Complaint: I currently paid off the mortgage with Ditech. The payment was processed with a late fee of XXXX. I called to get additional information and was told that this was assessed from XX/XX/XXXX? I am not sure how I was assessed in XX/XX/XXXX with a payoff and charged additional fees. In XX/XX/XXXX, they sent me a notice that my escrow was short. I sent in the amount they requested, the funds were applied incorrectly and was charged late fees again. I sent the payment in with the payment coupon they provided with my escrow analysis? I had to call 2-3 times to get it applied correctly. Everything was cleared up and my account was corrected. I received statements for XX/XX/XXXX and XX/XX/XXXX with no late fees? Now when I pay it off in XX/XX/XXXX there are late fees?? They have reported my account late to credit reports over these fictitious late fees.

Complaint: Recently I noticed my mortgage was not reporting to any of the 3 credit bureaus, after looking into it I found my mortgage was being reported as closed due to bankruptcy! After speaking with their customer service in XX/XX/XXXX I was told all they would need is my bankruptcy papers from XX/XX/XXXX stating that particular mortgage was exempt. On XX/XX/XXXX I scanned and sent copies of the bankruptcy paperwork showing my property was exempt as they asked. On XX/XX/XXXX I received an email stating that my home could not be exempt from bankruptcy! I called on XX/XX/XXXX to follow up, spoke with 3 different representatives in 3 different departments, customer service, closed loans and blue bankruptcy! No one has taken the time to follow the paper trail that would show this is an open, up to date mortgage that was never foreclosed or in bankruptcy. I did have another loan with the same mortgage company that did go to bankruptcy, I wonder if they are confusing one for another. They say no. I asked to speak with a supervisor on my call of XX/XX/XXXX and was told she was not in the building. Was once again told by yet another account rep that someone would get back to me. In the meantime I can not get the credit I deserve with the loan showing as a closed, and in bankruptcy account.

