Complaint: My mortgage that I took to buy my home in 2001 originally was with XXXX, when XXXX went through bankruptcy the loan was sold, changed to Green Tree then Ditech. After missing two payments during a divorce I was threatened with foreclosure. For missing two payments of {$1300.00} each, I ended up paying them over {$8700.00}.
My payments have been current through auto deduct from my bank account for the last eight years. After the threatened foreclosure Green Tree required me to do a monthly bank draft and charged {$16.00} for every draft, said that was the only way they could accept the payment. When I asked for a loan modification they ignored the paper work I sent them, called and harassed me, had a person showing up every Sunday when all the neighbors were home and made a big display out taking pictures of the property.
My issue now is they are not showing my mortgage payments on my credit report, not showing me as a home owner, and it looks like intentionally trying to keep my credit rating degraded to prevent me from refinancing.
Is there someone I can call to help me with this, what documents to supply etc.

Complaint: My husband and I are both in our 70s and we refinanced our home in XX/XX/2016. We had deferred property tax payments, but used that loan to pay the balance with the County. Deferred, not delinquent.
We again deferred property taxes on our new mortgage so as to mitigate monthly budget issues.
Our payment history is perfect.
Ditech mortgage paid {$8600.00} to XXXX County Tax Assessor on XX/XX/XXXX. They paid Deferred taxes, not Delinquent.

Ditech refused my XX/XX/XXXX Payment as they adjusted it from {$1100.00} to {$2400.00}.
My husband has had more than ten XXXX in the past year and suffers from XXXX. I lost the use of one of my XXXX due to a XXXX XXXX procedure two years ago.
This will literally kill us. Please help!

Complaint: Ditech Financial assumed my home loan from Greentree, who previously assumed my loan from XXXX. I have excellent credit that has been threatened by Ditech representatives for their gross negligence. In XX/XX/XXXX, I made a payment of {$1400.00} on XX/XX/XXXX, received by Ditech on XX/XX/XXXX. I later noticed that my payment had increased, therefore, I made an additional payment of the difference of {$86.00} on XX/XX/XXXX, received by Ditech on XX/XX/XXXX. I wanted to make sure that they received their payment by the cutoff of their late due date of XX/XX/XXXX. However, I was sent a letter with a late fee charge of {$40.00}. The difference was paid before the cutoff, therefore, there should be no late fee. I then made my XXXX payment early because of issues stemming from XX/XX/XXXX. I was informed during that time that my payment was late because it was received after the first of the month. I spoke with several different representatives, whom were all demanding of an unwarranted late fee, and finally spoke with a belligerent manager. She said the same thing ... 'your payment was received after the first of the month, and it is therefore late and you are being charged a late fee '. I was threatened that I would be turned over to the credit bureau if I did not resolve " their '' issue and pay a penalty. Therefore, I started paying earlier than usual. However, since I made two payments in XXXX of XXXX, they decided to apply the early XXXX payment towards principal. Therefore, I have been assessed with a monthly late fee of {$40.00}, that is now equivalent to {$160.00} per their misconception in paying my monthly payment a little early so I could avoid these preposterous late fees.
This company is affecting my credit and utilizing unscrupulous tactics to collect unjustifiable late fees. The representatives for this company are irrational and do not aid in solving the problem. They will only ask for payment. I am done dealing with this company - please listen to all the complaints you receive. I wish XXXX had never sold my loan - I NEVER would have chosen Greentree or Ditech. I hope something is done to change their unjust late fees. I refuse to pay something I do not owe.

