Complaint: I had a loan on my house. It was supposed to be paid off by XXXX, XXXX. Ditech bought my loan. I noticed that the escrow account was high. They say that they sent me a letter stating that it was in default by XX/XX/XXXX, but I didn't see the letter. I kept going on the website and paying them. Today, XX/XX/XXXX I was contacted by them, and they stated that they were putting me into default on XX/XX/XXXX. They refused to take the final payment on the house, which is XXXX. They said they wanted XXXX by next week. I begged them to let me continue paying on the escrow, and they said no. I spent a long period of time on the phone with XXXX, and she kept getting off to talk with someone else. I bought the house in XXXX, and it was paid off in 24 years. the house was paid off on time ; they NEVER asked me to increase the amount of payment on the escrow, and now they're tacking on late fees. I always answer the phone, and I was on the website repetitively. I would have been glad to remedy this : now they're going to ruin my credit. I think they are pursuing predatory lending policies and I want someone to help me. I do not have enough time to get the loan for the escrow amount before the principle which they refuse to let me pay off goes into default.

Complaint: Ditech will not work with us at all to try to get our mortgage in current status. We have lived there for 11 years. We had a loss of income from social security due to child receiving assistance moving out which decreased our income by approximately {$950.00} a month. Also, my wife has been diagnosed with XXXX and XXXX XXXX which sometime make it difficult for her to work on a consistent basis. I'm trying to make some kind of arrangement with them to no avail.

Complaint: My servicer is Ditech Financial LLC. I received Trial Period Plan for a mortgage modification XX/XX/XXXX with this company. I made all three of the payments as required for XXXX- XXXX, XXXX and XXXX. I was suppose to receive a permanent modification in XX/XX/XXXX. When I did not receive said documents at the conclusion of my trial payments, I called Ditech and spoke with a representative to inform them of the situation. The representative told me she would have another copy sent out to me. It is now, XX/XX/XXXX and I did not receive the documents. I called Ditech today, this morning and spoke with a represented named XXXX extension XXXX and informed her of my situation of no permanent modification documents. XXXX told me she would have another copy sent out again. I am seeking CFPB assistance in this matter, because even though I believe XXXX will do her job, the previous representative at Ditech told me the same thing and nothing happened. In fact, XXXX informed me that the last communication in my file was that the document were delivered back in XXXX ; and no new copy was requested or sent out. I already informed the first Ditech representative that I did not receive this package and that was why I was calling her for another one. However, that conversation I had with the first Ditech representative was not noted in my file and this worries me. It is as if Ditech is refusing to send me my modification documents if they would erase the conversation I had with the representative stating I did not receive them. Why would they erase the call? This behavior worries me.

Complaint: ditech said i owe back payments talk to a lady and made a deal to catch up on payments so i been making extra payments.but i keep getting letters from them that i haven't made any payments an i get conflicting letters telling me different amounts i still owe them.the lady is rued on the phone they do not know want they are doing it seams to me they just want my house and keep telling me there are going to foreclose on me.i don't know what to do anymore i am stressed out about this.

Complaint: On XX/XX/XXXX I received a note ( dated XX/XX/XXXX ) from Ditech saying that my payment for XX/XX/XXXX which was due on on XX/XX/XXXX had not been received. On XX/XX/XXXX I received 2 voicemails from a collection agency as well ( however not sure if the 2 are related ). The issue here is that the payment for XX/XX/XXXX was made and debited from my account on XX/XX/XXXX. My regular payment is {$1900.00} and I always add an additional {$1000.00} to the payment just because Ditech is known for their unethical practices, hoping that the {$1000.00} would cover any additional fees that they keep adding from time to time. Ditech appears to have applied this payment of {$2900.00} made on XX/XX/XXXX to additional principal thus making it look like I had defaulted on my payment and giving Ditech a chance to apply a late fee to my account. My credit score is around XXXX, have made all my payments on time and have consistently paid more than what I owe to avoid this very situation.Request you to please help correct this error and more importantly investigate Ditech 's reporting and credit collection practices. Unlike most other businesses it is impossible for consumers to walk away from such shady businesses since these things are forced on us. Given a choice I'm sure none of us would want to do business with Ditech, nor did my mortgage originate with Ditech, this was just forced on me. Attached is a copy of my payment history and all the payments that I have made so far ( this includes that XX/XX/XXXX payment which was accounted incorrectly )

Complaint: I refinanced our mortgage and closed on XX/XX/XXXX. Ditech owed us {$3300.00} from the escrow account.
On XX/XX/XXXX I called Ditech, and they said they mailed a check for the full amount the previous Saturday, XX/XX/XXXX. and gave me the check number. It has not arrived, and it has been 9 days.
I called Ditech again today, and they said it must have gotten lost in the mail. I was warned beforehand that it could be difficult getting the escrow refunded in a timely manner. I was also told there are regulations that lenders must follow in re : to returning escrow funds, and I research this. There are regulations and fines, and I believe Ditech needs to be investigated and fined for not returning our funds within the required timeframe.

