Complaint: My residence is located on XXXX XXXX XXXX XXXX, XXXX XXXX, New Jersey. On or about XX/XX/XXXX, an insurance payment in an amount XXXX XXXX XXXX XXXX and XXXX dollars was remitted to me ( XXXX ) and mailed to Ditech for co-endorsement. This was a result of water damage to my home caused by a broken water main pipe. I mailed the check for co-endorsement as directed by the insurers. On or about XX/XX/XXXX the check was returned to me by Ditech and deposited shortly thereafter, where it remains pending final resolution of insurance claim. Subsequent to receipt of the co-signed instrument on or about XX/XX/XXXX, I received a notice from Ditech advising of an escrow shortage that coincidentally, almost mirrored the amount of the insurance payment. The timing of the assessment and notice of the option of a one- time payment of more than six thousand dollars or a XXXX XXXX dollar increase in my monthly payment, prompted my request, for the third time in seventeen years for escrow cancellation. This unexpected shortage puzzled me, especially since I received an escrow surplus check in XX/XX/XXXX as a result of a reduction of XXXX On or about XX/XX/XXXX, I submitted a Qualified Written Request to Ditech for escrow fund cancellation. This, I hoped, would allow me to manage my escrow funds and realize the monetary interest benefit of same. The request was, once again, denied. Subsequently, correspondence from Ditech received on or about XX/XX/XXXX advised a review/consideration would be executed and results could be expected in mid or late XXXX. Unfortunately, two separate pieces of correspondence arrived, both dated XX/XX/XXXX : 1. Signed by XXXX XXXX, Customer Service Correspondence Supervisor indicated the following : Your request to cancel escrow has been forwarded to our Escrow Department for review. Our Escrow Department is scheduled to review your request writing 20 days. Once they have completed their review, you will be notified of their decision. 2. An anonymous response, dated XX/XX/XXXX erroneously noted that my initial request was received on XX/XX/XXXX. The request was received during the month of XXXX. In addition, the request for cancellation of escrow payment denial was buttressed with the statement that The escrow account, may also be called an impound or trust account. Moreover, without documentation or explanation the following items on the list of reasons : a. Payments in the past 12 months have been 30 days past due or significantly late. b. Funds have been advanced on your behalf to pay unpaid expenses and those funds have to be repaid. I am at a loss, based on the above, as to whether there is a culture of collaboration among the departments within Ditech that handle the accounts of so many working and elderly who struggle to manage their accounts in regard to their ability to live without the Sword of XXXX is wielded by a corporation that has not learned from its mistakes. There appears to be a lack of coordination, consistency, and an environment lacking in a milieu that encourages a service-oriented camaraderie that encourages productivity and a desire to excel. Over the past seventeen years, this mortgage has been serviced by, no less than three companies. This company, no matter what they call themselves, appears to be, as evidenced by published complaints, well versed in disservice, as opposed to service. After my complaint to your agency, some years ago ( XXXX ), I was inundated with mail regarding credit repair and loan information from XXXX/Ditech. Although I requested, in writing, and was assured there would be no more telephone or written solicitation that practice did not cease until XXXX. Presently, I do not anticipate a repeat of that behavior, as I deem it harassment. Finally, this inquiry is in regard to whether, as a consumer : a. I am entitled to a thorough and efficient review of my request. b. I am entitled to more than a check off list with expanded or documentation of the standards applied to the request were deliberately or capriciously dismissed, as evidenced by a written assurance of further consideration and a denial of request, dated on the same day. c. If Ditech has an obligation to delineate the nature of advanced funds for unpaid expenses that I am required to repay. It appears the climate at Ditech is one where the right hand does not know what the left hand is doing, so to speak. That being said, I have no confidence in regard to the results of the Ditech investigation of my ability to manage my escrow account. If would appreciate a clearly written explanation and documentation ( expansion ) of the reason for rejection. Any assistance will be greatly appreciated. Given the business dealings of this corporation, it is possible, not unlike humans ; the organization is capable of making an error.