Complaint: This has been a long involved process, over the past year. My loan is through Ditech, orgionally XXXX, then Greentree, and so on. Been with all of them, but currently Ditech.
For years I have gotten a hardship discharge on my taxes. In XX/XX/XXXX I received a 'newly analyzed ' bill from Ditech which included property taxes. I promptly submitted my discharge letter showing there was XXXX taxes due. Over the next six months, I received several bills showing due for 'past property taxes. ' And I subsequently sent/faxed/mailed many times the discharge letter showing XXXX taxes were due. Each time, beginning in XX/XX/XXXX through XX/XX/XXXX that I sent a letter/faxed, Ditech would send me a standard reply letter stating 'we are looking into the matter and will respond in 30 days. ' However, they never responded until XX/XX/XXXX when I had filed a case with the AG of Michigan ( XXXX XXXX # XXXX ). By then, the house had gone into foreclosure. ( I did pay my monthly house payment of {$260.00} ; the only amount that was overdue was the property taxes. Ditech was demanding I pay $ 1000-2000 for property taxes. But please remember I had submitted to Ditech on numerous times my hardship discharge showing I owed XXXX property taxes. Ditech had proclaimed from XXXX to XX/XX/XXXX that they had completed many escrow analysis '. When the case with the AG was brought to Ditechs attention ( XX/XX/XXXX ), a Ditech Representative, through very malicious letters, claimed that I was lying, and that I indeed owed property taxes. I have corrospondence from this representative where she throws all the blame of this mistake onto me, and insists there are taxes due. She herself throughout this corrospondence is caught in many lies. Ditech sent a check for property taxes to two taxing authorities. One had been returned, and the other one was caught in limbo, but eventually sent back to Ditech. And even though the one check had been returned, and Ditech had many copies showing I was tax exempt, they still insisted I owed property taxes and were charging me for these transactions. Please remember, my home was in foreclosure XX/XX/XXXX due to these purported property taxes, I am a XXXX senior citizen on a extremely fixed budget. I would like to reiterate that from XX/XX/XXXX through XX/XX/XXXX there had been no corrospondence from Ditech, short of the standard reply letter stated above.
Moving forward, in XX/XX/XXXX Ditech closed my escrow account, entirely. Ditech representative, which I stated above, insisted I asked to close it, which, I never did. This included my house insurance. In XX/XX/XXXX, Ditech demanded I pay them {$1100.00} for back escrow. Again, I filed a claim with the AG of Michigan, case number and worker stated above. Without my knowledge or consent, Ditech sent a check to my old home insurance company ( XXXX XXXX ) in XX/XX/XXXX, and were demanding payment. However, when Ditech closed my account in XX/XX/XXXX I had changed insurance providers and was paying a monthly amount to the new company ( XXXX ). AGAIN, Ditech put my home into forclosure XX/XX/XXXX, because of the back escrow which they now said was due. I would like to like you to know that despite Ditech reinstating my escrow account on XX/XX/XXXX, due to THEIR error, they did not notify me of this until XX/XX/XXXX, almost three months.
I would like to add here, that in XX/XX/XXXX, due to all the stress from Ditech, I was admitted to the hospital in XXXX XXXX. XXXX I had a XXXX with an XXXX XXXX XXXX. My health is very XXXX. But even this amount of XXXX would affect a healthy person, let alone a ill person.
It took this money some time to circulate through XXXX XXXX, and know that Ditech was charging me this entire time for their mistake. XXXX finally sent me the money, of which I returned to Ditech. XX/XX/XXXX, upon advice from AG XXXX XXXX.
XXXX XXXX dismissed this case in XX/XX/XXXX. However, I went to the mailbox yesterday and received a bill from Ditech for {$640.00}. According to XXXX XXXX, Ditech reports I did not pay XX/XX/XXXX payment. When in fact I did, and have the canceled check. I have paid my {$260.00} each and every month, and the {$54.00} insurance since XX/XX/XXXX. For XX/XX/XXXX admittedly there was an emergency and I had to be late with my payment, but that is a mere {$310.00}, and will be paid this week.
Next month, it will be one year since this began. There had been more issues with Ditech before this year, but I was just to sick to fight. I have gone through two foreclosures due to Ditechs mistakes, and refusal to address issues, over the past 12 months. Also, Ditechs representatives are allowed, and encouraged, to lie and manipulate customers ( when asked why Ditech did not call and discuss the above matter regarding taxes, the rep said 'we prefer to have written corrospondence. ' However when it was pointed out that Ditech had four to five months and only sent the standard 30 day reply stated above and did not follow up, she became vicious and accused me of lying. But in fact, it was her that had been lying. And I have substantial proof of this ).
Furthermore, I do not believe that my account throughout this period with Ditech has been properly handled over the years. Ditech has been applying almost the entire payment to interest, with little to none going to principle. And I know for certain years ago, when the interest was at a lower rate, they overcharged my account. And again, there has been almost XXXX interest paid down.
I also would like to add here, just how low Ditech will go. As I have told you, I have been working with XXXX XXXX at the Attorney General 's office of Michigan. She called me during this case, in about XXXX or XX/XX/XXXX. She told me that the Ditech Representative XXXX XXXX ( this was a new girl, as the previous one had been caught in so many lies ) had informed her that I supposidly had sent a check to XXXX XXXX, she told Ms. XXXX that she recieved the check and it 'had been written all over. ' Now, the only thing I could make out of this was Ms. XXXX was trying to make me look a little crazy. Or maybe stalkish? I dont know. And I wondered what that had to do with my house payment. But anyways, I sent a copy of this purported check to Ms. XXXX showing her it was indeed made out to Ditech, not Ms. XXXX. And there was no unnessacary scribbling or writing on the check. The only way Ms. XXXX could have gotten the check was if she worked in the mailroom, but since her title is 'paralegal ' I doubt that. The point is, why? What was Ms. XXXX trying to prove falsely? But, that is Ditech for you.
Please, help me with this case. My XXXX XXXX has gone up substainially over the past few months. This is all absolute nonsense and unnessacary, and I would call harassment. Ms. XXXX has tried, but more apparently needs to be done. My home is going into foreclosure again ... ... ... ... ... according to Ditech.

