Complaint: I originally filed a complaint on XX/XX/XXXX, Complaint Number XXXX and Ditech did not answer the questions asked nor did they provide the correct documents ( which I will attach in this complaint ). The escrow account is still short over {$3000.00}. I am attaching documents that outline the following : 1. The tax payments were taken from my OLD LOAN in XX/XX/XXXX., XX/XX/XXXX., and XX/XX/XXXX, before the closing ( document that was attached to the surplus check we received ) 2. The 2nd and 4th pages of the closing document ( information was blacked out in the letter received from Ditech regarding this complaint ) where {$3100.00} was put in escrow at closing and then taken out of the new account two weeks later. No one notified us from the mortgage company that our NEW loan started out with XXXX in our account. 3. Attached are 3 XXXX XXXX from XX/XX/XXXX and XX/XX/XXXX. In XX/XX/XXXX there were property taxes paid from the OLD ACCOUNT - Loan # XXXX, in the amount of {$2000.00}, which is the amount that we have been missing in both XX/XX/XXXX and XX/XX/XXXXto have the XXXX XXXX correctly reflecting the taxes paid for that year. If you look at all the documentation there were 3 payments made to the tax assessor in the first quarter of XX/XX/XXXX. One from the old account and 2 from the new one. 4. In the letter from XXXX XXXX, Customer Care Mgr. from Ditech, on the first page she states " The Tax Detail also shows that due to the duplicate payment, you paid {$11000.00} in taxes in XX/XX/XXXX, but due to the credit of {$2000.00}, only {$7200.00} in taxes in XX/XX/XXXX. '' This is incorrect since there is no documentation showing we paid {$11000.00} in taxes in XX/XX/XXXX. See attachments for XX/XX/XXXX where there are two XXXX XXXX. One tax payment from the old loan and one from the new loan. 5. The escrow refund check sent to us was SURPLUS from the OLD ACCOUNT. The amounts are not the same from the old account vs. the new one that was set up. We were told at closing that the closing costs INCLUDED the {$3100.00} that is detailed on the closing document on Page 2 ( Attached ). 6. We have repeatedly asked over and over if the surplus check was supposed to be in the new account and Ditech " made a mistake '' then where exactly did all the money go that we paid at closing and can we have an itemized list of costs that total {$8000.00} ( which includes the {$3100.00} escrow amount ). Also, the amount of the surplus check and the escrow amount originally put in the new account are not the same. Please have DItech look at this case again and resolve our escrow and tax issues. Complaint: Ditech has refused to send statements on a monthly basis to cut down paperwork, they also have not reported my payments to the credit bureaus. Now I will no longer know if they have received and posted my payment or have any balance information given to me like they use to and I believe this is unfair. The company claims they want to cut down on sending paper statements. Now I will loose all track of payments and balance history unless I call them monthly or request a payment history which means they will have to send paperwork anyway so this is unfair and makes no sense. This kind of behavior with these companies has to be stopped. Consumers seem to have no more protection of our second mortgage debt and that should be against the law.

Complaint: I recently filed a complaint about this under complaint # XXXX. Ditech responded but gave you false calculations and you closed the case. I responded to their response. According to DiTech they paid taxes in the amount of {$1500.00}, {$1400.00}, {$1400.00} and {$1600.00}. The tax Bill shows {$6100.00} that would only be a shortage of {$94.00}. No dates of payment do not appear on my copy. Ditech paid homeowners in the amount of {$1000.00} The Premium is {$920.00} A difference of {$140.00} {$6100.00} + {$930.00} = {$7100.00}. DiTech shows a beginning balance of escrow as {$9400.00}. That is an overage in escrow of {$2300.00} in my favor. How is it possible that my payment went from {$1000.00} to {$1200.00}? Please also note records from a conversation with XXXX of DiTech who admits a mistake on Ditech 's part. If you look at the picture I sent you of DiTech 's Escrow eval you will see that added an extra tax payment of $ {$1600.00} ( E ). XXXX said that was a mistake right there among others. That there was an overpayment in Escrow and she couldn't fix it so she had to escalate it to the escrow analysis dept. Not only was there no response to the escalation, but fees are accruing and my credit is being damaged. Thank you for your time.

Complaint: its Ditech.com that is perpetually SO IMPOSSIBLE TO access to log into my account is like breaking into XXXX for two years, once in a lifetime u get into the home page, clicking the log into my account gave you Error page. i spent tons of money calling from overseas n the answer they gave u is " dont use iphones, and when i said i did not n they came up with other excuses like we can get on fine, it must be your network!!. i have complained n send them emails n they got back with a do not reply email that simply condescended you with someone will be in contact ... .3-5working days, WHAT THE HECK??

