Complaint: This is a follow-up to a previous complaint I had filed against Ditech Financial, LLC. Ditech has refused to cancel our PMI for multiple months. Per the Homeowner 's Protection Act, Ditech must automatically terminate our PMI when our LTV reaches 78 %. Our LTV dropped below 78 % LTV prior to our XX/XX/2018 statement. In addition, we requested over phone and email that Ditech terminate our PMI three times in XXXX, XXXX, and XXXX. In our most recent call with Ditech, the Ditech representative tried to push us to pay for their appraisal service before we cited the Homeowner 's Protection Act, at which point they became apologetic. Ditech 's previous response to our CFPB claim cited the section in the Homeowner 's Protection Act that allows Ditech to require evidence that our home 's value has not depreciated in value. However, per the " Automatic Termination '' clause in the Homeowner 's Protection Act, if our LTV drops below 78 %, Ditech can not require this evidence before terminating our PMI.

Complaint: I lost my job in XXXX and applied for a loan modification which was granted, I was to have the XXXX payment skipped and would start with a slightly larger monthly payment in XXXX. DiTech took the XXXX payment out of my account causing XXXX $ in overdraft fees. I attempted 6 times to rectify this issue without results. My husband also attempted several times to resolve this issue. XXXX payment was taken from the wrong account causing another XXXX $ fee. I spent over 2 & 1/2 hours on the phone trying to clear this up. Our account stayed overdrawn for several weeks

Complaint: Sold our home on XX/XX/2018. Temporarily moved to XXXX and had a forwarding order for all mail. Assumed Ditech would mail our escrow refund check to our old address and it would be forwarded by USPS. They somehow updated their records with a new address for us ( NOT AT OUR REQUEST AND NOT A CORRECT ADDRESS ) and mailed the refund on XXXX to that incorrect address. Sent multiple emails through their secure message server - it sent me emails saying they received my email and are looking into it but no one ever responded or contacted me in any way. Called XX/XX/18 and spoke with XXXX who said she would request the check be reissued and sent to new address. Updated our address ( AT OUR REQUEST ) and stated it would take 7-10 days Called XX/XX/18 and spoke with XXXX. Said she could " see '' the request to issue check but it had not been issued. Stated the deadline was today for reissue. No action XX/XX/2018 called and spoke with XXXX who said it was not reissued yesterday ( their deadline not mine ) and that it " should '' go out this week XX/XX/18 called and spoke with XXXX - she states she can see the request but it has not been cut. XX/XX/18 called and spoke with Ms. XXXX - still not cut but again states it " should '' go out this week. It is Thursday already! Ditech Mortgage has had {$3300.00} of my money for over three months now and will NOT resolve this issue. This is a very simple transaction of an escrow refund check that WAS NOT CASHED and just needs to be reissued and mailed ....

Complaint: After I paid in full my mortgage with dtech financial I requested the refund of my scrow account. The mortgage was paid in full on XX/XX/2018 and XXXX confirmed on XX/XX/2018 that a check of {$2800.00} dollars was issued already. Three weeks later the check was not received and I contacted again dtech customer service for an update. I was told that they have no control over USPS as the check was mailed already. They offered the possibility of making a direct deposit if within a week the check was not delivered. A week later I called again and at this time I was told that dtech does not make any direct deposits to reimburse scrow balances. I was ensured that a new check was going to be issued and delivered within 5 to 10 business days. Today I have been told that the check has not been issued yet. This situation is unacceptable from a financial institution who will not hesitate to charge you fees if you do not pay your morgage on time. However they have the luxury to play with customers money and blame the postal office when the checks mysteriously disappear.

Complaint: I ma an XXXX XXXX XXXX veteran and I had sent my loan company DiTech Financial my Property tax adjustment in XXXX. This was not adjusted and I had to call back in XXXX. Again it was not adjusted and I had to call again and speak with a Supervisor on XXXX when my account was finally reanalyzed. I was also informed that in XXXX the account should have gone under an automatic anazlysis of my account when i first requested it and submitted my state documents for the adjustment of my property Tax. Here we are in XXXX and my payment has still not been adjusted. They have issued my refund and my payment has not adjusted by the {$210.00} I was told it would adjust by. This is the XXXX month where I have paid an additional {$210.00} and I believe this additional money is not being allocated to my principal but instead to someones pocket. I have called and called to try to get help having this adjusted and feel as though I am getting no where.

