Complaint: TRIED TO PURCHASE A DITECH FINANCIAL FORECLOSED HOME FOR CASH. WE OFFERED {$24000.00} AND THEIR AGENT, XXXX XXXX SAID THEY WOULD TAKE IT BECAUSE THE HOME WAS STRIPPED AND BEEN ON THE MARKET FOR 4 1/2 YEARS. HE SAID THEY WOULD TAKE ALMOST ANY OFFER. THIS WENT ON FOR TWO MONTHS, BUT WE NEVER GOT AN ANSWER. TWO DAYS BEFORE CLOSING, XXXX SAID DITECH WOULD HAVE TO HAVE {$35000.00} OR WE COULDN'T CLOSE. THIS WAS AFTER TWO MONTHS OF XXXX TELLING US DITECH WOULD TAKE THE OFFER.HE NEVER IN TWO MONTHS WAVERED ON THE {$24000.00}, BUT HE ALSO NEVER SUBMITTED OUR OFFER TO HIS BOSSES. HIS BOSS SAID THEY NEEDED {$45000.00}, BUT CALLED TWO DAYS LATER WITH THE {$35000.00} PRICE. THIS WAS ALL AFTER WE WERE SUPPOSE TO CLOSE A WEEK EARLIER AT {$24000.00}. TREATED US LIKE WE WERE THE ENEMY. VERY RUDE ON PHONE. THEY FINALLY ARRIVED AT {$35000.00}, WHICH DIDN'T LEAVE US ENOUGH TO FINISH THE HOME. MY WIFE AND I GOT PHYSICALLY SICK OVER THIS WHOLE ORDEAL. WE DON'T WANT ANYTHING EXCEPT OUR {$11000.00} DIFFERENCE. DITECH FINANCIAL IS FRAUDULENT AND VERY DISHONEST. SEVERAL LAWSUITS HAVE BEEN WON AGAINST THEM. THE FEDERAL TRADE COMMISSION HAS FINED THEM MILLIONS OF DOLLARS FOR UNLAWFUL AND UNFAIR PRACTICES. THERE ARE 63 LAWSUITS PENDING AT THIS TIME. SOMEONE NEEDS TO HOLD THEM ACCOUNTABLE. TRYING TO DECIDE WHETHER TO FILE A LAWSUIT OR NOT. DON'T HAVE ANY MONEY TO HIRE AN ATTORNEY.

Complaint: I received a phone call on my work cell phone number which I have previously written, and Ditech acknowledge not to write or call on my phone number because of the nature of my business. Phones during the day can be a interruption especially due to the nature of my job and I had told them not to contact on this number. BUT today Ditech started their harassment ways again. I was contacted by a XXXX who works for XXXX who stated that he wants to speak to me and I asked him who he was and he said he was from Ditech. I told him that I have a cease and desist on my account and I provided other methods to contact me. I receive all their notices and they must send me at least 3 certified letters telling me how much I owe as well as threats to foreclose. I dont know why they need to call me on my cell phone, to tell me what I owe. I ask to speak to a Supervisor and an XXXX came on the phone. She then tried to tell me that since I applied for a modification that the cease and desist order did not apply since 2017. I told her I just asked for the modification not relinquishing my rights for communication. If a modification will be given then they can send my a letter, which I always get and I will get back to Ditech reps. This company is also calling my ex-wife harrassing her and telling her about my mortgage account, which is totally illegal. She is also considering bringing legal action for harrassment. From what I was told from my attorney, she on the property but not on the account and have no business knowing any information about my debt. That's illegal. She is not on the note.

