have gotten the late fee notices both times but not the payment due notice either time.

Complaint: I put my home for sale XX/XX/XXXX ... dropped the price multiple times with no buyers. In XXXX of XXXX we started the short sale process with Ditech, with a qualified buyer. Since then it has been an endless cycle of submit paperwork ( tax returns, paystubs, any revenue streams, hardship letter, etc. ), they hold it for so long ( about two weeks ) and then they want more recent info. I submit the updated info over and over, then they ask for something else but it is always the same results, like this is some sort of game. In XX/XX/XXXX, they claimed I asked for a modification ( not a short sale ), but that I was denied. I NEVER asked for that (? ), my taxes went from $ XXXX to $ XXXX in XXXX years and I knew that I couldn't afford to reside there anymore. They then admitted it had been a mistake in their system, so we began the paperwork merry go round again. My real estate agent suggested a lawyer may help speed the process, because by now several months had gone by again, so I hired one in XXXX. Same thing, they asked for a current P & L statement, and other information, which was already provided to them several times prior. So once again, I provided all info in a timely fashion. Summary : They ( Ditech ) have all the information regarding my P & Ls, from XX/XX/XXXX through XX/XX/XXXX, held it for two weeks, and now demand a quarterly statement of XX/XX/XXXX through XX/XX/XXXX. ( There is definitely a pattern here as you can see ) So another delay and change up tactic by Ditech, since they already have the pertinent information that they have requested. I have yet to be formally notified of the sheriff 's sale, I only know because my lawyer told me. Aren't they required to notify me by certified mail? According to my lawyer, they refuse to stop the sheriff 's sale while they consider the short sale, even though this has been held up by them since its inception in XX/XX/XXXX (? ) My Ditech account number is # XXXX. All correspondences on our end have been done via email by my realtor and or my attorney. I can take the time and get copies of those email chains if necessary.

Complaint: I am a customer of Ditect Financial LLC and I have a mortgage loan with the company. I have been regularly paying off my monthly bill without any delay every month. And I have been doing this through a standing instruction through my bank. In the month of XX/XX/XXXX, my premium increased by {$28.00} from a monthly payment of {$1600.00} because of an annual rate change. Since I had set the payment method as automatic, my bank sent them the old amount of {$1600.00} which was short by {$28.00} in XX/XX/XXXX. As soon as I realized the problem, I made the additional payment of {$28.00} within 30 days. However, when I received by bill dated XX/XX/XXXX, I was slapped with a late charge of {$82.00}. I called Ditect to explain the situation and requested them to waive the late charge since I thought it was unfairly high and more so because I have not defaulted before and that too it was a genuine oversight which I corrected immediately. They refused to comply stating that the fee was justified. I requested to talk to the supervisor who also declined my request. I am being asked to pay a fee of {$82.00} for a late payment of {$28.00} by about 15 days. Ditech seems to be engaging in unscrupulous and unfair means of collecting additional fees from its customers. I would like the situation to be rectified.

Complaint: My name is XXXX XXXX I live At XXXX XXXX XXXX XXXX XXXX va. On XX/XX/XXXXI called Ditech my morgage company and asked them how much is needed to bring my loan current since I was behind on my payments. They gave me the amount of XXXX cents. I went to XXXX and made that payment using their bill pay process. On XX/XX/XXXX i called ditech again wanting to make my usual monthly payment thinking I am all caught up only to be told by the representative that my payment was not accepted and that we are under foreclosure. I asked for the name of the attorneys office and asked for the reason why was I not alerted I am in foreclosure and why did i not get correspondance. I was not given a reason for either. I called every day since then up untill XX/XX/XXXX asking where is the payment that i gave them for XXXX and what is the name of the law office handling my case. Not once did they gave me answer to either. On XX/XX/XXXX I received a lettwr from XXXX XXXX XXXX XXXX wanting XXXX for the missed payments and XXXX in attorneys fees. I called ditech and law firm again asking why am I paying this and why am I given a forclosure letter dated for XX/XX/XXXX when they got full payment onXX/XX/XXXX. Since then I have been calling various non profits, ditech and XXXX XXXX wanting to get my money back for XXXX that was the amount past due so I can make most current payment again and for the XXXX fee to be removed since I paid the balance owed way before this letter was sent. Ditech has been putting me on hours long holds and when they did speak to me it was in a rudest manner but money was never sent nor was I given any straight answers for 1. Why was I not initially notified of forclosure beforeXX/XX/XXXX? Why was my payment not applied and/or why was it not returned on time to me its been over month and a half and why am i paying attorney fees for debt that was paid month before? I feel like they been purposely dragging so the time XX/XX/XXXX comes around they can do a foreclosure and take my home. I have been living in constant fear and there is XX/XX/XXXXchildren under the age of XX/XX/XXXXliving here. All we want to do is pay our mortgage and move on. I was also told by ditech that if i was not lazy I would walk my XX/XX/XXXXto the library and fill out modification papers back in XX/XX/XXXX when I tried to reach them in regards to trying to find a solution to not losing my home. This was another issue before payment was made I requested modification papers at least 4 times and no luck. Enclosed you will find uploads of the letters and proof of payment.