Complaint: When we bought our home, we had XXXX, then XXXX XXXX XXXX, now Ditech We paid our mortgage for many years. When XXXX XXXX became ill we fell behind on our mortgage. Then we were offered a Loan modification and we thought that was really wonderful, but we paid ( 16 ) loan modification trial payments and each time we paid the required trial payments, we had to start over for some reason, such as the offer that was given us had expired and we had to be put into another loan modification offer. We don't know where the payments went or where they were applied. We constantly paid the trials and waited and waited never receiving the final loan modification documents.
Ditech has not been considerate of any of the situation, they have not been easy to deal with. We have been submitting documents and as soon as we sens what they are asking for there is another request with a very limited time to send it in and when you do get the requests in there are more request waiting for you. We have Social Security Benefits and XXXX XXXX has a job ( salary ) and their son contributes and he has a salary.
We have sent all of this to them more than once. We certainly would like to know what happened to all of the monies we paid in trial payment to XXXX XXXX XXXX before they sent us to Ditech who fail to research of help us.

Complaint: I called three time during the month of XXXX which is recorded by Ditech mortgage company to move money from unused funds over to the actual mortgage payment. After the first call the problem seemed resolved online only to find two days later the solution was reversed online.
Secondly, i submitted payment online on time for. XX/XX/XXXX payment which was stated as received. I then get a letter from Ditech on XX/XX/XXXX saying that the payment was returned for some reason they did not disclose. The letter stated that if I paid as soon as I got the letter that there would be no late fees. Now there is a late fee on my account dated XX/XX/XXXX online in the amount of {$560.00}. This is a serious issue because of the time of the initial payment I have {$5000.00} in my account ; the only account I have used to pay my mortgage.
His has happened in the past and was hard to prove that they move money around to create a late payment of {$560.00} when in fact the payment is not late.

Complaint: Hazard insurance was placed on my home in early XX/XX/XXXX. I had allowed my homeowners insurance to lapse, I take complete responsibility for this issue.
I acquired my own homeowners insurance again effective XX/XX/XXXX. As Ditech is adamant about communicating with them via their website ( and I had a copy of my proof of insurance available in electronic format ), I uploaded a copy of it via the Homeowner Assistance > Upload Documents portion of their website on XX/XX/XXXX. That day I also submitted a message to them via their website indicating that insurance had been purchased and asking what else I needed to do to remove their lender placed coverage and square my account.
No response was received to my message via the " Message '' portion of their website. However, while I was on hold with their customer service today I did receive a response to my personal email account indicating that in order to modify my insurance coverage I must either : 1. MAIL a copy of the proof of insurance to Ditech or 2. FAX a copy of the proof of insurance documentation According to the first phone representative I spoke with " Insurance documentation must be mailed or faxed per regulations. '' ( seemed odd ) According to the second phone representative I spoke with " Insurance documentation must be imaged in a particular way per Ditech policy and these documents can not be accepted via our website. '' Although they can collect proof of income and tax information via their website...?
Finally when I asked to speak to someone who could explain the absurdity of the insurance paperwork " policy '' and the 10 day response to my email I was informed of the following : 1. Because of the status of my account ( I am behind because of the exorbitantly priced hazard insurance ) I would not be allowed to speak to a customer service person because my account would be routed directly to a collections agent.
2. No one was actually available to speak with me regarding my website concerns because " they were all in a meeting '' ( funny - every time I talk to a mortgage company all the supervisors are always in a meeting, together, in the late afternoon... ) I'll mail them a copy of my document. But this absurd insurance document handling policy seems incredibly galling for a company that is adamant about sending all statements and notifications to me via their website....