Complaint: This is follow up to complaint XXXX that was closed before the issue was resolved to my satisfaction. I contacted Ditech on XX/XX/XXXX to inquire about removing the PMI from my mortgage. My property value had dramatically increased and I was quite certain the loan to value ratio had more than been met to remove the PMI. I was told to obtain and submit an appraisal on the house. I questioned them about whether I could do it myself or must go through Ditech and they put me on hold to verify. They came back and told me to do it myself and the PMI would be removed once they received the appraisal verifying the values. I had an appraisal done the following month that showed the value high enough to remove the PMI. But Ditech says they received the appraisal in XXXX ( though I am quite certain I faxed it in before that time ). And they came back by phone to tell me that the appraisal was being rejected because it was more than 90 days old. I got off the phone and searched their website for where it says in writing that the appraisal must be less than 90 days old. I never found anything ( which makes sense considering that Ditech admitted that there has NEVER been a policy allowing a customer to obtain their own appraisal, it has always been required to set it up through the company. They admitted that the agent misinformed me on that first phone call ). And when I received the call from ditech informing me that the appraisal was being rejected, NEVER AT ANY TIME did they inform me I was not supposed to obtain and send in my own appraisal. So at my husband 's urging, I scheduled another appraisal to be done the next morning after the phone call. I was dismayed to receive in the mail AFTER THE SECOND APPRAISAL was already completed a form with a checklist of what to do to have the PMI removed that included contacting Ditech to arrange for an appraisal. I was never told I could not arrange my own appraisal. This was the first I had heard. I mailed the new appraisal in along with the checklist making notations that I was not told I needed to go through ditech to schedule the appraisal. Ditech shows record that they rejected the second appraisal because they don't accept appraisals scheduled by the homeowner. But Ditech never bothered contacting me by phone or in writing that they received and rejected the second appraisal. It was only months later that I realized I was STILL being charged for PMI. In response to complaint XXXX Ditech admitted that I was told wrong by the agent in XX/XX/XXXX and never at any time has the homeowner been allowed to obtain their own appraisal and not to schedule it through Ditech. But they have told me over and over again that I was told by the agent on the XX/XX/XXXX phone call that the appraisal must be less than 90 days old. When I asked for a copy of the call to show proof of this, I was told calls are proprietary and not shared with the public. But I know for a fact that I was NOT told that the appraisal must be less than 90 days old. Why would he mention this if there isn't even a policy allowing homeowners to send in their own appraisal? It doesn't make sense and it is a lie. Later, in the same response to complaint XXXX, the paralegal wrote that I was told " the appraisal must be less than 120 days old '' in the phone call dated XX/XX/XXXX. Their lies are contradicting. And it makes me upset that after months of trying to work this out when I finally ( FINALLY ) got a phone call from ditech, they told me they could not continue the call if I was recording it. Can you blame me? They can record calls but won't provide them to me when requested. But it isn't ok for me to record our calls??? Although Ditech did pay to obtain another appraisal last month and they did refund me on the second appraisal I purchased, I still submit that they should not have charged me PMI from XX/XX/XXXX - XX/XX/XXXX since they received an updated appraisal that was sent in good faith with ZERO knowledge that it would or could be rejected. The newest appraisal shows that the value on my house has gone up more than 20k since the XX/XX/XXXX appraisal was done. Ditech needs to take responsibility for the lies, the misinformation and the poor customer service. I did submit a complaint to XXXX XXXX XXXXXXXX that has had over 12,000 views. I also posted a link to this complaint on Ditech 's official XXXX page. There were 16 comments made to this XXXX post but Ditech has somehow made them private or hidden so that only two of the comments are visible ( see attached pics ). They have that right, but it is sad that they are unwilling to be held accountable for the problems they have caused.

Complaint: XXXX XXXX XXXX tranferred the servicing of this fraudulent loan, that I have been forced to pay them over the years. Ditech in addition of its knowledge that the mortgage lender was not XXXX XXXX XXXX, took the service of such fraudulent loan on XX/XX/XXXX with the intention to stole my property by conducting an evil plan with the aide of XXXX XXXX XXXX, XXXX by refusing payments. First they said, " we have to wait for all the documentation from XXXX XXXX XXXX it might take up to 60 days ''. Then they said on the 60 day " we still have not completed the transfer '', after the 60 days they said, '' we can not receive payments, you have to wait for a letter from us ''. We insisted that they could use the direct payment draft from our bank that XXXX, was using, but they insisted we have to wait for the letter. We made several calls to them the first one was in XX/XX/XXXX to XXXX who told us they have transferred the service to Ditech because they did not inform us. We called them right after and they replied what I wrote above, " we have not received the documents from XXXX you have to wait '', we called them several times each month. but they insisted to wait for their letter. but all of these was just part of their scheme because we discovered that Ditech Financial withdraw a payment on XX/XX/XXXX and then stopped the withdraw of the payments pretending they couldn't do it with the purpose to foreclose and stole our property. Then on XX/XX/XXXX they sent us a letter from XXXX XXXX stating, the full amount to reinstate the loan is {$6600.00} good to XX/XX/XXXX '' they also stated that some charges might not be used by that date. We paid them the entire amount requested before their due date. It was obvious they wanted to lead us to foreclosure to rob our property, because they knew XXXX and they did not own the mortgage because it was satisfied since XXXX. At that time we did not know of this fraud until three months ago. Ditech transferred the servicing to XXXX XXXX XXXX that also knew about this fraud on XX/XX/XXXX. We want an audit history that includes all the payment of principal, interests and fees. This crook had the audacity with the aide of its partner of crime XXXX XXXX XXXX to provide them when I asked for information from XXXX copies of fabricated monthly bills that they never sent, and fabricated letters stating, as if we asked them for a modification, and others as if we appealed their denial. which is a big lie. they again as XXXX and XXXX mentioned the name of a New York trust to be the owner of my alleged mortgage, which trust doesn't exist. The investors who are the ones that funded my loan based on my signature were fully paid.