Complaint: I set up an Electronic Payment to occur on XX/XX/18 for my regular amount of {$1500.00} plus an additional {$8000.00} of principal. The whole {$9500.00} came out of my bank and was credited on XX/XX/18. However, they DID NOT apply the {$8000.00} to paydown of principal. They applied it to XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX regular payments, costing me an extra {$1500.00} of interest. This is the 7th time that DiTech has erred/refused/failed to apply a prepayment of principal to my principal balance within the past year. They are downright fraudulent! I call and call and call before getting them to correct their error/fraud. That's stealing. If I did that, I would be in jail.

Complaint: This mortgage company took over my account and immediately started attempting to charge me late fees for my payments. When I would call to dispute such charges the representative would tell me that month 's payment was applied to the prior month and that I was a month behind. I have never missed a payment and have all of my bank statements and cancelled checks to prove such. Each time I inquired which month they claimed was missing no one has ever been able to tell me. The burden of proof is on them to prove this false accusation.I have refused to pay any of these " late fees '' as I do not owe any. I have continued to pay my monthly mortgage and have been doing so for 26 years.I also always mail my payments 7-10 days early to assure they arrive by the due date. This company is a predatory mortgage company and have deliberately mismanaged my account in an attempt to gain extra funds from me and in the recent weeks threaten me with being in default. They have cashed recent mortgage payments and not credited me and have deliberately held my payments and cashed them after the due date in the past in order to charge me a late fee. Again, I always mail my payments early enough to arrive before the due date. There is no way such payments arrived late. This company also has sent offers in the past to " wipe away '' all late fees if I refinance with their company.This would cost thousands of dollars and leave me with a higher interest rate than I currently have. This again shows their predatory nature and what their true intentions are. This company has over 12,800 complaints with the CFPB and should be highly investigated.

Complaint: Ditech Financial has not credited my fixed rate mortgage account with interest paid. I made a payment for XX/XX/XXXXthat Ditech received on XX/XX/XXXX. Instead of applying extra funds to the loan as agreed, Ditech applied part of my payment toward the interest for XX/XX/XXXX, calling it " prepaid interest. '' This was the only prepaid interest ever shown on the account. They set the next payment as due XX/XX/XXXX. I wrote and called them about the error. Ditech told me they had fixed it and all extra funds had been applied to the loan principal. They re-set the next payment due as XX/XX/XXXX. So after this, the XX/XX/XXXX payment should have been wiped out, as if it had never been made. The prepaid interest figure should have gone away. It did not go away. When I made a payment on XX/XX/XXXX, Ditech subtracted the prepaid interest amount from the interest due for XX/XX/XXXX. I ended up with a negative figure for interest paid, on the XX/XX/XXXX statement. I wrote to Ditech, told them exactly what the statement should show, and why the negative interest was an error. Ditech wrote back a month later. They do not recognize any error on the statement. They have not fixed the problem of the prepaid interest in XX/XX/XXXX counting against this year 's interest. Since it's a problem of their refusing to credit the account with interest paid as of the date received ( XX/XX/XXXX), aren't they required to fix it? I don't know how the loan could be transferred to a different servicer or how the XX/XX/XXXXtax form will be correct if not. Basically, they are refusing to service the mortgage. Ditech doesn't have the capability to automatically apply extra funds as they say they will. They keep applying them to future months after assuring me they will apply them to the principal. Then I have no payment documentation. This amounts to a penalty for trying to reduce the loan principal. XXXX XXXX should not allow them to service mortgages if they will not service them.