Complaint: I have been working with Ditech for over 3 months on a review for Loss mitigation to try to get my account current. IN the midst of my review Ditech decided to place a sale date for XX/XX/XXXX. A week before my sale date they denied my review stating that there was not enough time to review my case with an upcoming sale date, as they state I am not eligible for another modification until XX/XX/XXXX being that I received one in XXXX. When they began the review process 3 months ago, they had told me that I was not eligible until XXXX but that I could start applying now as the review would take a few months and that the investor allowed a review within 6 months of the 24 months deadline for a program eligibility under FHA guidelines and that if need be they would postpone the sale date to allow me time to be eligible. We are 2 months away from being qualified, and I have been informed that FHA has actually allowed people to be approved within 18 month of their last approval, and in this case even though we are eligible and within the time frame, Ditech will not postpone the sale date to allow us to qualify. I feel this is predatory lending, as I fell on an unfortunate set of circumstances when I go severely sick last year and my significant other lost her employment. I have since then been trying to do everything under my power to make amends on the loan and be able to get back on track now that my finances have gotten better, and Ditech stated they would try to help me and work with me only, to turn around and deny me a week before the sale date and try to say my only option is to come up with a total amount of over 15,000 $ which is impossible for me at the moment. I would like Ditech to postpone the sale date and allow me to be able to get back on track through the FHA Modification which I will be eligible for in a little over a month. Please help as I have been in my home for a very long time and would like to do everything possible to keep it and my family there.

Complaint: I am long-time customer of Ditech mortgage company. Recently, XX/XX/2018, I found out that Ditech overcharged me on my escrow. They sent me notification that I'll receive a check for {$410.00} back and few days later, XX/XX/XXXX Ditech representative assured me that check was mailed. Few weeks later, no check yet so I called Ditech and they said that most likely that check was lost and they will re-issue another one which they said they did on XX/XX/2018. I called them on XX/XX/XXXX and was told that check was mailed on XX/XX/XXXX and I should receive it in 5-7 business days. Today is 10 days and still no check. During this ordeal I called Ditech on multiple occasion and diferent representative had different information. Not even once Ditech had an integrity to stand up behind their promises! I am a retired senior citizen and had been making my payments always on time and this is the worst abuse I've ever experienced as a consumer! Ditech not only overcharged me but now refusing to pay back and lying that they did while in fact they didn't!! I don't believe that all the mail is delivered ( including sensitive mail and checks ) and only checks from Ditech get lost one after another one!

Complaint: Ditech is the company that services my loan. I make regular payments to be applied directly to the principal in addition to the regular payment. They do not credit the additional payments in a timely manner, which affects the amount of accrued interest which inflates the loan amount and does not accurately reflect the accurate principal amount. Now, Ditech has not applied any of the additional payments that they have received since XXXX. I had so many issues with them not applying the amounts in addition to not taking the automatic payments that I signed up for. I was forced to make the payments myself and I even sent the extra principal payment in a separate check. Their records document that they received all payments but did not apply them. I have contacted them numerous times regarding this. They still have not addressed this. I have been told that my only recourse is to continue to call them. Escrow : Ditech sent my hazard insurance payment in the wrong amount and with a wrong account number to my insurance company. The payment was returned ; This started a chain of errors, with them making double payments ( 2 on the same day ) leaving my escrow account underfunded. They notified me that my monthly payment would increase by {$200.00}. They made an escrow advance, which I was charged for to make the payments. They refused to work with my insurance company to resolve this after numerous attempts by the insurance company to rectify this. They flat refused to even contact the insurance company and would not take my company 's telephone calls. I was hung up on, passed around, and generally mistreated. No one could ever find any record of me contacting them. Finally I had to make the premium payment myself directly to the insurance company because they said that they canceled my policy. Luckily for me, my agent was able to reinstate it since there was no history of any late payments. He got a 2 month extension. The money for the premium is in my escrow account and there has been no action since XX/XX/XXXX. Each time I submit an inquiry they keep informing me that I would be contacted ... yet they have not done so. In my last 2 communications I asked to be reimbursed for the payment that I made. The money is there. In addition, I informed them that I would assume responsibility for making all insurance payments myself, and want the amount of the escrow payment to decrease. I made it clear that my escrow payment be recalculated to reflect that they no longer will collect money from me for insurance payments. I have made numerous attempts to resolve this. On most attempts to submit my concerns, I receive a message that they were experiencing technical difficulties and the message was not sent. I can not retrieve the message. They have also informed me that they would probably send me some form to give them permission to investigate my complaints. I have received nothing. I charge that Ditech is subjecting me to deceptive fraudulent practices.