Complaint: I am working with Mortgage company Ditech. A year ago their website stopped working to make online payments. I tried to pay using different, computers, browser engines and I kept getting the same message " UNABLE TO LOCATE ACCOUNT ) on XX/XX/XXXX I called the company and I got no help their only solution was for me to use a different bank to make online payments, that did not work either in XX/XX/XXXX I continued trying to see if there was any fix on the website and I still had the same problem. I called again and their answer was, It is not on our end is on your end do the payments in any other way. I have been paying late fees {$48.00} because every time I use other methods the payment does not arrive on time. I Called on XX/XX/XXXX and the customer service representative did not offer any solutions other than tell me to email customer service, which I have done in the past and no one ever answer the emails or offer any solutions. I am really frustrated and disappointed with this mortgage company. I am paying late fees because of a mistake on their end. The customer service person XXXX told me that they don't have an IT department, so I question if when I enter my bank account my privacy is being protected, if the can't fix this glitch are the accounts Ditech mortgage owners secure from hackers? Why do they advertise make payments online, when that feature does not work? Is this a scam to make mortgage owners pay late fees? Thanks

Complaint: My original mortgage with Greentree servicing had a monthly late fee that was {$5.00} and imposed after a 5day grace period. Ditech financial bought the loan and I was told yesterday that same fee would be {$65.00} per month applied one day after the payment due date with no grace period. This is a breach of my original contract that I signed with Greentree servicing and should not be allowed.

Complaint: I have damage to my roof and my insurer has paid a claim by check. The check was made payable to Ditech and me, individually. Ditech required me to endorse the check to them and send it to them. They then took 4 weeks to return a check to me. The check they sent to me was payable to my roofer and me. My bank will not let me deposit the check unless the president of the company, who endorsed the check for the roofer, is present. I've asked for a new check to be sent payable to me individually since I've already paid the roofer. Ditech will not do that.

Complaint: My now ex husband applied for a home equity loan in 2004. When the agent came to close the loan at our house she required me to sign all of the documents including the applications. At the time I did not know any better. My husband defaulted on the loan, I started to dispute the validity of the loan. At the time of the loan, I did not work, was not on the first mortgage to the home and did not apply jointly for the loan. I have sent numerous certified letters to Ditech ( XXXX XXXX/Greentree ) requesting the application and underwriting of the loan. I have been given the run around for a year and a half. They originally would only send me the promissory note and a payment schedule. I continued to call, email, and send registered letters for the application and underwriting package. They would not send it. I spoke to their attorney who verified they sent it to someone else 's address ( a relative of my ex ). Finally a year and half later I received the application. The typed one is signed and dated the day of closing, you can see that they typed a earlier date in the corner but the signature date is the date of closing. The handwritten one is not dated at all.. I never received the underwriting. They filed a judgment against me, which I had no knowledge of and I recently had to pay them over XXXX dollars from the sale of my house. Not the one for the HELOC. I told them I would still dispute it but I had to sell the house or risk bankruptcy. Lastly they have yet to even satisfy the judgment 2 months after receiving my funds. The bottom line is I did not apply for joint credit. I did not sign the application at the time of application. My husband ( ex now ) was approved for this without me. I did not work or contribute to the income.

Complaint: I called Ditech for payoff information and was told to cancel automatic ACH and to mail my payoff amount. I did both. Unfortunately, they took my ACH ( they didn't cancel it ) and also took my payoff check. They also owed me more than {$6500.00} in escrow. When I called Ditech the first time to inquire about my refund, they said they would refund my money in 20 days. It's been six weeks and I've called multiple times and each time they have a new excuse for not refunding my money -- from the check is in the mail, to there was a printing error. It's never the same excuse. It's been well over the amount of time they said they would refund the check and, as the amounts total more than {$10000.00}, I am anxious to get the money and am worried they will refuse to pay it back.

Complaint: On XX/XX/XXXX, we entered into an agreement for a loan modification that would be approved contingent upon making three consecutive monthly payments, signing an agreement and my account would be current after three months. We have successfully made 6 monthly payments ( see attached ) and have never received an agreement to sign. I was notified that our home has been scheduled for foreclosure sale because Ditech never received the signed documents. I am sure you will agree that it is impossible to sign a document that you never receive. On XX/XX/XXXX, I spoke with XXXX and he said there was no way to continue the modification. He indicated he would start the process again. I called later the same day and spoke with XXXX to ask for proof of delivery of the documents, assuming that such time sensitive documents would be sent with proof of shipment, delivery and signature required. He notified me that Ditech is not obligated to provide me with such information. He also told me that the conversation I had with XXXX was not true and XXXX would not have initiated a new modification. I asked him to patch me through to XXXX and he refused and said Ditech has no obligation to follow through with their agreement. I highly suggest that this phone call be reviewed.

Complaint: Ditech.com misapplied a payment of mine months ago ( XXXX ) and has failed to fix it. I have called them multiple times, and they have continued to promise that they are " researching the problem ''. However, they continue to send me collection notices and threatening letters, even though they have admitted that they see where the misapplied payment occurred. This has gone on for more than 60 days, and I have been unable to get anything more out of them than " we've escalated it to the VP of our department ''. Meanwhile, they are sending me letters that sound more and more like they are trying to take legal action against me, even though this is not my error. I'm concerned now that they are reporting this to my credit, but they are " unable to confirm '' that as well.
