Complaint: Again I am writing concerning my request for correction of the error described below in regards to the mortgage on my property. After years of dealing with Ditech refusing to accept I had paid the sums to bring the mortgage balance current. On XX/XX/XXXX I paid with certified funds in the requested amount of {$410.00}. Ditech scan the check into their file and destroyed the check, they never processed it. I had to cancel the check, pay a XXXX fee and both parties had to sign an affidavit stating the check was destroyed by Ditech. During this process Ditech 's director of collections agreed that Ditech will. 1. Refund the XXXX that was paid to cancel the official check 2. Remove the late credit reports. Once I received the sign affidavit from Ditech, I returned docs to my bank for processing. I called Ditech 's representative who process the payment and sent over the confirmation by email, confirmation number XXXX to bring the loan current. On XX/XX/XXXX, I received an email notification from my credit monitoring service stating Ditech has reported me again as past due. I have reach out to, Ditech Director of Collections and he has not return my call. One representative contacted him on instant message ; he stated : I will call him in 30 minutes, that was XX/XX/XXXX I want the two items above resolve as stated, and put in writing, not verbal over the phone. The last time Green tree stated I was current but never put it in writing, now again Im still dealing with this from Ditech

Complaint: We are trying to refinance our mortgage but Ditech has not been providing the information we are requesting them. We are asking them to provide a mortgage rating for our First and Second loan with them. Our Broker, XXXX XXXX, requested a verification of mortgage on XX/XX/2018. He called the following day and was told that they will provide it to them. They fax the balance of our mortgage to him but did not include the mortgage rating he was requesting, he was told that it will be provided in six business days from XX/XX/2018 but they kept sending the same information. We called, last Monday, XX/XX/2018 and was told that it will be mailed directly to us within 3 business days but never received anything. It appears that they our sabotaging our wish to refinance and seek your help to direct them to do their job and provide a mortgage rating for the past 12 months for our first and second loan with them so we can close our refinance transaction. We don't understand why they are doing this to us.

Complaint: DITECH is refusing to release my insurance claims checks to pay the contractor for the completed repairs. The claim was from XX/XX/XXXX and all repairs were completed in XX/XX/XXXX. Insurance has paid all checks on the claim, including recoverable depreciation, total $ XXXX. DITECH has issue only one draw check for $ XXXX in XX/XX/XXXX. The contractor is losing patience and will proceed with filing a lien against the home. DITECH actually told me to take out a short term loan to paid the contractor and they will paid me once they are satisfied that the home was repaired to their satisfaction, despite the fact that the county code inspectors and the insurance company adjustors have signed off! This is an overstep of the promissory note and harms me, due to 1 ) the devaluation of the home due to the Lien, and 2 ) hurting my credit. I believe DITECH needs to be sanction for this practice and to pay me my claim money plus interest.

Complaint: In XX/XX/XXXX I got a HELOC loan from Beneficial, I paid it off in XX/XX/XXXX. In XX/XX/XXXX I closed the account due to selling the home. XXXX released for recording on XX/XX/XXXX to XXXX recorder, loan number XXXX. I also got a copy of Satisfaction of Morgage from XXXX XXXX XXXX XXXX. which states it authorize and directed to discharge the same upon the record of the said morgage. Instrument no. XXXX in the records of the county recorder in the county of XXXX State of Minnesota This Satisfaction of Morgage. It was issued in State of Florida and Notary Public XXXX XXXX.Notary # XXXX. Now comes the issue XXXX went out of bussiness and sold a large group of loans that were not paid off to XXXX XXXX XXXX for pennys on the dollar. My paid off loan got in this mix. The account number with Ditech is XXXX, I have never heard anything about this issue till I was buying a home 4 years later, and have never worked with this company. My paid off loan got in this group of open loans, I am buying a new home and it was in under writing and on all three credit reporting companys it shows this loan is not paid off and still owe XXXX which is what the origanal loan was for. Ditech has copys of the satisfaction of the loan in my file. But will not fix there mistake. I have now lost the home I was buying and have to be out of this rental in 18 days. I am have no idea what I am going to do and I have 2 dogs and 3 cats so a rental will not rent to me with my pets. This has caused me so much stress and making me sick. I am stuck, there is a class action suit filed for the same issues with 100 's of poeple filling lawsuits. I have spoke to an Attorney both for the class action suit and a local attorney in XXXX. I will be filling a lawsuit if not corrected now. I have asked in writing for a complete payment history showing this loan from XX/XX/XXXX has never had a payment made to it. A lawsuit will take years take years and I can't buy a home. I beg of you please help me.