Complaint: Our mortgage is serviced through Ditech Financial LLC. Loan # XXXX, XXXX XXXX XXXX XXXX. We purchased our home in XX/XX/XXXX and our mortgage was through XXXX. In XX/XX/XXXX XXXX sent our loan to be serviced through XXXX XXXX servicing which has since changed to Ditech. When we took out our loan with XXXX I asked if this was a simple interest loan. I was told yes, however I can not find anything in the documents stating the Interest type. I : also asked if I could make monthly payments over the required amount due and if the overpayment would be posted to the principal on my loan. I was assured that any overpayments go to the principal thus bringing the balance down more quickly and saving on interest paid. I do have a document from XXXX that explains that any overpayment is posted to the principal also. My loan payment was originally {$1200.00} a month. Over the years each month my loan payment has decreased {$4.00} each month. In XX/XX/XXXX my statement dated XX/XX/XXXX shows my payment {$1000.00}. I have been paying {$1200.00} each month since prior to XX/XX/XXXX. In XX/XX/XXXX I changed my homeowners insurance to Ditech which would be included in my monthly payment. My XX/XX/XXXX statement for some reason has my interest due increased from $ XXXXin XX/XX/XXXX to {$500.00} in XXXX thus resulting in the payment increase to {$1100.00} plus insurance {$82.00} totaling {$1200.00}. The XX/XX/XXXX. payment should have been {$1000.00} plus insurance {$82.00} totaling {$1100.00}. I called Ditech inquiring as to the increase from {$1000.00} up to {$1100.00}. I was told it was always this way. I spoke with 4 individuals and none could explain the reason for the increase in my interest. The XX/XX/XXXX. statement showed the Insurance 3 year premium on the statement as charges. I asked if this increase in interest due was because of the insurance premium being added to my loan. They assured me they could not do this due to laws. I still think this is why the interest due was higher. XX/XX/XXXX statement also showed another increase in the interest due of {$580.00} and my payment going to {$1200.00} plus insurance {$86.00} total payment due {$1300.00}. Once again I called questioning this and no one could explain it. XX/XX/XXXX again the interest increased to {$590.00} with an increase in the payment due. All of this brought me to pull out all my statements from the past. With this I realized that since XX/XX/XXXX I have paid more than what was due and no overpayments have ever been posted to the principal. I wrote Ditech a message regarding this and asked them to go back and correct all my payments. I received a notice back saying that they would only correct payments for the past 6 months. When I received the paperwork showing their corrections for the past six months, XX/XX/XXXX through XX/XX/XXXX. It was all hosed up. They backed the payments out and reposted each payment as {$1200.00} due with the overpayment of {$4.00} to principal. Here is what they did : XX/XX/XXXX pmt. reversal {$1200.00}, XX/XX/XXXX Principal pmt. {$4.00}, XX/XX/XXXX payment {$1200.00}. The payment due on the statement was XX/XX/XXXX amount due {$1000.00}. XX/XX/XXXX payment {$1200.00}, XX/XX/XXXX Pmt. Reversal {$1200.00}, XX/XX/XXXX Princ. pmt. {$4.00} the XX/XX/XXXX statement payment was {$1000.00} not {$1200.00}. XX/XX/XXXX Princ. pmt. {$4.00}, XX/XX/XXXX Pmt. {$1200.00}, XX/XX/XXXX Pmt. reversal {$1200.00}, This payment should have been {$1000.00} plus {$82.00} insurance totaling {$1100.00} not {$1200.00} as on the XX/XX/XXXX statement nor the {$1200.00}. XX/XX/XXXX Principal Pmt. {$4.00}, XX/XX/XXXX Payment {$1200.00}, XX/XX/XXXX Pmt. reversal {$1200.00}, this payment should have been {$1000.00} plus {$86.00} totaling {$1100.00} not {$1300.00} as on the XX/XX/XXXX statement not the {$1200.00}. XX/XX/XXXX pmt. reversal {$1300.00}, XX/XX/XXXX payment {$1200.00}, XX/XX/XXXX Princ. pmt. {$74.00}. The XX/XX/XXXX statement payment was {$1300.00} and should have been {$1000.00} plus {$86.00} totaling {$1100.00} not {$1300.00} or {$1200.00}. The amount to principal should have been {$190.00} not {$74.00}! After this month and all this mess, I cancelled my insurance on XX/XX/XXXX. and have gone back with my original carrier. The XX/XX/XXXX statement dated XX/XX/XXXX shows in the Explanation of amount due block, Princ. due {$78.00}, Interest due {$0.00}, insurance due {$86.00}, total due {$160.00}. On the lower portion showing payments made it shows : XX/XX/XXXX Pmt. reversal {$1300.00}, XX/XX/XXXX pmt received -Thank You {$1300.00}. XX/XX/XXXX payment {$1200.00}, XX/XX/XXXX princ. pmt. {$74.00}. The actual payment due should have been {$1000.00} with no insurance as it had been cancelled XX/XX/XXXX. This is just the most recent errors I have found. When I made 2 payments of {$1200.00} each in XX/XX/XXXX one was posted with the principal amount due and the remainder to the interest and the next days payment was broken down with a principal pmt and the remainder to interest. It should have taken approx. {$24.00} for one days interest and all the rest should have paid to principal. I have gone through my statements from XX/XX/XXXX through XX/XX/XXXX and my balance should be less than {$77000.00} they are showing {$82000.00}. In addition, if they had posted the overpayments to principal, the interest due the following month would have been less than what they charged due to the lower principal balance each month. They refuse to make these corrections and will keep all the extra interest they have collected. THIS IS TOTALLY UNACCEPTABLE!!! If they have done this to me how many other mortgagees are they doing this to. They are padding their pocket and that is illegal. Could you please help me get this resolved. Complaint: They told and sent us a statement saying we didn't have mortgage payments for 2 months then they were trying to Default on our home. I am now current on my loan and still being harassed. They are angry that through my chapter XXXX filling we were able to get rid of our second mortgage and ha tried all kinds of tricks to take our home even sending a statement say we had no mortgage payments for 2 months. And even telling me the same thing on the phone. All there phone calls are recorded so it would be very easy to provide. I also have the statement. Since we finished our bankruptcy 42 months payments successfully and have been discharged they have been trying to trick us and harassing us to no end my wife has XXXX and this is to much I am current on my loan can you help me please

