Complaint: when the federal rate increased my payment would increase and when it went down my payment would go down. When the last federal rate increased they lowered my mortgage payment. I called them and asked why they did that. They said they get more interest that way. I have been paying on this loan for 22 years and that has never happened. Is this legal? How will my loan get paid off in 8 years with them doing that? Are they doing that to others. MY account number with them is XXXX. Please help. Complaint: We received an escrow analysis indicating that we have a shortfall and upon review of the analysis we discovered that our PMI ( RBP ) insurance payment increased more than 22 % beginning the month of XX/XX/XXXX ( highlighted on included documentation ). We called the customer service and spoke with XXXX and she explained to us that it increased because the value of our home increased. Surprised by that answer, I told her that my hazard insurance covers my property not PMI. If my property value increased, then it makes sense that my hazard insurance will as well, as it does from time to time. I explained that my loan value ( which PMI insures ) is actually decreasing over the length of the loan and PMI should decrease accordingly. She replied reaffirming that " the property value '' is what she was told as to the reason. Unsatisfied, I requested to speak with someone else, but was told someone would call us back. Never heard back and thus, this complaint. I would just like an explanation as to the increase in my PMI for the months in question ( XX/XX/XXXX - XX/XX/XXXX ) and an adjustment as appropriate.

Complaint: We have been trying to get a loan modification on our home since XX/XX/2018. Once we filled out the loan modification application we were told to check back weekly on the status but that it generally takes 30 days for the processed to be completed. I have called this company weekly to inquire about the status of the loan modification or loss mitigation process. It was only through these calls that I made that I was able to know about what was going on in the process as I did not receive any calls regarding how it was progressing. It was only through My calls that I would find out that the company would or would not require any additional information. I submitted our pay stubs several times and even submitted a report from my husband 's employer when I was told that Ditech was unable to read the dates on my husband 's pay stubs. We had to fill out another completely new form at one point to start the process all over because, after a call to the company, we were told about the issue with the pay stubs. Then the company told us at one point during one of my many calls to them that our house had gone into foreclosure and not to send any more money in as it would only be returned. Not once did we receive any documents stating this fact. Because of the time that the company took to make a decision on our loan modification and their stating not to send any more payments has caused us to be several months behind on our payments. This has escalated the amount that will now be due to reinstate the loan to an amount that is ridiculous. Had the company excepted payments this amount would not be so much. It is due to their lack of communication either verbally or written that and their lack of timely processing that has allowed our house to even get close to the foreclosure status. I previously had requested a copy of our loan and never received it. Today before filling this complaint out I called the company to inquire about what type of loan that we had. I was questioned by the representative as to WHY I wanted to know what type of loan that I had. She kept asking what I needed this information for. Regardless of what the reason or why the reason I had the right to inquire and obtain this information. This company has not been consistent with the information that has been given to me over the phone about my loan modification process and I have found that I need to call at least twice if not three times back to back and ask the same question then take the one that matches the answers from at least two representatives. We were given a name and direct number and extension for our account representative but was only able to reach him during this process a couple of times. Our representative did tell us that if someone else took the call and that we needed to speak with him directly that we were to instruct the rep that took the call to email him and tell him that we needed to speak with him so he could call us. We even met with problems with other reps that took our call when I asked to have them email him. One even told me that there was no reason for him to email our rep in charge of our account because he would just tell us the same thing that he had. We never got a call from our rep over our account on any of these occasions. I believe this company deliberately withheld our loan modification with their lame excuses so that our house would go into foreclosure. All we wanted was a chance to get current and to continue to make our house payments so we could remain in our home. I know everywhere that I look online that countless people are or have had problems with this company and I think its time that something is done to help the people who are honestly want to make their house payment and remain in their homes. This company also paid our taxes one time because we had overlooked them. Since then the company pays our taxes before the due date and we never even see what our taxes are because we don't see a statement for the taxes. They refuse to allow us to pay the taxes. They add this amount to our monthly amount due. They also added insurance on our house when my husband was on workers comp. We found out that the company that paid the weekly benefits on the worker 's comp and were also the company that we had our home owner 's insurance with were not taking it out of the weekly benefits as they had been doing on his work check, therefore, our coverage lapsed. They chose an insurance company that was expensive and offered no coverage except on the home. Then once we filed a claim with the insurance company on our roof, the mortague company held the check XXXX and refused to sign it and return it to us so we could pay our contractor, stating that this is their policy and that they would pay the contractor.

Complaint: Last week on XXXX XXXX I paid off my HELOC loan in full sending a cashier 's check in the amount of {$18.00}. XXXX based on payoff figure provided by Ditech. I send XXXX by overnight mail. Tracking shows it was received on Tuesday XX/XX/2018. To date they have not applied my payment nor closed out the loan pursuant to the letter enclosed. I called. last Thursday and was told that by Friday it would show as paid off as of the date received. I waited until Friday and was told wait until Monday. I called today and was told by XXXX that they applied my payment to a dummy account and that she sees the check and sent an email to the appropriate department and wait three days and payment should be applied. I am tired of being given the run around. I will attach copies of proof of payment, mailing and receipt.