Complaint: We had damage to our home after Hurricane Irma. After 9 months the insurance company finally issued a check in the amount of {$120000.00}. By that time we had already taken the money out of our retirement account and the house had been completely repaired. The check was sent to Ditech in XX/XX/2018 as they hold the mortgage on the property. Also sent to them was all documentation requested including a signed waiver of lien and copy of statement from contractor stating payment had been made in full. An inspector from Ditech finally came to do the inspection on XX/XX/18. He submitted his report stating all work had been completed in full and the house had been totally repaired. Our adjuster spoke with Ditech on Tuesday XX/XX/18 and was told the inspectors report had been received and the check had been issued. On Friday XX/XX/18 we received a check for {$18000.00} made payable to our public adjuster. This was the exact amount he was owed. We spoke to Ditech that afternoon regarding the remainder of the funds and were told they were releasing another {$31000.00}. When questioned about the remaining {$75000.00} they responded that it was a lot of money and they had to check with the contractor to assure he had been paid before they released it. They agreed they had the signed release and statement from him showing he had been paid in full in their files but would not release the funds to us. Even though we sent them all required documentation we still have not received any funds from Ditech.

Complaint: To whom may concern I am emailing you today because I received a check in the mail for {$10.00} in regards to the XXXX XXXX XXXX lawsuit that was settled. I am not happy with this settlement I have been put through XXXX these past 5 years trying to find a home because I was forced out of my home and was caused pain and suffering and also went through a financial disaster I have been struggling ever since because of XXXX XXXX XXXX.
I'm also very mad because I just found out about this lawsuit with this check I received. I want to know why did it take so long for you guys to contact me that there was a lawsuit against XXXX XXXX XXXX XXXX. I Want more then {$10.00}. I want my life back. I want to file a lawsuit and get allot from these people who put me and family thru XXXX. I was harassed every day 20 times a day. I was told that if I did not pay I was going to jail they were going to have me arrested when I told them I couldn't pay and said I needed to move out in 10 days or I was going to have my possessions garnished. Unfortunately, the response was not accurate, there is no way to contact the person who sent the response. In my opinion this company as sending fraudulent information to you. Complaint: In XX/XX/2016 I requested help ( loan modification ) through the HARP program with my mortgage company, Ditech. The modification they did did not help at all. It did not lower my payment or interest rate. All they did was add 10 years to the life of the loan. Now, instead of a 30-year loan I have a 40-year loan. NOTHING else changed. In what universe is that a modification?
I just thought that was the best Id get until the monthly payment was really becoming a very serious problem. Ditech just advised me to sell the house an move on, so I hired XXXX. They did their best, but Im now told that Ditech has stood firm and that their stance is that Ive already had a loan modification and am not entitled to another.
Is there anything else that can be done? Is this action even legal under HARP?