Complaint: I have tried to work with Ditech, From XX/XX/2018 we have submitted documents to Ditech, we submitted requested documents. Then on XX/XX/2018 we received a letter stating that information was received and we had to wait 30 days for a response. Then we were notified that the loan was transferred to another servicer. We waited and then when we tried to communicate with the new servicer they had none of the information concerning our loan. Again on a letter dated XXXX XXXX again we received a Notice of Sale of Ownership of Mortgage Loan, but on XX/XX/2018 Ditech accepted a mortgage payment in the amount of {$2300.00} with a conformation number of:XXXX. We have a notice of Servicing Transfer dated XX/XX/2018 to XXXX XXXX with no new loan number and they do not have the complete file from Ditech and we have a sale date for XX/XX/2018 @ XXXX. What happens to all of the documents that were submitted to Ditech in XXXX, XXXX, XX/XX/2018? Why do we have a sale date when they accepted a mortgage payment from us? Please help us with this impossible situation. Thank You

Complaint: Review of recent credit reporting ( XXXX Report # XXXX ) indicates Ditech has reported my account delinquent XX/XX/XXXX ( 60 days delinquent ), XX/XX/XXXX ( 60 days delinquent ), XX/XX/XXXX ( 120 days delinquent ), XX/XX/XXXX ( 120 days delinquent ), XX/XX/XXXX ( 150 days delinquent ), and XX/XX/XXXX ( 180 days delinquent ). However, the loan was on an Active/Performing Unemployment Forbearance Plan. The Unemployment Forbearance was submitted XX/XX/XXXX and approved XX/XX/XXXX effective XX/XX/XXXX through XX/XX/XXXX in the amount of {$390.00}. Ditech erroneously cancelled the Unemployment Forbearance Plan on XX/XX/XXXX due to the automated process of a Loan Modification Solicitation being mailed. A complaint was filed on XX/XX/XXXX and Ditech remediated the error and obtained approval from the Investor XXXX XXXX for an extension of the existing Unemployment Forbearance. Correspondence was received from Ditech ( XXXX XXXX ) dated XX/XX/XXXX indicating the Unemployment Forbearance Extension was approved effective XX/XX/XXXX through XX/XX/XXXX in the amount of {$390.00}. The loan was under Error Resolution review XX/XX/XXXX through XX/XX/XXXX. Unemployment Forbearance payments were Paid as Agreed, as stipulated XX/XX/XXXX through XX/XX/XXXX. The credit reporting account status should have been reported as Active Forbearance -Paying as Agreed XX/XX/XXXX through XX/XX/XXXX. According to 12 CFR Part 1024.35 ( b ) and ( i ) Regulation X of the Error Resolution Procedures the Mortgage Servicer ( Ditech ), after receipt of a notice of error, a servicer may not, for 60 days, furnish adverse information to any consumer reporting agency regarding any payment that is the subject of the notice of error. Therefore, the loan should not have been reported as delinquent XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX as the loan was under review for the complaint filed XX/XX/XXXX. The loan was also brought current XX/XX/XXXX in the amount of {$7.00}, XXXX and should have been reported as current for XX/XX/XXXX. In addition, the Investors ( XXXX XXXX ) Credit Bureaus Requirements ( C0-4.1 ) also require the Servicer ( Ditech ) to provide a complete and accurate full- file status report for all mortgage loans to each of the four major credit bureaus describing the exact status of each mortgage loan as of the last day of each month ( delinquent mortgage loans including 30, 60, 90+ day delinquencies, forbearances, modifications and liquidated mortgages ). ALL credit reporting bureau information ( XXXX, XXXX, and XXXX ) is required to be updated accordingly.

THIS IS BEYOND INCORRECT! PERIOD. DITECH IS BEING DECEITFUL and further DITECH IS THREATENING US WITH FORECLOSURE DUE ITS OWN GROSS FAILURE AND INABILITY SO PROPERLY RECORD OUR PAYMENTS! HOW CAN THIS BE ACCEPTABLE TO THE CFPB. DITECH IS LYING TO YOU BY SAYING THEY ARE UNABLE TO RESPOND - - -- THEY ARE ***UNWILLING***** TO RESPOND. DITECH KNOWS IT IS WRONG.