Complaint: My XXXX Personal Credit Report contains three inquiries made by XXXX XXXX XXXX XXXX on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. The stated purposes are for account review and promotion. All of these inquiries were made illegally, I have had a promotional block on my XXXX file since XXXX, a permanent security freeze in place since XXXX, and I have no account with XXXX XXXX XXXX XXXX. XXXX was notified and promptly deleted the inquiries from my file since none were permissible. Apparently this company willfully evaded or circumbvented the safety measures I put in place to prevent unauthorized release of my private information.

Complaint: I closed on my house in late XX/XX/XXXX - ditech owes me over 1300 andstill has not paid me as ofXX/XX/XXXX. First I was told they sent the check to the house I sold. Then I was told they needed to investigate. Then I was told I has to wait another 10 days so they could cut another check. Last week I was told by the manager XXXX ext#XXXX the check was in the mail- still no check all I received was a letter saying they were looking into the matter. I have already reported this company to XXXX and need someone to look into this - I think there is a law that they only had 30 days- next I will speak with my attorney about legal action against this company.

Complaint: My monthly mortgage payment should be revised to reflect that my total monthly payment is about {$980.00}, and not {$1000.00}. Ditech has continuously sought to increase my monthly mortgage payments without reason, after repeated attempts for clarification or information supporting same, and have ignored the fact that my wife and I have the Louisiana Homestead Exemption. A. Background My wife and I purchased the home located at XXXX XXXX XXXX XXXX in XXXX XXXX, LA on about XX/XX/XXXX. In connection with that purchase, we signed a signed a mortgage loan agreement with XXXX XXXX XXXX XXXX, our previous lender. That lender subsequently sold the loan to Ditech. From at least XX/XX/XXXX up until at least XX/XX/XXXX we made payments to payments on this loan towards the principal, interest, and escrow account each successive month in the amount of {$980.00}, the total amount of our monthly mortgage payment agreed upon with our previous lender. Every Ditech billing statement which I received on this loan from XX/XX/XXXX to XX/XX/XXXX showed the total escrow amount due as {$380.00}. Subsequently, around XX/XX/XXXX I received notice from Ditech that our total monthly mortgage payments would be increasing in the range of {$1000.00} to {$1000.00}. I inquired with Ditech representatives over the telephone several times as to why this increase occurred. I was advised to check with my property insurance carrier or my Parish/County Tax Assessors Office as there may have been an increase in my insurance premiums or taxes. B. No Evidence Exists for Ditechs Increase in My Mortgage Payments My property insurance provider has confirmed that my property insurance premium has not increased. My agent confirmed that my yearly property insurance is {$1200.00}. Thus, my total monthly escrow payments to Ditech for my property insurance would be {$100.00} ( $ XXXX ). My yearly flood insurance premium did go up ( from about {$1300.00} to {$1300.00} ), which is an increase of {$15.00} over the year which would result in a negligible increase of about $ XXXX/month for my escrow payments to Ditech. Thus, my total monthly escrow payments to Ditech for my flood insurance would be {$110.00} ( XXXX ). The XXXX XXXX XXXX ( XXXX ) Parish Tax Assessors Office showed an increase in my property taxes of about {$120.00} for the year XX/XX/XXXX ( my XX/XX/XXXX property tax bill was {$1600.00}, whereas my XX/XX/XXXX property tax bill was {$1700.00}. {$1700.00} - {$1600.00} = {$120.00} ). However, my XX/XX/XXXX XXXX property tax bill notes that I have the Louisiana Homestead Exemption resulting in {$780.00} less in yearly property taxes, for a XX/XX/XXXX total property tax assessment of {$970.00}. Thus my monthly escrow payments to Ditech for my XX/XX/XXXX property taxes would be {$81.00} ( $ XXXX ). Thus, my total monthly escrow payment to Ditech for taxes and insurance from XX/XX/XXXX to present should be about {$290.00} XXXX {$81.00} + {$110.00} + XXXX ). I may be required to have mortgage insurance on this property, which is indicated in the XX/XX/XXXX escrow analysis as {$1000.00}, which would amount to monthly charge of about {$85.00} ( XXXX/XXXX ). Thus, my total monthly mortgage payment should be no more than {$980.00}. ( principal of {$200.00} + interest of {$390.00} + {$290.00} escrow + XXXX for mortgage insurance ). However, Ditech contends that my monthly mortgage payment is {$1000.00} to {$1000.00}, for which purported increase Ditech has provided no evidence, or explanation. C. Ditechs Escrow Analyses Provide No Assistance Ditech has performed two ( 2 ) escrow analyses on my account. Ditechs XX/XX/XXXX escrow analysis appears to show a projected yearly deficit of exactly {$590.00} in three different categories - in what is needed to pay for my XX/XX/XXXX flood insurance, property taxes, and property insurance, which would amount to a total of about a {$1700.00} over the year. As I have shown above, such a deficit is baseless and unfounded. Secondly, Ditechs analysis specifically indicates I only owe a deficit of {$590.00}, which again is baseless, and illogical given its breakdown. Third, this analysis indicates that a monthly escrow payment must be made in the amount of {$1000.00} as mortgage insurance. However, no prior bill from Ditech mentions this in any past payment breakdown.

