Complaint: XX/XX/2018 TO : Ditech Financial llc XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX From : XXXX XXXX XXXX XXXX XXXX, FL XXXX To Whom It May Concern : On XX/XX/2018 I sent a letter explaining all my payments that has been paid to you with detail.
I have received letter from you that as per your records shows that my payment are in default and late, this must be a mistake.
On around XX/XX/2018, I went to pay my taxes and they had told me it was already paid by Ditech, which there is no paper that say that you can pay without me being notified. I never requested, Ditech to pay for parcel # XXXX for property located at XXXX XXXX XXXX XXXX XXXX, FL XXXX, in the amount {$5000.00} ; this amount was paid back and returned to Ditech on XX/XX/2018 with check # XXXX.
After this occur I realized that all my payment were not being applied To my account correctly, I saw my bill and now suddenly I have and escrow account that I did not request or open, I urge you that this account should be closed and money be sent back to my principal account, to be applied correctly accordingly you have applied my mortgage PAYMENTS INCORRECTLY AND THIS HAS MADE MY ACCOUNT TO BE DELIQUENT.
ON THE MONTH OF XX/XX/2018, I WENT TO THE XXXX XXXX TO PAY TAXES ON OTHER PROPERTY I CURRENTLY HAVE AND THEN AGAIN I was told that it was paid again and applied to my other property Parcel # XXXX that belongs to another property house @ XXXX XXXX XXXX XXXX XXXX FL XXXX, 1st of all this property is not financed through your company and shouldnt have been paid by you, this has been a confusion and it has led my account to be delinquency, because of your mistake, so I request for you to investigate that this has brought my account into a disaster, therefore back on XX/XX/2018 I sent another check to Ditech check # XXXX amount of {$5400.00} to cure this amount that was paid incorrectly by Ditech with a different parcel #.
I urge you to back it up and realized that your Ditech, supervisor or a professional that has been assigned to my account to correct this will correct this mistake by your department, To cancel my escrow account, and return money to be applied to my monthly payments, and to remove this delinquency that has been reported incorrectly by you, in my credit, I urge you to correct this at soon as possible because this is extremely hurting my credit, I am a Business man and I pay all my bills ahead of time, and as you show in my records you have been getting 3 payment in advance to be apply for My principal and taxes, therefore all this tax issue that your company has paid has mess up the status of my account, I have authorized my representative Ms. XXXX XXXX to speak and discuss this matter with you, to get this issue resolve at soon as possible You may contact her @ XXXX XXXX, to discuss further more.
Also please note that a letter was certified was sent to you on XX/XX/2018 signed by XXXX XXXX and it was also sent by fax and until todays date there is no respond by your company.
After all this gets cleared and corrected, please send me the payoff amount, I can not remain making business with a finance Company that could not accept me or look at me as a good satisfied customer, at this moment I believe that you had made a big mistake and may keep on making mistake in the future and I am a serious business man, to be getting frustrated for your bad decisions, I will not recommend your finance Company to any one, due to your bad communication and the bad service I get provided when I call.
I urge you that I supposedly dont have the time to wait 30 days for your decision, this could be nicely escalated with my attorney, if you delay this in bad faith, I will not tolerate this delinquency in my account I dont have time to be on the phone waiting to speak to your representatives that sounds like computers when they talk and dont have the answers to my questions.
I need the correct person handling my account to call me and take this account into consideration seriously to correct all the facts that were explained in this letter.