Greentree took over servicing for the loan and would also not work with me on payment arrangements. At this point, Ditech Financial LLC took over servicing, and still would not allow payment arrangements with me. It is now effecting my credit.

Complaint: I wrote to ditech and spoke to them on the phone, I have send them divorce papers and informed them that I no longer live in the house. XXXX XXXX lived there and he got the house in the divorce. Im not paying on a house I couldn't live in. the account # was XXXX. I had no idea that he wasn't making payment on the property. I was not informed. ditech claims that my name was still on the account but wouldn't give me information on the account or discuss it with me because XXXX XXXX was living in the house. I should not be held at fault because of what he did. I couldn't live in the home nor was I giving any information about the house. They will have to look at XXXX XXXX for what is owed. I'm no longer have any contact with him and the house has been sold.

Complaint: How it started ... .. I have questions regarding my mortgage ( non escrowed ) account. Ditech established an escrow account by paying a school tax early XX/XX/XXXX - {$570.00}. I have always paid those taxes at the same time every year and never had an escrow during the duration of this loan. After the Escrow was added, I was told I could remove the Escrow by paying the balance of the Escrow ( plus tax and fees ) and drafting a letter stating the request to remove the Escrow. The Escrow payment was made, then I received a letter stating I had an Escrow Surplus and Ditech returned money via a check. I have had over 12 different account managers during the process of attempting to remove the Escrow, and received numerous denials citing " payments have been 30 days late '' or " Funds have been advanced on your behalf ... '' after being assured that the last money pay off the Escrow could be Reallocated and removing the Escrow would not be a problem. I have appealed the denials several times. My Problem ... I need an Audit of my account. I believe my payments are being applied to a different account. After GreenTree changed to Ditech my payments have been shown as delinquent by the Ditech computer system. Even though I submit an electronic payment and it is received and posted to my bank account Ditech sends a delinquent letter. Ditech will not allow me to remove the Escrow. I have never been late in the last year. I was granted a Forbearance due to Hurricane Harvey, and continued to make timely payments to my mortgage. Ditech also added other fees which I paid in full so that I could remove the Escrow. I need a dedicated Ditech Account manager for the duration of the loan and I need to pay off the mortgage asap because Ditech has been the worse and most stressful experience of my life.

I been paying my mortgage every month however my statement reflect a balance of {$8100.00}, my question is where is my payment going for the past years, this is an ongoing problem, I have spoken to uncountable representatives along with written correspondences over the two years, with each making adjustments to account changing my monthly payment each time however after paying, this new month payment my account was still in teacher rears, my escrow payment is and was misapplied several times causing deficit to my account. Thirdly my account is presently in default, collection, modification ; my question is where is my payment going? Requested statements indicating my payment, made to Ditech however, never sent even with numerous requests. To date my account is still being mishandled causing misallocations of payment, confusion default, collections, bad credit to account. On XX/XX/18 spoke with XXXX, collection department, I requested a payment history, still I have not receive this information. This is not my first mortgage ; unfortunately this has been my worst experience I am calling on you to review, make the necessary adjustments, restore my account and my credit. Thank you

Complaint: We recently ( about 3 months ago ) filed for bankruptcy. We notified Ditech that we would be reaffirming the debt ( our mortgage ) and requested the paperwork that needs to be filed in Federal court. Since then, myself and my attorney have contacted Ditech numerous times and they keep saying " they are working on it. '' The filing deadline is XX/XX/2018, just a few days from now and they are still refusing to provide the documents. I have had to pay my attorney extra fees now to file a request for an extension with the court. Ditech is purposely doing this to put us into a position where they can force a foreclosure on our home. I am permanently XXXX and Ditech wants out of the contract. Purposly holding up the bankruptcy from being finalized is also causing financial problems. Ditech either needs to provide the paperwork required by the court, or provide a lien release if they continue to refuse to let us reaffirm the debt.

Complaint: On XX/XX/XXXX we secured aHome Equity Line of Credit in the amount of {$46000.00} from XXXXXXXX XXXX XXXX, XXXX. XXXX XXXX XXXX XXXX, XXXX, IN, XXXX no where on the Deed of Trust was there any mention of the interest I was to pay or the amount of number of payments that were to be paid. I paid on this loan every month from XX/XX/XXXX until XX/XX/XXXX. Thatnwas thelast payment I made bcause every month the amount on the statement never changed. After all of this time seeing that I was making no progress on the original loan amount owed, I just quit making payments. That was not the right thing to do but I had a feeling there was something wrong but I had no idea what to do. At some point shortly after, the loan was bought by ditech Financial LLC, XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, AZ XXXX, XXXX. From the time I received this loan, every statement I received was for the same amount of {$46000.00}. Not once did the amount I paid was reflected on the statement. Even when ditech took it over. I made 48 months of $ XXXX@ 15.658 %. None of this was stated in the original loan papers that I have. What got me wondering is that I received a letter dated XX/XX/XXXX informing me that if I felt that this account has been collected unfairly that I should notify their complaint department. On around XX/XX/XXXX I received a billing statement dated XXXX XXXX stating my next payment due date was XX/XX/XXXX but I have not received anything else from them since. Today, XXXX XXXX I contacted ditech 's complaint department to discuss this with them. The agent I spoke with so rude and defensive. He told me that he would not send me any information about the original loan contract or the list of payments that I had made unless I agreed to pay off this loan in full.He toldme there were 1000 pages of documents concerning this loan. I am enclosing the paper work that I do have regarding the loan and the 2 documents that I received in XX/XX/XXXX. I hope you can please help me find out if this was a fraudulant loan or at least get me the documents that I requested. And find out exactly what happened. Thank you