Complaint: I own a house for 12 years but when the lender keep selling my loan around in some how they record my house is foreclosure for 7 years and transfer my house to some bank name. When I do a refinance my house 4 years ago and XXXX XXXX XXXX do my refinance they do it with some loop hole to go through without a right deed of trustee. I been calling the bank for the last 7 years to fix the problem but no one want to help and keep telling me the same answer that the house is mine. If you go to the tax city the house is not under my name. Escrow still take my money every month to pay for the property tax. Now Im selling my house title company cant closed the deal because the house is not under my name. My title company keep called by them and talk to their legal team put they keep send us around and go back to square one no one can help. Please investigate this matter. My family want to move but keep stuck in this house for so many years.

Complaint: I submitted a complaint # XXXX regarding an error on my title. I recently applied for a home equity loan and during a title search found an error from a previous lender. I refinanced a first mortgage and home equity line of credit with XXXX in XX/XX/XXXX. Both the first mortgage and home equity ( +closing costs ) were consolidated into one mortgage loan at this time. In XX/XX/XXXX, three years later, XXXX submitted a lien for the mortgage and another lien for the additional money extended to me to satisfy the old HELOC and closing costs. There must have been some confusion, my complaint did not refer to my current HELOC that now belongs to XXXX. This loan was recorded correctly and is current. My complaint is with the new mortgage dated XX/XX/XXXX described in the Consolidation, Extension and Modification Agreement. XXXX not only recorded the new HELOC, they recorded the refinanced mortgage and {$11000.00}, the portion of the new mortgage as a separate lien. I am disputing the recording of {$11000.00} lien, it is not valid. It was consolidated into a new mortgage {$120000.00}. This loan now belongs to Ditech and they have not been helpful in aiding me to remove the error. I am looking for a letter that states that the {$11000.00} was recorded in error to submit to the XXXX County Clerk 's office to have the lien removed. If you refer to the response from the previous complaint I submitted, this same conclusion was made. I am submitting the Clerk 's recording page dated XX/XX/XXXX to prove this lien exists.