Complaint: I have that in writing greater than 10 times for account information to include everything that has been charged to us, Payments we have made and where they have gone and any notes on the account. I have communicated in writing to Ditech requesting all of the above account information Because I dont agree with charges that were made for months. We have a VA loan and we have been charged more than one late fee for several months and I kept telling them that is not right and it can not be greater than 4 % of the payment. One occasion they sent me a XXXX XXXX document ( that was manipulated ) and changed half the fees to NSF charges And I have communicated that this is not accurate in my bank statements can prove I did not get several nonsufficient fund charges.Ditech refused payment from the spouse and said they Did not have authorization to speak to me however Im the only one who makes the payments and they lost the authorization more than once. I have also had the VA reach out to Ditech to receive all the information and Three weeks later I received another manipulated document numbers did not match and it did not have any charges whatsoever Ditech charged. I am doing the math and I know thousands not be accounted for. I have demand of this information of all account charges and fees and payments And they are refusing to give me this information. They paid my homeowners insurance and drained the escrow account. I have asked repeatedly in writing why this was done for what reason and all the charges and late fees that were applied and additional interest occurred for a double late payment for months and months I do not agree with and I know this is wrong and against va regulations for servicers to do. Also my monthly payment has skyrocketed {$200.00} and this should not happen when taxes are lowered. Ditech is also a bully every time Im on the phone and collection practices are disgusting. They are breaking every consumer protection law and TRUTH IN LENDING law. I have never felt so bullied in my life. I can not see what they are doing however one of our VA representative was very vocal to make above all my other litigations, DITECH should be sued for XXXX!!! I see that they are a dirty company and Ive read about 60 other complaints within 2018 very similar. Ditech has a pattern. Ditech refuses to disclose ANYTHING true. Stop stealing and committing fraud!!!! Ditech is destroying families with their disgusting actions. Welcome to the start of your next class action.

Complaint: Our company, XXXX XXXX XXXX XXXX, made a complaint in regards to this mortgage on XX/XX/XXXX, Thursday, and we were quickly given a response back from CFPB that Ditech did not have us listed as an authorized 3rd party, which is strange seeing that we have been communicating with Ditech since XX/XX/XXXX. I called Ditech today and confirmed that we are and since XXXX, have been an authorized 3rd party. In XXXX XXXX XXXX and XXXX XXXX received a cancellation of debt discharge from Ditech. Their mortgage was forgiven. XXXX XXXX was involved in several lawsuits for shady loan practices and Ditech is now new owner of those loans. In XXXX Ditech issued a discharge of the mortgage debt and sent XXXX 's to XXXX and XXXX, however never sent discharges to the registry of deeds which is REQUIRED by law in Massachusetts to occur within 45 days of the forgiven debt. Per Mass. G.L. c.184, 17B Mortgages must be discharged within 45 days of receipt of full loan payoff by recording and furnishing a copy of the discharge with corresponding recording information or providing a proper discharge to the per-son paying off the loan. They received full loan payoff on XX/XX/XXXX, which means a discharge should have been recorded by XX/XX/XXXX of XXXX. That never happened. XXXX and XXXX are trying to sell their home. When title was pulled the mortgage was still on title. When we called to find out why a discharge was never recorded, we were told that the debt was still due. Both XXXX and XXXX had to pay taxes on this forgiven debt in XXXX, so for Ditech to say the loan is still due makes no sense. When we pushed further, they sent us a new XXXX with no information on it.

Complaint: We were scammed by a company called XXXX XXXX from XX/XX/XXXX-XX/XX/XXXX. They offered to help us avoid foreclosure for a {$200.00} start-up fee plus a {$1400.00} overall fee for their services. Although we paid all fees they asked of us, we later realized they did nothing to help us catch up or get our mortgage amount reduced. After awhile, they would not answer their phone. Later in XX/XX/XXXX, XXXX XXXX XXXX bought our mortgage. Initially, they stated our mortgage balance was {$190000.00}. Because of XXXX XXXX 's non-help, we asked Green Tree for help so we could get current with our mortgage. Green Tree refused to help, sent threatening letters, did not communicate with all representatives within their company, made harassing phone calls to us, and insisted we pay a larger than usual amount for our mortgage payment. We paid mortgage amounts of {$2200.00} because of one rep., {$1700.00} because of what another rep. stated we needed to do, and other amounts because Green Tree could not give us consistent amounts we needed to pay. Overall, we paid {$50000.00} to Green Tree and yet, they still listed our balance as {$240000.00} as if we paid nothing at all the whole time they held our mortgage.

