Complaint: I was laid off from my job, I applied for a Modification was denied and was told that I couldn't apply for an modification until XX/XX/XXXX ... Applied in XX/XX/XXXX was denied stating that I didn't make enough money, applied for an modification again in XX/XX/XXXX it was denied stating that someone in the has to be disabled, Applied for a modification again XX/XX/XXXX showing that my child was disabled and that I receive money for her disability call every week for 9 months on the status of the modification and have been getting the run around ... Last week XXXX XXXX a man was banging on my door screaming that he had legal documents to give me ... .it was documents from the courts that the mortgage company is foreclosing on my home less than two months from today. Also on the papers it stated that they filed against me on XX/XX/XXXX why did I receive the paperwork without an envelope on XX/XX/XXXX. This just can not be right. My home for XXXX years is about to be taken from under me and I just do not know what to do at this point.

Complaint: 2013 I filed for bankruptcy on my business in chapter XXXX bankruptcy, my house in it and my mortgage lender sold it to Ditech, telephone number XXXX. Loan # XXXX. I did not included my home in the payment to the court and pay it directly to the Ditech, during the course of the bankruptcy they failed to contact me or my attorney of any changes to my loan as far as the escrow changes etc, the never want to talk to me even when my attorney gave the okay to deal with me directly. The fixed amount that was transferred from the old lender was changed immediately my bankruptcy was over and they are claiming I missed payments which they can not prove. I have tried so many times to resolve this but we never reached anywhere.. please intervene to resolve this on my behalf.

Complaint: My property at XXXX XXXX XXXX, XXXX, CA XXXX is serviced by Ditech Financial. XXXX XXXX XXXX, my originator, sold this loan while I was in a confirmed plan with XXXX XXXX Bankruptcy Court, a clear violation. They sold my loan without identifying that the property was included in a Chapter XXXX Reorganization - with a Debtor in Possession status. I have received a Demand for {$68000.00} for erroneous accrued mortgage payments from Ditech. I have received a threatening letter from Ditech 's attorney entitled " Notice of Appearance and Request to Receive Notices '' which is attached, enjoining the US Trustee, XXXX, CA and my Bankruptcy attorney of record. Then I received a letter entitled " Notice of Sale of Ownership of Mortgage Loan by XXXX XXXX XXXX XXXX, also attached. My letter response to Ditech 's attorney 's is a Cease & Desist and addresses the payments made and confirmation status and to stop this harmful and illegal collection, a clear violation of the Confirmed Plan and federal bankruptcy laws. Upon further examination, these correspondence look like scams, and as a victim of illegal foreclosure, I am both, compelled to respond but also I am skeptical of the validity of these threats, backed up by Internet content that says specifically XXXX is a total scam. I am filing this complaint to put XXXX XXXX on notice, to Cease & Desist this illegal collection and violation of my confirmed plan, to get their attorney under control and to provide me compliant accurate loan accounting. Furthermore, this complaint seeks to expose the action by XXXX XXXX XXXX XXXX and demands I receive my official mortgage agreement that identifies the legal mortgage holder, terms of the loan, and appropriate adjustments on the loan as a result of the Chapter XXXX confirmed plan terms. This all looks like a set-up for illegal foreclosure.

I spoke with XXXX XXXX ( XXXX x XXXX ) and XXXX XXXX, Member Service Center Assistant Manager of XXXX XXXX XXXX ( XXXX ) faxed proof of payment and cashed check to Ms. XXXX at XXXX, Ms XXXX has not responded with follow up, nor has she replied to two subsequent follow up voice mail messages. The missing {$100.00} has still not been applied to my account.

Complaint: Ditech Financial Account # XXXX We have been escrowing money on this account since its inception for payment of property taxes. Our property taxes to XXXX County, Georgia were not paid in XX/XX/XXXX. I contacted Ditech when I first noticed the taxes haven't been paid. The first contact was on XX/XX/XXXX. Every time I call they tell me they are researching it. Meanwhile, they are sitting on approximately {$8000.00} of our escrow money and are taxes are still not paid.