Complaint: Ditech reversed my XX/XX/2018 mortgage payment for reasons unknown and unexplained to me. Customer Service has also been unable to explain what happened from my numerous calls to them. The funds paid to Ditech were posted to my Ditech account and cleared my bank account timely. I only learned about this situation when I received a letter from Ditech dated XX/XX/2018 which stated I was behind on my mortgage and that I needed to make a payment to avoid foreclosure. My account is current and I have bank records to prove every payment. I have spent hours on the phone with Customer Service and have gotten no resolution. I don't understand how my payment could be received, applied to my account, clear my bank and then be reversed months later, thus creating a default situation? Where did my funds actually go? As a financial institution, aren't they supposed to abide by strict accounting controls? After trying in good faith to work with Ditech to clear up this situation, I now feel they are willfully misstating my account status and payment history while also threatening me with foreclosure for their own shoddy accounting practices. Thank you for any help you can provide

Complaint: XX/XX/XXXX, we submitted a loan modification to ditech only to get the run around for a year, I would call a least 6 times a month to get any updates, I was always told my modification was under review and or they need more information which I did provide. in XX/XX/XXXX I was told to resubmit a new modification which I did, how ever before I faxed the information I recieved a letter from them saying our modification was in review. Again I called every week to get the same answers it's under review. Finally in XX/XX/XXXX I received a denial letter. I called them and was told to do another modification because they where using out dated information, so I did only to find out they never did anything with my new information .Again was told to resubmit a modification in XX/XX/XXXX. I did again. I feel we are getting the short end of the stick with them .ditech send a reinstatement letter which I asked for on XX/XX/XXXX only to receive it on XX/XX/XXXX which only gave me 15 days. I need help with this. I have all documents that support this.

Complaint: In XX/XX/2017 we were approved for a trial modification. Then trial period was to begin in XX/XX/2017. We agreed to the terms and thought our prayers had been answered and our nightmare was over! We called Ditech to make our first payment on XX/XX/2017. We spoke to representative " XXXX ''. Please let me mkae myself very clear. We called on XX/XX/XXXX to make our first trial payment. With that said, the representative confirmed all of our information to verify our account and then asked how he could help us. We told him we were calling to make our first trial payment. He said, " let me see whats going on with you're account. '' After he took a quick glance at our account he replied, " I see there is a shortage in the escrow account in the amount of {$3100.00}. '' He continued, " how would you like to take care of this shortage? '' We were confused and we didn't understand where he was going. He explained that we would need to bring the escrow account current before we could make the first trial payment. We froze!!! We could not believe what we were hearing. We did not have another 3 thousand plus dollars, PERIOD.He told us that the escrow and trialv payment both needed to be paid by the end of XX/XX/XXXX. The payments would have to record in XX/XX/XXXX to count. We asked the question, What if we cant make the payments? He said, " then you will need to resubmit another modification package and it would be due by XX/XX/2017. We hung up the phone and could not believe what had just happened. XX/XX/2017 we submitted once again another modification package along with an attached " attachment statement '' explaining what had happened and why our trial payment was not made. I called Ditech and they confirmed they had a complete package and we waited. We knew that this wasn't going to be a good thing for us. We waited for an answer and waited until finally this XX/XX/XXXX a gentleman posted papers on our home for foreclosure. We called Ditech immediately and asked about our status with the modification, the rep could not answer our question. We explained what had happened she told us we were given wrong info that the escrow account did not have to be brought current. We could not believe what was going on. Yes, we know this all falls on us. But we wanted to make that trial payment.secondly what happened to the mod package we submitted in XX/XX/XXXX? There was never an explanation given to us.The rep put us on hold came back and told us to submit yet again another mod package. We asked to speak to a manager. The manager got onto phone and told us to just send in our last two pay stubs the most recent ones. We asked her what was going on and she put us off with submit our pay stubs. She said she would send the paperwork that day. She made it sound like all we had to do was issue last two pay stubs and her exact words were they'd ( loss mitigation ) would figure something out. The paperwork came and I just noticed last night that they used the paperwork to answer in regards to our mod in XX/XX/2017 or at least thats what I got from it. we submitted again our paystubs and we waited. We couldn't wait so we had to file chapter XXXX. We cant afford the payment and they have new sale date. We can afford our house payment. There reasons for denial dont fall under fannie mae rules. its a mess and they wont listen to us. We are never able to speak to our rep. We need someone to listen to us. We are running our of time. we dont want anything given to us restructure the loan, something. We've lived here for almost 20 years. My husband lost his job after 17 years its been a nightnmare. Hes working now and we want to pay. Please can you help us can you make them listen we are human beings and we are trying to fix this. please we would appreciate anything you could do. They arent going off the truth.