Complaint: RE : Alleged Loan # XXXX Lawyer for Ditech Financial LLC/Green Tree Servicing - XXXX, XXXX & XXXX XXXX ; XXXX XXXX. XXXX XXXX. Alleged File # XXXX 1 ) Mortgage originally with XXXX XXXX. XXXX XXXX/XXXX XXXX XXXX., handled monthly billing. In XX/XX/XXXX/XX/XX/XXXX our Mortgage was " Mistakenly '' placed in Foreclosure. I spoke to 2 Representatives who confirmed. We tried to make a payment & couldn't. We got a loan & paid back amounts to insure our home was removed from Foreclosure so we could make a payment. None of the Advance Fees were ever Credited back. We also filed a Mortgage Co Review with OCC regarding XXXX XXXX/XXXX XXXX XXXX., several years ago, regarding the Illegal Mistake & " Robosigned Foreclosure proceedings in XX/XX/XXXX - XX/XX/XXXX. 2 ) Several years ago XXXX no longer maintained Mortgages and Mortgages were turned over to a company called XXXX. I tried to make a payment and got an error our Mortgage Loan information could not be found. Several weeks later we received a letter from Green Tree Servicing. Since then they have tried to collect on a Property Inspection for XX/XX/XXXX paid off in XX/XX/XXXX or I couldn't have reversed the Illegal and Mistakenly & Robosigned XXXX XXXX Foreclosure. I wrote Green Tree Servicing approximately a year later, asking for proof & copies of Lending Agreement Contracts with them containing our Signatures. Their reply, " Mortgage Companies do this all the time. '' My understanding is this is in violation of the Truth in Lending Laws, which I believe was enacted to prevent fraudulant Lending practices such as we feel were experiencing. Since then, first Green Tree Servicing and then Ditech Financial LLC. have sent us NEW Mortgage Loan documents for us to sign, which we have NOT done. We have never opened any of the envelopes ; but we could tell what was inside. A couple of years ago, we stopped receiving communication from Green Tree Services, and began receiving communications and alleged Loan Statements from Ditech Financial LLC. A year or so later, we received a check from Green Tree Servicing for {$10.00}??. We then began to receive We chose not to deposit or cash this check. Since Green Tree Servicing/Ditech Financial LLC has become involved, our alledged Mortgage Balance has increased over {$6000.00}. We have been a couple of months behind in our payments due to financial struggles the past several years. We've tried to continue to make payments, best we can to keep our Home from Foreclosure proceedings. We have not sent a Written Cease Communication to Green Tree Servicing/Ditech Financial LLC as we normally do with Debt Collectors, because of fear and suspicions they would immediately Foreclose on our Home. Also, since Green Tree Servicing/Ditech Financial LLC has become involved, we have NEVER received any Annual Mortgage Statement from XXXX or XXXX as we did when XXXX XXXX/XXXX XXXX was involved. Plus we were ALWAYS able to make payments online at XXXX XXXX! This is no longer the case as XXXX & XXXX are NO longer involved. Also in XX/XX/XXXX we changed our Homeowners Insurance Co., from XXXX XXXX to another co. Either Green Tree Servicing or Ditech Financial paid premiums to both companies knowing there was duplicate Homeowner Insurance coverages. We received a letter from Ditech Financial LLC 's Attorney, that we JUST SAW last week. This is due to serious Health Issues my husband has been experiencing since XX/XX/XXXX. We sent the Attorney a reply to his letter " Certified Mail '' yesterday XX/XX/XXXX, that we just received and read their letter XX/XX/XXXX ( which is true ) and also stating we have no record of any signed agreement and/or Loan with Green Tree Servicing or Ditech Financial LLC. The Attorney has threatened to immediately begin Foreclosure proceedings ; ( yet we were able to make a payment the end of XX/XX/XXXX ). In the letter from the Lawyer, he states that " Ditech Financial LLC is the creditor to whom the ( alleged ) debt is owed. '' However all of Ditech Financial LLC 's Communication, including in the letter from the Attorney, states they are a Debt Collector. This seems contradictory to me. How can a Company be allowed to collect and/or attempt to collect on an alleged debt when there is no signed Signatures from the consumer ( s ) agreeing to an ( alleged ) debt ; including a an alleged Mortgage Loan with that company? There is no indication that the original Mortgagee is involved or aware of any of these actions ; nor have they attempted to communicate or collect any payments regarding the original Mortgage loan! We also feel Green Tree Servicing and Ditech Financial LLC have assessed Fees and excessive Fees in our alleged account/loan, also not agreed to in any Loan documents with them. We also feel we have the Right NOT to sign any Loan Documents with Ditech Financial LLC ; as Ditech Financial LLC was NOT involved in the original XXXX XXXX XXXX Loan Agreement, with us. Please help us, so we won't lose our Home! And also please help us regarding Ditech Financial LLC., as we do not wish to have any Business dealings with them! We did not have any choice in this matter. Nor do we feel we should be required to sign any Loan agreement documents with Ditech Financial LLC. Also could you please forward any information regarding to the appropriate Laws and Legal Cases that will be helpful in our situation? Complaint: My complaint is with Ditech Financial LLC. They are the collection company for XXXX XXXX XXXX XXXX, The company I had my second mortgage with. I filed bankruptcy around 2013 and my bankruptcy lawyer told me that the law had changed that year so I could not write off my second mortgage, but I didn't have to pay them. Well they have a lien on my house so I wanted to try to settle with them. It started about 4 years ago when I called and talked to a representative who at that time agreed to accept {$10000.00} as settlement. I verbally agreed to that amount as well, but then about 2 weeks later I got a letter in the mail from them stating that it was a mistake that they offered to accept {$10000.00}. Then a few months later I called and talked to them and was told they would accept {$13000.00}, but I would also have to send them that last 2 years of financial statements, which I had already sent them 3 times prior so I told them I didn't want to send it again, because every time I sent it they kept telling me its not good enough. Then the next time I talked to them they now wanted {$20000.00}. This has continued to go up and up each time I talk to them. The last time I spoke with them was about 6 months ago and they now said they would only accept $ XXXX {$40000.00}. I told them at the time I filed bankruptcy my house appraised at {$140000.00} which I owed more than that already on my first mortgage and they said they dont care, that they would get their own appraisal. They keep using these unethical and false tactics to try to get more money out of the consumer. This company was previously known as GreenTree who used the same tactics on their customers which is why they were in the middle of a class action lawsuit which lead to them filing bankrupty themselves and then reopening up as Ditech. Their unfair and unacceptable tactics have not changed. I was trying to do the right thing and settle with them, but they keep on increasing the amount and going back on their verbal agreements with me. I'm looking for your assistance in settling this debt with them for the {$10000.00} they originally agreed on. I want to get the lien off of my home and just be done with this company, but I will not pay them this obscene amount of money they are currently asking for. Especially knowing their history of unethical business tactics that they use on the consumer. I would appreciate any assistance you are able to give me.