Complaint: I'm in the process of selling my home and received a payoff letter which lists a Total Corporate Advance amount of {$1000.00}. I sent an email request on XX/XX/XXXX requesting an explanation of this fee. I received an email with a letter stating " per the terms of the contract, the lender may may necessary expenses in order to protect its security interest in the property. The lender may then seek reimbursement from the customer. Unless arrangements are made, failure to pay the expenses may constitute a continuing default under the terms of the contract. Please find attached a copy of the advances to the account made on your behalf. '' I called Ditech 's customer service department at XXXXXXXX XXXX on XX/XX/XXXX and spoke with XXXX. I explained that none of the transactions add up to the amount listed on the payoff. I had filed Chapter XXXX bankruptcy in XX/XX/XXXX. The mortgage was sold to Ditech ( known as XXXX XXXX at that time ) in XX/XX/XXXX. The bankruptcy was discharged XX/XX/XXXX. XX/XX/XXXX directed my most recent mortgage payment from the principal, interested and escrow, reversed the payment and applied it to corporate advance repayments at that time in the amount of {$1900.00}. It was then necessary for me to make an extra mortgage payment. I contacted Ditech in XXXX via email and phone and had no resolution. I should have continued to fight and question but I seemed to be getting a runaround from the various representatives I spoke with. XXXX submitted a verbal request and it would take up to 30 days to receive a response. I don't have 30 days to wait from today XX/XX/XXXX as this house is going to settlement on XX/XX/XXXX. I need this resolved as quickly as possible. I find that this additional corporate advance repayment fee listed on my payoff letter to be highly unreasonable, especially since my chapter XXXX bankruptcy was discharged 14 months ago and Ditech didn't even originatet the mortgage. I would like to have this unreasonable fee removed from my payoff. I question Ditech 's ethics and the competence of their accounting procedures.

Complaint: Underwent Foreclosure process back in XX/XX/XXXX and got a Loan modification under the Act 91, but due to other debt obligations ended up having to file Bankruptcy. During this course of Bankruptcy recently was discharged and I recently contacted DiTech ( partner with Green Tree Servicing LLC ) to request No Doc Loan Modification ( XX/XX/XXXX ) to enter into a new mortgage agreement and continuing paying in a timely fashion. But after continuing to contact them on a weekly/bi-weekly basis ... no one can provide details on my Loan Mod status ( called on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX & XX/XX/XXXX ). In the interim, I received Foreclosure papers in the mail that a Civil Compliant - Mortgage Foreclosure was filed by XXXX XXXX, Counsel ( XXXX XXXX XXXX, XXXX, PA XXXX, XXXX ) for Green Tree Servicing XXXX on XX/XX/XXXX ... which had the same exact documents filed from the original XX/XX/XXXX filing. They ignored my intention to undergo a Loan Modification and/or at least file with updated documents from current Loan and payments made ( from XX/XX/XXXX thru XX/XX/XXXX ). Being in a much better position than in XX/XX/XXXX ( financial status and mindset ), and having made payments consistently through the Bankruptcy court system ... you'd think that they would prefer to re-enter into a new agreement, sale the loan and keep it moving ... instead of inducing all extra cost of filing for Foreclosure all over again. I am distraught, and all I am trying to do is regain a foot hold on my mortgage obligation and re-establish

Complaint: After receiving a request for payment of an additional amount to my regular payment I made a request for an explanation I was told it was due to an increase in property tax and insurance. I contacted both the town and my insurer and was told by the Town Clerks office my payments included late charges. I will pay both insurance and property taxes as of this date. I simply requested before any additional funds were paid that they provide the following : 1.An accounting of all late charges paid ( insurance and Taxes ) since they acquired the mortgage. ( I don't have any late payments ) 2. Removal and accounting of all mortgage, taxes and insurance as of the call date. 3. The New monthly payment reflecting the removal of property taxes and insurance. 4. Statement reflecting the status during mortgage company acquisition of my mortgage. 5.Immediate removal of late charges and negative credit report due to the new unexplained charges. Whatever the difference I will pay immediately it they are accurate however I am still waiting for the explanation and just received a collections letter from them. Thank you