Complaint: Our mother owned a house in XXXX. She XXXX last year from XXXX XXXX XXXX and we are now trying to sell her home. Prior to her XXXX, she transferred title to her home to my sister and me through a XXXX XXXX Deed.
She owned less than $ XXXX in assets and as we are the only heirs, there is no need to do a probate.
A probate is expensive and is not required in this case because she didn't own anything. Just the house. Which she transferred to us.
There is a mortgage on the house and we have been paying it monthly since our Mother 's XXXX.
However, Ditech will not give us any information on the account. We are the legal heirs and legal owners of the property - and DiTech will not give us a payoff, or tell us the monthly amount to pay. We are trying to do the right thing and they won't speak to us at all. We even called after Hurricane Irma and they wouldn't give us any information on how much the monthly payment should be or if we should defer payments due to financial hardship after the Hurricane.
We are trying to sell the house and we have sent to DiTech our Mother 's XXXX Certificate, the XXXX XXXX Deed which transfers title to our names, and our authorization to release the payoff to our Attorney 's office.
Ditech is saying that we are not authorized to get any information on our mother 's account. We own the house. We are her only children. And they will not give us access to our mother 's account.
It is legally unnecessary to do a probate on our Mother 's estate - and is a financial burden to us.
And yet, Ditech still refuses to review their regulations - they see a " one size fits all '' approach and don't realize there are individual circumstances.
Our mother 's estate does not require a probate. We own the house. We are trying to pay them as per the Note our Mother signed - and they are not giving us the payoff information.
They are preventing us from selling the house, providing clear title to the buyer, and paying the money due to them.
This is obstruction. This is cruelty. This is business at it's worst.
XXXX size does not fit all, Ditech. And someone in your organization should have a brain to figure out how to provide a payoff so that it doesn't cause your customers and their family members undue financial burdens or undue stress.

Complaint: I agreed to a payment arrangement with Ditech to pay {$350.00} per month via automatic payment in XX/XX/XXXX. This arrangement was made regarding a charged off second mortgage from XXXX XXXX that Ditech had purchased and collected on. Ditech stated that the payments would reflect on all three credit reports, XXXX, XXXX, and XXXX. I have sent multiple requests to Ditech, XXXX, and XXXX to update the reporting of this account on the credit reports. I received multiple letters from Ditech that state the account was defaulted on in XXXX, charged off in XXXX, and a monthly payment of {$350.00} has been paid on time in XXXX, XXXX, and XXXX of XXXX, and XXXX through XX/XX/XXXX. I submitted these letters to XXXX and XXXX agencies for correction of my credit reports. I have received the same response from both XXXX and XXXX of adding a comment to the report that consumer disputes and payment arrangements made on charged off accounts.There has not been any change to the closed dates and the payment grid still states that no payment has been received during these months. Please see the attached copy of how this account is being reported by XXXX and XXXX. XXXX lists all the above referenced months as FP which is translated to mean FAILED TO PAY and XXXX states no payment received. Ditech stated they would update and report the payments and have not reported these payments as was agreed. I feel that the collection practices Ditech used by stating the payment history would include the regular payments was unfair collection practices. Further, the credit reporting agencies XXXX and XXXX are not taking steps to ensure accuracy on my report or responding to my disputes.

Complaint: I purchased my home in XX/XX/2017. At that time I paid the property taxes in closing. In XXXX, Ditech paid those taxes again by their own error. XXXX XXXX immediately refunded the payment to Ditech. Since then, Ditech has continued to charge me for the payment they made in error to XXXX XXXX. The refund was not credited to my escrow account and Ditech has increased my monthly payments by nearly {$500.00} to cover the " shortage '' in escrow due to their error. I've contacted the company numerous time. My emails go unanswered. My phone calls are redirected repeatedly or I get hung up on.

Complaint: In XXXX of 2015 I had a mortgage with XXXX XXXX XXXX XXXX, which was transitioning to Dietech Mortgage Co. as I was refinancing my home with XXXX XXXXXXXX XXXX XXXXXXXX XXXX XXXX was handling the title searches and escrow accounts and disperments of funds. A few months after the closing I stared getting mortgage statements from Dietech again saying that I still owed money. I called XXXXXXXX XXXX who sent them the payoff agreement and copies of the check. Dietech has continued to try to bill me monthly and has kept my escrow account open and had been paying my taxes twice a year and billing be for the deficit in escrow while my new mortgage company, XXXX XXXX, has been paying my property taxes out of my on time monthly payments. Dietech also sent me a paid in full letter in XXXX of 2015 and closed my account and then later re-opened it under another account number and then when I did not pay them the escrow deficit, they sent my husbands name to the credit bureaus causing damage to my husbands credit and higher interest rates on our student loans for the children and car loans. Myself and XXXX XXXX have been trying to sort this out with Dietech for 3 years now. We get different customer service reps with each phone call which causes much confusion on both sides of this problem and many different excuses as to why this hasnt been settled. They also still have their name on my mortgage as they never sent out the satisfaction of mortgage that was needed. I have gotten apologies and promises to correct this error of their as we speak on the phone, and then the next week I call and they tell me it is my fault because I the escrow deficit or something else. I have paperwork from them telling me that they did an investigation and I have an escrow overage of {$5500.00} but I need to pay {$1700.00} first to get that money. The next phone call to them informed me that the money may not actually be in there as they may have paid something for me. There should be no activity on that account for three years so I dont know what they could have paid. They have both XXXX XXXX and myself chasing our tails with no clue as to how to resolve this. I would appreciate any help or guidance that you may be able to give me. I am at my wits end. Thank you so much!

