Complaint: As of XX/XX/2017 Property was sold at Auction ( on courthouse steps, as is practice in Missouri ).
Current notices from the " Ditech Financial LLC '' that liquidated that asset, still billing for over {$8000.00} This company " Ditech Financial LLC '' sent notices to the persons that were making payments on my behalf. And demanded that they move out. The company also was telling them that their payments were not enough and were increasing the monthly payment.
XXXX had been the Lien/ Mortgage holder when I made arrangement with renter/tenant, it was later that " Ditech Financial LLC '' purchased the Note from XXXX XXXX they did not modify the agreement.
I had a arrangement for my renter/tenant to make payments with a written agreement to transfer the property to them after the loan was paid off. This is called a " Contract for Deed '' in some states.

XX/XX/XXXX ditech escrow dept pays tax payment for vacant parcel XX/XX/XXXX Ditech pays additional {$330.00} on vacant parcel, ( one year in arrear ) XX/XX/XXXX Ditech pays XXXX County {$4600.00} for neighbor 's ( no longer vacant lot ) house and property. Mortgagee advises lender of error in XX/XX/XXXX.
XX/XX/XXXX Mortgagee receives XX/XX/XXXX escrow analysis with repeated error, showing ditech intends to make two payments to county for each parcel, and advises lender escrow analysis is wrong. She is told they are re-running the analysis.
XX/XX/XXXX Mortgagee receives bill for roughly {$6000.00} for escrow shortage and calls lender. Asks for supervisor. tells the details of which parcel is owned jointly by ditech mortgagee and which parcel was sold. Is told they will investigate.

XX/XX/XXXX mortgagee calls lender to advise of resolution or legal action after she recieves foreclosure " pre '' letter. She is told by advisor that the county has told Ditech that the refunded to money to the homeowner, but I received no check.
XX/XX/XXXX mortgagee calls County to find out to whom check was issued. County insists no refund has been given nor has been requested. Mortgagee calls Ditech to give them direct line to county assessors, name of employee and email address to expedite refund request. Mortgagee asks for phone number and address of legal dept for corporate office. Is given a fax number. when she calls back to get correct phone, is told they dont have a phone number.
XX/XX/XXXX mortgagee requests cancellation of escrow account, by email, and receives two emails from escrow agent XXXX XXXX that he needs the correct loan number. He is given two emails with a pasted loan account from ditech 's website.
XX/XX/XXXX Mortgagee calls lender to request to speak to escrow. is told they dont have a phone number. Is told by supervisor Luwanee that ditech has requested a refund for the last two payments made on the parcel that was sold. I believe that they have made another error, because the tax bill is paid for one year in arrear, and they owed a payment through XX/XX/XXXX.