Complaint: My loan servicer for my mortgage is DITECH. I requested a LOAN MODIFICATION application late XX/XX/2018. Never received it. I waited and waited and then in XXXX I called and talked to a REP. I told him I never received it and all he could say is that he would have to make a request to the main office to see if they would send me another one. He said they had 30 days to make their decision. HAVEN'T GOT IT YET. They constantly play games. My income is {$1500.00} a month and my mortgage payment is {$700.00} and they won't help me. Plus, I can not afford my property taxes. I get SOCIAL SECURITY and a Tiny Pension

Complaint: On XX/XX/XXXX, I filed two complaints with CFPB, one against Ditech Financial, and the other against XXXX XXXX, the mortgage company Ditech transferred my loan to. In that XX/XX/XXXX complaint against Ditech, I supplied the mortgage payment history from my bank to Ditech including all months after I had been approved for a Modification ad brought current. Ditech responded XX/XX/XXXX with their record of my payment history ( Attachment A ) Unfortunately Ditech 's record is incorrect. In their payment history, they have missed a payment made in te first month of my becoming Current. That payment was made XX/XX/XXXX. By missing this payment, Ditech 's payment history is off one month from it's inception. I am resubmitting the payment history with the request that Ditech correct their records, nd report the error to XXXX so that their records can also be corrected

Complaint: I received a letter from Ditech Financial, LLC dated XX/XX/XXXX that said they were in the process of reviewing a written request from me. Their research has not concluded. They stated the letter was to notify me of their ongoing investigation in an effort to provide me with resolution. Below that the letter stated thee communication is from a debt collector. It is an attempt to collect a debt, and any information obtained will be used for that purpose. Farther below on the bottom of the letter it had a note that said " Forward Progress-Written Request, XX/XX/XXXX. It gave me a number to call which I did ( XXXX ). The person that answered said the letter was to get me to call about refinancing. I described the letter and said that so you send me a letter describing that there is an issue with my credit ... .and that I have made a written request to resolve so that you can try to get me to refinance - his answer was " yes ''. I had previously told him that I was not interested in refinancing but then after he confirmed the unethical practice they were using with the letter I told him that I may now consider refinancing with another more ethical company. This type of solicitation should be illegal!

XX/XX/2018 - Paid my mortgage in full XX/XX/2018 - Bank sent escrow overage in the names of me and my ex-husband XX/XX/2018 - Spoke with XXXX and told her the problem XX/XX/2018 - emailed information regarding property to XXXX XX/XX/2018 - faxed same documents to where I was directed at XXXX XX/XX/2018 - mailed same documents to Ditech, LLC, Attn. : correspondence, XXXX XXXX XXXX, XXXX XXXX, SD XXXX XX/XX/2018 - I received a letter saying their " research has not concluded. '' and of their " ongoing investigation. '' I've called several times to no avail. XXXX XXXX - Spoke to XXXX. She said she would escalate XXXX - XXXX. - Spoke to XXXX. Said he would escalate XXXX - Spoke to XXXX who is going to escalate. They offered to direct deposit into my account if I would give them my account number and routing number. I don't trust them to do that. I asked that they overnight a check. Refused. I asked for a manager. They said none are available. Help, please.

Complaint: When my loan was transferred in XXXX from Green Tree to Ditech, I was told that I was {$20000.00} behind on payments and Ditech refused to take my payment of {$990.00} causing me to default on my loan then later my payment increased to {$1400.00}. But I have proof of payments. I am attaching a few of the most recent payments to this complaint To make my situation worse, I was diagnosed with XXXX. I just finished XXXX in XX/XX/XXXX and I made my last medical payment of {$800.00} recently. I am old my health is not so great and the thought of losing my home takes a toll on me. I need to know what happened with my payments of {$990.00} that were sent. Had my loan not been transferred, I would not be in this mess. I have proof that I was not behind since XXXX. I applied for a loan modification in late XXXX of XXXX and I was denied. They state they can't help me because I am more than 6 months behind ( which is clearly their fault ), my hardship has not been resolved and that the P & I payment amount is greater than the pre-modification P & I amount. The million dollar question is, " WHERE ARE THE PAYMENTS I MADE TO DITECH? '' I am financially stable because I can work all the overtime I need, WHICH MEANS I HAVE NO HARDSHIP. I sent them all my financial information and yet, what hardship are they referring to? My intention is to may my loan in full and keep my home.