Complaint: On Friday XX/XX/2018 I was contacted by Ditech ( email will be attached ) because I had applied for a HEL through another company on a home that Ditech holds my first mortgage on. They were kindly but aggressively trying to persuade me into not doing a HEL but instead doing a cash out refi through them. After negotiating a good deal with a good locked in rate, manager approved lower closing costs and a promise that it would cost me anything or harm me in any way to just let them start the process and show me that they could produce a great deal for me we decided to agree.
We spent the next almost 2 months diligently responding to every request they had and quickly providing them with every last absurd document request. They would NEVER except bank print outs from our online banking so we had to go to the bank every time to get it printed on bank letterhead. We live 15 miles one way from the bank, had to leave work to accommodate their constant requests and at time cancel our other life 's commitments in order to do our part in assuring that this loan closed. We were asked to have notary used, " source '' everything according to what Ditech said was " XXXX XXXX guidelines '' and resend documents that they already had on file. Ditechs constant used excuse was that everything was a " XXXX XXXX Guideline '' I contacted other mortgage professionals and asked all of our banks and credit unions about what Ditech was saying and they all said " no '' they are using that as an excuse those are NOT XXXX XXXX guidelines. I researched it on XXXX XXXX web site and it did appear to be a fact that Ditech was lying. We were told that funds that I had in a joint account and in accounts that I hold with minor children could not be used to verify reserves being requested even when the credit union holding those accounts wrote a letter stating " yes these are her funds '' and said they except those types of funds all the time. We were then able to verify funds through accounts in just our names. So then Ditech moved to a different topic to scrutinize. After multiple trips to our banks they began laughing every time we would come in saying " oh my what are they making you do now? '' Then we paid an IRS debt off with funds from one of those joint accounts, not wanting to touch our solely personal accounts to do so. Showed a XXXX balance with the IRS but was finally told the loan couldnt go through because we had used a non approved account to pay that debt. They stated it was XXXX XXXX guidelines and when I sent proof that it wasn't a XXXX XXXX guideline they then said well it must be a ditech guideline. When I asked to see proof of their guidelines I was told " I don't have access to that, sorry ''. I have dealt with 2 loan processors, XXXX XXXX and XXXX XXXX along with their managers and a 3rd manager, XXXX XXXX, XXXX XXXX and I do not have the others name.
I started sending emails and leaving voice mails 3 week ago asking what was going on and if for some reason they were not wanting this loan to close because the absurd running around, stress, life disturbances and financial losses they were causing were becoming immense. I was constantly told how sorry they were that it was just needing to adhere to XXXX XXXX guidelines and that they did want to close the loan. I expressed that rates had gone up and that if I needed to look to another company for a loan that I needed to do so asap because rates were climbing. Now 1 week before my rate lock with Ditech was to end I am told because of the IRS payment being made from and account with mine and my minor daughters name on it that the loan couldn't close. Every absurd request they had I met all while thinking that they were intentionally trying to beat me down and make me give up, which I didn't. Then finally once I did what they told me to do ( I was told the IRS debt either needed to be paid in full, set up to be taken out of escrow, or a payment plan refactored into the loan application ) When XXXX from ditech told me these options we both agreed that paying the bill in full immediately would be the quickest way to move forward with closing the loan. Once I paid it in full Ditech used the excuse of the account I paid it from being unacceptable even though the Irs showed a XXXX balance and the bank holding the account I paid if from writing a letter stating that it was my account. They finally had an action that I couldn't fix or change to use as their excuse to not close the loan. Everything else about us qualified and was approved to close. Now we are shopping the deal again and rates have gone up a full point or more, we have wasted months of time, resources, life and stress.
I am attaching 2 emails but have 2 months worth of correspondence proving these issues if needed

After our first call to Ditech, it appears that the XXXX payment reversal has been reapplied to the account but we are not convinced that any errors that might have caused with interest and fees was corrected. We do have documentation for all of this but it contains the personal information that you said not to include.
The only explanation that we have received for this is that Ditech is performing maintenance on our account and we will receive a new statement when the payments have been reapplied. This does not sound correct to us.

Complaint: I started my mortgage with Greentree Mortgage Company, but they sold some of their accounts to Ditech in 2017. Once they sold the account I decided to pay off the remainder, however, ditech was giving us a hard time and would not let us pay it off. We called them every day for 3 months and they finally let me pay it off. Every time I spoke with Ditech I asked if we were going to have any late charges and they always assured us that we would not, but they did put us as 2 delinquent payments. these payments should not be shown as delinquent considering Ditech was refusing to take our payment.

Complaint: I XXXX XXXX along with my wife XXXX XXXX have worked diligently to get our mortgage back on tract, and we were successful doing so. We are very pleased when Ditech approved our mortgage modification and they even set aside a large portion of the mortgage into forbearance. We have been making our mortgage payments by XXXX XXXX at a local XXXX. However, the payments, which were made in cash were never processed by Ditech, We are sure that there was a problem posting our payments through XXXX XXXX. However, we are now being threatened by Ditech that we have not made our payments and that our home was being placed back into foreclosure. We have not missed any payments and this has to be an accounting problem. We post this problem through the Consumer Financial Protection Bureau as we need Ditech to treat us fairly and to get the accounting problem resolved as quickly as possible. My wife and I do not want to go through a difficult modification process again, but to maintain our current mortgage payments and to have our final modification papers delivered to us as quickly as possible. As I stated earlier, we were both very grateful to Ditech for the help they showed us in getting back on our feet, and we desire to keep it that way. WE will do whatever is necessary to help Ditech resolve this problem, and all payments can be made from now on by regular check instead of XXXX XXXX. In that fashion a cancelled check will always be available to prove that payments are being processed properly.