Complaint: I pay my mortgage electronically I usually add an additional XXXX for principle payment every month. I paid and extra XXXX to principle in XX/XX/XXXX and noticed the payment wasn't applied correctly even though the system and payment method was abundantly clear when I submitted it online. I called to have to payment reallocated and asked them why it wasn't applied correctly they told me the system had a glitch and said since the payment was over a regular payment amount it just future pays instead. I let is go because I don't normally pay that much every month. I decided I wanted to try and start applying an extra XXXX every month I could so this month on XX/XX/XXXX I did that. The system once again applied it to future payments even though I clearly applied it correctly as stated in the correct fields in the online system. They are being deceptive in the practices for payments to hope that clients don't pay attention and they get more money towards interest verse the clients expectations on the principle balance they are trying to pay down on. I shouldn't have to call every time I pay extra and have them fix it. This is a shady company in my opinion. I want all my online payment to be applied correctly. The system states it can be applied up to XXXX so I'm not sure why it's not. When I call they say it's a glitch or I'm not applying it correctly and that is not the case. My email receipt reflects exactly how I applied it. But some how when I see how it was actually applied it's future posting and not being applied to principle. This is very deceptive. Please look into this and help find a resolution so every month when I apply my extra money to be rid of the shady company I'm not wasting my time calling every month to have my payments fixed which they hope people won't look so it's in their favor.

Complaint: To whom this may concern, XX/XX/XXXX Apparently, there is a fraudulent account in my name with my social security number and current home address attached. A judgment in the amount of {$53000.00} has been created against me because of this fraudulent account not being paid ; because of this judgment against me, I am unable to sell my home without paying the lien and move on with my life. According to the credit application, this account was opened XX/XX/XXXX. The company that has placed this lien against me is called Ditech Financial LLC. A couple of months ago I contacted someone by the name of XXXX from Ditech and informed him of my situation, and he made me aware that I needed to dispute the charges. I was also made aware that an investigation would take place soon thereafter. The process of the dispute had me to manually fill out paperwork before a notary and initiate a police report. There were no issues with this process especially since the original paperwork was done manually. The attached paperwork contains the original installment contract, credit application, the title, the dispute denial, and the dispute paperwork which contains my writing. Accordingly, I felt like whoever could clearly see the differences in handwriting since I was able to see the original installment contract that they had on file. So now I am at the point of feeling like I am getting the run around because its getting harder to speak to anyone about this and recently they have stated that my claim has been denied. This is difficult to accept because the handwriting on the application is not mine, and the credit application signature block stated signature on file. To me, this means they did not even sign the credit application! This account was fraudulently created because I was never or had any understanding of the signing process. Therefore, any signature on any of the attached paperwork for credit is not mine and I am without a doubt disputing.

Complaint: Ditech home loans was my mortgage company. My mortgage was sold/given/bought by another holder. I sent 3 payments by XXXX XXXX XXXX bill pay to Ditech after my account was closed with them. The amounts were XXXX each payment. One payment was forwarded to my new lender. The second was mailed to me. The third payment is being held by Ditech. They have acknowledged that I sent 3 payments and realized that they have not returned my final payment. This has been going on for 5 months. I have called and spoke with several persons regarding this matter and have been told every time " the check is in the mail '' and to wait a few days. Ditech sent two checks out to me which I never received and asked for my routing number so they can deposit it into my account. I gave them 2 weeks to do that and still I have not seen my money.

Complaint: I'm a recent widow of a totally and XXXX XXXX veteran, who passed XX/XX/XXXX. VA stopped payment of pension in XX/XX/XXXX7, mix up of claims prior to purchase of modular home. For fives years we have been putting in claims for service-connected compensation. No monies have be received since. Have paid mortgage up until XX/XX/XXXX. Husband has had symptoms of XXXX XXXX and last base was XXXX XXXX for three ( 3 ) years. Have notified, mortgage company of death, and asked for a deferment until DIC and Pension are received. Have the office of representative of the congressman helping to expedite claims. In the mean time the VA have paid my utilities for one month and I haven't received SSI yet. In desperate need of assistance, as I'm a senior with no money as of yet.

Complaint: My wife and I started having trouble paying our mortgage after my wife was diagnosed with XXXX and quit working. We started the loan modification process, which was a lot of work. We knew there would be applications and documentation that would need to be submitted, but it seemed like everytime we completed a task, suddenly there would be an unseen hoop wed have to jump through. We brought in some help from a local HUD agent, which helped get things moving. We finally got to what seemed like the last step of the process, which was a letter of explanation regarding who was listed on the title of our home XXXX my wifes name is on the title, but not the actual loan ). I drafted the letter, faxed it in within a day or XXXX, I even explained that the title included my wifes maiden name and had since changed since we were married. Well, my mortgage company came back and said I was denied because I was unable to provide a clear marketable title .... My HUD agent tried contacting the company, but could never get a straight answer as to why, other than having my wife listed on the title of OUR home, we were denied.