Complaint: Greentree has falsified documentation as to my home affordable loan. I have record that show how many times I applied starting in XXXX. XXXX XXXX was my reprehensive that harassed ma and lied about paper work. I have a folder of everything. I have a copy of a letter I wrote to hem on XX/XX/XXXX about all these issues..Greentree states that I denied help for a modification. It took many frustrated days until I finally got a mediator XXXX XXXX XX/XX/XXXX. Because it didn't matter all the faxing, talking was getting me nowhere. I have documentation to show all. When XXXX XXXX summited everything I sent to them, they had not choice but finally get the program I needed and had applied for. There facts are lies. And Ditech is doing the same dishonest things. Telling me after the hurricane that they were here to help. I took advantage of that and in XXXX the were threating me foreclose for {$3500.00} and added {$630.00} for interest ... I started to pay and extra {$500.00} a month but they came after me ... I sent them 3 Hurricane checks. In XXXX and the first of XXXX. Its now XXXX And they have held my money and lost one of the checks. The told me I must have sent it to another address. NOT. I called my insurance company and the told me the checks were deposited to the bank on XXXX XXXX Greentree and Diteck are sister companies and Diteck took over Greentree. Told to me by one of the employees a week ago. This is not a company that can be trusted. I have lived in this home for 40 years and I plan to keep it ....

Complaint: This is a formal complaint against Ditech for ignoring our requests to remove PMI and continuing to charge us PMI. On XX/XX/2018, we made a large payment to Ditech to reduce the principal for our mortgage far below the 80 % requirement for PMI. On XX/XX/XXXX, we called Ditech and asked for how we can formally request a cancellation of PMI. During the call, the representative told us to send an email requesting this. We sent them an email on XX/XX/XXXX requesting to cancel PMI. Ditech did not reply to this email. On XX/XX/XXXX, Ditech charged us {$150.00} for PMI. This appeared as a line item in our XXXX statement from Ditech. On XX/XX/XXXX, we called a second time asking how to cancel PMI, and Ditech told us to send an email. On XX/XX/XXXX, we sent a second email formally requesting to cancel PMI. Ditech never responded to this email either. When we received our XXXX statement, we did not see a line item for PMI, so we had believed it was canceled. However, in our XXXX statement, Ditech added TWO line items for PMI, one dated XX/XX/XXXX, and one dated XX/XX/XXXX. Per the Homeowner 's Protection Act, Ditech is federally required to allow us to cancel PMI upon request when our loan 's Loan-to-Value falls below 80 %. Ditech has not honored this request.

Complaint: This is a follow-up to Consumer Financial Protection Bureau Case No. XXXX. I received a response to my complaint from Ditech Financial LLC that I was satisified with on XX/XX/2018. Per the letter received from Ditech 's Paralegal, XXXX XXXX, Ditech was to issue a refund in the amount of {$1000.00} which was being processed and mailed to me separately. As of XX/XX/2018 I still had not received the refund check. I contacted Ditech customer service on XX/XX/2018 at XXXX XXXX EST and spoke with XXXX. XXXX stated that the check had been issued but had been received return to sender, do not forward. Since the my original complaint was filed I had closed on the home that Ditech held the mortgage on and no longer lived at that address. Ditech had my current mailing address on file from when the check was returned. However, no check was reissued and no one from Ditech attempted to contact me. I verifed the current mailing address with XXXX. He stated that they would have to put a stop payment on the original check but he was not empowered to reissue a check. XXXX stated that he submitted a reissuance request to a supervisor and to allow 7 to 10 business days. As ofXX/XX/2018, which is now 11 business days, I still have not received the check. I called Ditech customer service on XX/XX/2018 at XXXX EST and spoke with XXXX. XXXX stated that the service request was supposed to be closed out on XX/XX/2018 but was still open. She stated that a check was never issued because the funds need to be reallocated as the funds were still under advances and need to be transferred to escrow. So I said to XXXX was I lied to about a check ever being issued back in XXXX which I was told by XXXX. She stated a check was never issued. XXXX stated her supervisor needs to review this and it could take 10 to 14 days for the funds to be reallocated. I said this is unacceptable as this has taken long enough to be handled already. I asked to speak to her supervisor. I was then transferred to supervisor XXXX at extension XXXX. She stated Ditech can not just send a check, that she needs to get information reviewed and resolved. I asked her was a check issued in XXXX and returned to Ditech or not. XXXX stated a check was issued. I asked why can't it just be reissued. XXXX stated she needs to review the information and contact other departments. I asked which departments. She stated an internal department that I couldn't speak to. She said she hopes to have a resolution today but could not give me an estimated time on how long this process could take. This is completely unacceptable to me. I received a response from Ditech that I will received my refund on XX/XX/2018 and I've yet to receive it. The response stated it was being processed as of the date of the letter. Speaking with three representatives from Ditech has given me three different responses that all conflict each other. Ditech lies, decieves or can't provide any information upon request. XXXX, the supervisor, was barely able to answer any of my questions with a direct answer and tried to deflect or default to contacting other departments to get information. It should not be this difficult to get a refund check. I paid off the mortgage. I fulfilled my obligation. I expect the same in return from Ditech.