Complaint: On XX/XX/XXXX I paid through a XXXX XXXX {$1300.00}. On XX/XX/XXXX, I bought three money orders which totaled {$2300.00}. On XX/XX/XXXX, I paid through a XXXX XXXX the fee of {$1100.00}. This totals {$4700.00}. To cure the default I had to pay {$4000.00}, XXXX. Ditech left a balance of {$730.00} for the Corporate Advance Fee and {$840.00} in Late Fees. Ditech did not pay {$130.00} of NSF Fees, or {$20.00} for Other Fees. Ditech put money is Escrow which resulted a check for {$1500.00}. I wrote a Notice of Error requesting my money be reallocated. In XX/XX/XXXX, Ditech sent an Escrow check of {$1500.00}. I sent certified mail to return the check to me because Ditech did not allocate money correctly. On XX/XX/XXXX Ditech sent another letter out for me to Cure the Default with fees of {$130.00} NSF Fees, {$20.00} Other Fees, {$730.00} Corporate Advance Balance and {$930.00} in Late Charges. The first time I paid these fees were through 3 money orders, and 2 XXXX XXXX at XXXX. The second time I paid these fees were through 2 XXXX XXXX of {$520.00} each on the dates XX/XX/XXXX, and XX/XX/XXXX. I sent 4 money orders which all specified a certain amount and how it was to be applied. XX/XX/XXXX -- {$130.00} NSF Fees, and {$20.00} Other Fees. XX/XX/XXXX {$930.00} Late Charges, and {$730.00} Corporate Advance Balance. I am sending copies of the Quit Claim Deed I sent to Ditech. I am attaching Notice of Error from XX/XX/XXXX, information sent to through certified mail about the Escrow check sent to him in XX/XX/XXXX, and copies of what I have currently paid to Cure Default by XX/XX/XXXX

Complaint: This is a situation that was never resolve in my first complaint I had filed in XXXX XXXX. I did not realize that Green tree had filed theirs ' answer to my complaint at that time, until I received a new pass word to my old account number. The thing is Green tree did not stated the truth in their answer in XXXX. When they stated that I did not notify them to cancel a {$6000.00} policy that they had purchase from XXXX until XX/XX/XXXX that was not true. I had gave them a notice on XX/XX/XXXX it is when I gave them notice to pay XXXX who was going to be my new insurance provider for my home and they had received the information on XXXX XXXX from my insurance agent. The reason why I'm stating this because they had 15 days to cancel XXXX policy or not renew that policy, but they did on XX/XX/XXXX as they claim anyway. I was sent that {$6000.00} by XXXX instead of Green tree ending that policy, under regulation CFR 1024.37 ( g ) ( 1 ) Green tree should have cancel that policy and place those funds back into my escrow account. Now they should return all the over collected escrow funds they had already collected which is about {$4300.00} or come to some type of resolution to this problem. They had place my name into the credit report agency for not paying my mortgage which is not true, because I've been paying {$1400.00} each month since XXXX XXXX which is more then what I should pay that is {$1400.00}. I had submitted some new document into records with CFPB on XXXX XXXX under my old account number XXXX, for CFPB to look over in this matter. Ditech had been trying to get me to make a payment on what they was claiming, but under CFR 1024.17 ( f ) ( ii ) if I would had paid on their claim, I will be agreeing to their claim, that I had not made my mortgage payments and it would have given them the rights to keep those over collected escrow funds under that regulation. There must be a resolution to this situation at hand and not for it to stay as is with out a resolution.

Complaint: Original Instrument # XXXX dated XX/XX/XXXX was modified on XX/XX/XXXX by Ditech. During modification the instrument number was recorded incorrectly by one number # XXXX. When this lien was paid in full the wrong instrument number was released. I have provided property reports and documentation from the XXXX County Recorders Office several times showing the lien was still in place. I have been in contact with Ditech since beginning of XXXX with XXXX resolution and no contact names will be given. I have attached several correspondence emails and documentation to get this resolved. Letters from Ditech dated XX/XX/XXXX shows they are working on the issue and I received another from XX/XX/XXXX not resolved. I spoke to XXXX, XXXX, XXXX, and XXXX who was supposedly a supervisor. I also emailed information directly to the lien department with no response.