Complaint: My ex-husband and my divorce was finalized XX/XX/2018. The Quit Claim Deed was signed by both of us and filed on XX/XX/2018. Our original plan was for him to refinance the home loan in order to remove my name. After doing some research on the Ditech website, we found that we could do a loan assumption instead of a refinance to do this. I printed off all of the required documentation that the website said we had to send in. We both signed the authorization form as it requested. We faxed the following documents on XX/XX/2018 ( see fax confirmation included ). I was concerned on XX/XX/2018 that maybe it hadn't been received because I had put on the fax form to please contact me when it was received. I didn't want to rush them so I gave them 3 weeks. So finally on XX/XX/2018, I called Ditech. The woman was confused and didn't know anything about the loan assumption process even though I called the number that the form said to call if you had any questions. After a little over 20 minutes, she said she was able to send an e-mail asking if our documents had been received and she would call me back in 2-3 days. She said I should also receive a letter within 30 days of sending the information in. I waited. I work full time so I got a little busy and didn't have a chance to call back. Finally on XX/XX/2018, I called again because I was getting concerned that it now had been well over a month since I faxed the original documents in. In the divorce decree, it states that the home was to be put into my ex-husbands name only within 90 days of being final. At this point, it was 60 days since the divorce was finalized. I started to panic that it was not going to get done. In addition, I can not purchase my home or do much of anything with this large debt still on my credit report. I was actually denied by multiple banks when I purchased a smaller car in XXXX because it appeared that my DTI was very high when actually I hadnt been making the mortgage payment in over a year. When I called on XX/XX/18, I spoke with several different people. Two of them asked why we wanted to do an assumption instead of a refinance. In my head, I thought the benefits of an assumption ( for us anyways, not Ditech ), were obvious. One of the women verified that the fax number I first sent the information to was correct. It was. So she asked me to fax it again. We faxed the following documents again on XX/XX/2018 ( see fax confirmation included ). I proceeded to call every day that week only to be told every time that the information was still not imaged to our account. On XX/XX/2018, I sent a message through the online portal ( this message is included ). On XX/XX/2018, I faxed the documentation once again after calling and being told it was not there. When I asked if there was any way to expedite the process because we are on a timeline, I was told no. Later that afternoon, I called again and was told the documentation had not been received. I explained that this was court ordered and we were getting close to the deadline. Finally, this woman said she would speak to her supervisor to see if we could expedite the process. After being on hold, she came back and said that she could email me a link to upload the files if I had access to an email and a computer. I said I did. She said as soon as she received them, she would e-mail them to her supervisor, and he would get them imaged right away. I received a link to upload the files XX/XX/2018. I have a confirmation ( included ) that it was uploaded. I tried, unsuccessfully, since then to speak with XXXX XXXX again to confirm they were received. As of XXXX XXXX XX/XX/2018, the documents were still not in our file. This woman I talked to said there were some questions she needed answered on their end and proceeded to ask me several questions ( which was part of the information I had typed up because I had already read online they would need that information. ) I received another link to upload the files from XXXX XXXX which is this packet. I have a confirmation ( included ) that it was uploaded again XX/XX/2018. I called at XXXX XXXX on XX/XX/2018 and once again was told the documents were not received. This man was had an attitude and at first told me that by looking at my loan, it couldnt be assumed. I said that I had read on their website that if there was a divorce, one of the parties could assume the loan. He said oh yes if there is a divorce you can. I told him I was getting frustrated because this needs to be processed very quickly and they cant even get the information I have been sending. He informed me that I could mail the documentation. I mailed documents by certified mail today, XX/XX/2018 at XXXX XXXX I am absolutely panicking that this is not going to get done. We both have things that cant be completed until this is done. I am starting to feel like Ditech does not want to do a loan assumption. From the attitude about us doing an assumption rather than a refinance and the multiple failed attempts of me submitting the documentation that is the only conclusion I can draw. We feel like our hands are tied as we can not walk into a building and hand the documentation to a person. It has to be faxed, mailed, or uploaded. My fear is that it is never going to be imaged to our file which will force us to refinance and cost us a lot more money. We have wasted a lot of time, energy, and some money in this process. Complaint: I received a letter dated XXXX XXXX saying that I am behind in my mortgage payment and they have a right to invoke foreclosure, etc.
I received a letter dated XX/XX/2018, that says that unapplied funds were moved from unapplied funds and moved to the principal and my next mortgage payment is due on XX/XX/2018.
Why are they threatening to foreclose. I am not, nor have I ever been behind on my mortgage payment. In fact, I have a long history of paying an additional {$1200.00} on the principal each month. I was doing it electronically, but then they told me they could not do it that way, I started sending them a check with a coupon telling them how to apply it. They still could not get it right and now they are threatening me? This is not right.

Complaint: There have been several attempts to foreclose in my home without success because of fraud and forgeries.
XXXX XXXX Circuit Case # XXXX- the plaintiff dismissed the case because of fraud XXXX XXXX Circuit Case # XXXX- Declaratory Case, the judge denied Ditech/ Greentree the mortgage servicer equitable title, equitable mortgage and the ability to enforce the note.
XXXX XXXX Circuit Case # XXXX even though the plaintiff Ditech knew there was no equitable title, mortgage & no note to enforce a foreclosure was filed again. After mediation the judge told the plaintiff to close the case.
Ditech is fraudulently selling the mortgage serving to XXXX XXXX XXXX. The mortgage accounts have been removed from my credit report and Ditech told me to contact the title insurance company.

Complaint: Two years ago I was forced to file bankruptcy. I decided to keep the house out. I had a first and a second mortgage. The company that held the first mortgage worked with me a did a loan mortification. Ditech Financial held the second mortgage. I tried for almost a year to get them to do a loan modification and never was able to get them to approve it. They constantly told me they had not received documents that I had sent several times. I finally got to the point that they were able to confirm they had received all the documents requested. They then told me that the time period since application had run out BY ONE DAY and I would have to re apply.
I decided to sell my house because I could not take it anymore. I received an offer on the house. I wanted to know what I owed on both mortgages so I could make a decision as to except the offer. I did not want to except an offer that was not enough to pay off both notes. I called the first mortgage lender, XXXX, they gave me a verbal over the phone and said they would mail out the exact figures at no charge. They gave me the option to expedite by fax for a cost of XXXX dollars which I declined I called Ditech, not only did they refuse to give me a verbal they told me it would be 10 business days before they could give me a payoff.
I now have an offer on my home which I have 24 hours to except or decline. I have no idea what the payoff is on my second mortgage so I can not make an informed decision. Depending on what Ditech charges me to pay off the note I might very well have to bring money to closing to sell my home. I have owned my home for 13 years and never missed a payment until about two years ago.

Complaint: I regret to say I have not enjoyed being a customer of Ditech. They keep reporting me 30 days late. Im not the only one on this mortgage. My credit is reporting being 30 days late twice. Instead of the company updating the month of XXXX, they placed not reporting. I am taking care of XXXX children all by myself and worked hard to move into a house but not like this. I keep getting letters on the door and two days ago I received a face to face letter. Why does this company keep harassing? Please assist me. I have a baby in a oxygen tank and dealing with so much stress and getting harassed about a mortgage payment is something Im not prepared to deal with. They provided insurance and charged me over 1,200 last month. Is that money going to be credited back to my XXXX mortgage?