Complaint: On XX/XX/XXXX, I spoke to XXXX at Ditech with the concern that my unapplied funds balance was not reflecting the XXXX paid every month for the past three years. She told me I had to write to ask for these funds to be returned to the unapplied funds balance account and that sometimes it is applied to principal. I am very concerned that I have to write asking to return the unapplied amounts. I receive notice when escrow/disbursement tax/insurance are paid. I have not received any notice from Ditech explaining to me when the unapplied funds are transferred. I am requesting full disclosure regarding disbursement of funds and asking these funds to be returned to my unapplied funds balance. My monthly billing statement clearly reads that Any partial payments that you make are NOT applied to your mortgage, but instead are held in a separate un-applied funds account. If you pay the balance of a partial payment, the funds will then be applied to your mortgage.

Complaint: My house was listed last XX/XX/XXXX, but I have made multiple attempts at loss mitigation. We finally got a buyer in and Ditech told us the offer was too low. We put it back on the market and got an offer that met what they wanted and then they issued approval. We were so happy. The buyers are a young couple that had to get a loan. Their lender 's lawyer said they needed until XX/XX/XXXX to close. Ditech only gave them until XX/XX/XXXX to close and then set an auction for XX/XX/XXXX. I can not go through all of this for them only to foreclose right before the buyer is ready. There was no reason for them to set this auction RIGHT before the buyer was able to close. We have short sale approval and the buyers are at the mercy of their lender and they are working diligently to close.

Complaint: In XXXX I contacted my mortgage service provider ( Ditech Financial LLC ) about the requirements to cancel my PMI. They informed me that if my home appraises over 20 % of the loan value I would be able to cancel my PMI. They instructed me to submit a request in writing to cancel PMI, and agreeing to the {$500.00} appraisal fee. I was also informed that this process should only take two weeks from the time the request is submitted. I submitted this documentation both in printed and hand written form during the 3rd week of XX/XX/2018. I received a letter saying that I had not filled out the correct paper work, and my request was being denied. This was the first mention of specific paper work or additional forms. I promptly submitted the newly informed correct forms, and an inspection took place in mid to late XXXX. Weeks later ( only after I followed up ) I was informed that the home was appraised at over {$220000.00}, which was {$5000.00} over the {$210000.00} minimum amount required to cancel the PMI. I still have not received a physical copy of the appraisal, and I only received a digital copy after demanding from a supervisor at Ditech. However the request to cancel PMI was still denied. They sighted a " lack of structural improvement ''. I pointed out that 100 % of the flooring in the home had been replaced, a wall between the living room and dining room had been replaced, some electrical had been updated, new water heater, new HVAC and the entire home had been updated with LED lighting. They requested I provide documentation of these updates. After submitting over {$30000.00} worth of home improvement invoices, I have been informed again that my request to cancel PMI has been denied. When asked why, they said " the improvements to the home was not the cause for the increase in value ''. They also informed me that these decisions to deny PMI approval was directed from the loan owner, XXXX XXXX. I spoke a representative at XXXX XXXX, who escalated this issue. Both the original contact and the supervisor informed me that all customer documentation and communication needs to go through my service provider, Ditech. Even after I informed them that Ditech directed me to speak with XXXX XXXX, they said Ditech would still need to be the point of contact, but they would escalate the issue. I have now reached back out to Ditech, and requested justification for denying cancellation of PMI. I specified saying I would like to see the finical report, guidelines, and mathematical break down of why my request was not approved. I also suggested they call out exactly where in the contracts I signed that I have agreed to these terms. As a paying customer I feel I have rights to this information about my account. Ditech has continued to under inform me each time I requested information, and I feel is intentionally dragging their feet to resolve this issue so they can continue collecting fees from my PMI. This process has now been ongoing for 3 months, and I have spent hours of time on the phone with them as well as spent hours of my own time finding and submitting additional documentation. At each turn point, I have met every single individual requirement requested to cancel PMI, and each time Ditech responds with a new detail required, without providing and proof of process, or a defined list of requirements and regulations to cancel PMI. The most frustrating part of this process is that I did not agree to work with Ditech, but I am forced to because they purchased my loan. If I was not financially trapped in this business relationship I would terminate it. I would also like to add that I have submitted several negative customer service reviews to Ditech, which have not been posted on their website review, nor have they responded to.