For 10 years my payments were diverted to FPI ... EVEN after our XXXX Agent talked on the Phone to Green Tree, changed the necessary Policy requirements per Green Tree, SENT us a FAX with the Detailed Policy Changes THAT we immediately adhered too yet Green Tree continued their GREEDY pursuit and over the next seven ( 7 ) years deducted more than {$30000.00}!!!! We know this because we Subpoenaed Green Tree 's Records for a Small Claims Case XX/XX/XXXX. We LOST THE CASE BECAUSE THE STATUTE OF LIMITATIONS! This is ALL XXXX because my 1st XXXX Complaint was way back XX/XX/XXXX. After 36 Complaints to XXXX, FTC, FCC ( Phone Harass ) CA 's Business Oversight and a multitude of Sen, Reps both State & Federal ... Complaint: Ditech has identified a short amount in my Home owners and county taxes. The sent a letter asking me what I can do and options to make it happen. I selected an option. ( 1 ) The options was not relayed on the invoice for the following month. When speaking to them, 3 employees said that they could not change what had happened and that it was a automated program that NO ONE has control of. Odd, computer programmer at Ditech has no control over their company?? This resulted in the payment being increased for an option that I DID NOT Choose. The 3 persons that I spoke to said again, they can not change it. It is part of the invoicing system. Well ... ..the did, in fact change it to OPTION 2. The fact is, it was changed. ( to option 2 ) So that is an incorrect statement. 3 times from 3 different persons.. When challenged to find out a person that can stop this I was sent to the " GOOD OL '' Dead end call by voice mail. No call back from that VM. The Ditech company has not intention fo changing these issues. They are intentional.
This may seam trivial. But, in fact, it is NOT! This is a huge issue. There is small portions of money from all mortgages that are incorrect. The consumer may of may not have selected an option. Or ... overpaid. The money is not offered to the consumer but is applied as the servicer determined. I'm sure this is a CEO or CFO that makes this decision. Also, even small amounts are not processed properly when spread out over large amount of consumers the amount is HUGE!
Logic dictates that if they can change it payments up, ( option 2 ), they could have completed the option I selected to the correct statement. ( option 1 ). ( See Attached ) Why is this an issue? I have to call Ditech for other processing error also.
BIG ISSUES!
Ditech is sending invoices out as fast as you make payments. I have been engaged in 2 calls with this company in regards to LATE PAYMENTS. When in fact they had collected the money per their invoices and in their own statement said " they can not apply the amounts that were sent because of XXXX XXXX guild lines '' They then applied monies to principle and told me that I had LATE PAYMENTS! This is harmful to everyone. I have to fight them, I have a late payment that looks bad, this is what happened to me on another home where the same lender and services have sued me and foreclosed on the property because of late payments. You can not refinance for 2 years with 2 plus late payments. This is BY DESIGN. Locked in the loan! By Design! They know I can not change my loan until XX/XX/XXXX My home is a former XXXX XXXX Home Loan from XX/XX/XXXX. I'm worth more dead that alive. Same with the other home I purchased with XXXX XXXX. When these loans where purchased by XXXX XXXX XXXX for 50-60 % of face value, it is easier to foreclose and collect the full face value of the not from XXXX XXXX or XXXX XXXX on a foreclosure.
These issues are a set up for the servicer and lender to profit when the lock you into the loan that they purchased from the GOVERNMENT for WAY LESS that the face value of the note. SCAM!
Wake up! This company was called XXXX XXXX XXXX prior to Ditech and was sued repeatedly for PREDATORY LOAN SERVING. ( OWNED BY XXXX XXXX XXXX ) This is what we have here again. I do not have time to see what the SCAM is this time, I sure do not want to have to fight them to correct their errors, ( Even if the service personal believe that it is a deity that is making changes to the computer programs ) and I will not act stupid to make them feel better with the incorrect statement that they make. Logic is true. I do not think ANY SERVICER OR LENDER SHOULD BE ALLOWED TO SEND INVOICES TO PERSONS THAT RESULTS IN A XXXX XXXX OR XXXX XXXX RULE VIOLATION. WHEN, IN FACT, IT IS THE SERVICER THAT CAUSED THE OVER PAYMENTS. THEN APPLY THEM TO PRINCIPLE AND CLAIM YOU HAVE A LATE PAYMENTS. WHY! Consumers should not need to look up these rules. Why must I, I grow tired of correcting the servicer and having to challenge unintelligent persons working there that will fight to prove that their illogical statements are true and that a deity is doing the programing at their company. ( must be an IQ test to work there and you need to be on the lower scale ) Please audit my file for the last 7 years. I have to call these people 2 times a year to correct issues. I DO NOT WANT TO BE TARGETED AND SCAMMED OUT OF MY HOME. HELP! HELP! HELP!