Complaint: I have a loan with Ditech Financial the property need insurance which I provided by XXXX XXXX the problem is Ditech went on put insurance which take the mortgage too high for me to afford the mortgage. I send them the all the insurance information and have XXXX XXXX company called and still Ditech refused to take the insurance off, my mortgage payment was {$890.00} now because they had insurance is now {$1100.00} which is way too much for me can you instruct me on my next step thank.

Complaint: I have paid {$2200.00} in " principal only '' payments to my mortgage company. The amount was recorded on the PRINCIPAL ONLY line on each statement and PRINCIPAL ONLY was recorded on the memo section of each check. They applied these payments as regular payments and when I checked last month, they had me paid in advance until XXXX of this year. I have called them three times, most recently on XX/XX/XXXX ( XXXX ) and each time I was promised a copy of all payments and how they were applied to my account for the past two years but a statement never comes. I have written twice and no reply. I am ready to contact my local news station but want to try this first. These are the check numbers : # XXXX for {$300.00}, # XXXX for {$500.00}, # XXXX for {$300.00}, # XXXX for {$300.00}, # XXXX for {$350.00} and # XXXX for {$500.00}. These were personal checks as my bank sends a separate draft every two weeks in the amount of {$360.00} in advance of each monthly payment. I want these funds applied to principal only. There is no pre-payment clause and I feel what they are doing is FRAUD. The company is DiTech Financial and payments are mailed to XXXX XXXX XXXX XXXX IL.

Complaint: Mortgage company Ditech continue to escrow home owner insurance and send payments to the insurance company when I requested them not to do so and the company approved my request not to escrow home owner insurance. We pay our own home insurance for the year beginning XX/XX/2018, yet they have escrowed and have sent a check to the insurance four times between XXXX and XX/XX/2018. The latest was XX/XX/2018 I received an email from the mortgage company on XX/XX/XXXX, that they sent a check to the insurance company in the amount of {$1400.00}. This is my second complaint on the company since XX/XX/2018. The mortgage company response to your agency and to me is that they corrected the problem but the same issue happen again right after they sent out that communication that they corrected the issues.

Complaint: it's about Ditech mortgage Co, mortgage loan # XXXX. In 2013 I applied for personal bankruptcy and was granted a complete debt discharge in Federal court under Chapter XXXX, all my debt was discharged including the stated above mortgage, all documentation was sent by my attorney to ALL my creditors, including Ditech. Ditech refuses to honor the Court orders and refuses to remove my name off the mortgage documents. They are trying to force my husband and I to refinance the whole mortgage just in order to get my name removed and leave just my husband 's name alone of the mortgage. I DON'T HAVE THOUSANDS of $ $ $ to gift to Ditech for just removing my name off the acc. Please explain to me why Ditech is allowed to ignore the Court order.I no longer have any association with this mortgage and I want MY name completely removed off that mortgage, this house belongs to my husband and the mortgage debt should be only under my husband 's name. thank you!