Complaint: I have sent my loss payment check of XXXX for an insurance claim I filed for Hurricane Irma damage to my home. The ck was received by ( Ditech Financial ) my mortgage holder back on XX/XX/2018. I sent them all requested documents except a detailed estimate from the insurance carrier. This estimate that they are requesting was not given to me.As the claim was a negotiated settlement amount that was agreed to by both the insurance carrier and myself. No such estimate exists and i can not supply them with this document as they are requiring to release the {$28000.00} dollars that they are holding. They only sent me {$5000.00} to commence repairs. I have sent them a contract that I have with a roofer for {$7700.00}. I had to pay my public adjuster who negotiated the claim, his fee for services of {$3700.00}. for which I sent the receipt of payment. I am caught in a very difficult position of how to proceed with repairs without the necessary funds. My roof is still leaking and conditions are getting worse. Ditech refuses to release any additional funds as they tell me " their investor requires this detailed estimate to release the funds ''. This is impossible to do as my public adjuster explained to them. It is a negotiated settlement for a fixed dollar amount. My attorney sent them a letter on XXXX-18, so as to release all funds as to continue repairs, and they have ignored his petition.

Complaint: Ditech is putting me through a collection process for a late fee of {$120.00}. I incurred this late fee because they held my payments in a Funds in Suspense status. I have paid {$22000.00} towards my 2018 mortgage obligation of {$19000.00} ( {$2800.00} due on the first of every month ). I calculate that as an overpayment, however the overpayment is being held as Unapplied Balance while they put me through their collection process.
I used to use Ditechs Bi-Weekly Mortgage program which auto debited my mortage in partial payments that occurred every other week. They discontinued this program in XXXX and their website does not offer any other type of autopay except for full payment on due date. My finances and due dates for other financial obligations are set up around the bi-weekly payment plan because my mortgage is my largest one payment. I set up auto pay through my own bank bill payment system to continue the bi-weekly payments as I have been making them through Ditech. The payments I made were then held in Funds in Suspense and show that I was delinquent in my payments at the same time they money was collected from my bank account. Entire payment would be applied to principal as extra principal payment and they would attempt to collect an additional payment from me and go through a collection process.
There must be some policy against this. My mortgage balance is $ XXXX, and my house is valued at $ XXXX. Are they using unfair practices to put me in a collection cycle to gain my home?
Any payment balance should be applied in a way that protects the consumer always. Any money collected should go to : Balance due ( oldest to newest ) ; Escrow ; Fees ; Principal only when other balances have been collected on. Or at the very least you should be able to allocate your own money to these categories on their website. If the company decides where to allocate payments, by law it should be in a way that protects the consumer, not potentially puts them in a foreclosure. This company stinks of unethical practices!
I called and spoke to XXXX on XX/XX/18. I was scolded for making partial payments, even though I did so previously through a Ditech sanctioned program. And made each partial payment PRIOR TO THE DUE DATE for the balance due. I tried to rectify the situation and was given no solution but the pay the full amount on the due date, NOT BEFORE THE DUE DATE IN INCREMENTAL PAYMENTS or the payments WOULD always be misapplied. So I adjusted my due dates on other financial obligations to do this. I am still going through collections for a late fee and have an Unapplied Balance on my account which is an overpayment that just sits in suspense it doesnt go to my balance, my principlal or my LATE FEE. It just sits there. Meanwhile they send me to their collections division. I went ahead and sent a check ( no option to pay online other than the mortgage amount ) for the LATE FEE to suspend the collection process. How is this legal that a mortgage company can hold my money and NOT APPLY IT TO MY ACCOUNT in a way that is in MY BEST INTEREST. This has got to be illegal, besides being incredibly unethical
